Chairman asked if there were any corrections, additions, or omissions to Minute No. 171, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Capano, that Minute No. 171 be approved, as read. Resignation: Roll call vote taken: Mr. Capano - Yes; Mr, Mazza - Yes; Mr, Flynn - Yes, Motion carried unanimously. Chief Clerk read a resignation submitted by A. V. Capano as Solicitor of Washington County to be effective June 21, 1971, Mr. Capano thanked the Commissioners for the opportunity of serving the people of Washington County and stated that this has been the most enriching and rewarding experience of his political career, Report: Clay Graham Mr, Clay Graham of the Department of Parks & Recreation presented to the Board a modification to the Harmon Creek Watershed Work Plan to be approved. Old Business: Mr. Porter (Park Police Ordinance) County Solicitor Porter gave the third and final reading of the Park Police Ordinance prescribing rules and regulations for preserving public property and to promote and preserve public health, safety, and welfare in Washington County parks operated by the Washington County Department of Parks and Recreation, and prescribing penalties for the violation of such regulations. Moved by Mr. Capano, seconded by Mr. Mazza, that the above Ordinance be enacted. Motion made upon the recommendation of the County Solicitor. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Report: Warden Feconda Warden Feconda reported on our application for Federal Funds stating that the Governor's Justice Planning Commission is expected to approve an allocation of $33, 786. 00 toward the overall cost of $63, 486. 00 for jail improvements. The following is a breakdown of the improvements, their costs and the amount which will be allocated to us: Plumbing (toilets) $35, 278. 00 $17, 639.00 Steel Bunks $19, 450. 00 $11, 670. 00 Mattresses for Bunks $800. 00 $480. 00 No bids were received for the paving of the outdoor exercise area of the jail, but it is expected to cost approximately $7, 958. 00 with our allocation being $3, 979. 00, The above bids were opened and tabled on May 6, 1971. Mr, Feconda suggested that based on his re- cent conversation with Mr. Gahagan of the main office of the Planning Council in Harrisburg, the bids be awarded and the Commissioners re -advertise for bids for the paving of the out exercise area of the jail. Mr. Whalen entered the meeting. Awarding of Bids: Moved by Mr. Capano, seconded by Mr. Mazza, that the contract for the re- placement of toilets in the Washington County Jail be awarded to the JOHN B. BRUNO PLUMBING COMPANY, 65 Campbell Avenue, Washington, Pa. 15301; for the amount set forth in their bid; this being the lowest responsible bid received and being in accord with n P specifications. Motion carried unanimously, Moved by Mr. Capano, seconded by Mr. Mazza, that the contract for Steel Bunks for the Washington County Jail be awarded to GANDY INTERVAL, 495 Duncan Avenue Washington, Pa. 15301; for the amount set forth in his bid; this being the lowest and only responsible bid received and being in accord with specifications. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Also included in this motion is that the County Commissioners be authorized to re -advertise for bids for the Bituminous Paving, Sealing, and related work of the Recreation Area of the County Jail, said bids to be received in the office of the County Con- troller until 11:00 a, m, , Local Prevailing Time, Thursday, July 8, 1971, and opened immediately thereafter in the Office of the County Commissioners, and also that Warden Joseph Feconda be authorized to order 100 mattresses for the Steel bunks for the Washingto. County Jail. Mr. Feconda left the meeting. Mr. Clay Graham left the meeting. Correspondence: Mr. Murphy Chief Clerk read correspondence under date of June 23, 1971, directed to Commissioner A. V. Capano, from F. D. Whalen, Deputy Controller stating that the Controller's Office is in receipt of Commissioner Capano's bond covering the office of County Commissioner and is filed in their office. Chief Clerk read correspondence under date of June 18, 1971, from Elliott Bianchi, President, Board of Library Directors, Monessen Public Library, thanking the Board of Commissioners for the allocation of $1, 000. 00 they received last year. Corres- pondence included a breakdown of how the money was spent and requested that the Commiss- ioners repeat the allocation this year if possible. Moved by Mr. Capano, seconded by Mr. Mazza, approving an allocation in the amount of $1, 000. 00 for the Monessen Public Library. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of June 17, 1971, from R. Elme Winey for H. E. Myers, Director, Bureau of Municipal Services, Department of Transpor- tation stating that they have been informed by their District Office at Uniontown that the t42 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN. JOHN P. SEVEC, JOHN MAZZA, COMMISSIONERS Commissioners of Washington County have allocated- County Aid funds to all of the various political subdivisions within the county in accordance with their letter of May 28, 1971, Letter further stated that County Aid Applications have been received in the District Office for nearly all of the municipalities and are being processed and forwarded to the central office for approval. Chief Clerk read correspondence under date of June 21, 1971, from Beryl W. Brooking, Revenue Agent, Bureau of Institutional Collections, stating that they have been advised by the Department of Public Welfare that the per diem billing rate for F State Hospital has been revised from $14. 