case has been postponed and has been rescheduled for December 30, 1970; and that the
arguements for the Washington Mall Tax Appeal Case will be held on December 2nd or
3rd.

Morgan; Reporter Robertson of the Observer -Reporter; Reporter Roule of the Monongahela
Publishing Company; Reporter Liesch of the Brownsville Telegraph; and Public Information
Officer Huber.

Note: This bill was approved by Mike George.
Chief Clerk read correspondence under date of November 22, 1970,
addressed to Governor Raymond P. Shafer, from A. J. Watson, State Chairman,
Constitutional Party, asking Governor Shafer to abide by the Pennsylvania Constitution
on 21 year voting age. Mr. Watson requested a copy of a directive to the County Election
Board stating that they are to accep registration of voters 18 years of age and older
beginning with the new registration period, December 3, 1970. The following is from our
Pennsylvania. Constitution: Article VIII, Section 1, "Every citizen 21 years of age,
possessing the following qualifications, shall be entitled to vote at all elections........ "
The legislation passed by Congress could be declared unconstitutional, and the directive
to the County Election Boards that they in turn violate the State Constitution by registering
18 year olds could create considerable confusion and unnecessarily require the expenditure
of thousands of tax dollars.
Mr. Bevec: Mr. Welsh did say that he would send this directive to accept the registra-
tion of those 18 years and older. Mr. Muscaro has not received it yet.
Mr. Capano: I don't think they can do it by directive. I understand that there is going
to be a question up before the Supreme Court. These cards of 18, 19, and 20 year olds
should be kept separate, so that if this is ruled unconstitutional, they can be destroyed.
Mr. Bevec: You mean we will take these registrations starting December 3, 1970?
Mr. Flynn: We have received no notification.
Chief Clerk presented letter under date of November 20; 1970, addressed
to Warden Joseph A. Feconda, from Bruce McIver, acknowledging the committment to pay
one scholarship amounting to $100. 00 (one hundred dollars) to Washington County toward
participation in Correctional Management Institute I.
Moved by Mr. Bevec, seconded by Mr. Mazza, that Warden Joseph A.
Feconda be permitted to attend Correctional Management Institute I.

Chief Clerk read correspondence under date of November 24, to County
Board of Election, from C. Russell Welsh, Jr., Deputy Secretary of the Commonwealth
which was received this morning stating that the new Federal Voting Rights Act giving the
franchise to 18, 19, and 20 year old citizens becomes effective January 1, 1970. Mr. Welsh
advised us to open our registration to persons 18, 19, and 20 years of age as of December
3, 1970; and also to keep this category of citizens who register separate from those over
21 years of age, pending a U. S. Supreme Court decision.
Mr. Flynn: We will comply.
Memorandum under date of November 24, 1970, from F. D. Whalen, Deputy
Controller to Michael R. Flynn, stated that a Certificate of Deposit with PNB in the amount
of $250, 000. 00 matures Wednesday, November 25, 1970. Another Certificate of Deposite
with PNB in the amount of $200, 000. 00 matures November 30, 1970. The net balance of
the General Fund Account as of November 24, 1970 is $135, 549. 47. Mr. Whalen recommen
ded that we re -invest the sum of $125, 000. 00 at this time, in another Certificate of Deposit
for 30 days. This would mature prior to the year end.
Moved by Mr. Bevec, seconded by Mr. Mazza, authorizing the Controller's
Office to make a re -investment in the amount of $125, 000. 00 in a Certificate of Deposite
for 30 days, at Pittsburgh National Bank.

New Business:
Budget Posfing•
Mr. Flynn presented a statement stating that the proposed budget for fiscal
1971 for Washington County contemplates total expenditures of $7, 608, 513. 00. This is
$326, 908. 00 over the 1970 budget. The increase is due to the pay raise granted to em
in July of 1970 and to increased operating expenses in other areas of government. The
income necessary to meet this years anticipated expenditures will come from real estate
taxes, row office earnings and increased state grants in aid. This budget is based upon
departmental requests for 1971 and is still being scrutinized for possible reductions in

1971 for Washington County be made available for public inspection at the Office of the Chief
Clerk to the County Commissioners, County Courthouse, Washington, Pennsylvania,
beginning on Tuesday, December, 1970, for a period of twenty (20) days.
Remarks:
Mr. Flynn: We have prepared a statement about total expenditures which is self -explana-
tory.

