Motion carried unanimously. Mr. Murphy read correspondence under date of March 28, 1972, from Malcolm L. Morgan, County Treasurer, stating that salary increases for Helen Solomon and Helene Oberst were passed and approved by the Salary Board on January 24, 1972. Mr, Morgan stated that he spoke to Mr. Pinelli of the Internal Revenue Service and explained to him the exact situation. Mr. Morgan, stated that these women worked on a training basis prior to the impliment of the Pay Board. He was told that the intent of the law was not to inhibit the promotion or advancement of individuals. But, if he wanted a pay incre.,.se for those others who are in that pay category he would be in trouble. Mr. Murphy had originally contacted Mr. Pinelli, who. told him that he would have to write to Philadelphia to get the opinion. JOHN MAZZA, COMMISSIONERS Mr. Whalen presented the following information from this year's,budget: the budget that came in from the Treasurer's Office reflected the bi-weekly salaties of the staff that was in effect prior to December 27, 1971. The staff (excluding one clerk -typist) - total bi-weekly salary was $1, 963. This figure multiplied by 26 would make a factor of $51, 038. To this 5% was added, which increased the increments by one for every employee. This brought that budget itme up to $53, 59.4 - the budgetary reflection on Account 107-1-3, Salaries of Deputies and Clerks. This is the basis on which the Treasurer's Office Budget was adopted for the year 1972. , There isn't any provision beyond that. in the salary budget for the Treasurer's Office. A discussion was held on the part the new automation in the Treasurer's Office played in the amount of work being done. Mr. Morgan stated that this is the fourth year of trying to automate the office in some manner and hopefully we are making some pro- gress this year. Because � of the coordinating back and forth from Dayton, Ohio they are behind in posting .things for attorneys who search titles. A's far as cutting in personnel,. Mr. Morgan stated that we continue to collect thousands of dollars, and that when Mr. Stuart was County Treasurer he collected less money and had fourteen full time employees. Mr. Morgan stated that he collects about twice as much money and handles that much and only has eleven employees, Mr. Morgan stated he doesn't believe that we should inhibit the promotion and advancement of people who are filling the job and taking the responsibility of handling thousands of dollars. We are dealing with individual -cases here and everyone is entitled to a fair salary for the amount of work and amount of responsibility they carry. Mr. Flynn stated that it shocked and surprised him that after two years this was brought to light. Mr. Morgan stated that the automation helps cut down the amount of extra help; but it was causing draw- backs insofar as error being made because of the difficulty in reading the number, which takes more time for the girls to look these things up in the books. Mr. Morgan also felt that the courier service for the magnetic tapes could be better. When asked what the difference was in the positions of these women, Mr. Morgan stated that the cashiers make $202.00 bi-weekly and these women performing the same duties $100. 00 a month less than what.the salary is for that position. He, asked that this be cut in half and their salary be brought from $150. 50 to $174. 50 bi-weekly. Mr. Elish asked if there was money in Mr. Morgan's budget to do this. Mr. Morgan stated in his opinion, yes. Mr. Whalen stated that in the official budget, no. Mr. Flynn pointed out that what Mr. Morgan was asking for was a, 20% increase for these two employees. They have been granted 5% and he is asking for 15%. Mr. Paluso stated that what we are talking about is $1200 a. yea.r,for both. Mr. Elish asked how the men at the jail got their increases. He said, to be consistent we have to do the same way. BEVEC, .JOHN MAZZA, COMMISSIONERS increase. Mr. Flynn stated that there was a, deletion of men from the jail payroll and at first it was tabled. They gained increases for the jobs of other people taken off the payroll. Mr. Flynn stated that the point he was trying to make is that it never occurred that anybody got these three increments. There has to be a day when we.are going to stand up and be counted and when that time comes that there is no more money available, you are going to.have to govern yourselves accordingly in the operations, Mr. Jones stated that he is not going to go against a state mandate or a federal mandate and that he is, not going to vote for something that is unlawful: Mr. Morgan stated that the gentlemen at the Internal Revenue Service ex- plained to him that it is lawful. Mr. Flynn stated that Mr. Morgan.is relaying what this gentle- man said orally, but he would like this in writing for the records. Mr. Elish stated that the problem is, there are girls working at the window every day, just like the other clerks, and those other clerks are making considerably more money, which is not fair at all. Mr. Elish said that what Mr. Morgan is trying to do is promote them. If it is a, matter of promotion thi: wouldn't be improper, but if it is a .matter of budget, that's another thing. Mr. Capano spoke on this matter. He stated that he was in on the matter originally when it was presented. He recalled that Mr. Morgan presented -it as increases and not as promotions to another category. We held the line for the simple reason that everybody was getting a one increment increase in accordance with the law and that was it, Mr. Hormell stated that the whole key to the matter is: "Is there a promotion?" Mr. Morgan stated that they are handling thousands of dollars in money. Mr. Hormell stated that handling money doesn't constitute a promotion. Are these two women doing different work than they did before. Mr. Morgan stated that these girls were on a training program. Mr. Paluso asked what did they do before that. Mr., Morgan answered that they worked as clerks back on the