Gillespie, Temporary Special Auditor and Accountant for the Controller's Office, be set at $270. 00 bi-weekly. (Mr. Jones questioned the fact that this was not brought to the attention of the other board members) Roll call vote taken: Mr. Paluso - Yes; Mr. Elish - Yes; Mr. Jones - No. Motion carried. Also present being: Chief Clerk Murphy, Solicitor Hormell, and Sheriff Debreczeni. Meeting called to order- by Chairman and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Elish - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. 35-S, each Commissioner and County Controller having received copies. as read. Moved by Mr. Paluso, seconded by Mr. Elish, that Minute No. 35-S be approved, Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Elish - Yes; Mr. Flynn - Yes. Motion carried unanimously. Dld Business: Mr. Flynn C 1 919 SALARY MINUTE BOOK w BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEYEC, JOHN MAZZA, COMMISSIONERS Chairman stated that he had some unfinished business to bring up in reference to the previous meeting; but due to the time, he would bring it up at the next meeting. SHERIFF'S OFFICE: Moved by Mr. Debreczeni, seconded by Mr. Elish, that Deputy Sheriff James Fazzoni oe promoted to the rank of Lieutenant Deputy Sheriff, effective May 28, 1973. His salary to increase from $290. 50 to $300. 00 bi-weekly. Also included in this motion was the approval of the salaries of the following special deputies in regards to the John Matthews Case: Edward J. Lee 4 days @ $20. 00 $ 80.00 Louis Waddy 5 days @ $20. 00 $100. 00 Thomas DeFabbo 4 days @ $20. 00 $ 80.00 Also included in this motion was the approval of the salaries of the following matrons: Paula Teagarden April 27 - April 30 (3 days) $ 90.00 Dorothy Ulom April 30 - May 9 (9 days) $270. 00 Paula Teagarden May 9 - May 22 (14 days) $420. 00 Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Elish - Yes; Mr. Debreczeni - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Debreczeni: I would like to make a comment at this time to the Salary Board. I was very happy to be here when you approved the payment to Erie County. I would like to go on record as part of the minutes of this meeting that I will present to this Board all extra pays, all extra hours that my deputy sheriffs put in at the starting of the Yablonski Case - when we went to Cleveland and when we stayed at the hotel and all hours. It is going to be a difficult job, but I hope to have it before the Salary Board. I take this position because of this reason: that the first part of the bills that was sent to this County stipulates that a deputy sheriff also is labeled as a special deputy after 4:30 p. m. , the hour of the closing of the Courthouse. Each one of those, deputy sheriffs were paid in Erie County by this county, and I certainly will be no part with my employees not to take this action whether it be passed or not. I want to be on record that for each and every hour that they worked for they also be paid. Mr. Flynn: I believe, if I recall the resolution correctly, that we did pay them subject to our scrutiny by the controller, commissioners; and I don't know who all was involved. I can't recall just how it was worded. The idea is that we paid this to show that we are acting in good faith, but we still have the right to go over and account of all of this. Mr. Debreczeni: Well, may I stipulate it ithis way. If they be paid, then I will take this posi- tion naturally. Mr. Flynn: This leaves a good question. BEVEC, JOHN MAZZA, COMMISSIONERS Mr. Elish: There is somewhere in the County Code that you can not pay a regular employeee overtime, and I would like to have a decision of the same. I am sure, from years of experience, that somewhere in the Code that there is some distinction where no person who is on a perman- ent salary can get complete compensatory payment except time off. Mr. Flynn: That is what we are trying to get to Erie County. We are not trying to shove our responsibilities, but we do not want to pay a bill that is not legal. What they have done in Erie then is that the closing time is at 4:30 and automatically my day is done, and they assign me as a special deputy. Mr. Debreczeni: They can't do that in the first place as long as he is a deputy sheriff. Mr. Flynn: It is a point well taken. I'm glad you brought it up. It is something to be looked into. Mr. Hormell: Let me make this comment also for the record. The motion that was passed by the Commissioners in the payment of the Prater expenses specifically provides that the Commis - sioners are reserving the right to determine whether any bills are properly authenticated. This would also include an exploration of the subject that you raised, and a legal determination has to be made as to whether those costs were proper as well as others. I would say that if it is deter- mined that those costs are proper in Erie County that it would similarly be proper in Washington County. If, on the other hand, it is determined that they are not proper in Erie County, then they would not be proper in Washington County. Mr. Elish: If these people are in a union and have a union contract, then it is a different color. Mr. Debreczeni: That may be your interpretation just because they have a union, but I don't feel that that should apply once you have given extra hours. You are not paying them up there because of the union business. You're paying because they request for services they have ren- dered, and it would be the same thing here. That is the way I feel about it. Mr. Paluso: That is one of the things that we discussed yesterday morning with the union. If you recall, the last paragraph says that, in effect, parts of the contract that violate statutes, codes, or laws of the commonwealth are not applicable; and one of them is the County Code definitely says that you do not pay overtime. (More discussion was held) COURTS: Moved by Mr. Elish, seconded by Mr. Jones, approving the temporary employment of Mary Hamilton replacing Lillian E. Sowers, who will be hospitalized from June 6, 1973 to July 23, 1973, at the salary of Mrs. Showers, which is $202. 00 bi-weekly. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Elish - Yes; Mr. Flynn - Yes. WASHINGTON COUNTY PLANNING COMMISSION: Moved by Mr. Elish, seconded by Mr. Jones, that the starting salary of Kenneth J. Krupa, replacing Mr. William Gilbert, Senior Planner, be set at $11, 000 yearly. Upon re- ceipt of his Masters Degree, his salary will be raised to $12, 000 yearly. Effective date is July 2, 1973.
