their consideration and approval.
Moved by Mr. Capano, seconded by Mr. Flynn,. that the Airport Lease Agreement
between the County of Washington and JETCRAFT, INC., for the Washington County Airport,
situate in South Franklin Township, Washington County, Pennsylvania, together with the privi-
lege of operating and managing said Airport, together with ingress and egress from State High-
way Route No. 18, be approved.

The Board of County Commissioners met in regular session with the following
members being present: Commissioners Capano and Flynn. Also present being: County Solici-
tor Porter; Mr. Jack Merdian - WJPA; Reporter Roule of The Monongahela Publishing Company
Reporter Robertson of The Observer -Reporter; and Public Information Officer Huber. Chairma
made note that Chief Clerk Murphy was in Harrisburg on business.
Meeting called to order by Chairman and roll call taken:

Chairman asked if there were any corrections, additions, or omissions to Minute
No. 187, each Commissioner having received a copy.

Solicitor - Mr. Porter
Chairman requested that the regular order of business would be dispensed with in
order that the business of the County Solicitor be conducted because it was necessary for
Solicitor Porter to appear in Court.
County Solicitor Porter presented to the Board three (3) Petitions for Approval of
Purchase of Real Estate in conjunction with the Department of Parks and Recreation - Mingo
Creek Expansion - Washington County, By Board of County Commissioners:.
(a) IN RE: Acquisition of real estate of Paul Geary and Nancy Marie Geary, his
wife, in Nottingham Township, Washington County, Pennsylvania, By Washington
County, Pennsylvania (ME-13).
(b) IN RE: Acquisition of real estate of Henry Thomas and Mary Ellen Thomas,
his wife, in Nottingham Township, Washington County, Pennsylvania, by Washingt
County, Pennsylvania (ME-14).
(c) IN RE: Acquisition of real.estate of George Shemloff.and Adelaide Shemloff,
his wife, Nottingham Township, Washington County, Pennsylvania, by Washington
County, Pennsylvania (ME-24).
Mr. Porter: May I recommend that these Petitions be executed by the Board and that Mr.
acknowledge them and that they be returned to Mr. Robert Ceisler.

by the Board and acknowledged by Mr. Flynn and returned to Mr. Robert Ceisler; said motion
based on the recommendation of County Solicitor Porter.

(Tax Refunds)
County Solicitor Porter presented a Tax Refund to the Board for their consideration
and approval.
Moved by Mr. Capano, seconded by Mr. Flynn, that the Tax Assessment Office be
authorized to prepare the followingitax refund due to either duplication or overpayment of real
estate tax; said refund approved by the County Solicitor.

North Strabane Township -
Request for refund has been made in re the above -captioned tax account by First
Federal Savings & Loan Association of Washington. 1971 county tax was paid
twice on July 1, 1971 in the amount of $29.75.
Enclosed find duplicate receipt and Xerox copy of receipt .showing both payments.
Kindly forward refund check in the amount of $29. 75 to FIRST FEDERAL SAIVINGS

County Solicitor Porter presented two (2) Tax Refunds to the Board for their con-
sideration and approval; said refunds having been approved by the County Solicitor and County
Treasurer.
Moved by Mr. Capano, seconded by Mr. Flynn, that the Tax Assessment Office be
authorized to prepare the following tax refunds due to either duplication or overpayment of Per-
sonal property tax:
(a) Charles Wm. Fife, 414 W. Pike Street, Houston, Pa. 15342 - said refund
to cover a portion of the 1970 Personal Property tax paid on July 1, 1970. Mr.
Fife erroneously reported private stock on which the tax is paid directly to the
Commonwealth, rendering said stock not taxable under the Personal Property 4
Mill tax, making a refund due in the amount of $29. 36 payable to Mr. Charles
Wm. Fife, 414 W. Pike St., Houston, Pa. 15342.
(b) Raymond Fife et ux, 524 W. Grant Street, Houston, Pa. - said refund to
cover a portion of the 1970 Personal Property tax paid on July 1, 1970. Mr. Fife
erroneously reported private stock on which the tax is paid directly to the Common
wealth, rendering said stock not taxable under the Personal Property 4 mill tax,
making a refund due in the amount of $80.40 payable to Mr. Raymond Fife et ux,
524 W. Grant St., Houston, Pa, f5342.

County Solicitor Porter presented to the Board 'the following Lease Agreement for
their consideration and approval:
(a) Between the Commissioners of Washington County, Pa., and Barry Ealy, for
Mr. Ealy to occupy designated premises in the Ten Mile Creek Park, House # 1.
Moved by Mr. Capano, seconded by Mr. Flynn, that the above lease as per above
be approved.

County Solicitor Porter left the meeting.
Correspondence (Mrs. Cianelli acting in place of Chief Clerk Murphy)
Mrs. Cianelli informed the Board'of a check received in the amount of $23, 438.00
to Washington County for the acquisition of approximately 1100 acres of land adjacent to an
existing f400 acre regional park - Mingo Creek Park - for future development of recreational
facilities. This is a partial payment on Contract #3-4-62-00-A=S-2. This partial payment re-
presents 30% reimbursement on approved acquisition prices totaling $76, 800 and $1, 327 in
eligible legal fees. These parcels of land are also being acquired with the assistance from the
Bureau of Outdoor Recreation -Land and -Water Conservation Fund Program.

