Minute No. 180
Office of the County Commissioners
Washington, Pa., August 19, 1971
The Board of County Commissioners met in regular session with the
following members being present: Commissioners Capano, Mazza, and Flynn. Also
present being: Chief Clerk Murphy; Mr. Michael George, Director, Department of Parks
& Recreation; Deputy County Controller Whalen; County Surveyor Yuhas; Reporter Robert
son of the Observer -Reporter; Reporter Roule of the Monongahela Publishing Company;
and Public Information Officer Huber.
Meeting called to order by Chairman and roll call taken:
Mr. Capano - Present; Mr. Mazza - Present; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions, or omission
to Minute No. 179, each Commissioner having received a copy.
Moved by Mr. Mazza, seconded by Mr. Capano, that Minute No. 179
be approved, as read.
Roll call vote taken:

Motion carried unanimously.
Reports: Michael George Re: Federal Funding for Land Acquisition
Mr. George reported on the acquisition of an additional 1100 acres for
Mingo Creek Park, stating that grants have been approved in the amounts of $285, 000. 00
and $369, 000. 00 from the State and Federal Government. These grants combined, will
cover 80% of the total cost of the project withAhe County'& share not exceeding $200, 000.
Mr. George stated that the County has to enter into an agreement with the state to carry
out this project according to their regulations. -
Moved by Mr. Capano, seconded by Mr. Mazza, that the County enter
into an agreement with the State in reference to the acquisition of an additional 1100 acres
for completion of the total park acreage at Mingo Creek Park, and that the Chairman of the
Board be authorized to execute said agreement.

Mr. George further reported that.an agreement must be entered into
with a consulting firm for a $600, 000.00 development project which will begin in spring
of 1972. Mr. George recommended the firm of Griswold, Winters, & Swain to do this

work and stated that this agreement does not bind the County for any period of time, just
for the services the firm renders.
Moved by Mr. Capano, seconded by Mr. Mazza, that the County enter
into an agreement with the firm of Griswold, Winters, & Swain for the above mentioned
development project for Mingo Creek Park.

Old Business: Mr. Capano
Awarding of Bids for Earth Slide Correction and Related Work at the
Washington County.Airport.
Moved by Mr. Capano, seconded by Mr. Mazza, that the bids for the
above mentioned project be tabled again for further study by the Solicitor and the County
Engineer until the next regular meeting.

Correspondence: Mr. .Murphy
Chief Clerk read correspondence under date of August 6, '1971, from
Howard W. Felton, Superintendent, Department of Transporation, stating that on a recent

inspection of a slide area adjacent to L. R. 62122 between Stations 233+00 in Burgettstown
Boro, He found a very hazardous condition and the probability of the entire road surface
sliding into the creek. Mr. Felton stated that since their existing right-of-way extends
only from curb to curb and this sliding condition is outside of the Departments right-of-way,
they have no authority for its repairs. Mr. Felton stated that he is of the opinion that an
emergency does exist and that the Board of Commissioners should proceed to make immed
iate repairs because further delays may create a very ddinite hazard to the traveling
and, also, a flooding conditions.
Mr. Yuhas stated that the problem exists behind Petrucci's Food Market and at the time
he was down there along with Mr. Felton, Mr.: Dave Miller came up with a price of
$4900. 00,to do the work which will include. removal of the slide area, rip rapping to 10 feet
and dumping of slag.
Moved by Mr. Capano, seconded by Mr. Mazza, declaring a state of
emergency in the above named area (along LR 6.2122) and authorizing the M & M Sales Equip-
ment Company to do the above mentioned work at said area.

County's Timber Bridges. Invoice in the amount of $7, 578. 12
is hereby approved.
2. Raymond B. O'Shinski - Professional services, in re survey
and drawing - Washington County Fair Grounds. Invoice in
the amount of $3 50.00 is hereby approved.

