PALUSO, COMMISSIONERS 1 1 Washington, Pa., Jul-r 7, 1976 An emergency meeting of the Washington County Prison Board was held on Wednesday, July 7, 1976 at 11:35 A. M. in the Public Meeting Room with the following members being present: Judge Sweet, Judge DiSalle, Judge Gladden, Judge Simmons, Commissioner Morgan, Commissioner Gilmore, Sheriff Debreczeni and Controller Mascara. CHAIRMAN: I was called to the jail by the Warden. Walter Marm and Pit Johns were present also. This was in regard to $105. 98 being stolen from a week -ender. They want the Board to do something about this. They have a pretty good idea who is responsible for this. JUDGE SWEET: CHAIRMAN: Is there any evidence? Only circumstantial. I understand that this is not the first time. There is also food and other things being taken out of the jail. JUDGE SIMMONS: JUDGE DiSALLE: CHAIRMAN: JUDGE SWEET: discharge this person? C HAIR MAN : JUDGE SWEET: What kind of evidence do you have against this suspect? Is the suspect an employee or another inmate? He is an employee. Do you have enough evidence, in your opinion, that we could In my opinion, no. Do you think if we had some sort of hearing that enough evidence could develop to discharge him? CHAIRMAN: JUDGE DiSALLE: JUDGE SWEET: I think so, but I do not know what the Union's position would be. What does the contract say? There is a just -clause of dismissal. We could appoint a person to hold a hearing on this subject, and if he is convinced beyond a preponderance of probability that the suspected person had committed the theft, the Prison Board could fire him and we would not fac6 a strike on that issue. (Further discussion on this was held. ) JUDGE SWEET: I make a motion that the Chairman of the Prison Board be directed to proceed conformably to the contract to have an evidentiary hearing to determine whether or not the suspect is guilty of theft proven sufficiently to justify disciplinary action. If he is guilty, we will take action to discharge him. Motion seconded by Judge DiSalle. (Discussion not reported. ) Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye". PALUSO, COMMISSIONERS JUD GE SWEET: I would like to make a second motion. If, after this good - cause hearing has been held and the Chairman of the Prison Board is of the opinion that criminal charges should be proven against him, we authorize the Chairman to make such charges before a magistrate. JUDGE GLADDEN: I think we are putting the Chairman on a limb, maybe he should have some legal advice. JUDGE SIMMONS: Maybe the District Attorney should make the investigation. JUDGE GLADDEN: I think the Chairman could turn this over to the District Attorney's office. JUDGE SWEET: I would amend the motion to say that after a fair hearing, if enough evidence is produced, it should be turned over to the District Attorney, s office. JUDGE GLADDEN: I second the amended motion. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye". Sheriff Debreczeni brought up that the contract with the Washington Hospital has not been signed yet, and they are giving him a rough time when he takes prisoners up to the hospital. CHAIRMAN: Our Solicitor assured me that the hospital will continue to service us until such time as the contracts are signed, and we will have to take the prisoners to the hospital. The contracts will be prepared today and taken to the hospital. Commissioner Gilmore moved to adjourn. Seconded by Judge Di5alle. Motion carried by unanimous vote cast by the Board signifying their approval verbally by stating "Aye". Meeting adjourned at 12:10 P. M.
