Also present being: Acting Chief Clerk Ivery; County Solicitor Capano; Assistant County Solicitor Porter; Deputy Controller Whalen; Mr. Roland Bourke - Executive Director of the Redevelopment Authority; Mr. Robert Nyswaner - Redevelopment Authority; Mr. Michael George - Director of the Department of Parks and Recreation; Reporter Roule representing the Monongahela Publishing Company; Reporter Coleman of The Brownsville Telegraph; Reporter Robertson of the Observer -Reporter; and Public Information Officer Huber. Chairman asked if there were any corrections, additions, or omissions to Minute No. 119, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Bevec, that Minute No. 119 be approved as read. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Unfinished Business: Solicitor Capano informed the Board of a check in the amount of$2800. 00 � 1 as received from the Fidelity Deposit Company of Maryland which serves as reimburse- ment to the County in connection with the surcharge case that has been pending based on the 1964 Controller's Report. Assistant County Solicitor Porter reviewed the case for the Board and recommended that the following motion be adopted: 166 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. JOHN P BEVEC, JOHN MAZZA, COMMISSIONERS Moved by Mr. Bevec, seconded by Mr: Mazza, that the action of and Commissioners Bevec, Mazza, on May 20, 1970, in signing the release prepared in connection with the dismissal of the surcharge case arising,out of the 1964 Controller's Report, is hereby ratified and confirmed and adopted as of said date as the formal action of this Board; and further that the action of the Assistant County Solicitor in giving cons to the entry of the court order that was handed down May 25, 1970, on the joint petition of the County Controller and Edward Stuart for dismissal of the surcharge case, is hereby ratified and approved. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Assistant County Solicitor Porter left the meeting. Special Order of Business: Chairman stated that the regular order of business would be dispensed with in order that Mr. Roland Bourke, Executive Director of The Redevelopment Authority, could make his presentation to the Board. Mr. Bourke presented threef' (3 ) resolutions to the Board for approval. Moved by Mr. Bevec, seconded by Mr. Mazza, that (1) Resolution approv- ing proposal for redevelopment of disposition parcel No. 1-B by Fine and Salzberg, Inc. and the form of the redevelopment contract with said developer; (2) resolution approving proposal for redevelopment of disposition parcel No. 7 by Fine and Salzberg, Inc., and the form of the redevelopment contract with said developer; and (3) resolution approving proposal for redevelopment of disposition parcel No. 1-C by John W. Chapman, an individual, and the form of the redevelopment contract with said developer be approved; project known as Washington Central City Project, Pennsylvania R-98. Remarks: This program has come into fine shape and I think we are reaching our goal. I think it is wonderful and I want to compliment the Redevdlopment Authority on the pro- gress that has been made in the City. Mr. Mazza: I would like to add to what Mr. Bevec has just pointed out and also to bring out the progress that is being made under the Redevelopment Authority in Canons- burg. Mr. Bourke also reported to the Board on the GSA Flood Control Project F L in Canonsburg. Commissioner Bevec informed the Board of the Magisterial Tabulation as submitted by the Controller's Office. A total income of $15, 405. 77 has been 'tabulated for the thirteen magistrate districts. This tabulation is based on the first four months of operation. Commissioner Bevec stated that the Commissioners had estimated an original income this year of $20, 000. 00. County Solicitdr opened and read the following sealed bids as submitted for two (2) oil furnaces located at the Washington County Airport: (1) Frank Liberatore - (2) C. R. Breese, President - Tri-State Aviation, Inc. $405. 00 (two furnaces) $300. 00 (two furnaces) Moved by Mr. Mazza, seconded by Mr. Bevec, that the bid for two (2) oil furnaces located at the Washington County Airport in the amount of $405. 00 as submi by Frank Liberatore be awarded to 'same for the amount as s-et forth in his bid; motion made upon the recommendation of the County Solicitor. Report: Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Public Information Officer Huber made a presentation to the Board in reference to the Three River Ferries. Mr. Huber's report was compiled from inform obtained from the study of Captain Jack Ross, construction firms dealing in river barge construction and installation, private citizens and industry in the areas concerned. Mr. Huber highlighted on Capital Costs (cost of construction of ferry flats, transport costs, other cost factors, cables and installation, and purchase of landings); Annual Operating Costs (operators salaries, rates) and Progress. Anthony, Director of the Washington County Planning Commission, informed the Board that he has received word from.the Department of Housing and Urban Development and within the next two weeks will submit for the Commissioners approval a contract for the completion of Phase #2 of the County Comprehensive Plan to be executed. Mr. � Anthony also informed the Board that the new six -year Highway program for the years 1970-1976 will cost $78, 000, 000. 00 with yearly expenditures of $13, 000, 000. 