Washington, Pa., September 30, 1971
The Board of County Commissioners met in regular session with the following
members being present: Commissioners Capano, Mazza and Flynn. Also present being:
County Solicitor Porter; Assistant County Solicitor Carson; Chief Clerk Murphy; Deputy Con-
troller Whalen; John D. Anthony, Director of the Washington County Planning Commission;
Reporter Roule of The Monongahela. Publishing Company; Reporter Robertson of The Observer -
Reporter; Reporter Jane Bennett of The Brownsville Telegraph; and Public Information
Officer Huber.
Meeting called to order by Chairman and roll call taken:

Chairman asked if there were any corrections, additions, or omissions to Minute
No. 184, each Commissioner having received a copy.

Correspondence - Mr. Murphy
Chief Clerk read a Court Opinion under date of September 23, 1971, signed by the
five Honorable Judges Charles G. Sweet, Alexander R. Curran, Richard DiSalle, Thomas
Gladden, and P. Vincent Marino. Said Court Opinion requests the Sheriff to have two (2)
deputies present when criminal matters are going on in any courtroom. Said Court Opinion
stated that it is the opinion of the said five Judges that this additional security is necessary
for the proper administration of justice.
Chief Clerk informed the Board of a check received from Emil A. Eckert, Execu-
tor, Estate of Sylvia Ann Kerr, in the amount of $576. 54, which is for part of her board bill
while she was staying at the Washington County Home for Aged Women.
Chief Clerk informed the Board of a check received from the D6partment of Public
Welfare in the amount of $2, 738.30, which covers the Commonwealth's share for the third
payment for the 1971 Grant -in -Aid program - Services for the Aging.

Joan W. Owens, Executive Director of the Washington Greene Community Action Corporation,

Mr. Capano: This is payment up to the first of September. Twelve (12) bridges have been
completed. This is not the final payment.

Chief Clerk read correspondence under date of September 28, 1971, from John D.
Anthony, Executive Director of the Washington County Planning Commission. Correspondence
requested a resolution approving inclusion of McMurray Road in the Federal Urban Highway
Needs Study by the County Commissioners.
Moved by Mr. Capano, seconded by Mr. Mazza, that the Washington County
Commissioners adopt a resolution whereby McMurray Road in Peters Township, from Ever-
green Drive to the Allegheny County Line, as recommended by the Washington County Planning
Commission, be included in the Urban Highway Needs Study of the Federal Highway Adminis-
tration.

Chief Clerk read correspondence under date of September 29, 1971, from John D.
Anthony, Executive Director of the Washington County Planning Commission. Said correspon-
dence stated that Mr. Anthony recommended to the Washington County Planning Commission
that Green Engineering, Sewickley, Pennsylvania, be retained as the planning and engineering
consultant to the Washington County Planning Commission in the preparation of the Washington
County Solid Waste Disposal Management Plan. Anthony also asked that the recommendation
be qualified by the condition that Green Engineering be required to perform an amount of work
according to that offered by Gilbert Associates in their work proposal. Correspondence
advised that the members of the Planning Commission adopted said recommendation. Said
correspondence requested consideration of this matter by the Washington County Commission-
ers.

Chief Clerk read correspondence under date of September 24, 1971, from Keery
McAmbley of the Washington County Industrial Development Agency, stating that the new
director of the Washington County Emergency Employment Program, John Fantini, is now
incurring expenses which will have to be funded immediately. Correspondence requests that
the Commissioners direct a letter to the Controller's Office stating that said office will not be
responsible for the expenditure of funds under said program.
Mr. Flynn: The Washington County Commissioners are meeting all of the requirements of the
Emergency Employment Act. Mr. McAmbley and myself are authorized to sign all checks. I
would like the records to show that Mr. Whalen and myself did clear the above matter by tele-
phone prior to this meeting.
Chief Clerk read correspondence under date of September 24, 1971, from the De-
partment of Transportation - James H. Mifflin, District Engineer, which enclosed a recommen-
dation of the Washington Shopping Center's consultant which recommended that construction of
project L. R. 62214 and T. R. 19 Washington Mall and Washington Shopping Center, Washington
County, Pennsylvania, be delayed until spring of 1972.
Chief Clerk read copy of letter from Donald R. Hillstrom - Maret Development
Corporation - under date of September 24, 1971, directed to James H. Mifflin, P. E. - District
Engineer - Commonwealth of Pennsylvania, Department of Transportation, In re: Washington
County, Washington Mall Shopping Center, Washington Plaza, L. R. 62214 - T. R. 19, which
stated the multiparty agreement dated July 30, 1971, between the Commonwealth of Pennsylvanizz
Washington County, Washington Park, Inc., and Washington Mall has been fully executed, but
the construction contract has not been consummated. Said correspondence advised that a pro-
posed agreement with a paving contractor generally acceptable to Washington Park, Inc., has
been negotiated; but it is the Maret Development Corporation's understanding, however, that
Washington Mall has raised several objections to such proposal. Correspondence further
stated that should compliance with PennDOT Specifications and Directives mentioned in a pre-
vious letter result in a significant increase in the negotiated contract price, the Maret Develop-
ment Corporation may be forced to re-examine their present position.
Chief Clerk read correspondence under date of September 23, 1971, from, Keery
McAmbley - Director of the Washington County Industrial Development Agency - which stated

that on June 10, 1971, the Washington County Industrial Development Agency was authorized by

