Washington, Pa., January 25, 1968
Board of County Commissioners met in regular session with the
following members being present: Commissioners Bevec and Mazza. Also present
being: County Solicitor Capano, Chief Clerk Kittridge, Public Information Officer
Huber, County Surveyor Yuhas and Reporter Robertson. Absent being Commissioner
Flynn.
Meeting called to order by Acting Chairman Bevec and roll call taken:
Mr. Mazza - Present; Mr. Flynn - Absent; Mr. Bevec - Present.
Mr. Bevec announced that Commissioner Flynn is hospitalized, this
being the reason for his absence.
Chairman asked if there were any corrections, additions or omissions
to Minute No. 4, each Commissioner having received a copy.

Old Business: Mr. Yuhas submitted a report on a recent meeting relative to the
Canonsburg -Houston Flood Control Project; said meeting was held at the Canonsburg
Borough Building on Thursday, January 18, 1968, at 8:00 p.m.., to discuss damages
submitted by the Canonsburg -Houston Joint Sewer Authority. After a lengthy discussion
on the various problems, two-thirds of the problems have been resolved and cost reduced
considerably; a representative of the Corps of Army Engineers, reported that they
would like to get the first phase/of this project under construction by late spring of this
year. Mr. Yuhas also listed those persons present.
Mr. Bevec stated that a report had been received from Special
Counsel, At torney Zeman.
Mr. Mazza: Were all members of Council present?
Mr. Yuhas: Four (4) were present.
Mr. Capano informed the Board that a question had been raised by
the Office of the Controller on the appointment of the Tax Claim Bureau Solicitor meet -
ing the requirements of the law that saya a County Solicitor can make recommendation
for said appointment, at such salary that may be allowed by the Salary Board (appointment

made p er Minute No. 4, dated January 18, 1968. ) In the discussion that followed, the
Board was of the opinion that the Tax Claim Bureau Solicitor was appointed by the Board
of County Commissioners without the authorization of the County Solicitor, exception
being that they must consult him on any appointment of Special Counsel.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the motion
whereby the Tax Claim Bureau Solicitor was appointed at the meeting held January 18,
196810 by the Board of County Commissioners, be rescinded.
Mr. Capano: I hereby notify the County Commissioners, that I recommend for
appointment as Solicitor in the Tax Claim Bureau, William C. Porter in place of Sanford S.
Finder, this action to be effective January 15, 1968.
As recommended by the County Solicitor, moved by Mr. Mazza,
seconded by Mr. Bevec, that William C. Porten be appointed as Solicitor in the Tax
Claim Bureau; this action to be effective January 15, 1968.

Letter under date of January 19, 1968, from Peter F. Jollick,
Superintendent, Washington County Home and Hospital for Men; notified the Board that
the name of George McCrary was to be deleted from the County Home payroll, effective
January 11, 1968, due to dismissal.
Chief Clerk requested authorization to Secure quotes from the three
local banking institutions for the borrowing of one million dollars on a take -down basis.

Chief Clerk presented a request from the Washington County Child
Welfare Services to the Board for consideration, that the rate of $1. 50 per day be in -
creased to $1. 80 in order to have one rate regardless and to be in the same category
as surrounding counties; present rates are $2. 00 for children requiring additional care-
$1. 80 for babies under two and $1. 50 all other.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the rate of
$1. 50 be increased to $1. 80 per day for the maintenance of children in foster homes that
do not require additional care.

Chief Clerk presented additional field registration dates and areas as submitted by the
Registration Office, to the Board for approval.

Letter under date of January 12, 1968, from Charles F. Hess, Soil
Conservation Director, notified the Board that recently enacted legislation has amended
Act 217, The Soil and Water Conservation Law providing for establishment of local soil
and water conservation districts; under the provision of the amended law, seven directors
shall administer the programs of local soil and water conservation districts. There
shall be four farmer directors, two urban directors and a County Commissioner director.
The terms of the first six mentioned members shall be for four years and their term of
office shall be so staggered that one farmer member's term shall expire each year while
one urban director's term shall expire every second year, the County Commissioners
term of office shall be for one year; any director may be reappointed. The appointment
of directors shall be made by the County Commissioners in the same manner as provided
previously. The principal changes are the addition of two (2) urban directors to a board
of directors that does not currently have an urban director or one additional urban mem -
ber and one additional farmer member to a board of directors that already has one
urban member. In order that a desirable selection of urban directors may be made it
will probably be desirable or even necessary to request approved nominating organi -
zations to submit nominations for urban directors. Appointments should be made not

Moved by Mr. Mazza, seconded by Mr. Bevec, that the Board of
County Commissioners submit a request to the Washington County Soil and Water Con -
servation District, for nominations with regard to the appointment of two (2) urban
directors to the Board of directors of the Washington County Soil and Water Conservation Di Strict.

