Mr. Capano and Mr. Flynn attended that hearing and raised the question with the
Pennsylvania Labor Relations Board. Mr. Bitti, who conducted the hearing, after
consultation with some of his assistants ruled that the Commissioners as such are the
employer and the ones who will have to sit down and bargain. If we are considered the
employer, then we should be the ones that have the right to hire, fire and discipline.
This could bring up an interesting subject in the future because we received notice
from the labor organization that they have sufficient names of other employees to
conduct a hearing. After consultation with his board, he stated that there was a prior
ruling which stated that the County Commissioners are considered the employer
(Act 195). Judge Gladden asked if Mr. Capano could obtain from Mr. Bitti the prior
ruling and his written opinion on it. Mr. Capano said he could give Judge Gladden
the name of the board.
Mr. Roupe stated that he received information this morning that the
tanks for oil are coming in Monday. After the tanks are in and the blacktop is completed,
he plans to make application to the Crime Commission for a grant for other facilities
in the recreation area.
Judge Gladden appointed Mr. Paluso and Mr. Debreczeni to make an
inspection of the jail on behalf of the Prison Board and to report back at the next meeting
on the acomplishments, their recommendations and what measures should be taken by
Mr. Interval with respect to the air vents.

The Prison Board of the County of Washington met in the Commissioners' Confer-
ence Room at 11:30 a, m. , Wednesday, July 19, 1972, with the following members being present:
Sheriff Debreczeni; Deputy Controller Croquellion; Commissioner Flynn; Judge Marino; Com-
missioner Paluso; and Judge Gladden. Absent being: Mr. Costa; Judge Curren; Judge DiSalle;
Commissioner Jones; and Judge Sweet. Also present being: Warden Roupe and Solicitor Capano.

Chairman asked if there were any corrections, additions, or omissions to Minute
No. 6-P, dated June 21, 1972, each member of the Board having received a copy.
Being none, the minutes will stand approved, as circulated.
Warden's Report:
Warden Roupe reported to the Board that the prison will be able to begin a re-
search study on drugs this coming Saturday, Mr. Roupe stated that the insurance policy will
be ready this afternoon for Mr. Capano's inspection. Mr. Roupe presented the following items
to the Board for their inspection: samples of consent forms, samples of various schedules
used in this study, a list of drugs being used in this study, and a list of the names of 36 prison-
ers who have signed consent forms to participate in this study, and a letter from James P.
Maloney, President, Drug Research Associates.
Remarks:
Mr. Paluso: For the record, do you think we could have it in somewhere, Mr. Capano, that
you have perused the contract and it absolves the County of any liability. I think that was in
the last minutes.
Mr. Capano: Well, it isn't exactly the way I wanted it, but never the less, I believe we have
enough protection. They have agreed to indemnify the County in the event a suit is filed, they
are going to have a bond. That would give us adequate protection.
Mr. Paluso: I think this statement by the Solicitor should be in the records.
Mr. Paluso requested the letter of responsibility from Mr. Maloney, President,
Drug Research Associates, Inc., to be made a part of the minutes. Said letter attached on
Page 2 -A.
Mr. Roupe stated that the population has increased to 131 prisoners, 11 work
release prisoners, and 27 weekend prisoners. Mr. Roupe stated that in the first six months
of this year we have earned over $4, 000 for federal prisoners keep, $1, 200 from the City of
Washington, and $1, 920 for room and board for the work release prisoners and weekend
prisoners. Mr. Roupe stated that there has been no word on the capture of the two escapees.
Judge Gladden stated that at the last Prison Board meeting, Commissioner Paluso
and Sheriff Debreczeni were appointed to make an inspection of the Prison, but were unable
to make the inspection because of other commitments. Judge Gladden requested that Commis-
sioner Paluso and Sheriff Debreczeni report their findings to the Prison Board at its next
meeting.
Mr. Flynn stated that in regard to Pennsylvania Labor Relations Board Matter
and what progress has been made with the -jail guards, that an election was held and the em-
ployees voted 10 to 2 for a union, but three of those voting could be contested. Mr. Flynn
stated that the Commissioners are retaining the services of a labor consultant for all County

union matters. Mr. Paluso stated that this labor consultant will also serve as a negotiator
for the Commissioners in all County union matters.
Warden Roupe recommended that Frank Valla, who has been working on a per diem
basis ag guard, be employed on a full time basis.
Moved by Mr. Debreczeni, seconded by Mr. Paluso, that Frank Valla be employed
as a full time guard, effective July 24, 1972, at the Washington County Prison at a salary to
be determined by the Salary Board.
Motion carried by unanimous vote cast by the Board, signifying their approval
verbally by stating "Aye. "
Prison Bills for the Month of June 1972:
Prison bills for the month of June 1972 were read by Deputy Controller Criquellion
in the amount of $4, 701. 57 (2837 Prison Days); a list of said bills attached hereto and made a
part hereof.
