Board of County Commissioners met in regular session with the follow-
ing members being present: Commissioners Bevec, Mazza, and Flynn. Also present
being: County Solicitor Capano, Chief Clerk Murphy, Deputy Controller Whalen, Public
Information Officer Huber, Parks and Recreation Director George and Mr. Crouse of the
Observer -Reporter Publishing Company.
Meeting called to order by -- airman and roll call taken:
Mr. Bevec - Present; Mr. Mazza - Present; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions, or omissions to
Minute No. 83, each Commissioner having received a copy.
Moved by Mr. Bevec, seconded by Mr. Mazza, that Minute No. 83 be
approved, as read.

Motion carried unanimously.
Old Business: Awarding of Contracts -
Moved by Mr. Bevec, seconded by Mr. Mazza, that the contract for
Bituminous Paving of the Parking Lots at the Courthouse and Driveways at the Washington
County Home for Aged Women, be awarded to BLACK TOP PAVING CO., INC., 446 E.
Beau Street, Washington, Pennsylvania 15301, for the amount as set forth in their bid
($12, 050. 00); this being the lowest responsible bid received and being in accordance with the
specifications. Motion made upon the recommendation of the County Solicitor.

Moved by Mr. Bevec, seconded by Mr. Mazza, that the contract for
Vegetating Earthfill Embankment and other areas at Site PA-479, Harmon Creek Watershec,
located near Eldersville, Washington County, Pennsylvania, be awarded to DAVID
SHEPLER, R. D. 1, Champion, Pennsylvania, subject to the approval of the Soil Con-
servation Service, for the amount set forth in his bid ($9, 537. 00); this being the lowest
responsible and only bid received. Motion made upon the recommendation of the County
Solicitor.

Mr. Capano: On Data Processing - Tax Statements and other Supplies for the year 1970,
we received two (2) bids;
The National Cash Register Company total bid 'price' $3, 977. 63
The Standard Register Company total bid price: $3, 666. 43.
Here, we have a situation where we are using NCR equipment in the beginning year and it
has been recommended that we use nothing but NCR equipment forms, etc. so if they develop
any problems they know where it is and therefore, it is recommended that the contract be
awarded to NCR even though it is a little higher.
Moved by Mr. Bevec, seconded by Mr. Mazza, in view of the fact the
County is initiating a new system and it has been recommended that we start with the NCR
equipment forms in spite of the fact that the bid is higher, the contract for Data Processing
Tax Statements and other Supplies for the year 1970, be awarded to THE NATIONAL CASH
REGISTER COMPANY, 355 Fleet Street, P. O. Box 717 15230, Pittsburgh, Pennsylvania
15220; motion made upon the recommendation of the County Solicitor.
Remarks -
Mr. Whalen: We use Boroughs equipment in our office and we buy very few forms from
Burroughs because of the price situation; we use another form and the quality of their
material is comparable with Burroughs.
Mr. Bevec: Being as we are just starting out with the system, I think we are going to
have to make the attempt to see how it will work out.
Mr. Capano: I took the matter up with Sandra Lesch, Supervisor of the Department, and
several others and we had an opportunity to see the equipment down at the new Bank and it
has been recommended that for the first year we use their equipment rather than operate
with something else and if we have problems we can put our fingers on it; afterwards it will
be open to competitive bidding.
Mr. Whalen: You were not influenced by the recommendations of NCR were you?
Mr. Capano: No; by our own Help.
Mr. Whalen: Any reputable company could question the matter.
Mr. Capano: As long as you have justifications, and I think we do, because we have some
questions ourselves until it is working right.

