Also present being: County Solicitor Capano, Chief Clerk Murphy, Deputy Controller Whalen, Mr. Charles Gillespie of Washington -Greene Community Action Corporation, Public Information Officer Huber, Mr. John Anthony, Planning Commission -: Director - Tax Claim Bureau Solicitor Porter and Reporter Robertson. Absent being Commissioner Bevec. Meeting called to order by Chairman and roll call taken: Mr. Bevec - Absent; Mr. Mazza - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions or omissions to Minute No. 81, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Flynn, that Minute No. 81 be approved as read. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Unfinished Business: Warden Feconda's request tabled. (see minute no. 81, dated August 7, 1969) Moved by Mr. Mazza, seconded by Mr. Flynn, that Joseph A. Feconda, Jail Warden, be authorized to attend the yearly meeting of the American Congress of Correction, Minneapolis, Minnesota, from August 18-21, 1969. Remarks: Mr. Feconda will be presenting awards - this will be his last trip; there will be minimum expenses. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. SEVEC, JOHN MAZZA, COMMISSIONERS (reinstatement) Moved by Mr. Mazza, seconded�by Mr. Fl nn; that Metro Petrosky, Jr. be reinstated as the Community Organizer Coordinator for the Aged; this action to be effective August 18, 1969. Chief Clerk -Correspondence: Letter under date of August 12, 1969 from W. E. Addison, State Administrative Officer, Harrisburg, Pennsylvania, officially notified the Board that the Soil Conservation Service vacated space provided by the Washington County Commissioners at Washington, Pennsylvania effective July 18, 1969 (first floor of the County Building at 67 West Cherry Avenue) and expressed their appreciation for the long and pleasant association while they occupied said space; they wished to emphasize that the decision to relocate their office in Washington was made because of the opportunity to consolidate the two Soil Conservation Services in Washington with other USDA agencies at the same location. Letter under date of August 12, 1969 from County Surveyor Yuhas listed those persons in attendance at a meeting held on Tuesday, August 12, 1969 at 2: 00 p.m. re- garding approval to abandon railroad crossing at Hall Avenue in the City of Washington - all costs of the above project will be borne by the Redevelopment Authority. (a copy of) Letter under date of August 8, 1969 from Sheriff Edward J. Protin, to The First National Bank concerned the investment of Funds Account No. 433-112, Treasury Bills (as of August 8, 1969) and authorized said bank to purchase treasury bills for a 90-day period at 15, 000 maturity value; the Sheriff further authorized the bank to hold in safe -keeping until maturity, all bills which are issued, the Sheriff to be notified in writing of the maturity date, interest percentage, and dollar amount of charge on the investment, also on maturity of bills, and reinvest until further notice. Solicitor Capano was of the opinion that the same ruling or procedure should apply that is for the Commissioners to reinvest funds; during a discussion of the reinvest- ment authorization note was made the escrow account doesn't involve public funds, it is parallel with the Adult Probation Office and it is good business to keep loose money invested however, there ,should be a knowledge of the earnings but to what account will the interest be accredited..... Letter under date of August 4, 1969 from John Kiplinger, Intergovernmental Relations Assistant, Southwestern Pennsylvania Regional Planning Commission, enclosed a Project Indentification Sheet containing the essential information on the application by Peters Township, Washington County, to the U. S. Department of Housing and Urban De- velopment for a federal grant of $8, 533 for urban planning assistance on the amended scope of services of the Peters Township work program. -notification is part of the pro- cedure that the SPRPC provide the Commission members (in whose county a project is located) an opportunity to comment on the project that is being reviewed, Mr. Mazza stated that he had discussed the project with the Planning Commission Director and the Planning Commission approved the project and the project has been agreed to do. Letter under date of August 11, 1969 from Frank R. DeLuca, President, Monongahela Valley Building & Construction Trades Council, requested a meeting with the Board of County Commissioners, if possible, for Friday, September 19, 1969 at 11:00 a. m. in the Commissioners' Office with regard to construction jobs that come under the County jurisdiction. Treasurer Morgan entered the meeting. Chief Clerk was instructed to check the Commissioner agenda and arrange said meeting. Letter under date of August 7, 1969 from J. H. Mifflin, District Engineer, Pennsylvania Department of Highways, reviewed their file on the Washington County T. R. 19 and Hidden Valley Road Traffic Condition, beginning with the subject reported to their office on January 26, 1968, by the office of the County Coroner pan -behalf of the residents of Peters Township as a dangerous situation; during their investigation in 1968, they dis- cussed the problem with a member of the Pennsylvania State Police - they agreed that the best solution as an immediate measure was to change the traffic flow pattern to the one presently in effect, and upon completion of