THE FOREGOING MINUTE READ AND APPROVED: 1971 ATTEST: CHIEF CLERK Minute No. #161 Office of the County Commissioners Washington, Pa., April 1, 1971 The Board of County Commissioners met in regular session with the following members being present: Commissioners Bevec, Mazza and Flynn. Also present being: Chief Clerk Murphy; County Solicitor Capano; Mr. Kyle Riggs of The Redevelopment Authority; Reporter Roule of The Monongahela Publishing Company; Reporter Moore of The Observer -Reporter; and Public Information Officer Huber. Meeting called to order by Chairman and roll call taken: Mr. Bevec - Present; Mr. Mazza - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. #160, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Bevec, that Minute No. #160 be approved, as read. Roll call vote taken: Mr. Bevec - Yea; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Special Order of Business: Chairman stated that the regular order of business would be dispensed with in order that Mr. Kyle Riggs - The Redevelopment Authority, could make his presentation to the Board in reference to the Borough of Donora (Southgate Urban Renewal Area). Mr. Riggs requested the Commissioners approval to make application for a State planning advance of $163, 017. 00 in order that the Urban Renewal project in Donora could get underway. MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS Moved by Mr. Bevec, seconded by Mr. Mazza, that the Resolution whereas the Redevelopment Authority of the County of Washington is authorized to file Application for a Redevelopment Assistance Grant in the amount of $163, 017, 00 for the Borough of Donora be approved by the Washington County Commissioners. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes;: Mr. Flynn - Yes. Motion carried unanimously. Mr. Riggs left the meeting. Mr. Sismondo entered the meeting. County Solicitor Capano presented for the consideration and approval of the Board a proposed Agreement between the City of Monongahela and the County of Washington in which the City of Monongahela is to secure the property through condemnation of Charles Fritch located in the First Ward of Monongahela. Said Agreement is in conjunction with the meeting up of mine drainage neutralization projects and the costs of processing the property. Moved by Mr. Bevec, seconded by Mr. Mazza, authorizing the Washington County Commissioners to enter into Agreement with the City of Monongahela as per above. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. John Merdian entered the meeting. Mr. Sismondo left the meeting, County Solicitor Capano presented a Resolution and Deed whereas Consolidation Coal Company agrees to exchange 42. 6306 acres of its land for 42. 6288 acres presently owned by the County for the consideration and approval of the Board. Said land received by the County shall be devoted to the purposes of the Mingo Creek Park. Solicitor Capano recommended the adoption of the Resolution and the approval of the Deed to be executed by the Commissioners. Moved by Mr. Bevec, seconded by Mr. Mazza, approving the adoption of the Resolution in conjunction with the Consolidation Coal Company and the County of Washington and also giving approval to the Deed for same; said Resolution and Deed to be executed by the County Commissioners. Old Business: None Correspondence: Moved by Mr. Bevec, seconded by Mr. Flynn, approving the bill as submitted by the Washington County Planning Commission in the amount of $31. 00 due to Recorder of Deeds John Mazza for recording fees for four (4) easements. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza -- Abstained; Mr, Flynn - Yes. Motion carried. Chief Clerk informed the Board of a check received in the amount of $5, 273. 60 from the Department of Public Welfare for Day Care Contract #687 (70). Chief Clerk informed the Board of a check received in the amount of $156. 10 from the Commonwealth of Pennsylvania for reimbursement from Department of Forest and Waters for Chartiers Creek Flood Control Project, Phase I, Canonsburg. Budget Request: Moved by Mr. Bevec, seconded by Mr. Mazza, approving the first quarterly request of the Redevelopment Authority in the amount of $19, 437. 50 based on the 1971 county budget; certified copy of the resolution authorizing this requisition attached to request. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of March 12, 1971, from the Fayette County is planning on doing its part in celebrating the 200th birthday of the birth of our nation in 1976. Correspondence stated that purpose of said letter is to ask the Washington County Commissioners help in raising money for the "local share" necessary to secure matching grant money from the various state and federal agencies. Correspond- ence specifically requested that the County Commissioners make some financial eontribu to the local share of construction cost amounting to $311, 000. 00 of the Amphitheatre. fl 466 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS Correspondence stated that due to the fact that no less than 10 million automobiles will be passing through western Pennsylvania during the bicentennial year, one of several projects Fayette County Commissioners have undertaken to accomplish their goals is the development of the Great Meadows Park and Amphitheatre near Fort Necessity, Route 40 East, Wharton Township. Mr. Flynn: May I recommend that the Washington County Commissioners acknow- ledge receipt of the above letter and request, however; the Washington County Commissioners cannot meet their request for a financial contribution. Chief Clerk read correspondence under date of March 24, 1971, from Edward Eckels directed to Malcolm Morgan, County Treasurer, which stated that under the County Code entitled "Commissions from Commonwealth and Political Subdivisions" which is cited at 16 P. S. 1555-2, Mr. Eckels is required to return to the General Fund of the County all commissions from the Commonwealth of Pennsylvania and from any political subdivision which he receives in excess of $7500, 00 during the calendar year 1970, when he was acting Recorder of Deeds. Correspondence stated that a check is enclosed in the amount of $1798. 