BEVEC, JOHN MAZZA, COMMISSIONERS Minute No. #181 Office of the County Commissioners Washington, Pa., September 2, 1971 The Board of County Commissioners met in regular session with the following members being present: Commissioners Mazza and Capano. Absent being: Commissioner Flynn. Also present being: Chief Clerk Murphy; County Solicitor Porter; Mr. Clay Graham - Land Acquisition Agent for County; Reporter Roule of The Monongahela Publishing Company; Reporter Paul Carson of The Observer -Reporter; and Public Information Officer Huber. Meeting called to order by Acting Chairman and roll call taken: Mr. Capano - Present; Mr. Mazza - Present; Mr. Flynn - Absent. Chairman asked if there were any additions, corrections, or omissions to Minute No. #180, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Capano, that Minute No. #180 be approved, as read. Roll call vote taken: Mr. Mazza - Yes; Mr. Capano - Yes. Motion carried unanimously. Reports - None Old Business - Mr. Porter Re: Awarding of Contract for Earth Slide Correction and Related Work at County Airport Moved by Mr. Mazza, seconded by Mr. Capano, that the bids received for the above -mentioned project be tabled for further study by the Solicitor and the County Engineer until the next regular meeting to be held on Thursday, September 9, 1971; said action to be on the recommendation of the County Solicitor. Correspondence: Mr. Murphy Chief Clerk informed the Board of the following checks which were received from the Commonwealth of Pennsylvania: (a) Check in the amount of $23, 989. 00 received from the Commonwealth of Pennsylvania which represents a- grant under Project 70 for the original land acquisition program in Mingo Creek and Cross Creek Parks. (b) Check in the amount of $1035. 00 received from the Commonwealth of Pennsylvania which represents damageiF incurred with an intent to take right of way for the improvement to Route 62105, Section 01S, in Washington County. Bills: Moved by Mr. Mazza, seconded by Mr. Capano, that the following bills and requests as submitted be approved for payment: (a) Bill in the amount of $15, 000. 00 submitted by Patrono, Ceisler, Edwards and Pettit for property of Calvin and Mildred Franks - ME 20 Mingo Expansion program. Bill approved by Michael George, Director of the Department of Parks & Recreation. (b) Budget Item - Washington County Redevelopment Authority - $19, 437. 50 which represents their third quarterly allocation for 1971. (c) Budget Item - Washington -Greene County MH/MR Program - $5, 983. 49 for the period January 1, 1971 through June 30, 1971. Moved by Mr. Mazza, seconded by Mr. Capano, that Mrs. Mary Weaver, Caseworker for the Child Welfare Services, be authorized to attend a course introuction to Social Work Practice I and II to be held at the University of Pittsburgh every Tuesday from 1:00 p, m, to 3:00 p, m. beginning September 7 through April 13, 1972; transportation expenses are hereby approved. Roll call vote taken: Mr. Mazza - Yes; Mr. Capano - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of August 20, 1971, from Miss , Louise Abel, Director of Child Welfare Services, which gave a case history of three children; namely, Laura, Debra and Roger Hall. Correspondence requested that plane fare as follows - $145. 00 for Laura; $72. 50 for Debra and Roger (Total $290. 00) be approved due to the fact that said children are going to live with their step -mother, Mrs. Donalda Hall, who resides at 1149 North 32nd Street, Springfield, Oregon. Moved by Mr. Mazza, seconded by Mr. Capano, that the above request be approved as submitted by Miss Louise Abel, Director of Child Welfare Services. BEVEC, JOHN MAZZA, COMMISSIONERS Chief Clerk read correspondence under date of August 19, 1971 from Mrs. Helen Wohlgemuth, Secretary - Department of Public Welfare, which stated that the program plan for providing MH/MR services for the Washington -Greene MH/MR Unit for the fiscal year July 1, 1971 to June 30, 1972 is hereby approved, subject to conditions listed on enclosed correspondence. Correspondence stated that final approval of the estimate of expenditures is contingent upon the legislative appropriation for Community MH/MR services for 1971-1972. Chief Clerk read correspondence under date of August 23, 1971, from Glenn L. Bowers, Executive Director of the Pennsylvania Game Commission - Re: State Game Lands No. 245 - Addition Washington County - Project 70. Correspondence attached sheets which listed parcels of land that were acquired in Washington County and are eligible for in lieu of tax payments for the current year. Correspondence requested that the Chief Assessor of Washington County verify this parcel so that it is correct in Washington County verify this parcel so that it is correct in Washington County's application to the State Tax Equalization Board. Mr. Capano: May I recommend that a copy of the above letter be directed to Mr. Fetherlin, Chief Assessor. Moved