this change they received a complimentary letter from the Coroner (a copy was enclosed); however, this is the exact movement which the Commissioners are asking now that they reconsider and reverse traffic flow to the original pattern. BEVEC, JOHN MAZZA, COMMISSIONERS among the local residents as to which operation they prefer --this location is included in their future plans as a part of the safety improvement program. Until this project can be funded and programmed, they will complete a more detailed study to include all turning movements in order to determine what measures, if any, can be initiated as an interim improvement. Mr. Flynn: This was brought up once before by the, _'Commissioners, whereby Mr. Bevec reported to the Board that correspondence enclosed a petition signed by owners of property and taxpayers in the vicinity of T. R. 19 and Valleybrook Road, presented by Messrs. Patnesky, Hitchew, and Stubenbardt (see Minute No. 78, dated July 17, 1969). I suggest that a copy of the letter be forwarded to Mr. Patnesky, which is self explanatory and a copy forwarded to Mr. John Anthony of the Planning Commission. Letter under date of August 8, 1969 from the Pennsylvania Department of Public Welfare, signed by L. Marie Greco, R. N. Supervisor, enclosed recommendations to correct deficiencies observed by Miss Eileen Wilson, R. N. Field Representative, follow- ing her annual visit to the Washington County Home & Hospital for Men and Washington County Home for Aged Women. Note was made that a meeting has been set up with ;the Superintendents of both Homes to take care of the recommendations. Letter under date of August 4, 1969 from Thomas W. George, Jr., M. D. informed the Board that the recent on -site survey relating to Title VI of the Civil Rights Act indicates that the Washington County Home and Hospital is in compliance; regular visits will be made as mandated by Federal Regulation, to insure continued compliance. Budget Items: a/ Southwestern Pennsylvania Regional Planning Commission.- (final payment_ Moved by Mr. Mazza, seconded by Mr. Flynn, that the sum of $4Y�73. 00 due the Southwestern Pennsylvania Regional Planning Commissioners the County's final payment toward its share of the Commission's estimated expenses for the year 1969, be approved for payment, as requested in letter under date of 8/7/69; check to be made payable to the Southwestern Pennsylvania Regional Planning Commission and sent to the Commission Offices at 564 Forbes Avenue, Pittsburgh, Pennsylvania 15219. Cohen, Commissioner, Pennsylvania Department of Public Welfare, informed the Board that the application under Act 72 A of 1968 has been approved; these funds are being processed for payment and within a few weeks a check should be received in the amount of $13, 608; the amount of the allocation was determined by relating the total days of care to be provided by the County to the total for the State and to the amount of money available. Washington County Society for Crippled Children and Adults, 1415 Jefferson Avenue, Washington, Pennsylvania will receive $9, 128. 00 and United Cerebral Palsy, 70 East Wheeling Street, Washington, Pennsylvania, will receive $4, 480. 00. Note was made that United Cerebral Palsy has been substituted for Washington County Chapter PARC. Mr. Gillespie: The PARC was moved to Mental Health and Mental Retardation Act for physically handicapped children, and is a part of the Mental Health/Mental Retardation Program. A copy of a letter under date of August 6, 1969 from Robert L. Ceisler to the Washington County Planning Commission, concerned the sewage disposal problem in some of the "Little Boroughs" along the river - whether the Authority can condemn land located outside the municipal boundaries of its constitutent municipality or municipalities. Attention was invited to the Act of Assembly to be found at 53 P. S. 314 and the interpretations in the case of Condemnation of 203. 76 Acres of Land in Franklin Township, Beaver County, 431 PA. 306, 245 A. 2d 451 (1968)..... it is their opinion that there is no question of the extra territorial power of an authority so long as the purpose is within its stated purposes. Mr. Anthony: I requested this as legal advice - re; hopefully a single sewage system to serve the boroughs of Roscoe, Allenport, Stockdale and Elco. Mr. Mazza: Are you satisfied with the progress that is being made? Mr. Anthony: Yes. 'Mr. Capano: I requested copies of such letters, as a means of information. Chairman announced there will be no regular Board meeting on Thursday, August 21, 1969, because the Commissioners, Chief Clerk, and County Solicitor will be attending the annual convention, of County Commissioners. Bush be authorized to attend the Annual Meeting of the Assessors-1 Association of Pennsylvania at the Benjamin Franklin, Philadelphia, Pennsylvania, September 10-12, 1969. Registration fee in the amount of $20. 00 to be made payable to AAP, Local Government Center, 2941 North Front Street, Harrisburg, Pennsylvania 17110. Solicitor: Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Solicitor Capano informed the Board that John B. Bruno, General Plumbing and Heating Contractor, awarded the contract for remodeling toilet rooms in the Courthouse, has requested first payment for labor and material to date, in the amount of $11, 881. 00. (total contract is in the amount of $46, 115. 