Chief Clerk made note that Mr. Lebec, representing Moore Business
Forms, Inc. was in attendance at the opening of the Bids and that he had submitted an
alternate Bid stating that he realized the matter involved.
Chief Clerk - Correspondence:
Letter under date of August 25, 1969 from Andrew Speller, Director,
Division of Fiscal Management, Commonwealth of Pennsylvania Department of Public Wel-
fare, Office of Mental Health, informed the Board the allotment request for the Central
Washington County Mental Health/Mental Retardation Clinic for the period April 1, 1969 to
June 30, 1969 has been audited, approved for payment, and submitted to the fiscal offices
for processing; they found it necessary to make adjustments in the report as noted on the
attached copy - when adjustments are necessary, delay in payment may be occasioned/this
payment - $3, 614. 20.
Letter under date of August 29, 1969 from Harry Steigman, Director,
Bureau of Housing and Environmental Control, Commonwealth of Pennsylvania Department
of Health, serves as a commitment from said Department that the County will receive 50
percent of the costs for preparation of a Solid Waste Management Plan, as provided in the
Pennsylvania Solid Waste Management Act, for Washingt-on County, contingent upon the pass-
ing of legislation which appropriates funds for this purpose; the request for funding indicated
that the costs of preparing this plan would be $66, 000, 50 percent of which would be paid by
the Commonwealth; they are holding in pending the Service Purchase Contract which will
encumber these funds.
Chairman suggested that Mr. John Anthony, Director of the Washington
County Planning Commission, receive a copy of the above letter.
Mr. Bevec: I thought Mr. Anthony said that we would get the complete allotment.
Mr. Flynn: I understood that there would be no cost to the County.
Mr. Huber: County participation is services in kind.
Letter under date of September 2, 1969 from Michael George, Director
of Department of Parks and Recreation, requested approval to attend the Annual Congress
for Recreation and Parks to be held in Chicago; this Congress, conducted by the National
Park and Recreation Association, should prove '.very beneficial in that it will have many
educational sessions and workshops. Additional information concerning NRPa Annual
Congress was attached. Estimated cost - $175. 00
Mr. Bevec: I am going to be for it this time. We have not attended any such con-
ferences ourselves, we have not been to any national, conventions and I think starting the
first of the year, State conferences are sufficient to attend, next, year I don't think we should

permit this.

Donald W. Bertram, P. E. , Michael Baker, Jr., Inc. advised that a final inspection has
been scheduled for the Washington County Airport, Project No. FAA9-36-043-04, Contract
No. 5, on Wednesday, September 17, 1969 at 10:00 a.m.
< (copy of) Letter under date of August 27, 1969 to John Yuhas, County Surveyor,
from Donald W. Bertram, P. E. , Michael Baker, Jr. Inc. advised that their Electrical
Engineer, conducted a pre -final inspection of the electrical work performed by Baldwin
Electric Company on the Washington County Airport FAA Project No. 9-36-043-04, Contract
No. 5, listing items as a punch list preliminary to the final inspection.
(copy of) Letter under date of September 3, 1969 to Black Top Paving Company, Inc.
from Donald W. Bertram, P. E. , Michael Baker, Jr., Inc. advised that the final inspection
for the Washington County Airport Project No. 9-36-043-®t, Contract No. 6 has been
scheduled for Wednesday, September 17, 1969, at 10:00 a.m.
(copy of) Letter under date of September 2, 1969 to Mr. Gerald D. Curtin, Chief,
Airports Branch, Federal Aviation Administration from Donald W. Bertram, P. E. , Michael
Baker, Jr., Inc. offered comments in regard to the density tests performed on Washington
County Airport FAA Project No. 9-36-043-05; letter stated they feel the Contractor achieves
maximum compaction that could be obtained due to the field conditions and recommended
that the contract requirements of 98% of laboratory density be waivered on this project. It
is felt that the project has resulted in a pavement of good quality.
Letter under date of August 27, 1969 from Joseph Adestein, M. D.,
Deputy Secretary for Mental Health and Mental Retardation, Commonwealth of Pennsylvania
Department of Public Welfare, notified the Board the County Mental Health/Mental Re-
tardation Grant for the period July 1, 1969, through June 30, 1970, has been approved in
the amount of $643, 152. 00; since the total request from all county units was greatly in ex-
cess of the funds appropriated, it was necessary to pro -rate the funds available on a
formula developed by the Department - in the near future we will be requested to prepare a
revised estimate of expenditures indicating what programs will be supported out of this al-
location. First quarterly allotment will be computed in the Deputy Secretary's Office and
will represent one-fourth of the total amount approved for the county for theN69-70 year.
Authorization was given to begin implementation of the program with due regard to the con-
ditions set forth in the conditional approval letter from Thomas W. George, Jr., M. D.,

Secretary of Public Welfare.
Mr. Bevec made note that the amount that was requested by the Mental
Health/Mental Retardation Board was a little over $800, 000 and of course the Program will
have to be adjusted;
Mr. Mazza: Does this mean there will be a cut --back?
Mr. Bevec: There will be a cut -back in the recommended programs but with the ones
going now, we will be unable to increase services.
Letter under date of August 29, 1969 from Peter H. Smith, Executive
Director, Commonwealth of Pennsylvania Washington County Board of Assistance, made
reference to memorandum dated 8-28-69 received from Chief Clerk Murphy and stated they
were glad to be informed that Mr. Metro Petrosky, Jr. will be coordinating all welfare pro -
grams; Mr. Smith feels that it will be very easy for their agency to cooperate with Mrs
Petrosky.
Letter under date of September 3, 1969, from Louise Abel, 11�-_ ecutive Di-
rector of Washington County Child Welfare Service, submitted a request concerning a leave
of absence for a staff member; the request of Miss Elena Bell for one month's leave of
absence being made soley on the advice of her physician.
Moved by Mr. Bevec, seconded by Mr. Mazza, that Elena Bell, Clerk
Typist with Washington County Child Welfare Services, be granted a leave of absence as
requested; this action to be effective September 8, 1969, Date of Return - October 6, 1969.