Chief Clerk informed the Board of a check received in the amount of
$500. 00 from the Borough of Houston for their shar.e for the cleaning of Little Char -tiers
Creek.
Chief Clerk informed the Board of .a check received in the amount of
$10, 000-00 as payment for funding to the Washington - Greene Community Action Corpora-
tion.
Chief Clerk informed the. Board of a check received in the amount of
$200.00 from the Wheeling Creek Watershed Commission as their share of the cost for
Mr.,_ Clay Graham's trip to the relocation conference. Enclosed with check was correspon-
dence'Ander date of August 12, 1971, from Robert G. Wilson, Executive Director of the
Commission, submitting to the Board of Commissioners their Estimated Budget for the
period July 1, 1971, to June 30, 1972 and a copy of their Annual Audit for the past fiscal
year.
Chief Clerk read correspondence under date of August 13, 1971, from
Charles F. Rinkevich, Executive Director, Department of Justice, stating that on August
10, 1971, the subgrant for the "Washington County Police Training Program" in the amount
of $600. 00, (number SW-A-059) was approved. Mr..Rinkevich stated that the Commission-
ers may now begin applying the County's contribution to the cost of the project.
Chief .Clerk read correspondence under date of August 10, 1971, from
the West Alexander Agricultural Association requesting the appropriation that has been set

up in the County's budget for the expense of setting up and conducting their Free Fair to be
held September 14-18, 19.71.
Chief Clerk read correspondence under date of August 11, 1971, from
the Washington County Agricultural Fair, Inc, requesting their annual contribution .for ex-
penses and repairs made on the grandstand roof in 1970.
Moved by Mr. Capano, seconded by Mr. Mazza, approving the amount
of $4, 000.00 for the Washington County Agricultural Fair, Inc. and the amount of $1., 000.

Chief Clerk read correspondence under date of August 13, 1971, from
John Gillen,. Mayor, Borough of Roscoe requesting an increased Liquid Fuel Appropriation
from the County. Mr. Gillen_ stated that several months ago their council committee met
with the late Commissioner Bevec reqarding this appropriation and he stated that some
effort would be made to allot $2000. 00 with the possibility of $2500.00 as a maximum grant
Note was made that $1600, 00 has already been allotted.
Moved by Mr. Capano, seconded by Mr. Mazza, approving an increased
Liquid Fuel Appropriation in the amount of $400.00 for the Borough of Roscoe..

Chief Clerk read correspondence under date of August 6, 1971, from
Elco Borough requesting Liquid Fuels funds in the amount of $1, 000.00 for Elco Hollow
Road. Letter stated that before the late Mr. Bevec's most untimely death he had talked
Councilman Gainer and promised him the amount of $1, 000.00 toward this project.
Moved by Mr. Capano, seconded by Mr. Mazza, approving the. sum of
$1, 000. 00 for the Borough of Elco towards the Elco Hollow Road Project.
Remarks:
Mr. Mazza: I think that we should make it clear that they cannot come in here next
year and request the same amount of n-Awy. This might just cause a
chain reaction. .

Chief Clerk presented to the Board a summary of the In -Depth Bridge
Inspection Program to date as submitted by Michael Baker, Jr., Inc. Said Summary in -
eluded (a) Field Inspection; (b) Structural Analysis; and general comments based upon
the three bridges that have been analyzed to date.
Mr. Morgan entered the meeting.
Chief Clerk read correspondence under date of August 11, 1971, from
Jeremiah P. Delaney, Sheriff, Montgomery County, directed to Sheriff Alex Debreczeni
informing him that a conference and workshop will be held at the Hilton Motel, Route 202,
King of Prussia, Montgomery County, Pa., on September 13, 14, and 15, 1971. Authori-
zation for the Sheriff to attend was requested,
Chief Clerk read correspondence under date of August 12, 1971, from
G. Herschel Fetherlin, Chief Assessor, requesting authorization for Mr. Charles Bush,
and himself to attend the American Appraisal Company's seminar to be held at the Holii
Inn in Monroeville on October 26th, 27th, and 28th. The seminar consists of two progr
which are offered at $125.00 per/person.
Chief Clerk presented to the Board notification of the Pennsylvania
Association of County Hospital Administrators Annual Fall Conference which is to be held
on September 23, 24, 1971, at Hershey Motor Lodge, Hershey, Pennsylvania. Authoriza-
tion is requested for the two Home Administrators and one representative of the Commis-
sioners Office to attend.
Moved by Mr. Mazza, seconded by Mr. Capano, that the requests of
the Sheriff's Office, Tax Assessment Office, and the County Home Administrators be ap-
proved.