28 which is the total sum due to the General Fund. Correspondence further stated that before said sum is paid over to the County Fund, Mr. Eckels requested that the action which he is taking be fully approved by the County Solicitor and any other necessary parties. Moved by Mr. Bevec, seconded by Mr. Flynn, acknowledging receipt of the above letter but that action on the request be delayed until a meeting is arranged with the Recorder of Deeds, County Controller, and County Solicitor to settle the matter. Chief Clerk read correspondence under date of March 24, -1971, from Joseph J. Sambolt, Area Director - U. S. Department of Labor, Wage and Hour and Public Contracts Division, which stated that as a result of the recent audit of the payrolls and pay practices at the Washington County Home for Aged Men, Compliance Officer Bernard Gallagher has found $14, 478. 99 due to 27 employees. The underpayments resulted from the failure to pay males and females performing substantially equal work, equal rates of pay. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of March 24, 1971, from Congressman Thomas E. Morgan which stated that in reference to a resolution passed and adopted at a recent meeting of the Washington County Commissioners relative to Norman Monack and students of the California Area Schools who have designed a flag for the official use of the Congress, said matter has been referred to the attention of the House Administration Committee. Letter under date of March 2, 1971, from Wayne L. Hays, Chairman - Committee on House Administration, addressed to Congressman Thomas E. Morgan stated that said matter has been referred to the Subcommittee on Library and Memorials and will probably be considered in the first session of the 92nd C ongre s s . Chief Clerk read correspondence under date of March 26, 1971, from Paul A. Abraham, Principal - Trinity Senior High School, which extended sincere appreciation and thanks to the Washington County Commissioners for making arrangements to have the 18 year old students of Trinity Senior High School register for voting. Correspondence also commended Mr. Joseph Muscaro and members of his staff for their cooperation and efficie- ncy in handling this project. Chief Clerk read correspondence under date of March 25, 1971, from R. M. Davis, State Conservationist, which informed the County Commissioners that the informal field review of the tentative Cross Creek Work Plan will be held at 1:30 p. m. on April 19, 1971, at the Soil Conservation Service Office, 37 Highland Avenue, Washington, Pennsylvani Purpose of said meeting is to afford interested state and federal agencies the opportunity to comment on the proposed plan. Chief Clerk made note that correspondence was also received from the Washington County Soil and Water Conservation District informing the Commissioners of same. Chief Clerk informed the Board of a telegram received under date of March 29, 1971, from A. L. Hydeman, Jr. - Executive Deputy Secretary of the Department of Community Affairs, which stated that Act 66 of 1970, as amended by Act 273, Public Realty Tax Act- requires all municipalities, school districts, and counties to file for utility realty reimbursement by April 1, 1971. Revenue Department in accordance with Section 704 of fiscal code has extended report deadline to April 16, 1971. Fifty percent of local taxing authorities have not filed. Telegram urged local authorities to file by new date. MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS Chief Clerk read correspondence under date of March 22, 1971, from John D. Anthony, Executive Director of the Washington County Planning Commission, which stat- ed that John Buscavage of the Pennsylvania Department of Environmental Resources had indicated that a new road building material has been perfected. Said material utilizes coal mine refuse as its basic constituent. Correspondence stated that Mr. Buscavage would like to know if an experimental project of one mile in extent in some township in Washington County can be developed. Correspondence further asked if the County Commissioners have a particular township in mind for said project. Aft er a discussion was held on the above matter, it was agreed upon that said matter be turned over to Mr. John D. Anthony for further discussion with the Pennsylvania Department of Environmental Resources. Commissioner Bevec recommended that a letter be directed to the Township Supervisors Association advising them of said decision, Chief Clerk read correspondence under date of March 29, 1971, from George H. Ebner, Executive Director - Bicentennial Commission of Pennsylvania, which requested the Washington County Commissioners to consider designating or creating a particular agency to be responsible for Bicentennial planning within Washington County, in preparation for the Nation's Bicentennial in 1976. Mr. Flynn: The Washington County Commissioners will comply with the above request. Chief Clerk read correspondence under date of March 29, 1971, from Douglas A. Farber, State Coordinator - Pennsylvania State Clearinghouse Project Notification and Review System, Re: Washington County Airport Extension of Runway - PNRS Letter of Intent, which stated that information has been received that Washington County is applying for Federal assistance under a program requiring compliance with the Project Notification and Review System as established by U. S. Bureau of the Budget Circular A-95. Corres- pondence noted that a Letter of Intent has not yet been received pursuant to the PNRS pro- cedures. Moved by Mr. Bevec, seconded by Mr. Mazza, authorizing the County Engin eers Office to send a letter of intent as per above. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. New Business: (Holiday) Chairman made note that the Court House will be closed on Friday, April 9, 1971, in observance of Good Friday. Re -investment: Liquid Fuels. BEVEC, JOHN MAZZA, COMMISSIONERS 1 Chairman informed the Board that as per conversation with Deputy Controller Whalen prior to the meeting, that a Liquid Fuels Certificate of Deposit at the Pittsburgh National Bank in the amount of $150, 000. 00 will mature on April 5, 1971. Deputy Controller Whalen requested authorization to reinvest said sum of $150, 000.00 in a certificate of dep at the Pittsburgh National Bank for a period of 60 days. Moved by Mr. Bevec, seconded by Mr. Mazza, authorizing the re -investment of the Certificate of Deposit.in the sum of $150, 000. 00 at the Pittsburgh National Bank for a period of 60 days. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Moved by Mr. Bevec, seconded by Mr. Mazza, approving the Budget Transfer of $40, 000. 00 from the General Fund Account to the Sinking Fund Account. Temporary Loan: Moved by Mr. Bevec, seconded by Mr. Mazza, that the Chief Clerk be authori zed to borrow from the Pittsburgh National Bank, the sum of Two Hundred Fifty Thousand ($250, 000.00) Dollars as part of the authorized aggregate amount adopted in the Resolution of January 28, 1971, at the rate specified. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. The following is a copy of the Certificate of Indebtedness: April 5, 1971 CERTIFICATE OF INDEBTEDNESS OF WASHINGTON COUNTY, PENNSYLVANIA $250, 000. 00 April 5, 1971 The County of Washington in the Commonwealth of Pennsylvania, promises to pay to Pittsburgh National Bank, or order, at its Office at 6 South Main Street, Washington, Pennsylvania, Two hundred fifty thousand ($250, 000. 00) Dollars, on or before December 31, 1971, with interest from date on the unpaid principal balances hereof from time to time out- standing at the rate of 2. 73% per annum, interest payments to be made on the first day of each calendar quarter throughout the year. Payment of the indebtedness evidenced hereby may be anticipated in whole or in part at any time and from time to time without penalty. Chairman informed tha Board of correspondence under date of March 16, 197 from John Yuhas, County Surveyor, Subject: Dredging of Pike Run Creek & Gorby's Run in the Borough of California , Pennsylvania. Correspondence stated that on Monday, March 15, 1971, at 10:00 a, m, a meeting was held with representatives of the Corps of Army Eng- ineers, Department of Forests and Waters, the Pennsylvania Fish Commission, and Washington Sportsmen; also residents and other interested persons in the Borough of Cal- ifornia, correspondence enclosed the names of those present, and summarized the meeting. Chairman also informed the Board of correspondence received from the Corps of Enginee directed to John Yuhas under date of March 30, 1971, which commented on Pike Run contro- versy - Granville Flood Protection Projects. Correspondence stated, in conclusion, (1) the area of Pike Run involved in this discussion is a Federal Flood Protection Project; (2) The Corps of Engineers DOES have authority, -Congressional authority, to recommend remedial work; and (3) the Washington County Board of Commissioners IS responsible for maintaining the project. BEVEC, JOHN MAZZA, COMMISSIONERS 1 1 1 the Borough of Roscoe whereas the Borough of Roscoe requests that the County Commission- ers grant said Borough full ownership and title to the area designated as Lots 31-38 in said Borough. Such ownership will permit planning and developing for public use. Solicitor Capano recommended that the County of Washington adopt the resolution authorizing the con- veyance to the Borough of Roscoe of Lots 31-38 for recreational use only. Moved by Mr. Bevec, seconded by Mr. Mazza, adopting the Resolution No. 2 of 1971 as submitted by the Borough of Roscoe and also giving approval for the County of Washington to convey to said Borough Lots 31-38 situate in said Borough; said conveyance is to be used for increasing recreational facilities. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. County Solicitor Capano informed the Board that there are five (5) proposed Constitutional Amendments to be voted on at the Primary Election to be held on May 18, 1971. Also there is a Special Election for a Senator in the General Assembly - Washington County. Solicitor Capano stated that the matter of ballots for the Special Election and the Constitutio- nal questions should be handled by quotes rather than by competitive bidding if possible. Moved by Mr. Mazza, seconded by Mr. Bevec, authorizing the Election Boar( to proceed by quotes rather than by bids providing the cost is below $1500.00 Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes.