60 to $21. 80 effective June 1, 1971, Letter stated that liability for maintenance periods beginning June 1, 1971 will be computed at the rate of $21, 80 per day unless the Commissioners contact the revenue agent and produce evidence satisfactory to him indicating our inability to meet the increased change. Remarks: Mr, Flynn: May I suggest that we do with this situation as we have in the past, I suggest that we write them that it is impossible for us to comply until our new fiscal year. Chief Clerk read correspondence under date of June 22, 1971, from Stephen Drizos, Acting Co. Commander, Pennsylvania Army National Guard inviting a representat- ive from the County Commissioners to be present at a ribbon cutting ceremony opening a Self Service Supply Store which will serve the Western part of the National Guard Units, of the State of Pennsylvania. The ceremony will take -place at the Washington Armory at 2:00 p, m. , July 1, 1971, Remarks: Mr, Flynn: Notify them that we will comply. Chief Clerk read correspondence under date of June 21, 1971, directed to Commissioner John Mazza from E. C. West, Colonel, Army Corps of Engineers, District Engineer, in reference to a Navigation Replacement Study of the Lower Monongahela River which the Army Corps of Engineers has undertaken: This study is a continuation of the modernization program for the entire river and will focus on Locks and Dams 2 and 3 and Locks 4. With the reconstruction of Locks and Dam 7 and Locks 8 as recommended in a recently completed report, this lower portion of the river will remain as the only antiquat section and as such will undoubtedly act as a bottleneck to the upriver improvements. Correspondence further stated what the investigation will be primarily concerned with and items for consideration at this time. Chief Clerk read correspondence under date of June 18, 1971, from Douglas Bowman, County Superintendent of Schools, stating that with July 1, 1971, the effective date of the Intermediate Unit, the responsibilities of the County Commissioners to the Coun y Board of Education and the County Superintendency end. Chief Clerk read correspondence under date of June 17, 1971, from Helen G. McKee, Secretary, and Mrs. J. Kelvin, Treasurer, Donora Public Library, thanking the Commissioners for their donation of $500. 00. Chief Clerk read correspondence under date of June 17, 1971, from Sophie Despot, Secretary, East Bethlehem Township Board of Commissioners concerning a foot bridge off LR 62012 near the town of Pitt Gas. Letter further stated that the bridge was originally placed there by the W. J. Rainey Company for the convenience of the people re- siding in Pitt Gas (Jefferson Twp. Greene Co. ) who use the bridge to come from their placE of residence to the stores, churches, etc. in Clarksville, but has become so dangerous due to deterioration that the Board found it necessary to have a barricade placed at the East Bet] side to prevent any future accidents. The East Bethlehem Board of Commissioners is of the opinion that the additional money that was received by the County in the Liquid Fuels Fund should be utilized in the repairs of this bridge, Remarks: Mr. Flynn: I suggest that we write back and say that our engineer did meet with the officials down there. Chief Clerk read correspondence under date of June 21, 1971, from Matt Powers, First National Bank & Trust Company regarding the restoration of the Frederick - town ferry. Mr. Powers stated that the local merchants and residents of Fredericktown, Millsboro, and the general surrounding area have suffered a considerable loss of trade, and have been very inconvenienced due to the lack of a direct connection to the opposite side of the river. / Chief Clerk read correspondence under date of June 18, 1971, from Mrs. M. Rosenthal, Rosenthal Jewlers, concerning a bridge connecting Fredericktown with LaBelle, Pa. Letter further stated that the people must travel 28 miles to get to Fredericktown if they want to shop and requested that something be done to correct the situation, / Chief Cler read correspondence under date of June 17, 1971, from Myron L. Gross, Gross Furniture Co. , concerning the Fredericktown ferry. Mr. Gross stated that it is of vital importance for the whole area in general to have the Fredericktown ferry functioning again. He stated that his business serves many people on the other side of the river and it is quite a hindranc, for them to come to his store, and also quite difficult to serve them without a direct connec- tion, across the river. Chief Clerk read correspondence under date of June 16, 1971, from William M. Graham, District Right of Way Administrator, Department of Transportation, stating that their appraisal of the effect of highway improvement L. R. 62105, Section 01S has now been completed and they are pleased to offer the sum of $1, 035. 