The Salary Board of the County of Washington met in the Office of the
County Commissioners with the following members being present: Commissioners
Jones, Paluso, and Flynn; and Controller Elish. Also present being: Chief Clerk
Murphy; Administrative Assistant Whalen; Solicitor Capano; Sheriff Debreczeni;
Reporter Robertson of the Observer -Reporter; Reporter Roule of the Monongahela
Publishing Company; and Reporter Liesch of the Brownsville Telegraph.
Meeting called to order by Chairman and roll call taken:

Chairman asked if there were any corrections, additions, or omissions
to Minute No. 12-S, each Commissioner and County Controller having received copies.

BOARD FOR ASSESSMENT OF APPEALS:
Mr. Flynn: If I may, gentlemen, I believe we are all familiar with the story on these three
board members and the background and controversy that has evolved around it and the
minutes and so forth that has been taken on this. Originally, it was proposed that the
Chairman be given the salary of $5670 annually and the Board Members receive the
salary of $5145 annually. As you well know, and the minutes will confirm what I'm
saying, for several meetings Mr. Elish, the Controller took exception to it due to salary
and so forth. Just to expedite the matter, finally after several meetings where there
was quite a bit of controversy about this board, Mr. Elish moved, the records indicate,
that these gentlemen be paid on a per diem basis - the Chairman $60. 00 per day and
the other two members $50. 00 at the hearings. The motion was Jost for want of a
second.. Of course, your point was that you wanted to be convinced that this board was
actually earning this money, etc. If we so desired, we could very well jump on to that
motion. Because at $50. 00 per day and $60. 00 per day, who determines the number
of days? Here is a good question. Then again, I talked to Mr. Elish just recently
and one man in particular is being penalized if you put him on a per diem basis. Mr.
Cox would be penalized in view of the fact that he comes under the retirement system.

If you put him on a per diem basis, then he would definitely be penalized. The time he
has would be to no avail. It is my understanding, it will be agreed upon if we reconsider
the salaries, that Tom Cox's salary would remain as it was in the previous year for
Chairman, without any increase - $5400 annually, effective as of January 3, 1972 because
the man was there -- it was not just a continuation; and the other members would receive
the existing salary as of last year without the increase - $4702 annually, but would not
become effective until February 1, 1972. In view of the fact that they didn't take the oath
of office until the latter part of January. That's the status on it, gentlemen. What is
your pleasure on it.

Remarks:
Mr. Elish: You have taken up most of the things I wanted to say, but I still think you
people should look into this matter and see if the Commissioners themselves can sit
as a board. Now, there are two fourth class counties that don't besides ourselves.
I think this is something that maybe at your convention you could discuss. My office
is not an administrative office. Although I feel that the Commissioners should sit as
a board of appeals, it is not my prerogative. I'm not an administrator. You people
know what you are doing. If you are too busy with other matters and there are a lot
of appeals, then maybe you don't have the time. I'm just saying, my feeling has been
based on what other fourth class counties similar to ours are doing. As far as the
personnel of the board is concerned, I have no interest as to who the board appoints,
as long as they are competent people. So, I'll second the motion.
Mr. Paluso: I agree with you. I think it is pretty well known, the entire story. However,
I still object, not to the individuals or to the board, but to the fact that the minority
representative of this board does not have anyone acting for him at the board, as stated
in the County Code, in extension of his hand, so to speak, who would keep him informed.
My own personal experience with the board was the board members conducted themselves
(the two that were present) as gentlemen, which is one of my major complaints, But I
still voice my objections to this and a no vote because I do not have a representative there;
and as a representative of 27, 000 minority Republicans, I think that they are entitled to
someone there that I appointed as a Republican Minority Commissioner. Since that is not
the case, I object strenuously to this.

Mr. Flynn: I want the records to show also, that as the Chairman of this Board, I take
exception to that because I don't have a special representative on it either. Those
men are representing the thousands of people of this county and that is exactly what the
law states. The statute does not specifically state that you as a minority representative
shall appoint the minority representative.
Mr. Paluso: Your interpretation of the statute and mine obviously are different. That's
the way I interpretted it.
Mr. Flynn: I'm sure I don't have any personal control over that board.
Mr. Paluso: I think you made a statement about a half an hour ago, "he who controls
the purse strings controls the purse". This matter comes exactly under that. The
same thing. The statute does not say a majority of the County Commissioners. It
makes clear it means the three County Commissioners. I have stated it many times
and I'm re -stating it. If I am not permitted to sit there myself, then my representative
should be appointed by me and not somebody else to sit there and make decisions in
my name.
Mr. Flynn: May I remind you, he is not your representative a bit more than he is mine.
Mr. Paluso: You're right, they are all your representatives.
