Board of County Commissioners met in regular session with the
following members being present: Commissioners Bevec, Mazza and Flynn. Also
present being: Chief Clerk Kittridge, Deputy Controller Whalen, Mrs. Amor Flenniken,
Director of the Washington County Tax Claim Bureau; Mr. Louis Furman, Supervisor
of the Real Estate Department; Parks and Recreation Director George, Mr. Graham
with Mr. George, Mr. Bourke, Director of the Washington County Re development
Authority; Frank Conte, Esq. , Public Information Officer Huber, James C. McCreight,
P resident of the Washington County Bar Association, Reporters Robertson of
the Observer -Reporter and Lilley of the Daily Notes.

Chairman asked if there were any corrections, additions or omissions
to Minute No. 53, each Commissioner having received a copy.

Regular order of business dispensed with in order that Attorney McCreight might be
presented to the Board by the Chairman.
Mr. McCreight made reference to Act No. 358 of 1968 adopted by the
legislature concerning implementation of the revised constitution effective January 1,
1969-it provides a mandatory appointment in each county of a Public Defender by "the
Board of County Commissioners. In explaining the program that has to do with the
rights of impoverished::, adults and juveniles involved in crimes, Mr. McCreight
stated that the Public Defender after his appointment may then provide for as many
full or part time assistants as he may deem necessary subject to the approval
of the County Commissioners, as his duties will consist of a very wide spectrum
of work ( practically all of the legal proceedings).
Mr. McCreight: This is a very important new department in Pennsylvania
Law; it has been coming for some time. Attorneys were of the opinion that it was
their obligation to handle cases with regard to impoverished persons concerning
legal defense, however this method of handling has been tremendous. For the past
2 or 3 years, we have had a method -)of providing such legal defense with the
assistance of the County, the fees were modest but because of the increase in crime
rate, changes in criminal and new constitutional respon sibility, is has created
a heavy broadtaking; during the time mentioned 240 cases were handled at a cost
of $9, 000. 00. Because of the impOrtance of the Public Defender's office, it will be
a busy office. In the establishment of the office, their personnel, the Commissioners
have an opportunity to set guide lines to make this an effecient and effective office
with regard to the civil rights for those persons that will be involved; the Bar
Association will be most helpful where ever possible. This mandatory office will be
a fairll large one; the Washington County Bar Association stands ready to help.
Mr. Flynn: We appreciate your accepting the invitation to appear at our meeting
and we are asking you in your bosition as President of the Bar Association and your
various committees, to submit to the County Commissioners such guidelines, advice
and counsel in establishing this office. Will you consider this a request to so submit

Mr. Bevec: With reference to the filling of this position, it means that we are
going to have some assistants?
Mr. McCreight: I believe you are right.
Mr. Bevec: This thing as it gets off the ground should be done in the right manner.
Does the Bar Association have any way of recommending a list of names so that these
fellows are fairly well qualified to handle criminal cases ?
Mr. McCreight: W& have no existing committee for that purpose; if you wish
we will try to submit a list of attorneys that are capable and experienced. WE will
be glad to be of any help we can.
Mr. Mazza: Do you feel under this Act it will be equivalent to or larger than the
District Attorney's office?
Mr. McCreight: It could in terms of personnel or expenditures be nearly
equivalent, I don't think it will be larger.
Mr. Mazza: _Xi With regard to our budget, I think the public is entitled to know the
various mandates that are being put on the County Commissioners. If it is equivalent
to the District Attorney it means a quarter of a Mill or $70, 000.
Mr. McCreight: Whatever I might say about the size and cost is my own
opinion. Perhaps the Bar Association can give the Commissioners a firmer figure.
On the basis of what I have been informed, the warranted size of the office would
be probably just slightly smaller and slightly less expensive than the District
Attorney's Office.
Mr. McCreight left the meeting.
Washington Central City Project, Pennsylvania R-98:
Mr. Roland Bourke, Director of the Washington County Redevelopment
Authority, presented drawings to the Board concerning Disposition Parcel No. 10
submitted by the Jefferson Avenue Methodist Church, making note that he had met
with representatives of the Department of Housing and Urban Development, their
attorney and his attorney; the federal government is asking them to come before the
County Commissioners t6 review each parcel disposition and adopt a resolution.
Mr. Bourke: We required the Church to let us know what they were going
to do with the additional piece of land we will sell them; they agreed to resurface and
put in parking. For the first time they are going to have some off street parking that
is quite attractive; the property is approximately 13, 000 square feet-$4, 785. 00 is
the cost we are going to sell to the Church.