00. Mr. Anthony also added that Sections 1-2-3 of the Mon Valley Expressway are still in the program. Acting Chief Clerk read correspondence under date of May 26, 1970, from Michael George, Director of the Department of Parks and Recreation, which requested approval for a list of items located both at Mingo Creek County Park and Cross Creek County Park to be advertised for sale. Moved by Mr. Bevec, seconded by Mr. Mazza, approving the sale of these items(individuaILy) located in both Mingo Creek County Park and Cross Creek County Park and that these individual items be posted for public notice for a period of ten (10) days and that quotes will be received by the Department of Parks & Recreation through June 12, 1970. Prasse, Commissioner of.Correction, Department of Justice, which forwarded an inventory of prisoners4rom Washington County who were confined to a Bureau of Correction Institution as of April 30, 1970. Correspondence stated that said inventory is the first of, two which will be received this year and in succeeding years. 1 Corres- pondence also forwarded an inventory of those persons who were on authorized absence to court, etc. , as of April 30, 1970. , , I .. Moved by Mr. Bevec, seconded by Mr. ,Mazza, that the Invoice as submitt- ed by the Commonwealth of Fefnsylvania, Department of Public Welfare, for the Food Stamp Program, Quarterly statement of Administrative Costs, for the quarter ending March 31, 1970, in the amount of $6, 222. 80,be approved for payment. Whalen, Deputy Controller, which stated that as of May 22, 1970, the Controller's Office has completed the proceeding of payments to local election boards in the amount of $30, 236. 60. Acting Chief Clerk read correspondence under date of May 20, 19.70, from Gerard N. Massaro, Director - Southwest Region - Pennsylvania Crime Commission, which stated that the Southwest Region of the Pennsylvania Crime Commission wishes to inform the Commissioners of the availalllity of federal funds for improvement of the Criminal Justice System. The funding program requires a 40 per cent match of the total project cost on the part of the local unit of government and the Crime Commission will contribute 60 per cent. Correspondence further stated that if the Commissioners are interested in applying for project funds, please do not hesitate to contact said office. Moved by Mr. Bevec, seconded by Mr. Mazza, that the above quotation as submitted by Baldwin Electric Company, Inc. , in the amount of $789. 00 for additional work to be performed at the Washington County Prison be approved and that said Com be authorized to proceed on said work; bill to be submitted upon completion of the work. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk read correspondence under date of May 22, 1970, from John R. Fantz, Administrator - Washington -Greene County Mental Health/Mental Retardation Program, which enclosed copies of the Monthly Population Report for March and April showing services provided by each of the Base Service Units. Acting Chief Clerk read correspondence under date of May 19, 1970, from the 5th •Precinct Election Board, South Strabane Township, which listed conditions under which said Board of Elections had to work on Election •Day at Patten School. Correspon- dence stated that it was the said Election Board Is belief that a business -like atmosphere should prevail at Voting Precincts on Election Day. Mr. Bevec: I would like to suggest that this matter be referred to the School Board. Moved by Mr. Mazza, seconded by Mr. Bevec, that the Legislative Committee be contacted to draft the necessary legislation to have Election Day declared as a legal holiday in the various school districts. Solicitor informed the Board of a property settlement (Emile Lerby) which was agreed upon and that the Board approved on April 9, 1970. Solicitor presented the Agreement to Settle Condemnation for said party to be executed by the Commissioners. Moved by Mr. Bevec, seconded by Mr. Mazza, that the Washington Cou Commissioners execute the Agreement to Settle Condemnation between -Emile Lerby, widower, of R. McCune, In re: Commonwealth of Pennsylvania vs. Norvelle DeWitt Jennings, No. 90, September Term, 1969, statement of charges received from Christopher T. Manos, for investigative services furnished to the defense attorneys of Norvelle DeWitt Jennings, defendant; the Court shall pay the total sum of $628. 50 as payment in full ,for all services furnished by him in the case of the Commonwealth vs. Norvelle DeWitt Jennings. Mr. Flynn: The Court Order will be complied with. Mr. Anthony left the meeting. Solicitor read Court Order No. 108, May Term, 1970, signed by Judge Charles G. Sweet, President Judge, In re: Salary for Jury Commissioner, which is in reference to Charles Koch. Court Order stated that there was some opposition to the Koch appointment and later it developed that the Solicitor for the Controller felt that Mr. Koch had held office illegally because Mr. Koch was also a road supervisor in Union Township. This brought about a suspension of Koch's pay. The Court Order stated, in conclusion, that the Court has no choice but to, protect the proper administration of justice by directing the prompt payment to Mr. Koch. Court Order stated that the Controller and Treasurer shall do so forthwith. Moved by Mr. Bevec, seconded by Mr. Mazza, that Amerigo Zugaro, Jr. , of Monongahela, in accordance with the provisions of the Amendment to Article IX, Section I, to the Constitution, be hereby exempt from any County Taxes assessed against him to the extent of 100%. Tax Refunds: Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Solicitor Capano presented the following tax refunds to the Board for approval; said refunds having been approved by the County Solicitor. Moved by Mr. Bevec, seconded by Mr. Mazza, that the Tax Assessment Office be authorized to prepare the following tax refunds due to.either duplication or overpayment of real estate or personal property tax. In re: Stollar, Margaret J. Estate East Finley Township Tax in the amount of $1.28 net was paid on June 20, 1969, by Morgan Stollar. Tax in the same amount was also paid by Della G. Plants on August 29, 1969 in the face amount of $1. 35 making a refund due in the amount of $1. 35 to DELLA_ G. PLANTS, George Washington Hotel, Washington, Pennsylvania 15301. In re: Elizabeth T.
