BEVEC, JOHN MAZZA, COMMISSIONERS Minute No. 19-P Office of the County Commissioners Washington, Pa., July 16, 1975 The regular monthly meeting of the Prison Board of the County of Washington was held in the Public Meeting Room at 11:30 a.m. , July 16, 1975, with the following members being present: Judge DiSalle; Commissioner Flynn; Judge Gladden; Com- missioner Jones; Controller Mascara and Commissioner Paluso. Absent being: District Attorney Costa; Sheriff Debreczeni; Judge Hanna; Judge Simmons and Judge Sweet. Also being present: Warden Roupe; Chief Clerk and County Administrator Whalen; County Solicitor Gilmore; Bob Robertson of the Observer -Reporter; Earl Bugaile of WKEG Radio and Phil Angelo of the Daily Notes. Meeting called to order and roll call taken: Mr. Costa - Absent; Sheriff Debreczeni - Absent; Judge DiSalle - Present; Mr. Flynn - Present; Judge Gladden - Present; Judge Hanna - Absent; Mr. Jones - Present; Mr. Mascara - Present, Mr. Paluso - Present; Judge Simmons - Absent; Judge Sweet - Absent. Secretary Paluso stated that in the absence of the Chairman and the Vice - Chairman of the Washington County Prison Board, Judge Gladden was designated to act as temporary chairman for this meeting. Acting Chairman asked if there were any corrections, additions or omissions to Minute No. 18-P, each member having received a copy. Moved by Mr. Flynn, seconded by Judge DiSalle, that Minute No. 18-P be approved as circulated. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye.I' (Secretary Paluso left the meeting.) Prison Bills for the Month of June, 1975: Prison Bills for the month of June, 1975, in the amount of $7, 452. 76, (Prison Days - 3480). FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS Moved by Commissioner Jones, seconded by Judge DiSalle, that the bills for the month of June be paid. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye." Warden's Report: Warden Roupe stated that operations in the jail during the month of June were normal. Warden stated that constructive improvements have been made. Warden stated that the recreation yard has been completed; this will comply with the act which states that the prisoners shall have exercise in the open air for two hours daily. Warden stated that the Board should be complimented because this is the first time in the history of Washington County that the Jail has had a recreation yard for the inmates. Warden stated that this should relieve the tension of the prisoners and should be good fo the morale. Remarks: Judge DiSalle asked if there will be any equipment in the recreation yard. Warden stated that Mr. Hunter Severding of the YMCA has been over and offered his services to lay out the basketball and handball courts, and other equipment whitrh will be safe and not usable as weapons. Warden stated that this will come out of the Prisoners Welfare Fund. Warden Roupe then stated that on July 4, 1975, Reverend Van Riper donated pies, cookies and soft drinks for the inmates. Warden Roupe stated that the plumbers, roofers, and other men have been very cooperative. Warden stated that there were broken pipes that needed valves, the roof was leaking, and that the guard tower in the jail yard is being constructed. Warden stated that this should be completed within the next two or three weeks. Remarks: Judge DiSalle asked what fund the equipment and other materials will be paid from. Warden stated that it will be paid from the Prisoners Welfare Fund. Judge DiSalle asked Solicitor Gilmore if he knew of any problems with paying for the equipment for the Prison Yard from the Prisoners Welfare Fund. Mr. Gilmore stated that he did not know of any, but that he had never looked into the matter. Judge DiSal suggested that Mr. Gilmore do some research on this matter. Old Business: None New Business: Solicitor Gilmore stated that Warden Roupe, Deputy Warden Johns and Captain Witzeling have been served with a summons of a complaint by a prisoner from the U. S. District Court. Mr. Gilmore stated that the prisoner is now incarcerated at Western Penitentiary. Mr. Gilmore stated that it is a complaint under the Civil Rights Act against the three named above for their alleged treatment of Robert Carl Maxwell. BEVEC, JOHN MAZZA, COMMISSIONERS Mr. Gilmore further stated that he has entered an appearance for the three men and' filed an answer. Mr. Gilmore stated that because of the situation, he imagined that Maxwell was acting without counsel and that the trial will have a federal result. Mr. Gilmore stated that he has talked with the Assistant Solicitor of Allegheny County and he stated that usually in the situations where they haven't appointed an attorney, the case would be settled in some kind of a trial. Remarks: Judge DiSalle asked if it was possible that we have some type of insurance to cover this. Mr. Gilmore stated that he did not know of any specific policy in the Jail, but that he didn't think the general liability policy covered this. Mr. Gilmore stated that the complaint is generally unfounded and that the man -had psychiatric problems. Judge Gladden asked if the Board should authorize Mr. Gilmore to act on behalf of the Prison Board and allow him compensation. (Discussion was held.) Mr. Mascara stated that we should take action and appoint Mr. Gilmore to represent the Prison Board. Moved by Mr. Mascara, seconded by Judge DiSalle, that County Solicitor Gilmore be appointed to act on behalf of the Prison Board to represent Warden Roupe, Deputy Warden Hanna Johns and Captain Witzeling. Motion, carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye." Meeting adjourned.
