Office of the County Commissioners
Washington, Pa. , October 1, 1970
The Board of County Commissioners met in regular session with the following
members being present: Commissioners Bevec and Flynn. Also present being: Chief Clerk
Murphy; County Solicitor Capano; Assistant County Solicitor Porter; Reporter Robertson of
the Observer -Reporter; Reporter Roule of the Monongahela Publishing Company; Reporter
Coleman of the Brownsville Telegraph; and Public Information Officer Huber. Absent being:
Commissioner Mazza - Out of Town.
Meeting called to order by Chairman and roll call taken:
Mr. Bevec - Present; Mr. Mazza - Absent; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions, or omissions to
Minute No, 135, each Commissioner having received a copy.
Moved by Mr. Bevec, seconded by Mr. Flynn, that Minute No. 135 be
approved, as read.
Roll call vote taken:
Mr. Bevec - Yes; Mr. Flynn - Yes.
Motion carried unanimously.
Report - Pat Huber (Ferry Service)
Pat Huber gave a report concerning the Ferry Service between Washington
and Fayette Counties. He stated that Capital expenditures for the project would be well over
$150, 000. 00. Mr. Huber also -said that they have been unable to locate a Marine Engineer
to review the studies made by Captain Jack as yet but will continue to inquire.
Mr. Huber proposed that the Commissioners begin to look for people to serve
on the Authority, and also that the Commissioners meet along with Captain Ross, the Planning
Commission, and Fayette County Development Council and completely discuss the project as
soon as possible.
Mr. Flynn: I would suggest that we proceed along the lines recommended by Mr. Huber
in his capacity, and authorize him to make arrangen-e nts with Fayette County Commissioners
in conjunction with our Commissioners.
Mr. Bevec: Never once did we have a meeting with the Commissioners of their Board
and our Board.
Mr. Flynn: I think we should get a little deeper into this.

Jeanne L. Potter, Secretary, Monongahela Area Chamber of Commerce, stating that Mr.

M. E. Zabowsky of West Penn Power Company has been appointed to serve as their represent-
ative on the Washington -Greene County Tourist Promotion Agency Board.
Chief Clerk read correspondence under date of September 18, 1970 from M
Lorraine Mullen, Secretary, Donora Chamber of Commerce, stating that Mrs. Norma R.
Miller, has been appointed to serve as their representative on the Washington -Greene County
Tourist Promotion Agency Board.
Chief Clerk read correspondence under date of September 15, 1970, from
Paul Frey, Secretary, California Chamber of Commerce, stating that Mr. Bernard Grebb has
been appointed to serve as their representative on the Washington -Greene County Tourist
Promotion Agency Board. Letter also stated that Mr. John Fleckwas chosen to act as
alternate in case of Mr. Grebb being unable to attend a meeting.
Note was made that two (2) other names have already been submitted prior to these letters.

Chief Clerk informed the Board of a check received in the amount of $33, 981. 81
for Project PA OSA 26, Open Space Grant, Final. Check number 58,482,467, deposited in
the Parks and Recreation Account, September 30, 1970.
Authorization to Advertise:
Moved by Mr. Bevec, seconded by Mr. Flynn, that the Controller be
authorized to advertise for bids for : (1) approximately 4, 275 feet of stream clearance of
Pike Run Creek and approximately 600 feet of Gorbys Run in California Borough; (2) approxi-
mately 9,435 feet of stream clearance of Chartiers Creek in the City of Washington and Canton
Township; and (3) approximately 25,400 feet of stream clearance of Burgetts Fork in Smith
Township and Burgettstown Borough. Bids will be received at the office of the County Controller,
Court House, Washington, Pennsylvania, until 11: 00 A. M. E. D. S. T. , Thursday, October 22,
1970; and opened immediately thereafter in the office of the County Commissioners.

Chief Clerk read correspondence under date of September 15, 1970, from Gerard
N. Massaro, Director, Southwest Regional Planning Council, to Joseph A. Feconda, Warden,
Washington County Prison, enclosing a check (no. 218432) in the amount of $13, 844. 00. Said
letter stated that this was the amount of the subgrant approved by the Pennsylvania Criminal
Justice Planning Board to purchase and install in the County Prison a television monitoring
system for surveillance; telephone and paging systems to improve efficient use of staff; and
the electronic locks for exterior doors to increase security.

Correspondence under date of September 18, 1970, addressed to Mr. Anthony
V. Luppino, Executive Director, Juvenile Court of Washington County, from Mary Jane
Fullerton, Social Service Department, Oakdale Home for Boys, stating that Robert Harding
is in need of some dental care and the dentist will not proceed with this work unless it is
authorized by the County.
Moved by Mr. Bevec, seconded by Mr. Flynn, that dental work for Robert
Harding be approved.

