BEVEC, JOHN MAZZA, COMMISSIONERS LI Minute No. #174 Office of the County Commissioners Washington, Pa, Tuly-8, 1971 The Board of County Commissioners met in regular session with the following members being present: Commissioners Capano, Mazza, and Flynn. Also present being: Chief Clerk Murphy; County Solicitor Porter; Reporter Robertson of the Observer -Reporter; and Reporter Roule of the Monongahela Publishing Company. Meeting called to order by Chairman and roll call taken: Mr. Capano - Present; Mr. Mazza - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions. to Minute No. 173, each Commissioner having received a copy. Moved by Mr. Capano, seconded by Mr. Mazza, that Minute No. 173 be approved, as read. Roll call vote taken: Mr. Capano .- Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Reports: None Old Business: Mr. Porter (Mingo Creek Park Shelter Bids) Mr. Porter stated that the bid for nine (9) Pre -fabricated picnic shelters for Mingo Creek County Park was reviewed and he and Mr. George felt that the amount quoted by Milroy Manufacturing was exceedingly high for the type of shelter desired. Mr. Porter: I recommend that the bid be rejected and that the bidder be notified and bid his bond be returned to him. Moved by Mr. Capano, seconded by Mr. Mazza, that the bid for nine (9) Pre -fabricated picnic shelters for Mingo Creek County Park as submitted by Milroy Manufacturing, P.O. Box 51, Thompsontown, Pa. 17094, be rejected and that their bid bond be returned to`,'them along with notification of the rejection of the bid. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Correspondence: Mr. Murphy Chief Clerk read correspondence under date of July 5, 1971, from Mr. Robert P. DeLotto, Chairman, Southwestern Pennsylvania Regional Planning Commis- sion, stating that at its regular meeting on June 28, 1971, the SPRPC considered House Bill 935, Outdoor Advertising Control Act of 1971, which will avoid a 10% reduction in Federal Highway Funds and will be a positive step in helping to eliminate the visual blight of the landscape, House Bill 950, Amendment to the Administrative Code of MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS 1929, which will permit the advance acquisition of rights -of -way and will result in less relocation and lower highway construction costs, and an Amendment to P. L. 1242, State Highway Law which would permit the expenditure of Federal funds for fringe parking facilities. Correspondence further stated that the SPRPC took official action urging the General Assembly to enact these pieces of legislation and requested that the Commissioners lend whatever support they can. Mr, Flynn: I suggest we instruct the Chief Clerk to follow through on this. Chief Clerk read correspondence under date of June 30, 1971, from Mrs. Joan W. Owens, Acting Executive Director, Washington -Greene Community Action Corporation requesting a transfer of funds'in the amount of $3, 666. 81, State share Minute #169, deposited on June 3, 1971, in Account #310. This is for use of establish- ing Senior Citizen Centers throughout Washington County. Moved by Mr. Capano, seconded by Mr. Mazza, approving a transfer of funds in the amount of $3666. 81 for the Washingt on -Greene Community Action Corporation to be sent to Community Action from Account #310. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of July 1, 1971, from Sanford W. Simmons, Secretary, Nottingham Township Road Supervisors requesting the amount of $1, 100.00 due to the township under an agreement signed by the Commissioners and the Supervisors on August 3, 197 0, to cover the expenses involved in maintaining the roads within Mingo Creek Park for the year 1971. Moved by Mr. Capano, seconded by Mr. Mazza, approving the amount of $1, 100. 00 to be paid to the Nottingham Township Road Supervisors to cover the expen- ses involved in maintaining the roads in Mingo Creek Park fox the year 1971. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of July 2, 1971, from Walter N. Peechatka, Director, State Soil and Water Conservation Commission, stating that in reviewing the Commissioners claim for cost -sharing on the Harmon Creek P. L. 566 Project, two (2) items were listed for reimbursement which did not qualify based on the cost -share items approved by the State Soil and Water Conservation Commission, namely: MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. BEVEC, JOHN MAZZA, COMMISSIONERS 1 E 1 (a) an expenditure on Site 486 (Mike Maltony for $400) (b) an expenditure on Site 483 (legal fees for $122. 50) Correspondence further stated that in the event there may have been a typographical error in submitting the claim, the Commission will .delay further processing of the claim until July 12, and if they have not received supporting information to justify the above listed costs, they will delete them and process our claim for $7, 259. 29 for re- imbursement,in the amount of $1, 1814. 