SEVEC, JOHN MAZZA, COMMISSIONERS NO. 40 Office of the County Commissioners Washington, Pa. , October 24, 1968 i Board of County Commissioners met in regular session with the following members being present: Commissioners Bevec and Mazza. Absent being Commissioner Flynn. Also present being: County Solicitor Capano, Chief Clerk Kittridge, Deputy Controller Whalen, Public Information Officer Huber, and Reporters Robertson of the Observer -Reporter and Liesch of the Brownsville -Telegraph. Acting Chairman Bevec stated that he wished the records to show that Commissioner Flynn was absent due to illness. Meeting called to order by Chairman and roll call taken: i Mr. Bevec - Present; Mr. Mazza - Present; Mr. Flynn - Absent. Chairman asked if there were any corrections, additions or omissions to Minute No. 39, each Commissioner having received a copy. Moved by Mr. Mazza., seconded by Mr. Bevec; that Minute No. 39 be approved, as read. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes. Motion carried unanimously. Old Business: None. Chief Clerk read letter under date of October 16, 1968 from Michael Kibelbek, President - Washington Association of Downtown Ente rprisers - expressing their sincere thanks for the use of the Court House lawn and rotunda for the performance of the Trinity High School Band, Trinettes and Majoretts and for the display by the Washington County 4-H organization. Chief Clerk read letter addressed to John Cromwell, Executive Director, Washington County Planning Commission under date of October 17, 1968 from T. W. Johnston, Division Manager - West Penn Power Company, thanking Mr. Cromwell for presenting a program on "Highway Planning" to the Peters Township Science Seminar class and stating that the program was both interesting and informative. Moved by Mr. Mazza; seconded by Mr. Bevec; that Cora Douglas be appointed as an additional member of the Return Board for the forthcoming General Election, November 5, 1968. Mr. Capano informed the Board that he had a request from the Treasurer's Office to refund fines that had been paid to the Treasurer for the violation of liquor law by minors. He stated that according to the Act, this money should not have been accepted 292 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS r by the Treasurer's Office as the fine is payable to the City, Township or Borough involved. Deputy Controller Whalen suggested that the money be paid back to the magis - trate and that he should disperse it inasmuch as the money was not received from the person direct. However, Mr. Capano stated that there was a Statute of Limitation on this. Many of these magistrates are no longer in office due to the fact that some of these fines go back several years. The Chief Clerk mentioned that this had been brought to his attention two years ago by the City Solicitor. He requested for the City Solicitor, at that time, to come forward. He further stated that arrangements are in the budget for these payments. Mr. Capano indicated that there is a total amount of $3, 980. 00 in fines collected to be paid after approval; hoav ever, at this time, only three have been requested. Moved by Mr. Mazza; seconded by Mr. Bevec; that the following fines for the violation of liquor law by minors be paid to the political subdivisions involved, Borough of Bentleyville Bradley R. Krosnoff, Solicitor Bentleyville, Pennsylvania CODE 675.1 MINOR LIQUOR VIOLATION Defendant: Joseph Rivak - $25. 00 Donegal Township B. F. Crane, Treasurer R. D. #2, Claysville, Pennsylvania CODE 675.1 MINOR LIQUOR VIOLATION Defendant: Louis Paul Rush - $25. 00 Smith Township Owen McGivern, Secretary Box #237, Slovan, Pennsylvania CODE 675.1 MINOR LIQUOR VIOLATION Defendant: Phyllis Brownfield - $100. 00 Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes. Motion carried unanimously. Solicitor informed the Board that motion adopted September 12, 1968 (See Minute No. 34) increasing the compensation ofkl.ection board members by $4. 00 each (in accordance with Act 211) would now have to be rescinded inasmuch as it is now a question as to whether it is constitutional, i. e. , a) The first consideration is the Statutory Construction Act which post- pones until the next succeeding budget period of local governments the effective date of any act which affects that local government's current budget regardless of an earlier effective date contained in the act. b) The second consideration is the Constitutional prohibition against increases or decreases in salary during the elected term of any public officer. The next term of district election officers will commence in January of 1970. (This is in accordance with Constitution - Section 27. - No Law shall extend the term of any public officer, or increase or diminish his salary or emoluments, after his election or appointment.) 1 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. EIEVEC, JOHN MAZZA, COMMISSIONERS 293 (Controller Elish entered the meeting) Moved by Mr. Mazza; seconded by Mr. Bevec; that motion adopted September 12, 1968 (Minute No. 34) increasing the compensation of election board members by $4. 00 each, be rescinded. Remarks: Mr. Mazza: Already, we have received a great number of inquiries ahout this. It should be spelled out properly. We are sympathetic as far as the increase is concerned but according to law, we just can't do it at the present time. The only people qualified will be the newly elected in 1970. Mr. Bevec: We are restricted by the Constitution as to the acts that are passed and we have no provisions in the budget for this increase. We realize their position but we can't give them a raise until their term of office is completed. We acted in good faith when the act was passed; however, we would be subject to surcharge if we should use a compromise. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes. Motion carried unanimously. Moved by Mr. Mazza; seconded by Mr. Bevec; that the Board of County Commissioners adopt Resolutions commending all those persons concerned with the development of THE WASHINGTON MALL and the 88 TRANSIT COMPANY at Speers, Washington County, Pennsylvania. Remarks: Mr. Mazza: At lease one thousand jobs have been created by the Washington Mall and eighty to one hundred jobs at Speers. These are new developments of which we are very grateful. The Commissioners of Washington County are interested in new jobs whatever they may be. Mr. Bevec: I attended the dedication of the new building of the 88 Transit Company. This is a group of bus drivers who took over the bus business and formed their own corporation. They have built a new terminal which is one of the largest in the area and an asset to the river area. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes. Motion carried unanimously. Complete copies of both above Resolutions on file - File Folder No. 1 - Chief Clerk's Office. Commissioners Mazza and Bevec, together with the Building Superintendent, had looked at property which could be suitable for new or temporary Detention Home. Mr. Mazza stated that he was very impressed with one; however, he did not want to divulge the name of the property owner at this time. He stated that he did wish to inform the public that the Commissioners are doing everything in their power to take care of this situation. S'heriffIs Office Deputy Controller Whalen stated that he had met with the President Judge Alex Debreczeni and the Chief Deputy Sheriff/ who, under the new Act No. 59, effective the 3rd day of May,