Mrs. Cianelli read correspondence under date of October 14, 1971, addressed to
Mr. Anthony Luppino - Chief Juvenile Probation Officer - from Mary Jane Fullerton regarding
dental care for Ernest -Davis and David Mikels. Ernest Davis has sixteen (16) bad teeth. The
estimated cost is ninety ($90.00) dollars. David Mikels has one (1) bad tooth. The estimated
cost is ten ($10. 00) dollars.
Moved by Mr. Capano, seconded by Mr. Flynn, that the dental assistance for Erne
Davis at the estimated cost of $90. 00 and for David Mikels at the estimated cost of $10.00 be
authorized for payment by the Washington County Commissioners.

Boiler House Stone Stack Repair. Said correspondence enclosed executed copies of the pro-
posals covering the work that said Joseph J. Graciano Company is authorized to perform on

the above subject building, in the amount of $3, 200. 00. Said correspondence advised the Board

that the work is scheduled to begin on Tuesday, October 19th, and will be under the direction of
Mr. Joseph F. Graciano. Said correspondence requests that any inquiries that the Board may
have concerning this said work be directed to Mr. Joseph F. 'Graciano. Said correspondence
thanked the Board for the opportunity of performing this work and assured them -of a clean,
first-class job with 100% cooperation.
Mrs. Cianelli read correspondence under date of October 15, 1971, from John R.
Fantini - Director - Washington County Public Employment Program. Said correspondence
enclosed copy of the Invoice, form No. MA 2 105B and a copy of the Detailed Statement of cost,
form No. MA 2 105C. Said correspondence advised the Board that completed copies of said
forms must be mailed to Philadelphia no later than the seventh of each month using the fiscal
data of the previous month. Said correspondence further advised -that the preparation, mailing
to the County Commissioners for their signatures, returning mail to said Washington County
c Employment Program Office and remailing to the Philadelphia office is very time con-
suming. Said correspondence stated that it has been suggested to Mr. John R. Fantini that in
order to preclude the consumption of all this time that the Board authorize him to sign said
reports and that Mr. Fantini sees no difficulty which could arise because of him signing these
reports since it is a routine monthly report. Said correspondence requests the Board to sign
e enclosed letter of authorization or compose a similar one and return it to Mr. Fantini if
said suggestion is acceptable.
Mr. Peter Elish entered the meeting.
Mr. Flynn: May I recommend that Mr, John R. Fantini be authorized to sign said monthly re-
ports with the condition that he sends a copy of each executed monthly report to the County
Commissioners.

Mrs. Cianelli read correspondence under date of October 13, 1971, from the De-
partment of Environmental Resources. Said correspondence stated that receipt was acknowledg(
of the application filed by the Washington County Commissioners, for permit to encroach in
Chartiers Creek, Borough of Canonsburg, Washington County, together with plans of the propo-
sed work. Said correspondence further stated that the application is being processed by the
engineering staff; and -in the event any further information is desired, the Commissioners may
contact the- Division of Danis and Encroachments, at Area Code 717, 787--6826.

New Business - Mr. Flynn
Chairman informed the Board and all those present that the Courthouse will be
closed from Friday, October 22, 4:3.0 p.m. until Tuesday, October 26, 9:00 a.m. in obsery
of Veterans Day.
Mr. Capano: I take exceptions to the article which appeared in the Observer -Reporter on Octo-
ber 21, 1971, which is entitled "Mazza Ballot Substitution Stirring Dissatisfaction in Local GOP
Ranks. " We are not concerned with the strife or dissatisfaction which exists among the membe:
of the Republican Party; that is a matter for them to decide. The Republican executive commit-
tee did comply with the Fourth Class County Code on the substitution of a candidate. However,
we do feel that the last paragraphs of the article, which deal with the authority of the County
'Election Board, do concern us. We are satisfied and confident that we have acted within the
powers and perogatives granted to the Election Board. The code provides that the Commis-
sioners retain their traditional role of County Election Board until noon of the Friday following
the election when the Official Return Board begins its canvass of votes cast. We are and, rem
the Election Board even though some of the members may be candidates for election. However,
I am not a candidate; and under any circumstances, I am not disqualified to act on the County
Election Board. We have accepted the petition fora substitute nominee in good faith and in
accordance with the law; and as far as we can determine, it was in proper order. The stopping
of the printing of the ballots was done on ray orders because we realized that the situation could
develop whereby they could substitute and request a reprinting of the ballots. In order not to
find ourselves in such a position, we stopped, after conference with the printer and Mr. Musc
Head of the Election Board, the printing and established a deadline of Tuesday noon so that we
could meet the proper schedule for printing ballots and make absentee ballots available to all
those who had applied for the same. Any longer delay would have made it impossible to get out
absentee ballots on time to those requesting them and to have them returned on time to be
counted in this election.
Moved by Mr. Capano, seconded by Mr. Flynn, that the final cut-off date for pay-
ment of regular expenditures be set as December 10, 1971, and that the cut-off date for all
expense accounts be set as December 21, 1971.

Chairman made reference of correspondence under dates of September 16 and 24,
1971, IN RE: Washington Mali Shopping Center - L. R. 62214 - T. R. 19. Chairman made note
of the $20, 000 commitment made by the Washington County Commissioners in Liquid Fuel
Monies for said project_ Chairman stated -what for reasons unknown to the Washington County

Commissioners, someone is holding up this project. Chairman further stated that the Board