Letter under date of January 23, 1968 from John F. Cromwell,
Director of the Washington County Planning Commission, requested payment in the
amount of $3, 296. 70 for property in the Mingo Creek County Park which is being acquired
by Washington County.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the sum of
$3, 296. 70 be approved for payment for property acquisition in the Mingo Creek County
Park; check to be made payable to John J. Yenny, Jr., Mary M. Yenny and Paul P. Posa,
their attorney, from the Parks and Recreation Account.

Deputy Controller Whalen entered the meeting.
Notification under date of January 10, 1968 was received from
Mr. L. D. Lambert, Director, Bureau of Municipal Services, subject being Act 385, New
Bonding Requirements to all townships, boroughs, cities and counties. Act 385 approved
by the Governor on December 20, 1967 makes it mandatory that on all contracts in
excess of $5000 the contractor shall furnish the contracting body the following bonds
which shall become binding upon the awarding of said contract to such contractor.
1. For furnishing material only, a performance bond at 100 per
cent of the contract amount.
2. On construction jobs, a performance bond and a labor and
material bond each at the amount of 100 per cent of the contract.
Said act shall take effect in thirty days from date of signing but shall not apply to any
contract awarded pursuant to an invitation for bids issued on or before the date it takes
effect or to any persons or bonds in respect of any such contract. All contracts sub -
mitted to their office for work to be financed wholly or in part by Liquid Fuels Funds
will be returned unapproved if they do not meet the above bonding requirements.
Memorandum under date of January 23, 1968 from John F. Cromwell,
Director of the Washington County Planning Commission subject being Conference of Mon
Valley Elected Officials: The Mon Valley Progress Council requests that the Washington

County Commissioners co-sponsor a Conference of Mon Valley Elected Officials on the
subject of the Mon Valley Expressway and community services. The Westmoreland
County Commissioners are also being requested to co-sponsor the conference. Con -
ference will be held on Tuesday, February 20, 1968 at the Mon Valley Country Club be -
ginning at 5: 00 p.m. A suggested program was attached.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the Washington
County Board of Commissioner s, agree to co-sponsor along with the Westmoreland
County Commissioners and the Mon Valley Progress Council, a conference of Mon Valley
elected officials for the purpose of preparing communities for the Mon Valley Expressway.

Mr. Capano presented a Lease between the County and General
Services Administration covering continued occupancy of approximately 535 square feet
of net usable office space, contained in the second floor, of the building located at 76
West Cherry Avenue, Washington, Pennsylvania, to the Board for approval.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the Lease
between the County and General Services Administration for occupancy of approximately
535 square feet of office space in the second floor of the building located at 76 West
Cherry Avenue, Washington, Pennsylvania, be approved; for the total sum of $780. 00
per year or $65. 00 per month, effective March 1, 1968, and that Acting Chairman Bevec
be authorized to sign said lease. Lease will expire February 28, 1971.

Mr. Capano presented a lease between the County and Mr. Howard C.
Fisher and his wife, Olive J. Fisher concerning the tract of land on which the Washington
County Civil Defense Radio and Air Raid Warning Transmitter site is located in North
Franklin Township, Washington County. Mr. Capano made note that said lease is a re -
newal of a previous lease that is still in effect but being as there are new owners, sug -
gested that it be executed with the new owners for the same period at $400. 00 for the
total period of the lease which is ten (10) years, said sum to be payable in advance.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the Lease be -
tween the County and Mr. Howard C. Fisher and his wife, Olive J. Fisher for a parcel

Motion carried unanimously.
Mr. Capano also presented a lease between the County and the
Washington County Agricultural Fair, Inc, for all that certain tract of land situate in
Chartiers Township known as Arden Downs and the Arden Fair Grounds; a motion was
made, seconded and unanimously carried by the Board for approval of the lease and
following a brief discussion was rescinded, for further study between an associated
lease involving Delvin Miller.
Controller Elish entered the meeting.
New Business:
Mr. Mazza: I would like to bring up at this time, that our Chief Clerk notify
our Director of Redevelopment with reference to a progress report for the year of 1967
and also a progress report from Mr. McKambley on Industrial Development.
Chief Clerk: Arrangements have already been started in this direction, next
week the Director of Civil Defense is scheduled to appear before the Board, the following
week, Parks and Recreation, etc., they are all scheduled.
