COMMISSIONERS C Minute No. 140 Office of the County Commissioners Washington, Pa,, October 29, 1970 The Board of County Commissioners met in regular session with the following members being present: Commissioners Bevec, Mazza, and Flynn. Also present being: County Solicitor Capano, Cheif Clerk Murphy, Public Information Officer Huber, Parks and Recreation Director George, Reporters Crouse of the Observer -Reporter and Roule of the Monongahela Publishing Company. Meeting "called to order by Chairman and roll call taken: Mr. Bevec - Present; Mr. Mazza - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. 139, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Bevec, that Minute No. 139 be approved, as read. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Parks and Recreation Department - Game Hunting: Mr. Michael George, Parks Director, was in attendance at the meeting to report on a meeting with representatives of the Washington County _sportsmen's & Conservation League and to submit recommendations concerning game hunting in Cross Creek and Mingo Creek County Park. Reference was made to the letter presented to the Board of Commissioners at their October 22nd meeting from the Sportsmen's League re- questing a meeting for the purpose of discussing the use of Mingo Creek County Park by hunters, Mr. George was contacted on the matter and a meeting arranged. Mr. George: Concerning the game hunting, we had a lot of meeting before and settled on Cross Creek, none at Mingo Creek (the matter was under consideration). I met with a couple of their representatives and submitted a plan that was acceptable to the representative, and the President of the League. Mr. George reviewed his recommendations with the Board. Mr. Mazza: Is this similar to what we had last year? Mr. George: We didn't have hunting in Mingo last year, only in Cross Creek. Mr. George also made note that you cannot please everyone at all times (residents in the area and hunters) but hopefully their Department will be able to control 316 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. BEVEC, JOHN MAZZA, COMMISSIONERS the situation and not have too many problems; proper signs will have to be posted on all of the buildings (no trespassing) in order to avoid any loss such as by fire due to carelessness of a hunter. Mr. George informed the Board of the recent loss of a very good barn as a result of fire (undetermined origin). Mr. Mazza: Will there be additonal security? Mr. George: We are going to watch Mingo Creek Park very closely because people utilize the Park. There will be no hunting in Mingo Park until all of the areas are posted properly, the Sportsmen's group have offered assistance. Mr. Capano: There should be something on your permit that the hunters are hunting at their own risk, that the County is not responsible for any bodily or physical damage. Moved by Mr. Mazza, seconded by Mr. Bevec, that the following con- ditions for game hunting in Cross Creek and Mingo Creek County Park, be approved; hunt- ing shall be in accordance with all applicable Pennsylvania Game Commission laws and regu-I Tations. Wild Game Hunting in Cross Creek and Mingo Creek County Park, 1970-71 Season 1. Small and big game hunting will be permitted in Cross Creek Park, in accordance with State Game Laws, beginning October 17, and ending January 1.6, 1971. 2. Only small game hunting will be permitted in Mingo Creek Park beginning October 31 ending November 28, 1970 and beginning December 26 ending January 16, 1971. Hunting will be controlled in accordance with the following: a. Hunters must obtain a permit at the Mingo Creek Park office each day they desire to hunt. Permits will be issued Monday thru Friday 9: 00 a, m, to 4:00 p. m. and 8:00 a. m. to 11: 00 a, m. on Saturdays. b. Hunting and parking of vehicles will be permitted only in designated areas as posted. 3. The Department of Parks and Recreation is authorized to prohibit or terminate game hunting at any time in either park, in part or entirety. This action will be based upon: a. Fire Hazard conditions b. Park development C. Posting of safety zones d. Posting of designated hunting areas e. Damage or distruction to private or park property f. Old Business: (Awarding of Contracts - Stream clearance) County Solicitor reviewed the number of bids received making note that in checking all of the lowest bidders have been found responsible. Mr. C4pano recommended the following: Moved by Mr. `Bevec, seconded by Mr. Mazza, that the contract for approximately 9, 435 feet of stream clearance of Chartiers Creek in the City of Washington and Canton Township, be awarded to M & M EQUIPMENT SALES COMPANY, Box 428, Burgettstown, Pennsylvania 15021, for the amount stated in their bid - $13, 860. 00; this being the lowest responsible bid received and being in accord with specifications; that the contract for approximately 4, 275 feet of stream clearance of Pike Run Creek and approximately 600 feet of Gorby's Run in California Borough, be awarded to ALEX E. PARIS CONTRACTING COMPANY, INC., Atlasburg, Pennsylvania 15004, for the amount stated in their bid - $7, 890. 00; this being the lowest responsible bid received and being in accord with specifications; that the contract for approximately 25, 400 feet of stream clearance of Burgetts Fork in Smith Township and Burgettstown Borough, be awarded to M & M EQUIP- MENT SALES SALES COMPANY, Box 428, Burgettstown, Pennsylvania 15021, for the stated in their bid - $8, 425. 00; this being the lowest responsible bid received and being in accord with specifications. Payment Authorization - (Tax Claim Bureau) Moved by Mr. Bevec, seconded by Mr. Mazza, that the sum of $19. 