Chief Clerk read correspondence under date of August 11, 1971, from
Sam Congie, Superintendent of Parks, stating that the Department of Parks & Recreation
is planning to wind up the summer :activities with a grand finale, including a sky diving
demonstration, a band concert, and a fireworks demonstration on Labor Day, September
6, 1971, Mr. Congie invited the Commissioners to say a few words to the crowd during
the speaking part of the program which will begin at 6:00 p.m.

the Washington County Sportsman's & Conservation League, stating that a meeting held
earlier in the year, the League announced their displeasure concerning the hunting privil-
eges in Mingo Creek park, and the dredging of West Pike Run. These issues seem to have
emerged again and it has just been announced that hunting will not be allowed this season in
Mingo Creek park, which the League feels is an unjustice upon the sportsman who would
hunt there. Last spring the county agreed to postpone work on West Pike Run. The work
is now scheduled for this coming Fall and, in order to control the manner in which the
is carried out the League feels some discussion is required prior to permitting actual wor
The League is looking forward to a meeting with the Commissioners and hope that Mr.
George and Mr. Paris (contractor for the West Pike Run work) can be present.

Chief Clerk presented correspondence under date of August 10, 1971,
from Wm. R. B. Froehlich, Executive Director, Southwestern Pennsylvania Regional Plan
ring Commission regarding a Sewage Treatment Plant, six (6) pump stations, force mains,
and 12, 291 feet of interceptor to provide transporation of wastes and sewage treatment to
the residents of the boroughs of Allenport, Elco, Roscoe, and Stockdale, A review is
being made of this project to determine the extent to which these are consistent with a co-
ordinated plan for sewer systems in the region. Correspondence further stated findings of
the review.
Chief Clerk presented correspondence under date of August 11, 1971,
from Robert P. Kane, Secretary of Revenue in reference to Maximizing Local Tax Collect-
ions with the aid of IRS 1970 Individual Income Tax Data. Mr. Kane stated that again this
year, qualifying local tax authorities can be supplied with limited individual income tax in-
formation made available by the Internal Revenue Service under authorization of Federal
law (Section 6103 (b) of the Internal Revenue Code). Correspondence further stated what
the information will consist of and enclosed an agreement to be executed by the Commiss-
ioners and six (6) provisions they must comply with if they are interested.

tioned correspondence be made a part of the record.

ing to a need felt in Washington County, they have organized a new pre-school program,
the Children's School -of Washington, which will begin operation with its first class on
September 20, 1971. Mrs. Thomas stated that their three major goals for the program
set it apart, they feel, from any otherr-nu-rsery schools they know of in this area. Letter
further stated the three things they are convinced they need for the new school and the
fine support they are receiving from various people in the community.
Chief Clerk read correspondence under date of August 13, 1971, from
Mrs. Helene Wohlgemuth, Secretary, Department of Public Welfare in regard to interim
funding for the County's Mental Health and Mental. Retardation Program during the current
fiscal year 1971-72. Letter stated that the Appropriation Bill for this year has not been e
acted at this time, and the Department, therefore, is required to operate under Stop -Gap
funding during which time financial support -may be provided only for ongoing programs at
the level of last year'.s expenditures. It,is obviously not possible at this time to determine
final allocations for each county MIJ/MR unit. Mrs. Wohlgemuth stated that for these re -
sons, it has been determined by the Department to process interim allotments for the first,
quarter of this fiscal year equal to one-fourth of our approved allocation for last year.
The allotment for Washington County is $223, 297.00 and will be processed to us at the
earliest possible time.

would be out of town attending the annual Pennsylvania State Association of County Com-
missioners Convention in Philadelphia, Pa.
Appointment of Acting Chief Clerk
Moved by Mr. Capano, seconded by Mr. Mazza, that Joseph Muse
be appointed as Acting Chief Clerk during the absence of Chief Clerk Murphy the week of
August 23, 1971.

