The Board of County Commissioners met in regular session with the following
members being present: Commissioners Carroll and Flynn, Absent being: Commissioner
Capano - who was absent due to sickness. Also present being: Chief Clerk Murphy; County
Solicitor Porter; Reporter Roule of The Monongahela Publishing Company; Reporter Robert-
son of The Observer -Reporter; and Public Information Officer Huber.
Meeting called to order by Chairman and roll call taken:
Mr. Capano - Absent; Mr. Carroll - Present; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions or omissions to
Minute No. 193, each Commissioner having received a copy.

Old Business - Mr. Flynn
Chairman requested that the records show that in reference to the Agreement
with Green Engineering Company in connection with the preparation of a Comprehensive Solid
Waste Management Plan for Washington County which was entered into at the last regular
board meeting (Minute No. 193 dated November 24, 1971) subject to a complete perusal of
said Agreement by the Commissioners and the County Solicitor, said agreement was signed
and executed by the Washington County Commissioners as of November 24, 1971.

the amount of $5, 000.00 to Engelhardt -Powers & Associates, Inc, for professional services
rendered relative to Crile Access Road, WCIDA Job #5039-73a; money to be drawn from the
Industrial Development Fund Account.
Remarks:
Mr. Flynn: I would recommend that the Chief Clerk contact Mr. Kerry McAmbley and request
that he submit a detailed report to the Commissioners on the status of the above project.

Chief Clerk informed the Board of a Telegram under date of November 26, 1971,
from Congressman Thomas E. Morgan, which stated that he is pleased to announce that the
Department of Housing and Urban Development has approved a Flood Insurance Program for
Union Township in Washington County. Telegram stated that beginning December 3, 1971,
owners of existing 1-4 family residences and small businesses may buy flood insurance from
their local insurance agents at a low subsidized rate under the Emergency flood insurance
program. Telegram further stated that local insurance agents may obtain information from
the National Flood Insurers Association Servicing Office which is the Zurich -American Group.
Chief Clerk read correspondence under date of November 15, 1971, directed to
Washington County Commissioners from William W. Walker, director - Bureau of Medical
Care Facilities, which stated that the on -site survey of the Washington County Home for Aged
Women on September 27, 1971, indicated that said Home is in compliance with Title VI of the
Federal Civil Rights Act and the Pennsylvania Human Relations Act. Chief Clerk also read
correspondence under date of November 8, 1971, from same directed to the Washington
Home and Hospital which stated that the on -site survey on said facility was held on July 1, 197
and said Facility was also in compliance with said Acts.

Chief Clerk read correspondence under date of November 15, 1971, from Edwin
J. McMahon, Acting Commissioner, Department of Public- Welfare - Office of Medical Ser-
vices and Facilities, directed to the Superintendents of Home for Aged Women & Home Hospital
for Men, which stated that under new regulatibna,, published in the Pennsylvania Bulletin for
October 29, 1971, every nursing home in the Commonwealth is being re-classified under a- new
payment system. Correspondence stated that said Homes have been evaluated under the new
regulations and the following payment and program category has been assigned: Clt.ssification-
Skilled IIB. Correspondence further stated that if said Homes disagree with the above classi-
fication, an appeal may be filed and directed to the Commissioner of Medical Services and
Facilities.
In conjunction with the above letter, Chief Clerk read correspondence under date
of November 22, 1971, from Edwin J. McMahon, Acting Commissioner - Office of Medical
Services and Facilities, which advised that the above letter dated November 15, 1971, which
stated that the Homes for Aged Women and Home & Hospital for Men were being reclassified
under a new payment system was sent in error. Correspondence: stated that the rate of pay-
ment for skilled nursing home care in a Public Nursing Home continua -xi to'be the Federal
share of the average per diem costs established and certified by the Auditor General's Office.
Correspondence further reminded that effective December 1, 1971, the, Public Nursing Home
that continues to have a practical nurse licensed by waiver as a charge nurse will be decerti-
fied from participation in the Medical Assistance Program.
Chief Clerk read a copy of a letter from Carl J. Bonidie directed to Carl G. Baker
& Associates under date of November 22, 1971, which stated in reply,, to Mr. Stokes' letter
of November 19, 1971, it is Carl J. Boni die, Inc. Is intent to complete the work at the- Washing-
ton County Home for Aged Women - Boiler Plant Alterations, to. -the satisfaction of the Owner.
Correspondence further stated that after delivery of the Temperature Controls, it is said
Incorporation's intent to install these controls and complete all other items necessary for a
complete and satisfactory job.
Chief Clerk read correspondence under date of November 23, 1971, from Anthony
Karpus, Borough Secretary - Borough of Brownsville, which informed the Commissioners of
a resolution passed at their special metting held on November 22, 1971, in which said parties
requested the Fredericktown Ferry placed back into operation between LaBelle and Frederick -
town. Correspondence stated that the people need the ferry service and the resumption of the
services would be an asset to Fayette County.
Mr. Flynn: May I suggest that the Chief Clerk acknowledge receipt of the above letter advising
them that the Washington County Commissioners cannot, at no time, underwrite the cost of
placing said ferry service into operation.

Chief Clerk read correspondence under date of November 23, 1971, from Daniel G.
Stanley, Schneider & Stanley, Inc. - Insurance Agents & Brokers, which advised and enclosed
Performance Bond #400DE5881 - Washington County, in the amount of $288, 000.00 on behalf
of their client - Cole Layer Trumble Company.
Mr. Murphy: The Performance Bond has been accepted and filed with the Controller's Office.
Chief Clerk read a copy of a letter under date of November 24, 1971, from Clay
Graham, Land Acquisition Agent directed to Mr. William G. Sutter, Jr., advising that the
Washington County Commissioners have agreed to a generalized meeting on the Mingo Creek
Park Expansion, December 9, 1971, at 7:30 p.m. in the Washington County Courthouse. Cor-
respondence stated that only those that are actual property owners should be in attendance for
said meeting.

Chairman informed the Board and those present that the Courthouse will be closed
on December 24, 1971, at 12:00 Noon in observance of the Christmas Holiday; and on Decem-
ber 31, 1971, at 12:00 Noon on December 31, 1971, in observance of the New Year's Holiday.

Moved by Mr. Carroll, seconded by Mr. Flynn, that the Board of County Commis-
sioners execute and file the Objections in Support of Appeal by Board of Commissioners of
Washington County, from Action on,Application No. 2668BSM4 Bologna Mining Company in
reference to the issuance of a strip mining permit - Cross Creek County Park, to the Depart-
ment of Environmental Resources; said action based on the recommendation of the County
Solicitor.

Moved by Mr. Carroll, seconded by Mr. Flynn, that the Washington County Commis•
sioners sign and execute the Agreement for Engineering Services to be performed by the Soil
Conservation Service, United States Department of Agriculture, for construction of a multiple
purpose structure at Site PA-481 - Harmon Creek Watershed; said engineering services to
cover geological investigations, development of final plans and specifications and construction
inspection services for the construction with an estimated cost to be $35, 900. 00 (County'a
share to be 34. 54 per cent of the actual cost of engineering services;) Said action based on the
recommendation of the County Solicitor.
