BEVEC, JOHN MAZZA, COMMISSIONERS 1 Minute No. 1-P Office of the County Commissioners Washington, Pa. , January 21, 1976 The regular monthly meeting of the Washington County Prison Board was held on Wednesday, January 21, 1976, at 11:30 a. m. , in the Public Meeting Room with the following L members being present: Judge Bell; Sheriff Debreczeni; Commissioner Flynn; Judge Gladden; Controller Mascara; Commissioner Morgan; Commissioner Paluso; Judge Simmons and Judge Sweet. (Judge DiSalle and District Attorney Costa entered the meeting later. ) Also being present: Warden Roupe; Reverend Ed Nicholson, Reverend Norman Johnson; Bob Robertson of the Observer -Reporter; Phil Angelo of the Daily Notes and Earl Bugaile of WKEG Radio. Chairman asked if there were any corrections, additions or omissions to Minute No. 24-P, each member having received a copy. Moved by Judge Gladden, seconded by Judge Simmons, that Minute No. 24-P be approved as circulated. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye. 11 Chairman referred to the last meeting in which the matter of alcahol being available at the Jail was discussed. Chairman stated that he has, a statement from James Williams which he will turn over to the new officers to continue this matter. Election of Officers: Chairman: Judge Bell nominated Frank Mascara for the office of Chairman for the year of 1976. Moved by Mr. Paluso, seconded by Mr. Morgan, that Mr. Mascara be elected to the office of Chairman of the Washington County Prison Board for the year of 1976. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye. t1 (Judge DiSalle entered the meeting. ) Secretary: Mr. Mascara nominated Mr. Morgan for the office of Secretary for the year of 1976. Moved by Mr. Mascara, seconded by Judge Gladden, that Mr. Morgan be elected to the office of Secretary of the Washington County Prison Board for the year of 1976. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye. 11 482 SALA' 'RY:MINU'TE,B00K BOARD OF COUNTY COMMISSIONERS WASHINGTON _COUNTY, PENNSYLVANIA MICHAEL R, FLYNN, JOHN P. $EVEC, JOHN MAZZA, COMMISSIONERS Vice -Chairman: Judge DiSalle nominated Judge Bell for the office of Vice -Chairman for the year of 1976. Moved by Judge DiSalle, seconded by Judge Simmons, that Judge Bell be elected to the office of Vice -Chairman of the Washington County Prison Board for the year of 1976. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye. " Sheriff Debreczeni then asked Chairman -Elect Mascara to conduct the balance of the meeting. (District Attorney Costa entered the meeting. ) Appointment of Warden: Judge Sweet made a motion that the Chair appoint a search committee to look for a warden who can serve for some indefinite period of years; that this warden be somebody with some professional training and actual experience in the field of penology, and that we ask Nfr. Roupe to continue to serve for the period, perhaps a fairly extended period, while the search committee is entering upon its work. Motion seconded by Mr. Paluso. Remarks: Judge Simmons asked if Mr. Roupe did not want to serve as Warden anymore. Warden Roupe stated that he will continue for a year or so. Judge Simmons stated that he could not under- stand why the Board could not appoint Warden Roupe as Warden, and then if they want to have a separate motion to look for somebody in the future, then that would be in order. Judge Simmons stated that it seems that they don't have confidence in Warden Roupe. and that he thinks if Warden Roupe wants to serve another year, that the Board should appoint him for another year. Mr. Costa asked if Warden Roupe was willing to continue to serve as Warden. Warden Roupe stated that he was. NIr. Flynn stated that he believes the statute requires that a warden be named. Mr. Flynn also stated that he thinks it is a personal affront to Warden Roupe to even ask him to serve under these conditions. Judge Simmons stated that he agrees with this. Johnson Chaplain Remarks: Judge DiSalle asked if this involved any changes. Warden Roupe stated that it did not. Judge Gladden asked if it was the policy of the Prison Board at this time to appoint a chaplain. Sheriff asked if the chaplain was a salaried employee. Warden stated that he was not. Sheriff stated that he wouldn't be recognized in this motion. Chairman stated that the Warden was merely stating who the chaplain will be. Moved by Mr. Flynn, seconded by Judge Simmons, that the Board accept the above recommendations made by Warden Roupe regarding the jail personnel. Motion carried unanimously. Warden's Report: Warden Roupe stated that during the past month, operations in the jail have been normal. At Christmas, students at the Eighth Ward School donated fruit and candy, and the Salvation Army donated gifts to the children of the inmates that were confined, and Soul's Harbor Lighthouse donated baskets. W 484 SALARY,MINU�TE BOOK BOARD OF COUNTY COMMISSIONERS,- WASHINGTON COUNTY, PENNSYLVANI,A MICHAEL R. FLYNN, JOHN P. BEVEC, J.OHN MAZZA, COMMISSIONERS' Warden Roupe stated that the 1975 Annual Report is just about completed and will be distributed to the members before the next meeting of the Prison Board. Warden stated that the year 1975 shows an increase in the population of 7401 over 1974. Warden stated that th overall cost of the Prison was $330, 635.19; units using the prai�on contributed $68, 854. 