Resolution No. 170 to negotiate for purchase by the county 6. 84 acres of land and an estimated
50, 000 tons of recoverable coal reserve located adjacent to Composite Metals at Wylandville.
Correspondence further stated that since said time, many things have happened to make said
purchase less attractive. Correspondence cites said conditions. Correspondence stated that
due to the changed conditions; the B; & O. will be notified that the County, at this time, is not
prepared to buy the site. Mr. McAmbley stated that he will also ask B. & O, to give W
ton County Industrial Development Agency an opportunity, should they decide to sell the site
and coal, to have first refusal on the property.
Mr. Flynn: I would recommend that the Washington County Commissioners be authorized to
abandon the plans on Per Resolution No. 170 dated June 10, 1971.
Moved by Mr. Capano, seconded by Mr. Mazza, that the Washington County Com-
missioners be authorized to abandon the plans on Per Resolution #170 dated June 10, 1971;
said action based on the recommendation of the Washington County Industrial Developme nt
Agency.

Chief Clerk read copy of correspondence under date of September 21, 1971, from
J. S. Minnotte - Chief, Engineering Division - Corps of Engineers - directed to Ronald J.
Murtha - Chief, Engineer - In re: Chartiers Creek Flood Protection, Project - Canonsburg -
Houston Reach Unit 2. Said correspondence advised that the existing Jefferson Avenue Bridge
at Canonsburg is not compatible with the above -captioned project and must be removed. Said
correspondence reported that the waterway opening for the proposed 116-foot clear span bridge
provides for a vertical clearance of 1. 5± feet between the improved design flood water surface
elevation 930. 9 and the bottom of the bridge girders. In view of this, the Corps of Engineers
has no objection to the bridge as shown on the drawings,
Moved by Mr. Capano, seconded by Mr. Mazza, that the Washington County Com-
missioners make application to the Pennsylvania Department of Highways for an allocation of
County Liquid Fuel Tax Funds in the amount of $20, 000.00 to be used for engineering services
rendered for design, construction contract plans, and specifications for reconstruction of
Jefferson Avenue Bridge #33, spanning Chartiers Creek in the Borough of Canonsburg.

Chairman passed out copies of a news release under date of September 29, 1971,

Chief Clerk read copy of correspondence under date of September 23, 1971, from
Kenneth Raine - Trustee - Music Performance Trust Funds - Directed to Sam Congie, Direc-
tor of Parks - Canonsburg, Pa. Said correspondence acknowledged receipt of contribution of
$100, 00 to the Music Performance Trust Funds to augment their expenditures for music as a
public service in the Local 592 A. F. M. Canonsburg, Pa., area.

County Solicitor Porter presented a Tax Refund to the Board for their considera-
tion and approval.
Moved by Mr. Mazza, seconded by Mr. Capano, that the Tax Assessment Office
be authorized to prepare the following tax refund due to either duplication or overpayment of
real estate tax:

Request is being made for the refund of 1970 taxes due to Court Order No

of Washington and DARWIN DEVITIS, R. D. 1, Box 385 A, Veronica Drive, Canonsburg,
Pennsylvania, for the storage of one A.eornca Sedan - NI448-11, in Hangar No. A-5, for the
sum of $40. 00 per month, beginning the lst day of October, 1971, and thereafter from month
to month be approved; and that the Chairman of the Board, Michael R. Flynn, be authorized
to execute said Lease. Rental fee to be payable to the County of Washington, c/o John Yuhas,
County Surveyor, 67 West Cherry Avenue, Washington, Pennsylvania 15301.

County Solicitor Porter reported on bids received which were tabled in regard to
the earth slide correction and related work at the Washington County Airport. Mr. Porter
stated that John Yuhas - County Engineer - had received some type of tentative commitment
for funding in the amount of $13, 000. 00 from the state. Mr. Porter recommended that a
motion be made and passed whereby the County Engineer - John Yuhas - be directed to apply
to the proper state agency for a grant in the sum of $13, 000.00 to be applied to the contract
price for the collection of the earth slide at the Washington County Airport.
Moved by Mr. Capano, seconded by Mr. Mazza, that the County Engineer - John
Yuhas - be directed to proceed as per above for a grant in the sum of $13, 000.00 for the above
named project; said action based on the recommendation of the County Solicitor Porter.

Local Officials Meet With Transportation Secretary
SECRETARY KASSAB CALLS FOR CANONSBURG
PUC HEARING
Secretary of Transportation (PennDot), Jacob G. Kassab, took action Friday that
will pave the way for the relocation of Chartiers Creek within the boundaries of the Canons-
burg Curry Field Urban Renewal Project to commence in the very near future.
Following a Harrisburg meeting between himself, Michael Flynn, Chairman of
the Washington County Commissioners, Robert McKee, Canonsburg Borough Council Presi-
dent, and Roland Bourke, Executive Director of the Washington County Redevelopment Author-
ity, Secretary Kassab instructed his Department to exercise a petition requesting a Public
Utilities Commission (PUC) hearing on the Canonsburg project. In concurrent action the
Secretary instructed his personnel to finalize contract documents pertaining to highway and
bridge construction in the Curry Field Project.