Notification received from John W. Macfarlane, Executive Director,
Commonwealth of Pennsylvania Department of Military Affairs, Pennsylvania Aeronautics
Commission, informed the Board that Mr. Edwin G. Kase is the new Airports Engineer in
charge of Airport Development and Construction Program and has filled the vacancy caused
by the resignation of Roy Benjamin.
New Business:
Moved by Mr. Mazza, seconded by Mr. Bevec, that Reese Dugan be ap-
pointed as a member of the Board of Revision of Taxes ((to fill the vacancy of the late
Bruno Sicchitano), on a temporary basis until January 1, 1970.
Remarks -
Mr. Mazza: The reason I suggested Mr. Dugan is because he has been an employee in
our Tax Assessment Office and he does have the experience.

Mr. Bevec informed the Board that Mr. John Showalter, Superintendent
at the Washington County Home for Aged Women, had requested permission to move from
said 'Hor,.e; note being made that such permission had been granted to the Jail Warden and
the Superitendent at the Home for Men.
Moved by Mr. Bevec, seconded by Mr. Mazza, that John Showalter,
Superintendent at the Washington County Home for Aged Women, be granted permission to
move from the Washington County Home for Aged Women.

Mr. Bevec informed the Board that Union TownshiqD had submitted a re-
quest for a Registration Day at Courtney.
Moved by Mr. Bevec, seconded by Mr. Mazza, that the Mobile Unit sit
at Courtney, Pennsylvania, on Wednesday, September 10, 1969, for the purpose of
registration.

Mr. Mazza read a portion of a letter from the Executive Director of the
Southwestern Pennsylvania Regional Planning Commission to the Solicitor for the Borough
of Fayette City; letter stated that their review of the proposed project of the Municipal Authority=
of Fayette City to reirisfxtute ferry service for persons and vehicles across the Monongahela
River between Fayette City and the Borough of Allenport, had indicated that the ferry service
would be of primary benefit to Allenport, Fayette City and several adjacent communities; as
a result of their review, they recommend that the Urban Mass Transportation Administration,
U. S. Department of Transportation, approve and finance the proposed project for the
construction of landings, ferry boat and cable system between the Borough of Fayette City,
Fayette County, and the Borough of Allenport, Washington County.; said Project has also
been approved by the Washington County Planning Commission.
Mr. Mazza also informed the Board that another meeting is being held on
r the 15th of September with the members of the Committee from Washington, on the Mass
Transit.
Mr. Mazza: Our interest is how this will affect Washington County; we will have this
meeting before the official meeting.

presentative on the Port Authority of Allegheny County Board, submit a report at the next
regular Board Meeting.

Mr. Bevec reported to Director George that in talking with several people
in the Park area, they are of the opinion that traffic is going through pretty `fast, perhaps
speed limit signs could be posted.
Mr. George: We cannot post this; in checking with the Highway Department, they said
the Township has to do this - a letter has been forwarded to Uniontown, Pennsylvania.
Mr. Mazza reported he had discussed the matter with Mr. Montagna of the Highway De-
partment and Mr. Whalen suggested that Mr. Warren Bailey be contacted on the matter.
Tax Refunds:
Solicitor presented various tax refunds to the Board for approval; said
refunds having been approved by the County Treasurer, Tax Assessment Office and County
Solicitor.
Moved by Mr. Bevec, seconded by Mr. Mazza, that the Tax Assessment
Office be authorized to make the following tax refunds due to either duplication or over-
payment of real estate tax.

Solicitor Capano reported: In the case of Daniel A. Nurnberger and The

Constitutional Party of Washington County bs. Joseph Muscaro, Director of the Washington
County Election Bureau - we received an opinion and Order and Decision from Judge McCune.
Judge McCune upheld the position which we had taken in refusing a nomination petition sub-
mitted by the Constitutional Party in behalf of Mr. Nurnburger. We held that there was no
vacancy and he was an unsuccessful candidate of another party. The Court upheld our
position.
Solicitor Capano stated a copy of a ballot has been received from the
Commonwealth to substantiate the discussion at the last regular Board Meeting concerning
the same.
Those Judges seeking retention election in November will be placed on the regular ballot.