00). Solicitor Capano checked the matter out with Building Superintendent Tony Bevec and everything is,in odder - more than 1/4 of the contract has been performed, there is a material on the premises and there is a performance Moved by Mr. Mazza, seconded by Mr. Flynn, that the sum of $11, 881. 00, first payment on the contract for remodeling the toilet rooms, be approved for payment. BEVEC, JOHN MAZZA, COMMISSIONERS Harmon Creek: Moved by Mr. Mazza, seconded by Mr. Flynn, that the application for the consent or permit of the Commonwealth of Pennsylvania Department of Forests and Waters, Water and Power Resources Board, be approved, to construct and maintain a dam across an unnamed tributary of Harmon Creek at a point approximately 7500 feet east of the West Virginia -Pennsylvania border, in Hanover Township, Washington County. This tributary is located north of the main branch of Harmon Creek and flows in a north to south direction, for the purpose of flood control. This structure is numbered 484 and is one of 14 structures, designed to prevent flooding damage in the Harmon Creek Watershed. This structure is earthen fill with an earthen spillway. Motion carried unanimously Solicitor Capano presented various tax refunds to the Board for approval; said refunds having been approved by the Supervisor of Personal Property Department, Treasurer's Office and County Solicitor. Moved by Mr. Mazza, seconded by Mr. Flynn, that the Tax Assessment Office be authorized to prepare the following tax refunds due to either duplication or over- payment of real estate tax and personal property tax. (Personal Property) (Real Estate) Re: Iams, A. M. & Rose J. 409 W. Lincoln Avenue McDonald, Pennsylvania 15057 On January 16, 1969, Mr. Iams filed a return in his name with a total valuation of $14205. On February 7, 1969, the Personal Property Depart- ment received from the Union National Bank in Pittsburgh a Return for Alonzo Iams, with the bank named as Agent. Since Mr. Iams related to the Department that he had overlooked the fact that he had authorizedthe Bank to file his return (Mr. Iams had been very ill and unable to handle all his business) and duplicate payment was made in this case, a refund is due in the amount of $53. 98 to A. M. & ROSE' J. IAMS, 409 W. Lincoln AVe nue, McDonald, Pennsylvania 15 05 7. Re: Denning, Homer W. and Ruth M. Hopewell Township, 1969 assessment Tax in the amount of $43. 52 net was paid on July 29, 1969 on valuation of $2545. Tax Adjustment #7841 reduced assessed valuation to $2125 and tax to $36. 34 net, making a refund due in the amount of $7. 18 to HOMER W. AND RUTH DENNING, R. D. 3, Washington, Pa. 15301. Roll call vote taken: Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. MINUTE B O U K 61L7 BOARD OF COUNTY COMMISSIONERS WAS'HINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. 6EVEC, JOHN MAZZA, COMMISSIONERS Attorney Porter reviewed events with regard to the assessment on new buildings that were erected by, and on property of, the McGraw Edison Company during the first half of 1969, - the North Strabane Township Supervisors made a request to assess the buildings for 1969 - between June 12 and July 1st, the first assessment was made by the County Assessor's Office and the valuation increased and notice was given or or about July 1st; Treasurer Morgan sent them a bill for the amount of money owed and they refused to pay it, they offered 1 / 2 of the amount on the basis that this was an interim thing. Mr. Morgan refused to accept 1/2 because he had no authority to do so. After reviewing the matter, Attorney Porter was of the opinion that the position of McGraw Edison was alright and recommended that the following motion be adopted. Moved by Mr. Mazza, seconded by Mr. Flynn, that the Washington County Treasurer is authorized to accept from McGraw Edison Company the tender in the amount of $5, 467. 86 and to accept the same as full payment of the 1969 taxes on the property which is the subject of the interim assessment in the amount of $639, 515. 00 and that the discount period for this taxpayer be extended so that this will represent satisfaction in full. Remarks: Reed Day, Esq. representing McGraw Edison Company: We are appealing the assessment amount. Roll call vote taken; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously, with Mr. Day leaving the meeting. Deputy Controller Whalen reported briefly on the seminar on the Magistrate Courts of the Commonwealth, attended by Controller Elish, Deputy Controller Whalen and Chief Clerk Murphy, stating that while there wasn't too much realized, there were many questions raised; the above named feel --responsibilities in the operation can be clarified in three (3) different ways. 1. Administration of the Court will rest with the President Judge. 2. The County Comn,�d sioners' responsibility is to provide the space for these offices and to provide the money to pay the staff and whatever improvement is necessary f or the offices (a Court Room, Waiting Room, and Two (2) Private Offices could possibly be involved) so we have only until the first Monday in January.to have all of these facilities available. Mr. Whalen made note that at the Commissioner's Convention the problem will come up as to who will staff these offices... the one opinion is the actual appointments will be made by the President Judge, (2) local Magistrates will have something to say about the staff (3) the County Commissioners may have this prerogative.