22. per diem cost per day was reduced from $9.19 in 1974 to $8. 65 in 1975. Warden stated that it costs $1.46 per day in 1974 to feed the inmates compared to $1. 43 in 1975. Warden stated that they have a new clotheswasher ordered, and they hope to have it in the next month or so. Warden then asked the Board how to dispose of 10 old televisions that were replaced with new ones. Warden stated that there is no trade-in value on the sets. Remarks: Judge DiSalle asked how many new television sets were purchased. Warden stated that they purchased twelve (12). Moved by Judge Gladden, seconded by Judge Simmons, that the Warden be permitted to dispose of the television sets that have been replaced and have no trade-in value at his sole discretion. Chairman pointed out that the Westmoreland County Jail opening will be extended. Sheriff stated that the jail was supposedly to be completed at the end of this month, but it has now been extended until March. Chairman stated that the total reimbursement from Westmoreland County for the year 1975 was $35, 523. 37, which is an average of $2, 960, and therefore, for a ten month period, the budget should reflect the reduction in departmental earnings of approximately $30, 000 for the calendar year 1975. Chairman stated that there may be a little more than $40, 000 less in earnings as a result of Westmoreland County not sending prisoners to Washington County. Sheriff stated that since we are at the beginning of the year 1976, he thought a motion would be in order for the Board to decide if they want to continue receiving prisoners from Westmoreland County as long as they are in need of our facilities. Sheriff stated that Westmoreland County courts and sheriff's office use Allegheny, Washington and Fayette County jails, but we receive more inmates because of the roads that lead into Greensburg. Mr. Paluso stated that he didn't think it was necessary to take a motion on this because the Commissioners have signed a contract to continue this until they cancel it. BEVEC, JOHN MAZZA, COMMISSIONERS n n Warden Roupe stated that there are a number of locks in the big jail that -needed overhauling. Warden stated thg Mr. Crothers was willing to try to correct the old -type lock devices. Mr. Morgan said that in reviewing the budget, he was going over the various departments as far as employees and salaries are concerned. Mr. Morgan stated that he noticed that the guards in the jail are scheduled for more overtime than any other department. Mr. Morgan asked if there was some problem that it was necessary to pay this much overtime. Warden Roupe stated that they have had four men in the hospital over the holidayE and one matron in the hospital now. Mr. Mcrgax) stated that he was looking at the year end balance. Mr. Morgan ask what could be done to resolve this. Mr. Paluso stated that if you look through the scheduling month by month, you'll find that this is an on -going practice every single month of the year. Mr. Paluso stated that he understands that some people only work certain shifts - that's part of the problem. Mr. Paluso stated that they think that this could be cut down considerably because there is a tremendous amount of overtime. Mr. Paluso stated that if you look at the actual work schedu you will see that no one is losing any money, but everybody is gaining, even though they are absent. that it, was. Judge DiSalle asked if this was time and a half overtime. Mr. Morgan stated Warden stated that he has to go by the union contract. Chairman stated that he has had experience in industry that there is a way that you can get an abundance of overtime by working in collusion with other employees to call in sick when you're really not sick, and it will necessitate the employee working a double shift and thus being paid overtime. One hand washes the other, and the next time, he'll get the overtime by calling in sick. Mr. Morgan asked if there were plans to rectify this situation in the future. Judge Sweet asked if there was any possibility of requiring physical examinations of these people so that we don't run a permanent binnacle list next year. examinations. Chairman asked if it was the prerogative of the Board to require physical Mr. Paluso suggested that perhaps the committee that investigates the various examinations would run into an expensive problem. Mr. Costa stated that it is required that when someone misses a day's work, he is required to produce a certificate from a doctor stating that he was ill on that particular day. Mr. Flynn stated that he is required to produce a certificate from the doctor a a period of three (3) days. (Deputy Controller Daniels entered the