00 for the right of way re- quired from our property for the highway improvement. Letter further stated that this offer is intended to provide just compensation for all interests in our property, including tenants, if any. Moved by Mr. Capano, seconded by Mr. Mazza, accepting the amount of $1, 035. 00 for the right of way required from Washington County's property for Highway Improvement L. R. 62105. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of June 22, 1971, from James P. Huber, Planning Administrator, Washington County Planning Commission, informing the Commissioners that the staff of the Washington County Planning Commission is presently conducting a study of the problems relating to Mass Transit and Public Transportation in Washington County, The study will include the total transportation which will include Air- ports and River (ferry) Transportation. Mr. Huber made note of the resolution adopted by the Board of Commissioners on April 8, 1971, requesting the assistance of various groups within the County in evaluating, and making recommendations to solve these problems. The first step in this direction will be a background report, prepared by the Washington County Planning Commission, Mr. Huber requested that the Planning Commission be given additio- nal -time to formulate this report, estimated to be from six weeks to two months and that no . major decision be made on any transportation problems by the Board of Commissioners until the report has been completed and reviewed. E. , Chairman, Legislative Action Subcommittee, Concerned Citizens of Union, Peters, Nottingham Township, Finleyville, against Drug Abuse, concerning Mingo 1 V1WUTE BOOK 545 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS L 1 Creek Park. Mr. Speer stated that Mingo Creek County Park was established in the County for the purpose of the recreation, rest and enjoyment of common citizenry which, he feels is not possible due to the fact that the park has been taken over, by hundreds and at times thousands of youths that have no respect for anyone or anything. Mr. Speer stated that gathering of these youths in many areas of the park and their wild actions intimidate families, groups and other citizens that visit the park and make them fearful of the fact that drugs or liquor may be present. Correspondence further invited the County Commissioners to visit the park particularly on a Sunday with several members of said Committee to view the con- ditions described, and also to sit down with the full committee to discuss the problem and possible solutions. A brief discussion was held concerning Mingo Creek Park and the situation now as compared to a few weeks back. Mr. Mazza stated that he has taken several inspections of the park and finds it to be comparitively better now that the park police have been established. Mr. George, Director of the Department of Parks & Recreation stated the situation described by Mr. Speer may have existed a few weeks ago, but he feels as Mr. Mazza does, that since the Park Police have taken over, things are much better and they are doing a fine job. Remarks: Mr. Flynn: May I ,make the recommendation that we acknowledge this letter stating that we would be more than glad to meet with this group. Mr. Whalen left the meeting. Chief Clerk read correspondence under date of June 18, 1971, from Richard G. Farrow, Commissioner, Family Services, directed to Miss Louise Abel, Executive Director, Child Welfare Services stating that the Office of Family Services is sending to Miss Abel her copy of the Purchase of Services Agreement between the County Authorities and the Department of Public Welfare, which has been executed by all parties concerned including the Governor. Letter further stated that the date of signature has no bearing on the effective date of the program, and all contracts have been written for a term of with a one (1) year/beginning date of December 1, 1970. Mr. Whalen re-entered the meeting. Mr. Porter left the meeting. Chief Clerk read correspondence under date of June 21, 1971, directed to Mr. Edward Maher, Department of Environmental Resources from James P. Huber, Plan- ning Administrator in reference to Mr. Maher's order of June 4, 1971 to the Borough of Ellsworth, Washington County, to close the open "Garbage dump" in said borough within thirty days from said date of order. Mr. Huber further stated that he has contacted the officials of Ellsworth Borough concerning this action and they have indicated that they wish to comply with the rules and regulations of the Department of Environmental 546 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Chief Clerk read correspondence under date of June 15, 1971, from Michael George, Director, Department of Parks and Recreation, directed to Dr. Maurice K. Goddard, Secretary, Department of Environmental Resources regarding two (2) strip mining applications that have been submitted to said department. Mr. George stated that there is a possibility that the water in Mingo Creek County Park and Cross Creek County Park could be seriously affected if these applications were approved. Mr. Porter re-entered the meeting. Mr. Wilt left the meeting. Chief Clerk read correspondence under date of June 21, 1971, directed t Officials of Municipalities in