Also present being: Chief Clerk Murphy; County Solicitor Capano; Assistant County Solicitor Porter; Reporter Robertson of the Observer -Reporter; Reporter Roule of the Monongahela Publishing Company; and Public Information Officer Huber. Meeting called to order by Chairman and roll call taken; A Mr. Bevec - Present; Mr. Mazza - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. 161, each Commissioner having received a copy. approved, as read. Moved by Mr. Bevec, seconded by Mr. Mazza, that Minute No. 161 be Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of April 2, 1971, from Charles F. Rinkevich, Executive Director, Governor's Justice Commission, which stated that on March 30, 1971, Warden Feconda visited their office in Harrisburg to discuss two applications for funding assistance. The County's request for assistance to upgrade the Washington County Prison is being considered for possible funding from a special program established particularly for this purpose by the Law Enforcement Assistance Administration, The matching ratio will be on a 75-25 basis, which, of course, will be to the County's advantage. The request will be processed as soon as formal application is submitted. The communications application has been temporarily tabled, Even though the Southwest Regional Council gave a positive recommendation to the project, it is their view that action should be deferred until a Regional communications study is completed. Chief Clerk read correspondence from J. Shane Creamer, Attorney General, Chairman, Governor's Justice Commission, which stated that the Pennsylvania Criminal Justice Planning Board has been renamed "THE GOVERNOR'S JUSTICE COMMISSION", effective with the signing of an Executive Order by Governor Milton J. Shapp on March 5, 1971. The GOVERNOR'S JUSTICE COMMISSION is Pennsylvania's comprehensive planning agency under the terms of the Omnibus Crime Control and Safe Streets Act of 1968 and the Juvenile Delinquency Prevention and Control Act of 1968. Mr. Capano left the meeting. Chief Clerk read correspondence under date of March 31, 1971 from William R. Wilcox, Secretary, Department of Community Affairs, stating that April 15th has been designated by Governor Shapp as Local Government Day. Miss Genevieve Blatt, former Secretary of Internal- Affairs, will serve as Honorary Chairman. Miss Blatt was instrumental in 1965 in making the first observance of Local Government Day a success. Local Government Day this year, will be dedicated to the memory of the late Dr. Hugo V. Mailey, founder and director of the Institute of Regional Affairs at Wilkes College, who died on March 8th. Mr. Wilcox urged that we observe Local Government Day and that we issue a proclamation rededicating our efforts to enhancing the quality of local government in Pennsylvania. Chief Clerk read correspondence under date of April 2, 1971, addressed to Michael R. Flynn, from R. N. Ames, Area Manager, Columbia Gas of Pennsylvania, which stated that the "Large Volume Application" for the proposed new gas load in Washington County Court House and Jail, was approved today by Columbia Gas of Pennsylvania, 474 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS Inc. This new gas load consists of two space heating boilers with a combined input of 16, 800 CFH. It is understood that gas service will be required by August 1, 1971. Letter asked that we acknowledge receipt of this communication and confirm the new gas load and date for commencement of service. Mr. Flynn: I suggest that we acknowledge receipt of this and forward a copy to Mr. Michael Baker, who is the engineer on this Mr. Capano entered the meeting. Chief Clerk read correspondence under date of April 2, 1971, from the Department of Public Welfare, stating that the Federal Budget for the fiscal year July 1971 - June 1972, will reduce Pennsylvania allocation for programs from $348, 000 to $206, 000. This amount is a reduction from previous larger allocations. Congress can increase the appropriation above that is requested. This will effect the funding of Grant -In -Aid, Services to the Aging. The State Appropriation was reduced from $300, 000 to the present $250, 000. A result of this change may be: (1) Projects may not be funded beyond the third year; (2) Funding for a reduced number of new applications, necessitating preference to be given to applications from counties which have not heretofore applied; (3) available funds may be applied to counties already in the program; (4) Expansion of existing services limited. Chief Clerk read correspondence under date of April 5, 1971, from Mr. Charles O. Bohner, Executive Director, Washington County Civil Defense, requesting that $100. 00 be transferred from the Civil Defense Budget Account 602-4 (Capital Outlay) to Account 602-2-11. The reason for this request, is in order that payment in the amount of $100 can be made to Mr. George V. Curry, for teaching the 5 classes (3 hours, 15 minutes) of the radiological monitoring to 41 county people at the Washington County Home for Men. This is a Civil Defense 16 hour course, designed for our Police, Firemen, and People in Industry. Mr. Curry is instructing the course each Thursday night, and drives from and back to Pittsburgh. Moved by Mr. Bevec, seconded by Mr. Mazza, that the amount of $100. 00 be transferred from Account 602-4 (Capital Ou%I to Account 602-2-11; this is to be paid to the above mentioned Civil Defense Instructor. Remarks: Mr. Bevec: There are about forty people taking this course every Thursday, and it is a good program. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. BEVEC, .JOHN MAZZA, COMMISSIONERS 75 L, E Solicitor: Mr. Capano Proclamation - Local Government Day Mr. Capano presented a Proclamation, which states that April 15th has been set aside as Local Government Day and calls upon all citizens to cooperate in recognition of this observance. Moved by Mr. Bevec, seconded by Mr. Mazza, that the above mentioned Proclamation regarding Local Government Day, be adopted by the Board of County Commissioners. Mr. Roule questioned about the participation in Local Government Day. Mr. Bevec: This is being handled by the 4-H People and there will be participants from different school districts. A brief program has been arranged for them. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Resolution - Transportation Problems Mr. Capano presented a resolution, regarding transportation problems for the consideration of the Board of County Commissioners. This resolution states that the Board of County Commissioners solicits the assistance and expertise of the Mon -Valley Progress Council, and the Mon -Valley Council of Governments, in cooperation with the Southwestern Pennsylvania Regional Planning Commission and the Washington County Pla Commission in evaluating and making recommendations as to the best possible solution to the problems of Highways, Mass Transit Public Transportation, and Restoration of River Crossing Ferry Service for the greatest benefits to all residents of Washington County. Moved by Mr. Mazza, seconded by Mr. Bevec, that the above mentioned resolution be adopted by the Board of County Commissioners. Cancellation of Portion of Treasurer's Tax Sale of April 24, 1940 Solicitor Capano presented a request from the Washington County Tax Claim Bureau that the Commissioners adopt a motion to cancel a portion of the Treasurer's Tax Sale of April 24, 1940. Mr. Capano presented for the consideration of the Board, Lease, Betwee the County of Washington, and Ohio Valley Piper Sales, A Division of Atlantic Central Corporation, Washington County Airport, for a period of five years, for a rental of Three Hundred ($300. 00) Dollars beginning May 1st, 1971, and a monthly rental of Five Hundred ($500. 00) Dollars per month beginning the second five year term, beginning May 1st, 1976. Mr. Capano recommended the approval of this Lease. Moved by Mr. Bevec, seconded by Mr. Mazza, that the above mentioned lease between Washington County and Ohio Valley Piper Sales, be approved by the Board of County Commissioners. New Business: Authorization to Advertise: Moved by Mr. Bevec, seconded by Mr. Mazza, that the Chief Clerk be authorized to advertise for bids for the printing and delivering to the Election Department of the County Commissioners the necessary ballots required for the conduct of the Special Election, to be held on Tuesday, May 18, 1971, Said bids to be received at the Office of the County Controller, Washington County Court House, Washington, Pennsylvania until 11: 00 a. m. , Eastern Standard Time, Thursday, April 22, 1971, and opened immediately thereafter, in the Office of the County Commissioners. BEVEC, JOHN MAZZA, COMMISSIONERS E i� Moved by Mr. Bevec, seconded by Mr. Mazza, that the Chief Clerk be authorized to advertise for bids for Jail Improvements - to include - plumbing and toilets, cots, and outside improvements for the recreation area. Said bids to be received at the Office of the County Controller, Washington County Court House, Washington, Pennsylvania until 11:00 a. m. Local Standard Time, Thursday, 1971 subject to funds being available and approval of Governor's Justice Commission. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Report: Mr. Porter The Court en banc has handed down an opinion in the Washington Mall Tax Appeal Case which affirms in part and modifies in part Judge Sweet's original order. The reduction in assessment has not been disturbed and, in fact, a further reduction has been made from $984, 000. 00 to $960, 000. 00. This was only to correct a mistake in arithmetic. The other part of Judge Sweet's original order, in which the Commissioners were directed to equalize the assessments within a certain period of time, under the supervision of the Court, has been removed. The Court's order specifically said that the 24% ratio which they declared was applicable to the Washington Mall Case only and was based on a theory of estoppel, and did not represent a finding that 24% is the prevailing ratio. We are, therefore, continuing to assess all newly appraised properties at a 30% ratio, in accordance with the Board's previous action fixing 30% as the ratio and we hope that the court, in future cases, will not disturb that ratio, so that we will be able as fast as possible to bring about a general 30% ratio throughout the county. I do not recommend that any further appeal from the Court's action be taken. 11: 00 - Opening of Bids - V-Plate Dump Truck for Mingo Creek Park Meeting reconvened at 11:00 a. m. for the opening of bids for one 1971 V-Plate Dump Truck, American Made, for the Department of Parks and Recreation, with the following members being present: Commissioners Bevec, Mazza, and Flynn. Moved by Mr. Mazza, seconded by Mr. Bevec, that all bids be tabled until a tabulation can be made by the Solicitor.