Mr. Conte: In compliance with HUD, on each parcel that is disposed by the
Redevelopment Authority, we should get approval on each parcel and adopt a resolution in
connection with the same; the resolution approves the contract documents involved,
Messrs. Bourke and Conte also explained that the City, Borough
and Township redevelopment authorities are not involved because in accordance with the
Act, the governing body that establishes the County Redevelopment Authority acts as the
Agent.
Mr. Conte: The proceedings are advertised, and all of those involved are aware of the
various plans.
Moved by Mr. Bevec, seconded by Mr. Mazza, that the resolution
approving proposal for Redevelopment of Disposition Parcel No. 10 submitted by the
Jefferson Avenue Methodist Church and the Form of the Redevelopment Contract with
said Developer, be approved and adopted.
Roll call vote taken:
Mr. Bevec-Yes; Mr. Mazza -Yes; Mr, Flynn -Yes.
Motion carried unanimously.
Mr. Flynn: I would like to suggest that prior to our meetings, since this is a new
regulation we are enlightened before the presentation.
Mr. Bourke: It will be the same form resolution with the necessary insertions, but
you will receive it a couple of weeks in advance.
Messrs. Conte and Bourke left the meeting.
Old Business: Awarding of carpeting contract,
Mr. Kittridge: On November 21, 1968, the Controller opened bids on various
remodeling at the Commissioner's Offices, on November 28, 1968 bids were awarde for
four (4) contracts, all except the carpeting which was held up until the bidders submitted
samples of their carpet. Letter under date of February 5, 1969 from Gretchen H.
Anthony, R. A., informed the Board of Commissioners that the sample received from
the three (3) low bidders for the Carpeting Contract for the Renovation the Commis-
sioners' and Chief Clerk's Offices, had been examined; although the Acrilan was the
lowest bid, they feel that the wool is a better buy because it normally wears longer,
looks better, develops less static electricity and is in general, a better carpet; therefore
it is recommended that the contract be awarded to the second lowest bidder and the
lowest bidder for wool carpeting, J. G. Appliance and Furniture.

the amount of $3, 384. 57 as set forth in their bid; this being the lowest bid received
and being in accord with our specifications.

Note was made that the County must be cautious when bids are accepted
for coal with regard to the price involved so that the County at a later date ( if necessary)
would not have to repurchase the property at a much higher price. Mrs. Flenniken
made note that the coal in question had been off the tax records since 1940.

Mrs. Flenniken presented and reviewed the annual bookkeeping reports from
the Real Estate Department and the Tax Claim Bureau with the Board, showing
collections, distributions, breakdown of balances on hand and recapitulation of Distributions.
Real Estate Department - January 4, 1968 to January 2, 1969:

Mr. Mazza: Is there any delay in getting these payments to the various districts?
Mr. Flenniken: No; we are up to dtLte.
Mr. Mazza: Are we receiving enough money to off -set the work we are doing for the
school and other political municipalities?
Mrs. Flenniken: No; not in my opinion.
Mr. Bevec: We are limited to 4% commission.
Mrs. Flenniken: 4% is allowed as the collecting fee by law, it could be increased by
legislation or by raising the cost of claims.
Mr. Mazza: I think we should amend it so that it will make it worth our while.
Note was made concerning the expenses to the County to collect the larger
portion for the school district; however, Mrs. Flenniken stated that their office is self -
efficient.
Mrs. Flenniken and Mr. Furman left the meeting.
Chief Clerk presented two (2) park resident, leases to the Board for consider-
ation and approval; involved would be Thomas O'Rourke at Mingo Creek and Thomas J.
Felak at Cross Creek County Park, both park employees.
Mr. George made note that the leases had been revised somewhat, from the
driginal leases.
In discussing the matter of a house provided for the park employee as part
of their salary, Mr. Whalen stated that if it is a part of their salary, they must pay
social security and withhobding tax; if it is a very definite condition of their employment,