Mr. Flynn: We just dispensed with the action regarding our former decision to
include retention election judicial candidates on the same ballot with other candidates, Mr.
McCreight. If we had known you were coming, we should have held off on it. We have
kept to our original decision to include, retention election judicial candidates:jon the same
ballot with other candidates.
Mr. Capano: Unless we receive a certification from Mr. Welsh, we shall stick to
our original decision. I agree with the Election Code and state constitution judiciary
article to contradict themselves, but we are going to print. these ballots as directed
by Mr. Welsh, Deputy Secretary of the Commonwealth, in which he said all candidates
would be on one ballot. I am going to chi with Beaver County on this, to see if the
State is being uniform with the issue.
Mr. McCreight stated that Washington County is the only county in which the issue has
been raised. He said that in an argument of conflicting provisions, the constitution would
prevail over the Election Code.
Mr. McCreight: "The purpose of the judiciary article was to show the electorate that
judges had been removed from partisan politics. A separate ballot would do much to
implement this. "
Commissioners again stated that they will not change their minds on the matter until they
receive an official reversal of decision from Mr. Welsh.
Mr. McCreight left the meeting.

The League of Women Voters of Peters Township - Washington Area would like to compliment
the County Commissioners upon the use of mobile voter registration units which have been
operating for the past two weeks. Such efforts to make registration easier for the citizens
of the County merit the thanks for everyone concerned with making- democracy work.
We would urge also that readers of this newspaper tell -newcomers to their communities,
young people who will be 21 by November 5th, and anyone who has changed his or her
name from that previously registered that the deadline for registering to vote in the
November 4th election is September 15th.
Our slogan for the year is "Voter chooser --stay-at-home loser", but -you can't vote in
November if you haven't registered in September.

district conducts the classes but does not provide transportation for the children.
Because of the foster father's working schedule, the family is unable to transport the boys
to school.
Parents of other children enrolled in kindergarten were contacted
and one mother, Mr s. Harry Cloud, Meadowlands, would be able to take the boys to
kincbrgarten with her child. Mrs. Cloud is willing to transport the boys but could use some
assistance with traveling expenses. We would like to reimburse Mrs. Cloud $10. 00
per month for the two boys. This amount could be deducted from the Child Welfare
Services' Special Account No. 320-3 and included in the monthly maintenance check to the
foster parents, Mr. and Mrs. Albert Craig, Pike Street, Meadowlands, Pa. Mrs.
Craig could then give Mrs. Cloud the $10. 00 for transportation.

adjusting federal staffing funds. Mr. Speller and his staff will be contacting us in the near

Secretary, Department of Forest and Waters stated that receipt is acknowledgedaf the
application filed by the Commissioners of Washington County for permit to encroach in an
unamed tributary of Harmon Creek, Hanover Township, Washington County, together
with plans of the proposed work.
The application is being processed by the engineering staff of the Water
and Power Resources Board.
Correspondence 1__ under date of September 4, 1969, from the Office of
Economic Opportunity, W. Astor Kirk, Regional Director, stating that the Development
Associates, a consulting firm, has been contracted by Region II to conduct an evaluation
of the Washington -Greene CAA on September 22-26, 1969. The Regional CAP Evaluation
Unit will be working closely with the contractor on arrangements for the site visit. The
evaluation design and procedures will be similar to that currently used by the Regional
Officer. They have every confidence that the extensive experience of this contractor
will provide a productive analysis of your CAA's program and operation. The contractor
will conduct a substantive exit interview at the conclusion of the site visit and a report
will be provided to the Board of Directors within four weeks following the -evaluation.
They have asked the contractor's project manager, Peter Davis, to contact us regarding
the details of the visit.
Correspondence under date of September 6, 1969, from Captain
Jack Ross, President, Captain Jack Ross & Associates, Inc., stated that he would like to
advise that they have received a number of inquiries for a large sternwheel boat, and feel
they could obtain a good price for the former Steamer CLAIRTON, which Washington
County owns. This vessel is laid up now in 'kn Mile Creek, unused, and deteriorating
much more rapidly than if it were in use. They are sure that we probably have continuing
expenses in connection with the vessel, as well. Should we be interested in disposing of
this vessel, they would be most happy to handle the offering for us. They are the only
established firm of shipbrokers in this area, and can offer us complete and qualified
service.

Mr. Flynn: This matter will be turned over to our solicitor for further consideration.
