SEVEC, JOHN MAZZA, COMMISSIONERS THE FOREGOING MINUTE READ AND APPROVED: ATTEST: No. 57 , 1969 CHIEF CLERK Office of the County Commissioners Washington, Pa., February 27, 1969 The Board of County Commissioners met in regular session with the following members being present: Commissioners Mazza and Flynn. Absent being: Commissioner Bevec - out of town. Also present being: Chief Clerk Kittridge; County Solicitor Capano; Parks and Recreation Director forge; Frank Conte, Esq. - Chairman of the Executive Committee of the Washington County Bar Association; James C. McCreight - President of the Washington County Bar Association; Mr. Kettelhot - Landscape Architect representing M. Robert Fenton; Public Information Officer Huber; and Reporter Robertson. Meeting called to order by Chairman and roll call taken: Mr. Bevec - Absent; Mr. Mazza - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. 56, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Flynn, that Minute No. 56 be approved, as read. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. The regular order of business was dispensed with in order that Attorney McCreight might be presented to the Board by the Chairman. Attorney McCreight_ presented material which contained guidelines as per a request made by the County Commissioners at the regular meeting held on February 6, 1969 in reference to Act. No. 358 of 1968 adopted by the legislature concerning implementation of the revised oon stitution effective January 1, 1969 - which provides a mandatory appointment in each county of a Public Defender by the Board of County Commissioners. Attorney McCreight also informed the Board that as per request the Bar Association will submit a list of persons qualified and interested in the Office of 11 the Public Defender. Attorney McCreight stated that the Bar Association has some names which might be more useful than others. BEVEC, JOHN MAZZA, COMMISSIONERS to the County Commissioners. Controller Elish entered the meeting. Deputy Controller Whalen entered the meeting. Planning Director Anthony entered the meeting. Mr. Flynn: We appreciate very much the Washington County Bar Associations' time and effort in coming here this morning. The names which you submit to the Commissioners will be given the upmost consideration in formulating our plans for the Public Defender's Office. Mr. Mazza: I would like to add that I am happy and grateful for the work that the Washington County Bar Association has been doing and the time that they have taken out in setting up the guidelines. I want to pay a tribute to the majority Commissioners for laying a firm foundation at the beginning of this program by asking the Bar Association to recommend the guidelines to us. In this way we can set up a good Public Defender's Office. Treasurer Morgan entered the meeting. Attorney McCreight and Mr. Conte left the meeting. Special Order of Business: Chief Clerk informed the Board of a 25 per cent fund reimbursement in reference to an Agreement entered into between the State Soil and Water Conservation Commission and the Washington County Commissioners on March 29, 1968. Chief Clerk listed all transactions related to this agreement and the amount of $2, 354. 00 was listed as reimbursement. Moved by Mr. Mazza, seconded by Mr. Flynn, that the following bills be authorized for payment: Engelhardt - Power and Associates, Inc. $4, 017. 60 Redevelopment Authority of the County of Washington 2, 700. 00 Patrono, Ceisler, & Edwards 2, 700.00 Total Expenditures $9, 419. 60 Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Moved by Mr. Mazza, seconded by Mr. Flynn, that Michael George and Douglas Graham be authorized to attend the Institute of Local Government's Training Course in "Labor Relations in Public Employment" to be held on Wednesday evenings of March 26, April 2, 9, 16, 23, and 30th, 1969 from 7: 30 p.m. to 9: 30 p.m. at the West Penn Power Company on Route 19. The cost of advanced registration is $10. 00 per person. SEVEC, JOHN MAZZA, COMMISSIONERS Motion carried unanimously. Michael George, Parks & Recreation Director, informed the Board that about a year ago M. Robert Fenton, Landscape Architect, was contracted to prepare a master plan for Mingo Creek development. Said contract was entered on January 2, 1968, between the Washington County Board of Commissioners and M. Robert Fenton. Mr. George introduced Mr. Kettelhot - Landscape Architect representing M. Robert Fenton, Registered Landscape Architect. Mr. Kettelhot made a presentation of the new plans for Mingo Creek County Park. Mr. Flynn: We would have to consult with the entire Board on the new proposed plans for Mingo Creek County Park. We have to be quite definite as far as approval. We will have to hold up on a decision until a latter date. Mr. Mazza remarked that he and Mr. Anthony attended the meeting of the Southwestern Pennsylvania Regional Planning Commission held on Monday, February 24, 1969, and discussed plans for the new proposed county home. These plans must be approved by the SPRPC. The Commission's approval was later received. Chairman asked the records to show that Mr. Anthony, Planning Director, had presented to the Board a copy of the minutes of a special meeting called by Mr. Merdian, Chairman of the Washington County Planning Commission, on February 3, 1969, in which the plans for thei-,new proposed county home at Arden had been approved by the local Planning Commission. i Moved by Mr. Mazza, seconded by Mr. Flynn, authorizing the Solicitor, A. V. Capano, to petition the courts for approval to construct a new County Home and Hospital. Remarks: Mr. Flynn: Asked the records to show that in view of the fact that Mr. Bevec was out of town, he would have been recorded as voting in favor of the above motion and the motion would have been unanimous. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk presented an invoice under date of November 25, 1968, submitted by Joseph F. Bontempo and Associates, Architects & Engineers, for additional work required to revise final plans and specifications to comply with new requirements of the Department of Public Welfare as requested at a meeting in Harrisburg on August 5, 1968, and in accordance with a lettee directed to the Washington County Commissioners dated August 12, 1968. Moved by Mr. Mazza, seconded by Mr. Flynn, that•the following Proclamation be adopted: PROCLAMATION COUNTY OF WASHINGTON WHEREAS: 170 years ago, on March 2, 1799, the Congress of the United States enacted its first weights and measures law, citing the necessity of standard weights and measures as a public service, the need of examin4ng and trying weights and measures devices, and the need of uniformity; and WHEREAS:, honest weights and measures are indispensable, not merely to the economy of the state but to the daily lives of all persons in it, it is a responsibility of the state, and its subdivisions, to prevent inequity by enforcement of uniform weights and measures requirements; and WHEREAS, the County of Washington has recognized these needs as pre- requisites to an orderly and equitable commerce by establishing a Department of Weights and Measures, which has regularly functioned for many years; and WHEREAS, said Department of Weights and Measures has continued to perform its duties of inspection of all weighing and measuring devices within the limits of its jurisdiction to insure equity in all commercial transactions for the protection of all citizens, - whether they be the buyer or the seller; and WHEREAS, March 1 through March 7 will be, observed nationally as of the State of Pennsylvania, do hereby proclaim the period of March 1 through March 7 as "NATIONAL WEIGHTS AND MEASURES WEEK". NOW, THEREFORE, We, the County Commissioners of Washington County of the State of Pennsylvania do hereby proclaim the period of March 1 through March 7 as "NATIONAL WEIGHTS AND MEASURES WEEK" in Washington County; and do urge our citizenry to take cognizance of and recognize the very valuable contribution to the welfare of the communities of this Nation being made by the Department of Weights and Measures in their respective jurisdictions. 418 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Moved by Mr. Mazza, seconded by Mr. Flynn, approving for payment expenses incurred for a trip to Philadelphia, Pennsylvania, made by Malcolm L. Morgan, County Treasurer, and Peter Elish Controller, for the Retirement Fund. Total expenses in the Amount of $38. 75 . Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Letter under date of January 1, 1969, received from Theodore Botula, Superintendent of the Allegheny County Work House and Inebriate Asylum, enclosing the semi-annual contract covering the boarding of prisoners at the Allegheny County Work House and Inebriate Asylum for a six month period commencing January 1, 1969 and ending June 30, 1969, which reflects the actual per diem cost for the stated period. Moved by Mr. Mazza, seconded by Mr. Flynn, that the Articles of Agreement between the Washington County and the Allegheny County Work House in Parkview, be executed; this being a semi-annual contract commencing January 1, 1969 and ending June 30, 1969. Remarks: Note was made that the County Solicitor had delieted the word "Magistrate" from the Agreement. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Moved by Mr. Mazza, seconded by Mr. Flynn, that Elizabeth Cowden and Robert Tyber, Caseworkers, be authorized to attend a two -week Summer Institute being offered at Case Western Reserve University, Cleveland, Ohio, from June 16, 1969 through June 27, 1969. Also, that Miss Louise Abel, Executive Director of the Child Welfare Services, be authorized to attend a three-day Institute for the Administrator as Commodty Planner, held at Case Western Reserve University, Cleveland, Ohio, From June 23, 1969 through June 25, 1969. SEVEC, JOHN MAZZA, COMMISSIONERS Tax Refund: Solicitor presented a tax refund to the Board for approval; said refund having been approved by the Treasurer, Tax Assessment, and Solicitor. ° Moved by Mr. Mazza, seconded by Mr. Flynn, that the Tax Assessment Office be authorized to prepare the following tax refund due to either duplication or overpayment of real estate tax: 1. Re •Triangle Shoe Ca, Inc. 1968 Assessment Monongahela, 2nd Ward Tax in the amount of $248. 06 net was paid on assessed valuation of $16, 320. 00 on June 28, 1968. Appeal #7211 reduced assessed valuation to $12, 720. 00 and net tax to $193. 34, making a refund in the amount of $54. 72 to TRIANGLE SHOE COMPANY, INC., Narrows Shopping Center, Box 1391, Kingston, Pa., 18704. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Moved by Mr. Mazza, seconded by Mr. Flynn, that the County Solicitor, A. V. Capano, be authorized to petition the Courts for approval to construct a new juvenile home at Arden. Remarks: Mr. Flynn: Asked the records to show that in view of the fact that Mr. Bevec was out of town, he would have been recorded as voting in favor of the above motion and the motion would have been unanimous. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Budget Posting: Moved by Mr. Mazza, seconded by Mr. Flynn, that the proposed budget for the year 1969 be made available for public inspection in the office of the Chief Clerk to the County Commissioners beginning March 3, 1969, for a period of 20 days. Remarks: Mr. Mazza: I am again grateful to have the opportunity to sit in on all of the budget hearings and in playing a part in developing this budget. A great many hours were put in on the budget. We had many debates on many of the accounts. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Deputy Controller Whalen informed the Board that as of the opening of business todgy, $151, 950. 00 is the net book balance in the general fund account.