Chief Clerk read correspondence under date of September 9, 1970, from
Mary J. Bakaitis, Jury Foreman, stating that the members of the September Term of the
Grand Jury for the yeaf 1970 made a tour and examination of the County Home for Aged
Women and the Washington County Jail. Letter stated that the County Home was cle an and
orderly and the food was excellent. It was recommended that an elevator be installed in
the Home to assist the elderly women in traveling from floor.to floor.
Letter also stated that the jail was well managed, and no complaints were
received from the in -mates.
Chief Clerk read correspondence under date of September 22, 1970, from
Arthur A. Florio, Chairman, Smith Township Supervisors, extending his personal pongratu-
lations on the conference entitled "The Mobile Homes in the Community".
Mr. Florio stated that this is a matter which is of deep concern to all municipal officials.
Chief Clerk read correspondence under date of September 23, 1970,
from the U. S. Department of Housing and Urban Development stating that the --,Department
of Housing and Urban Development is establishing an Area Office in Pittsburgh, Pa. Mr.
Charles J. Lieberth has been appointed the Area Office Director. The Pittsburgh Area
Office will be fully operational on September 30, 1970.

Mr. Michael George entered the meeting.
Chief Clerk read correspondence under date of September 15, 1970, from
James R. Showrank, Project Coordinator, addressed to Mrs. Charlotte K. Lane, Executive
Director, Washington -Greene County 'Tourist Promotion Agency, concerning the Summer
Intern Program. Mr. Showrank stated that Mrs. Lane Is cooperation is helping to make
this program a success.
Chief Clerk read correspondence under date of September 18, 1970,
from Michael George, Director, Department of Parks and Recreation stating that in the
past few weeks he has had various discussions with representatives of the Girl Scouts of
Southwestern Pennsylvania who wish to use some type of building in Mingo, Creek Park
which they feel would be ideal. Mr. George further stated that if the Board agreed to this,
a necessary agreement would be prepared; and also that Girl Scouts of Washington Co.
would have first preferance to the Building.
Jack Merdian entered the meeting.
Mr. Bevec: I would suggest that we grant permission as suggested with the proper
lease to be submitted for approval.
Moved by Mr. Bevec, seconded by Mr. Flynn, that the Girl Scouts of
Southwestern Pennsylvania be permitted to use a vacant house in Mingo Creek Park for
their various activities, with said Lease submitted for approval.

Chief Clerk read correspondence under date of September 28, 1970,
from Romayne K. Harry, Assistant Director for Management Services Bureau of Housing
and Environmental Control, enclosing a copy of the Service Purchase Contract authorizing
payment for the preparation of Solid Waste Management plan as provided for in the Pennsyl-
vania Solid Waste Management Act.
Chief Clerk read correspondence under date of September 23, 1970, from
John Suwak, President, Suwak Trucking Company, addressed to Mr. James Mifflin,
District Engineer, Pennsylvania Department of Highways concerning an underpass on Chest-
nut Street between Interstate 70 Exit 4 and their terminal near the offices of Coen Oil.
Mr. Suwak stated that this underpass is recorded as 131 6" and with the resurfacing of the
road the designed clearance has diminished causing several accidents at this location with
their equipment. Mr. Suwak firmly requested action by the Department of Highways to
provide required clearance at the underpass.

Mr. Bevec: I would suggest that we direct a letter to the Highway Department asking
that they correct the situation.

Chief Clerk read correspondence under date of September 17, 1970
from Senator Wilmot E. Fleming addressed to the Honorable Austin J. Murphy acknowledging
his letter of September 3rd in reference to House Bill 2459 which is presently in the Senate
Local Gov't. Committee. House Bill 2459 will be considered upon return of their session.
New Business: Mr. Flynn (Capital Investment)
Mr. Flynn reported that a Certificate of Deposit from the Liquid Fuels
Account in the amount of $100, 000. 00 matures October 6, 1970. This is at the interest
rate of 8%.
Moved by Mr. Bevec, seconded by Mr. Flynn, authorizing the treasurer's
office to re -invest the $100, 000. 00 in the Liquid Fuels Account, effective October 6, 1970.

Mr. Whalen entered the meeting.
Deputy Controller Whalen reported that $500, 000. 00 from the General
Fund Account will mature September 28, 1970.
Moved by Mr. Bevec, seconded by Mr. Flynn, that $400, 000. 00 of this
amount be re -invested in a 30 day Certificate of Deposit at the interest rate of 6 1%2%,
effective September 28, 1970.