meeting.) Mr. Paluso stated that he thinks it should be the responsibility of the committee to investigate all of these matters that were discussed today, and make recommendations at the next meeting. Chairman stated that he was wondering that if the people who are handling food at the jail are required by law to be examined. Warden Roupe stated that only the guards that handle food are required to have a physical. Mr. Flynn stressed that we are under union contract and could be accused of discrimination if we try to make a separate policy regarding the jail personnel. Moved by Mr. Paluso, seconded by Judge DiSalle, that the Chairman appoint a Committee to investigate the overtime situation at the jail and the possibility of physical examinations. Remarks: Warden Roupe stated that he must call the guards for overtime in order bf their seniority. Judge Sweet stated that they know who will be called next to work overtime. Chairman asked the following persons to serve on the Committee: Judge Bell Mr. Paluso and Sheriff Debreczeni. Chairman stated that the Courts appointed a Board of Visitors last year and stated that he felt that a committee comprised of members of this Board is tantamount to investigating ourselves. Chairman stated that he would like to recommend that the Board of Visitors be consulted on some of these matters regarding complaints in the Jail. Chairman stated that the Board of Visitors should be contacted to review the results of the investigation. Chairman, stated that he will serve as ex-officio on this Committee. (Discussion was held.) Chairman suggested that the Courts review the members of the Board of Visitors and either re -appoint the same ones or appoint new ones and give the Prison Board a list at th next meeting. Old Business: Warden Roupe then read a letter dated January 19, 1976 from Attorney William Porter which stated that he has received a letter signed by nineteen residents of the Prison C SALARY MINUTE BOOK 41�7 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS 1 1 1 asking that Reverend Nicholson be permitted to continue conducting services or Bible study sessions at the County Jail. Remarks: Warden Roupe stated that it has been a practice in the past to welcome all religious organi- zations -at the Jail on a one-to-one basis. Warden stated that the Jail does have a Chaplain, Reverend Johnson, appointed by the Council of Churches who is working with the Bureau of Corrections Chaplains on the services for inmates. Warden Roupe stated that he has nothing against Reverend Nicholson, and that he has had a few services at the Jail on Tuesday after- noons. However, Warden stated that we do have a Chaplain that comes every Thursday. Warden Roupe stated that both Reverend Johnson and Reverend Nicholson are present at the meeting. Warden Roupe stated that they do have a number of ministers coming in, but they don't have the guards to stay with them. Warden Roupe stated that it was up to the Board to resolve this matter. Warden Roupe stated that his recommendation is to continue with the chaplain and have Mr. Nicholson on a one-to-one basis. Judge Gladden stated that this is something that the people feel rather strongly about. Judge Gladden stated that Reverend Nicholson stopped to see him yesterday and stated that he has had an opportunity inthe recent past to have services in the Prison. In light of the fact that Mr. Porter has written to the Warden indicating that there are 19 men in the Jail who would want to have the benefit of the service, Judge Gladden stated that he thinks that it warrants discussion. Judge Gladden stated that he believes that it is Reverend Nicholson's impression that he has not been permitted to continue with the services of the Jail because he is not a member of the Council of Churches. Judge Gladden stated that he can see the danger because there are 700-800 churches in the County, and stated it probably would not be possible for all 700 ministers if they wanted to conduct services in the Jail to do so. Judge Gladden stated that there has been a request made for Reverend Nicholson's services, and that he thinks that we should establish some type of policy. Mr. Flynn asked if Reverend Johnson was assigned by the Council of Churches and designated as the Prison Chaplain. Chairman stated that this was correct. Mr. Flynn stated that when he conducts services in the Jail, anyone can attend. Mr. Flynn stated that if Reverend Nicholson came in to see a prisoner, then he has a right to consult with a prisoner, but he doe; not have an open congregation to conduct services. Judge Gladden stated that he presumes that if Father McKenna wanted to conduct mass in the Prison he would be allowed to do so. Warden stated that he has done this. Judge Gladden stated that a rabbi could also come into the Jail and conduct services. Judge Gladden further stated that we do have other people conducting services in the Jail. Warden stated that this is on a one-to-one basis. Warden stated that the rabbi sees the inmates