38 (county pro -rated share in regard to the removal of a tree on Washington County property, formerly owned by Harold Yancey Thomas, Washington 6th Ward), be approved for payment. Check to be made payable to Crane Truck Service Company. Remarks: Mr. Capano - I would suggest that the City be given notice that hereafter they go through the proper channels - the Washington County Tax Claim Bureau has the right to approve such action. In other words the City was in error to do this because this property is in trust to the Tax Claim Bureau and the City went ahead on their own without consulting the Tax Claim Bureau; they must first go through the Tax Claim Bureau. Note: The above was an emergency situation which happened during a severe rain storm and the city officials were called in... total amount of invoice is $102. 00 with the school board share being $51. 00 and City of Washington share being $31. 62. Letter under date of October 24, 1970 from Patricia Hammer, Secretary South Franklin Township, requested -that their Liquid Fuels Tax Funds in the amount of $850. 00 be held until next year (1971) in order that they may have sufficient funds to complete the proposed project. Moved by Mr. Bevec, seconded by Mr. Mazza, that Liquid Fuels al- location in the amount of $850. 00 due South Franklin Township, be held over until 1971 as requested. Letter under date of October 23, 1970 received from Miss Dorothy Squibb, Supervisor of Special Education, County Superintendent of Schools, notified the Board that Mrs. Ellen Davidson was employed by the Washington County Board of Education on a part time basis (not to exceed fifteen (15) hours per week) to teach at the Detention Home, supplementing the teaching time made available through Mr. Ondulik; a recommend- ation was also submitted that Mr. Daniel Luppino be considered a candidate for a part-time counselor position - a social history on certain children made available for the teachers would provide a frame of reference for the teachers to cooperatively develop education programs with the aid of a person skilled in counseling techniques. Chairman stated that authorization from the County Commissioners is necessary to join in with Fayette County to create a joint Authority for the purpose of transportation means between the two (2) counties to provide ferry service at three (3) sites on the Monongahela River - Allenport, Coal Center, and Fredericktown. Chairman made note that the Board of Washington County Commissioners met with the Fayette County Commissioners at Uniontown, discussed the matter at length and after much deliberation came to their conclusion regarding the formation of a joint Authority; Fayette County studied the situation for about two years. Washington County awareness - 8 to 10 months ago, there has been quite a bit of research, therefore, we have no choice but to recommend authorizing County Solicitor Capano to meet with the Fayette County Solicitor to draft the necessary legal documents to create a Joint Authority. Moved by Mr. Bevec, seconded by Mr. Mazza, that A. V. Capano, Washington County Solicitor, be authorized to meet with the Solicitor of Fayette County to draft the necessary legal documents to create a'Seven (7) Member Authority Board in connection with Ferry Service. Remarks - Mr. Mazza: How many members will we have? Mr. Flynn: Four members will be from Washington County, three members from Fayette County. Reinvestment of Funds: Chairman notified the Board that Deputy Controller Whalen had in - and October 28th formed him on October 26th,/Certificate of Deposit Investments maturing on those dates could be reinvested and each date the Chairman authorized the reinvestment of funds for a period of thirty (30) days - the one Certificate of Deposit being $200, 000. 00 and the other one being $250, 000. 00 for a total of $450, 000. 00. Mr, Flynn: I would like the record to show I do have the authority approving the investments. Moved by Mr. Bevec, seconded by Mr. Mazza, that action taken by the Chairman of the Board concerning the reinvestment of funds in the amount of $450, 000. at the maturity date of Certificate of Deposit Investments, be approved and confirmed. Mr. Whalen made note that investments from the Liquid Fuels Account, one in the amount of $100, 000. and one in the amount of $150, 000 would mature at the end of November. Transfer of Funds: Moved by Mr. Bevec, seconded by Mr. Mazza, that the amount of $800. 00 be transferred from Account 101-2-5 to: Account 101-2-11. Solicitor: (Tax Refund) County Solicitor presented a tax refund to the Board for approval; said refund having been approved by County Treasurer and County Solicitor. Moved by Mr. Bevec, seconded by Mr. Mazza, that the Tax Assessment Office be authorized to prepare the following tax refund due to either duplication or overpayment of real estate tax. Re: Ellis, James E. & Susan H. South Strabane Township County tax in the amount of $67. 50 Face was paid on August 31, 1970. Correction Slip dated October 20, 1970 corrected an error in addtion of the assessed valuation, reducing same to $3, 150. and tax to $56. 70, making a refund due in the amount of $10. 80 to JAMES E. (Public Utilities) Mr. Capano reviewed the circumstances whereby public utilities have been removed from the tax exempt listing to taxable listing stating that it is his recommendation to have our Tax Assessment Office place the properties on the taxable books, which was done before the deadline of October 1, 1970 and further, in order to be on the safe side) pending court action results - I recommend the County Treasurer be di- rected to send out statements in behalf of Washington County for taxes for one-half year of 1970. Moved by Mr. Bevec, seconded by Mr. Mazza, that the County Treasurer be directed to send out statements in behalf of Washington County to the Public Utilities for taxes for one-half of the year 1970. Remarks - Mr. Bevec: Ordinarily you are not to pro rate taxes, why do you say one-half year. Mr. Capano: They are using the July 1st date. Mr. Mazza: Some are paying under protest. Mr, Capano: We have until March to send assessed figures for all municipalities into Harrisburg; the Chief Assessor is going over the properties with the various utilities, such as updating, etc, which wasn't necessary before. adjourn.