by Mr. Mazza, seconded by Mr. Capano, that the Acting Chairman be authorized to execute the Hospital Transfer Agreement between The Washington Hospital and the Washington County Home. Roll call vote taken: Mr. Mazza - Yes; Mr. Capano - Yes, Motion carried unanimously. Moved by Mr. Mazza, seconded by Mr. Capano, that the Acting Chairman be authorized to execute the amended Cross Creek Watershed Work Plan Agreement in order to incorporate the Uniform Relocation Assistance Act of 1971. Roll call vote taken: Mr. Mazza - Yes; Mr. Capano - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of August 20, 1971, from Jack H. France - Murphy and France, Law Offices, which was directed to the Charleroi Borough Council, which stated that pursuant to the instructions given at the regular meeting of the Council on August 7, 1971, said Law firm has researched the issue of the creation of a urban mass transportation authority., Correspondence stated, in conclusion, that assuming Allegheny County to .be a first class county, Washington County being within twenty miles of said county, it is authorized to create a transportation authority. Correspondence stated that a copy of Mr. France Is letter will be directed to the Washington County Commissioners so that they might be informed of the interest of the Borough of Charleroi on said subject. Mr. Capano: May I recommend that the above letter be acknowledge and that a copy of the above letter be directed to Mr. John Anthony and also to the Mid Monongahela Council of Governments. County Treasurer Morgan entered the meeting. Chief Clerk read correspondence under date of August 31, 1971, from Joseph L. Hoffman, President - Washington County Bar Association, which requested the aid of the County Commissioners to make arrangements in the Law Library in order that all the works dealing with Pennsylvania could be placed in one section of the library and also that arrangements be made to have the installation of proper lighting and additional work tables. Mr. Capano: May I recommend that an exploration be made as to whether a future meeting will be held with the President Judge, Bar Association and County Commissioners. Chief Clerk read correspondence under date of August 25, 1971, from Mrs. Helene Wohlgemuth, Secretary - Department of Publip Welfare, directed to the Honorable John L. Brunner, House of Representatives, which stated that upon checking the regional office in Pittsburgh in reference to Robert McGlumphy, a ward of the County, she has been informed that Western State School and Hospital will be able to admit Robert McGlum to their adolescent unit on September 14, 1971. BEVEC, JOHN MAZZA, COMMISSIONERS i Chief Clerk read correspondence under date of August 19, 1971, from Mildred Ostop, Secretary - Independence Township Supervisors, which stated that the Independence Board of Supervisors and the Independence Township Municipal Authority are meeting with their solicitor this weekend August 21, 1971, in order to lodge a protest and request a hearing in reference to the reinstatement of a Mine Drainage Permit to the Bologna. Mining Company. Correspondence stated that Mr. John Anthony has been informed of said situation and would like to be advised when a meeting can be scheduled. Mr. Capano: May I recommend that the above matter be turned over to Mr. John Anthony to arrange a meeting and if possible, for a member of the Board of Commissioners to attend said meeting. Budget Item: Moved by Mr. Mazza, seconded by Mr. Capano, authorizing the sum of $500. 00 to be made payable to the Chartiers -Houston Community Library, Houston, Pennsylvania, to help aid in the high cost of books and materials. Kays, Department Commander - The American Legion - Department of of Pennsylvania, which requested assistance in reference to the recently passed Emergency Employment Act. of 1971. Mr. Capano: May I recommend that the above letter be acknowledged and that a copy of the above letter be directed to Mr. Keery McAmbley. Final Days and Hours of Registration: Moved by Mr. Mazza, seconded by Mr. Capano, that the following final days and hours of registration be approved as submitted by Joseph- Muscaro, Director of the Election -Registration Office: Friday, September 10, 1971 9:00 a. m. to 9:00 p, m. Moved by Mr. Mazza, seconded by Mr. Capano, whereby the Washington County Industrial Development Agency is .the administering agency for the Public Employment Program, enacted under the Emergency Employment Act of 1971, that Mr. Keery McAmbley, Director of the Industrial Development Agency be authorized to be the signatory authority for the Public Employment Program contract and all documents, checks and disbursements related thereto. Holiday: Acting Chairman made note that the Courthouse will be closed from 4:30 p, m. on Friday, September 3, 1971, until 9:00 a.m., Tuesday, September 7, 1971, in observant of Labor Day. Reporter Budinger entered the meeting. 