SEVEC, JOHN MAZZA, COMMISSIONERS Special Salary Board Meeting at a date and time mutually agreeable to all parties, to be arranged by Mr. Whalen, to present a formal motion for deletion, omission, or retaining of employees under their jurisdiction. Remarks: Mr. Jones: I have to raise objections to the motion because I think we are getting into something that is involved in court procedures, with other offices picking personnel for them. Let the judges get together and decide who the majority is and make their own decisions. Mr. Paluso: Regardless, it still has to go through the Salary Board. Mr. Elish: There should be no problem if the Judges agree. It seems to me that this should be a very simple thing. Mr. Hormell: I don't know, because I haven't checked into the records, but from my recollection, the precedent that has been set in this county, with the court, has been that the entire court considered personnel matter. I think we will find, if we go into the records, that there will probably be court orders to that effect, that contain many, many signatures. Now, that being the situation, I agree and think that this is a matter for the court to dispose of and that is the reason I say the objection is well taken. The Salary Board has the right to set the number and compensation of employees, but not the right to pick a specific person for a specific job. Mitchell, Assistant District Attorney for Juvenile Court, replacing David L. Gilmore who resigned this position, be set at $109. 00 bi-weekly, effective February 19, 1973. Mr. Flynn asked Solicitor Hormell to bring the Board up to date on the events which have taken place in an attempt to resolve the situation involving Stanley Brovey. Mr. Hormell read correspondence from: Judge Sweet (including a court order); Judge Gladden (including payroll voucher); and Mr. Whalen. These items were brought up at the last Salary Board Meeting. Since that time, the following items were received, which should be considered on this matter: (Also included are previous matters along the same line, No. 2 & 3) 1. An Administrative Order, under the date of February 16, 1973, which states that the President Judge is recognized as the representative of the Board of Judges on any matters which come before the Salary Board. :The actions and orders of the President Judge shall be deemed to be the action of the majority of the Board of Judges unless. reversed by the Board of Judges within five (5) days after actual notice of such action or order. (This was signed by all four Judges) 2. Correspondence under date of June 26, 1969, from Chief Clerk Murphy to Judge Sweet stating "that in the future we will hold any communications on the Court appointments and salaries unless the President Judge is present at the Salary Board. " 3, Correspondence under date of July 7, 1969, from Judge McCune to Mr. Flynn, stating that as far as he is concerned, his employees are his employees and not someone else's employees and he would be the one to decide on this. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMt88tONERS Mr. Hormell stated that the question is: Just whose employee is Mr. Brovey? Mr. Hormell stated that Mr. Brovey is designated as a Court Duty Officer -and you might be lead to / not think that he is an employee of Judge Gladden because Judge Sweet asked Judge Gladden to include Mr. Brovey on the payroll voucher, but it could be argued that he is an employee of the Court although not on a specific Judge's payroll. (This latter issue has not been raised) Mr. Brovey is not a court crier, tipstaff, or employee of the President Judge, unless, he is an employee of the whole court. Mr. Hormell stated that if Mr. Brovey is an employee of Judge Gladden, Judge Gladden sits at the Salary Board Meeting to make the decision as to whether Mr. Brovey is to be kept or not, but if Mr. Brovey is an employee of the whole court, Judge Sweet has to make the decision. Mr. Hormell stated that the Administrative Order is in direct conflict with the statute and doubted if this order would stand the test of legality. Mr. Hormell stated that there would be a problem if checks had been made up for and not delivered to Mr. Brovey (if the man was discharged and was on the payroll and performing his duties) Mrs. Criquellion stated that the last payroll voucher received from Judge Gladden had the figures changed in an amount less than the amount of Mr. Brovey's salary. The problem is - Whose employee is Mr. Brovey? - and this is not a matter for the Salary Board to settle. Mr. Paluso asked Mr. Hormell the question: Isn't it true, no matter what has to be done, it has to be done at a Salary Board Meeting? Mr. Hormell answered that the Salary Board establishes the number and compensation of employees. Mr. Hormell stated that he was agreeable to holding Mr. Brovey's check in escrow, Mr. Paluso asked if a check could be issued, if an amount was not provided for that amount on the payroll voucher. Mr. Hormell recommended that we ask the Court for a conference with all the Judges and Salary Board to try to work something out in accordance with the law, which will not affect future action. If such a conference results in irreconcilable conflicts or differences, we would have to start litigation. Mr. Flynn made a directive to Mr. Whalen to arrange a meeting agreeable to every- body concerned (giving them the required 24 hrs, notice), in compliance with Mr. Paluso's motion of last meeting on the above matter. Mr.. Paluso read said motion. Moved by Mr. Jones, seconded by Mr. Paluso, that the meeting adjourn. Meeting adjourned.