floor, handling, mail, not cash. The only people who handle, cash axe,the cashiers and those in accounting. Mr. Paluso stated in other words, they are clerks working as cashiers, after they were trained. Mr. Flynn pointed out that ,in the budget submitted by Mr. Morgan's Office he refers to Helene Oberst as a cashier and Helen Minor Solomon as a bookkeeper. Mr. Morgan called for a question on his motion to give them their raises they are entitled to. Mr. Flynn asked for an opinion from the solicitors before voting. on this. Mr. Hormell stated: Your present parliamentary position is this - there is a motion on renord to grant the increases subject to the approval of the Pay Board. This motion is out of order until .the previous motion could be rescinded, then a new motion would be made. Calling for.the question is out of order. Tiis motion is out of order. Moved by Mr. Paluso, that the previous motion of January 20, 1972 be rescinded, Mr. Flynn made note that in correspondence as far back as July of 1971, SALARY MINUTE BOOK 95 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. BEVEC, JOHN MAZZA, COMMISSIONERS 1 E 1 Mr. Morgan referred to these people as cashiers and asked how he was promoting them now, Mr. Morgan stated that he had them in a, training position and has been teaching them. Mr. Paluso stated that there is a motion on the floor to rescind the previous motion. Mr. Flynn stated that as far as he is concerned the motion is out of order. Mr. Flynn.ruled that the motion made by Mr. Morgan is out ,of order. Moved by Mr. Paluso, seconded by Mr. Morgan, that the previous motion of January 20, 1972 be rescinded. Remarks: Mr, Flynn: To rescind the action previously, means in effect that the motion with the proviso, you are wiping the slate ,clean and starting all over. Roll call vote taken: Mr, Morgan - Yes; Mr. Jones - No; Mr. Paluso - Yes; Mr. Elish - Yes,; Mr. Flynn - No. Motion carried. Moved by Mr. Morgan, seconded by Mr. Elish, that we grant the salary increases that were duly passed by this board on January 24, 1972 and give Helene Oberst and Helen Solomon their increases from $150. 50 bi-weekly to $174. 50 bi-weekly, in that they do qualify under all rules and regulations governing such things and we make this pay. raise retroactive to January 24, 1972. This is a change in classification other than what they were originally hired for. Remarks: Mr. Hormell: I think that motion is out of order because it contains a lot of legal conclusion Now, if he wants to make a motion to clear these salaries that is different. Moved by Mr. Morgan, seconded by Mr. Elish, that Helene Oberst and Helen Minor Solomon receive their salary increases effective January 24, 1972 of $150. 50 to $174. 50 bi-weekly, respectively by reason of re-classification of jobs they were originally hired for, Remarks: Mr. Jones: My remarks are still the same until we get the point cleared about the point of law. If that is all it takes, Mr. Morgan, to, get a, letter in, there's no problem. I don't think there is any problem of paying., But the point of law. That's the only point I have. Mr, Elish: I'd like to point out on the motion to give the re-classification to the Washington County Prison Employees, we said this was subject to the approval of the Wage Price Board, The very next day we gave them the rate increase anyway becuuse of the classification. This is the same thing, in my opinion. Mr. Hormell: Mr, Flynn, I'd like to make a comment. BEVEC, JOHN MAZZA, COMMISSIONERS, FZ here about the terminology "subject to". I think Mr. Whalen has a letter setting out guide- lines. Is that right? Mr. Whalen: Yes, Sir. Mr. Hormell: Now, when anybody says "subject to", I'm assuming that if it fits within those guidelines, it is satisfactory. And if it doesn't fit within those guidelines, that you are making inquiry with the proper officials. He's referring to a previous action and it is my recollection that the previous action with respect to the jail, everyone concluded wa,s within the guidelines set forth in that letter. Now, you have a situation here where that is not the case, because you have a verbal opinion by an employee who is not willing to put it in writing and you are waiting to get this from Philadelphia. So, ' its two different situations. Mr. Elish: Well, we didn't wait for the people at the County Jail. Mr. Hormell: That's what I'm telling you. It's two different situations, Mr. Whalen: The guidelines state: a bonafide promotion that constitutes an a.dvancement to an established job with greater responsibility is allowed since remuneration goes with the job, not the man. Mr. Hormell: Thats the point I'm making. You had concluded that those in the Jail were bonafide promotions. Now, Mr.' Flynn read correspondence from Mr. Morgan which classified these people as cashiers as fax back as July of 1971. Is that correct? Mr, Flynn: That is 'correct. Mr. Hormell: Mr, Morgan says that he meant to classify them as cashiers in training. Is that correct? Mr. Morgan: Right. Mr. Hormell: `We'll here's your issue. Is this a bonafide promotion. That's the question. Mr, Capano: This originated in July. At that time I was a member of the board. It came up for vote on the same. He says increases (3 increments at that time) and the board action at that time tabled it. At a. later date you came in when Mr. Mazza and I were the only two members here and you voted to have the question taken off table. It wa.s taken off table. It was voted on and defeated. It didn't carry. Is that correct? Mr, Morgan: I don't remember. Mr. Capano: At that time it was a matter of increase. So, a,t tha,t time it was voted down. It is not a new position. It is the same position as listed in July of 1971. The board at that time turned it down. Mr. Flynn: I want the records to show, I concur with the thinking of Mr. Jones insofar as the legality is concerned. I would further like the records to show that if this becomes effective, which no doubt it will be, that these two employees have received this increase i� 1