Chairman Flynn informed the Board, with regret, of the resignation
of the Chief Stenographer to the County -Commissioners, Mrs. Mildred Ivery.
Moved by Mr. Capano, seconded by Mr. Mazza, that Mrs, Gloria
Jo Cianelli be appointed to the position of Chief Stenographer to the County Commission
replacing Mrs. Ivery.
Remarks:
Mr. Capano: Mrs. .Ivery is a very competent and capable girl, and I wish her suc-
cess in her new work.
Mr. Mazza:;- I had the occasion of working with Mrs. Ivery in the Controller's
Office and under our jurisdiction and I have nothing but praise for
She is going to be a loss.
Mr, Whalen: I can assure you that I can never forgive my boss for transferring
Mrs. Ivery to the Commissioner's Office.

Motion carried unanimously.
Chairman Flynn brought up the matter of the Emergency Employment
Act of 1971 and a brief discussion was held. Mr. Flynn stated the Washington County will
receive $223, 900 for fiscal 1971-72 and will administer $156, 500. 00 while the remainder
will be given to the state for them to utilize in this area under state administration. The
money will provide for approximately 15-20 new jobs with the order of preference being:
(1) Vietnam Veterans; (2) the unemployed; (3) under employed; (4) rehabilitated drug ad -
diets.
Mr. Flynn: I recommend that we do go on record that we do authorize the county
to participate as a program agent and designate Leery McAmbley to be
the Administrator.
Moved by Mr. Capano, seconded by Mr. Mazza, that the County of
Washington participate in the Emergency Employment Act of 1971 by acting as a program
agent, and designate Mr. Leery McAmbley, Director of the Washington County Industrial
Development Agency to be the Administrator of said program.

Moved by Mr. Capano, seconded by Mr. Mazza, that the resolution
authorizing the addition of the paragraph to the Harmon Creek Supplemental Watershed
Work Plan Agreement No. 1, as stated in correspondence from Mr. R. M. Davis under
date of August 5, 1971, be adopted and made a part of the minutes as follows:
RESOLUTION
WHEREAS, the Public Law 91-646, "Uniform Relocation .A.ssisstance
and Real Property Acquisition Policies Act of 1970,, "became effective January 2, 1971.
WHEREAS, to comply with the Act, the following paragraph must be
added to the Harmon Creek Supplemental Watershed Work Plan Agreement No. 1 which

was signed June 3, 1971:
"The Washington County Commissioners in Pennsylvania and the
City of Weirton in West Virginia, in behalf of the sponsoring local
organization, will provide relocation advisory assistance services
and make the relocation payments to displaced persons as required
by the Uniform Relocation Assistance and Real Property Acquisitic
Policies Act of 1970 (Public L4w•917_(46,__84 Stat. 1894) effective
as of January 2, 1971, and their issued by the Secretary
of Agriculture pursuant theretd -- - -- --
Prior to July 1, 1972, the sponsoring local organization will compl
with the real property acquisition policies contained in said Act and
Regulations to the extent that they are legally able to do so in accor -
ance with their State law. After July 1, 1972, the real property ac-
quisition policies contained in said Act shall be followed in all case .
"The Service will bear 100 percent of the first $25, 000 of relocation
payment costs for. any person, business, or farm operation displac-
ed prior to July 1, 1972. Any such costs for a single dislocation in
excess of $25, 000 and all costs for relocation payments for persons
displaced after July 1, 1972, will be shared by the sponsoring local
organization and the Service "as follows:

"Investigation has disclosed that under present conditions the pro-
ject measures will not result in the displacement of any person,
business, or farm operations. However, if relocations become

THEREFORE, the Washington County Board of Commissioners hereby adopts and con-
curs in the foregoing Supplemental Agreement to the Watershed Work Plan Agreement
No. 1, and declares the same to be a part thereof and binding on the parties to the said
Agreement.