one at a time, he does not conduct mass. Chairman stated that if there are 19 prisoners at the Jail, who wanted to meet with Reverend Nicholson, he thought that they should not be denied. Reverend Nicholson said that he contacted Warden Roupe about the possibility of holding services. He had been counseling individuals for some months. Reverend Nicholson stated that he was told by Warden Roupe that it was very possible that he wouldn't have too much in interest in it. Reverend Nicholson said that services have been going on for some time. Reverend Nicholson said that Reverend Johnson approached him several weeks ago and gave him an ultimatum - either he join the Council or stop preaching. Reverend Nicholson wanted to know what right the Council of Churches has to dictate to the Prison Board who is going to handle the teaching of the Prison. He stated that he does not want to be the chaplain, he just wants the right to preach to these men. Reverend Nicholson stated that he has always had between 14 and 22 men attending these services. (Further discussion was held. ) Judge Simmons stated that he thought Reverend Nicholson should have the right to preach like everyone else. Chairman stated that this worked until the time that the Council of Churches stepped in, and if it was working under those conditions, it should continue to work. Reverend Johnson stated that he did not say to Reverend Nicholson that they were asking him to join the Council of Churches; he simply said to him that he sought his support and understanding. Reverend Johnson stated that he did not want to duplicate services for the men. (Reverend Johnson then read from the constitution of the Council of Churches regarding the purpose of the Council.) BEVEC, JOHN MAZZA, COMMISSIONERS Corrections stated that they would like to have the names of the ministers who would like to preach at the Jail so that they could set up a seminar to instruct the chaplains as to the beneficial needs of the prisoners. (Further discussion was held between Reverend Johnson and Reverend Nicholson.) Judge Simmons stated that it is the constitutional right of the prisoners to chose the minister they want. Chairman stated that he agreed with Judge Simmons. Mr. Paluso asked Warden Roupe if he could arrange for Reverend Nicholson to have an hour, on Tuesday evenings, regularly scheduled, and for Reverend Johnson to continue his regular schedule. Warden Roupe stated that he would have to arrange it for Tuesday afternoon. (Further discussion was held.) Moved by Judge Gladden, seconded by Judge Simmons, that in light of the requests made by the prisoners, that the Warden be directed to schedule Reverend Nicholson to conduct regular services with the prisoners on a weekly basis. Motion carried. Old Business: Chairman asked what the disposition was of the litigation in Federal Court concerning Warden Roupe. Warden Roupe stated that it was postponed. Judge DiSalle stated that Mr. Gilmore told him that it was coming up the first part of March. Chairman stated that he read in the Washington Observer about the Offender Aid funds that may be approved. Chairman stated that since the November meeting when he made a motion in that regard, he talked with several individuals concerning the pro- gram. Chairman stated that it was agreed that the motion was made subject to approval by the sub -grantee, which is Washington County. Chairman stated that he has looked into the matter and found that there are projected costs of approximately $125, 000 in three years and with the funding which goes to 25-75 the third year, the cost could be considerable to the County. Chairman stated that he wasn't aware that we had a counselor down there by the name of Danny Walter and that Anthony Luppino also volun- teered to work down there for the same program, and that we have the V.I. P. involved there. Remarks: Judge DiSalle stated that he chaired the meeting of the Governor's Justice Commission last Thursday where they considered that application. Judge DiSalle stated that the Council rejected the application without prejudice to the right of the applicant to re-submi it at next month's meeting. Judge DiSalle stated that Council insisted on the signature of the Chairman of the Board of Commissioners and there was some question about the 10% share of the applicant as to whether it qualifies. MINUTE BOOK 4`39 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS 1 E 1 Chairman stated that the total buy -in for the first year is $33, 734 and they project that to be at $215, 000 in three years. Mr. Flynn asked if he was referring to the program involving Mr. Peyton Schur. Chairman stated that this was correct. Mr. Flynn stated that his understanding was that. according -to his presentation, there was no cost to the County at all. Mr. Paluso then referred back to the meeting in November where there was a motion made by Mr. Mascara, seconded by Mr. Flynn, that the Prison Board adopt the Offender Aid and Restoration Program at the Washington