Mr. Bevec: Holiday Vacations:
Moved by Mr. Bevec, seconded by Mr. Mazza, that the Court House will be
closed starting 12:00 noon, December 24, 1970 because of the Christmas Holiday; and
12:00 noon, December 31, 1970, because of the New Year's Holiday.
Remarks:
Mr. Flynn: This is to let people plan accordingly. The purpose has double fold for
December 31, 1970, because the row offices must balance out their accounts and turn the
money over to the County Treasurer.

Chief Clerk presented memorandum under date of November 19, 1970, which
was sent to all offices stating that Friday, November 27, 1970 is a scheduled working day
and this applies to all personnel. Permission has not been granted by the Salary Board
to operate a skeleton force.
Solicitor - Tax Refunds:
County Solicitor presented various tax refunds to the Board for approval;
said refunds having been approved by the County 'treasurer and Solicitor.
Moved by Mr. Bevec, seconded by Mr. Mazza, that the Tax Assessment
Office be authorized to prepare the following refunds due to either duplication or overpay-
ment of real estate tax.
1. In re: Lucas, Frank J. & Margaret
Charleroi Borough
County tax in the amount of $43. 26 net was paid on August 14, 1970
by Frank J. & Margaret Lucas. This tax was paid in error as Mr.
Lucas does not own this property. Correction Slip dated November
13, 1970 removed same from the name of Lucas and listed it in the
correct name. Notice has been mailed to the correct owner, making
a refund due in the amount of $43. 26 to LUCAS, FRANK J. &
MARGARET, R. D. 1, Box 43, Charleroi, Pa. 15022.
2. In re: Modrak, John & Anna
3-31 North Jefferson, Canonsburg 2nd Ward
County tax in the amount of $31.12 net was paid on August 6, 1970 by
First' Federal Savings and Loan Association of Bellevue for John &
Anna Modrak, this being the correct payment. On August 7, 1970,
payment in the amount of $31.12 net was duplicated by John & Anna
Modrak, making a refund due in the amount of $31.12 to JOHN &
ANNA MODRAK, 331 North Jefferson Avenue, Canonsburg, Pa. 15317.
3. In re: Hughes, Herbert F. & Josephine
Washington 7th Ward
County tax in the amount of $45. 57 net was .paid on July 28, 1970, by
Herbert F. & Josephine Hughes. Same tax was paid on August 14,
1970 in the same amount by First Federal Savings & Loan Association
of Washington, this being the correct payment, making a refund due
in the amount of $45. 57 to HERBERT F. HUGHES, 595 Glenn Street,
Washington, Pa. 15301.
4. In re: Pugh, Homer W. & Mary M., Canton Twp.
(New Owner: Jasinski, Casimer)
County tax in the amount of $89. 86 net was paid on August 14, 1970 by
First Federal Savings & Loan Association of Washington. Payment
in the same amount was duplicated on the same date by First Federal
Savings & Loan of Washington, making a refund due in the amount of
$89. 86 to FIRST FEDERAL SAVINGS & LOAN ASSOCIATION OF
WASHINGTON, 77 S. Main St., Washington, Pa. 15301.
5. In re: Morrow, Melvin N. & Millinda M.
Washington 7th Ward
County tax in the amount of $84. 64 net was paid on August 6, 1970 by
Melvin N. & Millinda M. Morrow. Payment in the same amount of
$84. 64 net was made on August 14, 1970 by First Federal Savings &
Loan Association of Washington for the Morrows, this being the correct
payment, making a refund due in the amount of $84. 64 to MELVIN N.
& MILLINDA M. MORROW, 740 Summerlea Avenue, Washington, Pa.