County Solicitor Capano presented three (3) Tax Refunds to the Board for
approval; said refunds having been approved by the County Solicitor.
Moved by Mr. Bevec, seconded by Mr. Flynn, that the Tax Assessment
Office be authorized to prepare the following tax refunds due to either duplication or over-
payment of real estate:
1. In re: Dau, Eberhard H. & Jane-C., Mt. Pleasant Township
Tax in the amount of $46. 08 net, was paid on August 3, 1970
Payment was duplicated in the same amount on August 14, 1970
making a refund due in the amount of $46. 08 to Jane C. Dau,

Tax in the amount of $19. 66 net was paid on July 31, 1970
and payment was duplicated in the same amount on the same
date. Mrs. Fern Tonti of the Falconi Office asked that $15. 65
of this amount be applied to the account of Phillip D. Falcon
also of Mount Pleasant Township making a refund due in the
amount of $4. 01 to Dalbo, Mary et al, c / o Fern Tonti, North
Jefferson Avenue, Canonsburg, Pa.
3. In re: Jones, Edward D. & Marjorie B.
Peters Township
Tax in the amount of $49. 33 was paid on August 14, 1970
by E. Dale Jones. Payment was duplicated in the same amount
on August 14, 1970 by - Dollar Savings Bank for Alwyn & Sally
Poland, new Owners, making a refund due in the amount of $49. 33
to Mr. E. Dale Jones, 201 Water Dam Road, McMurray, Pa. 15317

Solicitor Capano presented a hangar rental to the Board for approval:
Moved by Mr. Bevec, seconded by Mr. Flynn that the lease between the
County of Washington and Mr. William I. May, 259 Linden Creek Road, Canonsburg, Pa.,
15317, for the storage of one (1) aircraft, Piper Cherokee - 140 N4438-J in Hangar No. A-5
for the sum of $40. 00 per month, beginning October 1, 1970, and thereafter from month to
month be approved; and that the Chairman of the Board, Michael R. Flynn, be authorized
to execute said Lease. Rental fee to the County of Washington, c/o John Yuhas, County
Surveyor, 67 West Cherry Avenue, Washington, Pennsylvania 15301.

Solicitor Capano presented to the Board a final bill from the Penn Central
Transportation Company in the amount of $1, 282. 09 for a railroad crossing and signal light
at Rt. 118 (Main Street) Bentleyville.
Mr. Capano: The P. U. C. has assessed the County of Washington 10% of the total cost
of the project. I recommend payment to them in the amount of $1, 282. 09.
Moved by Mr. Bevec, seconded by Mr. Flynn, that the amount of $1, 282. 0
be approved for payment to the Penn Central Transportation Company for a crossing and
signal light at Rt. 118 (Main Street) Bentleyville.

Mr. Capano:
There has been a controversy over the method of qualifying the employees of
the Mental Health - Mental Retardation Office with the administration of Harrisburg. Mr.
Gillespie was in Harrisburg to talk to Deputy Attorney General Cutting. This has been re-
solved, and it is now necessary to adopt the following resolution:
In Order to provide Social Security coverage for the employees of the Wash-
ington -Greene Mental Health -Mental Retardation Program the Washington County Commis-
sioners are formally requesting the use of a centralized reporting system in order that a
single report might be filed by this program for Social Security purpose. In making this
request, the Washington County Commissioners agreed that each employee will be furnished'.
a separate W-2 Form showing the aggregate of the wages paid by Washington County and we
acknowledge the county's liability for the payment of any taxes, both employer and employee
which may become due.

Mr. Porter (Washington Mall Tax Appeal Case)
In the Washington Mall Tax Appeal Case the tax payer has filed a cross appeal
and these appeals will be argued together at a date to be specially set in the latter part of
November and they will not be argued at the time of the regular argument Court during the
first week of October.

(Covered Bridge in Amwell Township)
Judge Curran has set a date for the hearing on the case involving the
covered bridge in Amwell Township which he will also set for a date in the latter part of
November.
Mr. Porter also reported that the Petition to erect a new Voter's
Precinct in Peters Township was up before the Court on September 21, 1970, and was
approved.
A brief discussion was held on the two (2) seminars which will be held
for the Judges of Election, on October 14, 1970. One seminar will be held in Charleroi,
and one at the Courthouse in Washington. The seminars are mainly for the Judges of
Elections, but anyone else may listen in. It was suggested that the Judges of Elections be
reimbursed for mileage in attending these seminars.
Moved by Mr. Bevec, seconded by Mr. Flynn, that the Judges of
Elections be reimbursed for mileage in attending said Seminars.

Mr. Anthony read correspondence under date of September 25, 1970,
from Mrs. Frances B. Hemminger, Secretary, stating that there will be a meeting on
Tuesday, Oct. 6, 1970 at 7:30 p, m, at the Elrama Fire Hall in connection with air pollution.
The meeting will inform citizens as to what can be done about the stacks at Duquesne Light
Company's power plant on emission of fly ash.
Mr. Jack Merdian read a News Release concerning the Ferry Service
between Washington and Fayette Counties, saying that it appears likely that it will be
resumed in 1971.