County Prison pending approval by the subgrantee, the Board of County Commissioners of Washington County. Mr. Paluso stated that at a subsequent meeting of the Washington County Board of Commissioners an application was submitted with a provision that Washington County would not assume any financial obligation in this program either now or anytime in the future in connection with the OAR Program. Subsequent to that, the presentation application was submitted to the Governor's Justice Commission by Mr. Schur with the proviso that the Hearst Foundation was providing the match money. Mr. Paluso stated that to his knowledge there is no documentation - there is no money. Mr. Paluso stated that it is his personal feeling that there will be no money expended through this County until in fact the matching money is deposited with the County, and up to this time, to his knowledge, there is no proof that the money will ever)pbPoduced. Mr. Flynn stated that the Board of Commissioners was , not involved in any way financially. Mr. Paluso stated that this is neither now or in the future because the grant.... their buy -in this year will be $3500 if they get it from the Hearst Foundation. Next year, the cost of the Program is $60, 000; the Justice Commission will only come up with 75% instead of 90%, and the following year - 50%, and the following year - where is the $125, 000 going to come from? Mr. Paluso stated that his motion at the Commissioners' meeting was that now or in the future, this County will not assume any financial obligation in this Program. (Discussion was held. ) Mr. Peluso stated that to his knowledge, there is no documentation that any of these gentlemen connected with this represent any organization. Mr. Paluso stated that he has to go by the worc of someone that there is even such a group. Mr. Flynn stated that on the basis of the recommendation and the action taken by the Prison Board, the County Commissioners followed through at their next meeting, and did approve the application per se, and they would be the sponsors with the stipulation that specifically states that there will be no obligation on the part of the County because the money was supposed to be forthcoming from this foundation. (Further discussion was held. ) Mr. Paluso asked if any of the members had any proof that any of these men represent any body. Mr. Paluso asked if anyone has a letter of intent from the Hearst Foundation stating that they are going to come up with this money. Judge DiSalle stated that at the meeting of the Council last Thursday, Mr. Schur was present with a man who identified himself as the National Director of this Program. Judge DiSalle stated that based on what they did, unless Mr. Morgan signs this, there will not be any funds. Mr. Paluso asked Judge DiSalle about the procedures of the Council on applications. Mr. Paluso asked if there was any investigation done to know that someone didn't invent this and submit it to them for a grant. Nfr. Paluso asked if it was true that the State has not approved this organization. Judge DiSalle stated that he did not know if the State has approved this. He stated that when an application comes in, they assign one of their staff to investigate it. Judge DiSalle stated that this is the basic reason why the Federal Government insists on dealing only with a municipal government because they can look to the Board of County Commissioners. Judge DiSalle stated that they assume that the, Board of Commissioners have investigated this and that they would not have made the application if they were not satisfied that they were dealing with a responsible agency. (Further discussion was held. ) Chairman suggested that the Board contact Mr. Luppino for answers in regard to funding. Mr. Paluso then read part of the minutes of the November meeting as follows: Sao MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK .TONES, .JR., EDWARD M. PALUSO, COMMISSIONERS Mr. Schur: "May I first say that the least reduction in recidivism in ay program that OAR has been invovled in, in any county, has been 46%. The budget for Washington County Jail or the amount of money spent last year was almost $304, 000. The least amount that OAR could reduce the expenditure in the jail, and any jail, has been 21%. So this program is going to reduce the cost of operating your county jail by a certain amount. And if it does so, I could not see why there would be`any objection to the County picking up the part that it has saved the County. I will first of all tell you, that I don't think it's going to be necessary for the County to pick up any thing if they don't want to, but I would think that it would be the obligation of the County Commissioners to help the program. " W. Paluso further stated that he doesn't think that there has been enough investigation into this. Mr. Paluso stated that he has only heard of one place where this program was ever instituted,- Fairfax County, Virginia - and there is no proof of this. (Further discussion was held.)