Letter under date of February 4, 1969 from Howard H. Peppel, M. D. ,
Superintendent, Western State School and Hospital, stated that the closing of the valve at

the juncture where their 8' line enters the 14" line to Alcoa Dam is permissible during
repairs of said line; and it is understood that the line will be in service by May 1, 1969.
Moved by Mr. Bevec, seconded by Mr. Mazza, that a survey of the 8-inch
line at Morganza and in connection with Phase One of the Chartiers Creek Flood Control
Project be authorized.
Remarks:
Mr. Flynn: McClelland and Yuhas Associates, have been doing the work; however, the
question has been raised if there is a conflict of interest. I don't think so.. the work is
not done on County time and', -he doesn't create the work, it is necessary.

the director of industrial development and the director of the county planning commission;
Mr. Flynn is our commissioner member.

Letter dander date of January 29, 1969 from W. Astor Kirk, Regional
Director, Office of Economic Opportunity, Mid -Atlantic Regional Office, informed the
Board of Commissioners, they had reviewed the documentation submitted in compliance
with the requirement of Sections 210 and 211 of the Economic Opportunity Act of 1964, as
amended, as those requirements were spelled out in Community Action Corporation full
recognition as the community action agency to serve Washington and Green County.
Letter under date of January 29, 1969 from Wm. M. Meighen, Chief
Clerk to the Commissioners of Greene County, informed the Board as per instructions,
that Greene County has eliminated the appropriation of $4, 256. 00 in their 1969 budget for
the support of the Washington -Greene County Tourist Promotion Agency, and are with-
drawing their support of this activity.
Mr. Flynn: We will acknowledge receipt of the letter; the matter will require some
study with the Tourist Promotion Agency.
Mr. Bevec: I contacted Mr. Sutherland, Director on this, and asked how he was going to
operate and he said they would be able to come up with contributions from Green County by

Leave of Absence:
Letter received from Sue Maceyko, employee, on leave of absence,
requested an extension due to health reasons; her leave of 60-days expired January 28, 1969.
Folloiwng a discussion of leave terminations it was decided the policy adopted by the Board
with regard to leave of absence would be adhered to.

Letter under date of February 4, 1969 from Samuel L. Rodgers, representing
the Borough of Houston, informed the Board that said Borough has appropriated in its
current budget the sum of $250 for the year 1969 and has adopted a Resolution to appropriate
a similar amount of $250 for the year 1970, to be paid to the County of Washington as their
contribution relating to the improvement of Little Chartiers Creek; the Borough will also
undertake to police and maintain this improvement after the work is completed.

Creek improvement project, Borough of Houston, be approved; and the advertisement for
bids relative to the project scheduled in order that the project can be started.

RESOLUTION
WHEREAS, the Board of County Commissioners of Washington County are
aware of the need for strengthening of the County's Capabilities for planning and coordinating
Federal, State and other programs, and
WHEREAS, It is the desire of the Board of County Commissioners to
promote operating efficiency and encourage compliance with prescribed management
policies and such additional fiscal responsibility and accounting requirements as the Board
of County Commissioners may establish, and
WHEREAS, The Washington Comm pity Action Corporation, as an
instrumentality of Washington County, has demonstrated the capability of planning, conducting,
administrating and evaluating various Federal and State Programs for a period of years
THEREFORE, be it resolved that the Board of County Commissioners of
Washington County, this 6th day of February 1969, designate the Washington Community
Action Corporation to coordinate the Health and Welfare Activities of Washington County and
to coordinate the fiscal and budgeting policies of Washington County. In the above stated
matters the Executive Director of the Corporation shall perform under the direction of
and report to the Board of County Commissioners of Washington County.

Remarks -
Mr. Mazza: Under this resolution it means we can call on the Director for Assistance
say for instance our new home and hospital, on personnel, or whatever advice we need.
Mr. Flynn: He has staff that can help us; ;he will have to assist us on the contents of
the resolution; as far as the Home is concerned we twill have to have some coordination,
which will be available at no cost to the County.