82. Chief Clerk read correspondence under date of June 29, 1971, from Judge Richard DiSalle stating that the Governor's Justice Commission has requested a meeting with him on July 14, 1971, at 10:30 a.m. , for the purpose of ''discussing and developing alternative forms Hof treatment for juveniles. Judge DiSalle requested that the Commissioners advise him .as to whether or not they would be available for the meeting and if it would be possible for them to meet in the Commissioners' Conference Room. Mr. Morgan entered the meeting. Chief Clerk read a Registration from Ronald J. Pettine, Deputy Secre- tary of the Commonwealth stating that on June.30th, Ohio became the 38th State to ratify the 26th Amendment to the U. S. Constitution lowering the voting age in all elections to eighteen (18). Therefore, 18 to 20 year olds have a Constitutional right to register and vote in all elections in Pennsylvania. Permanent registration records must now be treated and recorded in one like manner - it will no longer be acceptable to keep two seperate registration books. Mr. Whalen entered the meeting. New Business: Mr. Flynn Mr. Flynn read correspondence under date of July 8, 1971, . from F. D. Whalen, Deputy County Controller, stating that the net bank balance in the General Fund Account is $1, 122, 418. 95 and a payment of $135, 000. 00 is being made to the retirement fund to complete the County Contribution for this year. Mr. Whalen further recommend- ed that the sum of $500, 000. 00 be invested in Certificates of Deposit for a period of 60 days. Moved by Mr. Capano, seconded by Mr. Mazza, approving the invest- ment of $500, 000.00 in a Certificate of Deposit for a period of 60 days. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. BEVEC, JOHN MAZZA, COMMISSIONERS (appointment) Moved by Mr. Capano, seconded by Mr. Mazza, approving the appointment of Fred J. Sentnor as Assistant Public Defender, to be effective August 2, 1971, at an annual salary of $5, 512. 00. Motion made upon the recommendation of County Solicitor Porter. Roll call vote taken: Mr. Capano - Yes; Mr. Mazza. - Yes; Mr. Flynn - Yes. Motion carried unanimously. Solicitor Porter presented to the Board two (2) tax refunds for their consi tion and approval; said refunds having been approved by the County Treasurer and Solicitor. Moved by Mr. Mazza, seconded by Mr. Capano, that the Tax Assessment Office be authorized to prepare the following tax refunds to either duplication or over- payment of Personal Property Tax. 1. Cora B. McGill, R. D. 3, Claysville, Pa. - Personal Property tax in the amount of $76. 17 net was paid on June 24, 1971. T. A. 312 reduced assessed valuation to $11, 605. 00 and tax to $44. 10 net, making a refund due in the amount of $32. 07 to Cora B. McGill, R. D. 3, Box 104, Claysville, Pa. 2. Clarence McGill, R. D. 3, Box 104, Claysville, Pa. Personal Property tax in the amount of $76. 17 net was paid on June 24, 1971. T. A. 311 reduced assessed valuation to $20, 045. 00 and tax $44. 10 net, making a refund due in the amount of $32.07 to Clarence McGill, R. D. 3, Box 104, Claysville, Pa. Roll call vote taken: Mr, Capano - Yes; Mr, Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Elish entered the meeting. 11:08 - Opening of Bids for the Bituminous Paving, Sealing, and Related Work of the Washington County Jail Parking Lot. (one bid received) Name of Bidder: Address: Total Amount of Bid: Black Top Paving Company, Inc. 446 East Beau Street Washington, Pa. 15301 $7, 958. 00 Certified check in the amount of $400. 00 accompanied bid. Moved by Mr. Capano, seconded by Mr. Mazza that the contract for the inous Paving, Sealing, and Related Work of the Washington County Jail Parking Lot be awarded to BLACK TOP PAVING COMPANY, INC., for the price as set forth in their 1 1 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Motion carried unanimously, Chief Clerk read a letter under date of July 6, 1971, from Walter N. Peechatka, Director, State Soil and Water Conservation Commission stating that the Commission has received the County Commissioners' application for cost -sharing for the Cross Creek Water -shed and will be evaluating all applications received during the next month. Mr. Peechatka stated that as soon as they have received word that their budget has been officially approved, they will 00atim"s to make arrangements to discuss details of the cost -share agreement. Chief Clerk read a letter under date of July 3, 1971, from Mr. Arthur Marimpietri, President, ERG Incorporated, concerning a Mingo Creek Park Free Im- provement Project Proposal, Letter stated that their stripping operation will border Mingo Park at the Sugar Creek area and involves removal of coal from the uppermost ridges of these hills. Park facilities or year round water sources will not be disrupted and any water collecting at the stripping operation will be removed by pumping into several ponds in series, chemically treated if required to insure its inertness and purity, then discharged into the streams. Mr. Marimpietri stated that the northwest corner of the former Mary Putnack property appears to contain coal and could be included in their stripping operation.