1969 Tax Duplicate Charge to County Treasurer: Moved by Mr. Mazza, seconded by Mr. Capano, that the Washington County Board of Commissioners exonerate Malcolm L. Morgan, County Treasurer, from any additional responsibility in connection with the 1969 real estate tax duplicate. Roll call vote taken: Mr. Mazza - Yes; Mr. Capano - Yes. Motion carried unanimously. Solicitor - Mr. Porter Tax Refunds: County Solicitor Porter presented the following six (6) Tax Refunds to the Board for their consideration and approval. Moved by Mr. Mazza, seconded by Mr. Capano, that the Tax Assessment Office be authorized to prepare the following tax refunds due to either duplication or over- payment of real estate tax; said refunds having been approved by the County Solicitor. 1. Tax in the amount of $92. 34 net was paid on August 13, 1970, by Robert W. & Ruth L. West and payment was duplicated on August 17, 1970, by Pittsburgh Home Savings & Loan Association for new owners, making a refund due in the amount of $92. 34 to WEST, ROBERT W. & RUTH L. , 401 Riverbend, Baytown, Texas 77520. 2. In re: Charmely, Pat & Evelyn East Washington Borough Tax refund in the amount of $104. 14 was granted to the above -captioned taxpayer as per County Commissioners Minute No. #178. As per phone call to County Treasurer there is a balance due to be refunded in the amount of $5.48. The amount of tax paid by Pat & Evelyn Charmely was $109. 62 Face and the net amount of $104. 14 had been paid by First Federal Savings & Loan of Washington, making a refund due in the amount of $5. 48 to PAT & EVELYN CHARMELY, 1802 The Circle, Washington, Pennsylvania 15301. 3. In re: Elmhurst Club of Washington East Washington Borough An audit of the 1971 East Washington tax duplicate shows that an overpayment was made on the above -captioned account. Tax in the amount of $33. 34 net was paid on assessed valuation of $1950. 00 on May 26, 1971. Tax Adjustment #62 increased assessed valuation to $14, 065. 00 and tax to $240. 51 net and this amount was paid on June 16, 1971. As a result, total amount of tax paid on assessed valuation was $273. 85, making a refund due in the amount of $33. 34 to ELMHURST CLUB OF WASHINGTON, c/o Richard A. McCann, Box 102B, Washington, Pennsylvania 15301. 4. In re: Gutbro Development Company Washington 6th Ward , An audit of the 1971 Washington 6th Ward tax duplicate shows that an over -payment was made by the above -captioned taxpayer. Court Order #334 reduced assessed valuation from $12, 545. 00 to $11, 400. 00 and tax from $214. 52 net to $194. 94 net, making a refund due in the amount of $19. 58 to GUTBRO DEVELOPMENT COMPANY, Speers Road, Belle Vernon, Pennsylvania 15012. 5. In re: Gutbro Development Company Washington 2nd Ward An audit of the 1971 Washington 2nd Ward tax duplicate shows that an over -payment was made by the above -captioned taxpayer. County Solicitor Porter presented a Deed between Washington County, a county of the Fourth Class of the Commonwealth of Pennsylvania, and South Strabane Township, a township of the Second Class having its situs in Washington County, Pennsylvania, for the consideration and approval of the Board. Said Deed is for the conveyance of 2. 0402 acres to South Strabane Township by Washington County without money consideration and the purpose of the same is to make the land hereby conveyed available to the grantee for use for public highway purposes. Moved by Mr. Mazza, seconded by Mr. Capano, that the Washington County Commissioners execute the Deed between the County of Washington and South Strabane Town- ship as per above; said Deed is based on the recommendation of the County Solicitor and is for road purposes only. Meeting reconvened at 11 :01 a. m. for the purpose of opening bids for (a) purchase and delivery of two (2) 1972 - 127 inch Wheel Base Window Vans or Equivalent for the Wash- ington County Chapter P. A.R. C. , inc. ; (b) Printing and delivering to the Election Department the necessary ballots and election supplies for the conduct of the Municipal Election; (c) Printing and delivering to the Election Department the necessary election supplies required fo: the conduct of the Municipal Election; and (d) delivering of the ballot boxes w th the election supplies to the Judges of Elections for approximately 204 precincts. Deputy Controller Whalen reported on the Pennsylvania Income Tax which has been enacted into law by Governor Shapp. Mr. Whalen recommended to the Board that the Con- troller's Office be authorized to issue a Bulletin to all Departments as approved by the Washington County Commissioners in order that the Department heads may meet with their employees to determine the will of the majority of employees in reference to the deduction of said Income Tax. Moved by Mr. Mazza, seconded by Mr. Capano, that the County Controller's Office be authorized to issue a Bulletin to all Departments in reference to the Pennsylvania Income Tax.