Washington County, from Michael George, informing them that a meeting has been planned to provide municipalities of Washington County with guidance to establish a parks and recreation program along with information on Federal and State grant-in-aid 'programs. At the present time it is possible for a municipality to obtain a total of 80% financial assistance for the acquisition or development of recreation areas and facilities. The meeting is to be held in the Trinity Junior -Senior High School auditorium on Wednesday, June 30, 1971, at 7:30 p. m. Mr. Wilt re-entered the meeting. Chief Clerk read correspondence under date of June 22, 1971, from Laurence G. Holt, P. E. , Chief Bridge Engineer, Michael Baker, Jr., Inc. enclosing four (4) copies of a contract to cover an In -Depth Bridge Inspection of the County's timber bridges approximately 25 in number. This inspection would follow current State and Federal proce- dures and would develop the safe loading capacity for each bridge. *Chief Clerk read correspondence under date of June 21, 1971, from J Mifflin, P. E. , District Engineer, District 12-0, directed to Mr. Eugene Tenaglia, Bridge Engineer in reference to a meeting of June 10, 1971 at the Burgettstown Burough Building concerning the proposed modifications to the Burgettstown By -Pass, Washington County, Proposed Widening of Structure. Mr. Mifflin stated that Department of Transporation representatives reviewed the preliminary plans for the proposed widening and other modifi- cations to the subject structure with representatives from Washington County, Burgettstown Burough, and the Washington County Redevelopment Authority. This structure is under the jurisdiction of Washington County and is referred to by the County as the Center Avenue Bridge. 'Moved by Mr. Capano, seconded by Mr. Mazza, authorizing the County Commissioners to sign said contracts covering the In -Depth Bridge Inspection of the County' timber bridges subject to the approval of the County Solicitor. Motion carried unanimously, Chief Clerk read correspondence under date of June 16, 1971, from Irving Hand, Executive Director, Pennsylvania State Clearinghouse, directed to John Yuhas, Coul Surveyor in reference to the runway construction at the Washington County Airport, stating that the Commissioners have complied with the procedures of the Project Notification and Review System as required by the U. S. Department of the Budget Circular A-95 revised, as demonstrated by cooperation with the State Clearinghouse; satisfied the concerns of the various State agencies expressing interest in said project; and has demonstrated to the satis- faction of the Pennsylvania State Clearinghouse that the project is in conformance with plans developed or being developed for the Commonwealth. New Business: Mr. Flynn ( Holiday) Chairman made note that the Courthouse will be closed from July 2, 4: 30 p. m to July 6, 9:00 a, m, in observance of Independence Day. (Appointment) Moved by Mr. Mazza, seconded by Mr. Flynn approving the appointment of Commissioner A. V. Capano to represent Washington County on the Mid Monongahela Valley Council of Governments. Commissioner is replacing the late Commissioner Bevec. (Appointment) Roll call vote taken: Mr. Capano - Abstain; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried. Moved by Mr. Capano, seconded by Mr. Mazza, appointing William C. Porter Solicitor of Washington County, effective June 21, 1971. FLYNN, JOHN P HEVEC, JOHN MAZZA, COMMISSIONERS fore a new contract has been signed with the firm of Cole,Layer, & Trumble of Dayton, Ohio for Data Processing Computer Services. The contract is to be effective as of July 1, 1971 until July 1, 1972 at an annualy fee of $77, 600. 00. Cole, Layer & Trumble will assume all responsibilities as outlined in their proposal submitted to the Commissioners. All contracts with the National Cash Register Company will be terminated with the exception of the Treasurer's Office, which the representatives of Cole, Layer, & Trumble explained would fit into the new system with little difficulty. Moved by Mr. Capano, seconded by Mr. Mazza, authorizing the cancellati of the existing lease arrangement with NCR with the exception of the Treasurer's Office. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Moved by Mr. Capano, seconded by Mr. Mazza, authorizing the County Commissioners to enter into an agreement with the firm of Cole, Layer & Trumble for Data Processing Computer Services for a period of one (1) year at the annual fee of $77, 600. effective July 1, 1971. Remarks: Mr. Mazza: Mr. Wilt, if I read this correctly, your group guarantees that this will be done according to the contract that you have submitted to us. Mr. Wilt: Yes, absolutely. Solicitor: Mr. Porter Solicitor Porter presented to the Board an Application for Subgrant for the District Attorney's Office to be approved. This Subgrant is for a Washington County Police Training Program which is designed as a pilot program for training police officers from various municipalities in Washington County. Moved by Mr. Capano, seconded by Mr.- Mazza, that the above mentioned Application for Subgrant for the District Attorney's Office for a Washington County Police Training Program be approved.
