Also present being County Solicitors Capano and Finder, Chief Clerk Debreczeni, Jr., Elish and Deputy Controller Luketich, Budget Director Gillespie, Mr. Sittler of the Tax- payers' Association, Mr. Bradshaw, Reporter Crouse and various individuals representing firms who have submitted bids for the purchasing of the issue of bonds of the County of Washington, Pennsylvania, known as "Funding Bonds of 1964". Chairman of the Board, Michael R. Flynn, called the meeting to order, stating that this portion of the meeting be designated as "special order of business" prior to the regular meeting which will follow. Mr. Finder enters the meeting room and at the call of the Chairman of Board, the meeting is reconvened. Also entering the meeting at this time is Reporter Merdian. 88 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JCHN P. SEVEC, JOHN MAZZA, COMMISSIONERS Chairman of the Board entertained a motion to award the contract to the highest responsible bidder, Moore, Leonard & Lynch, et al; if there were no objections. Motion by Mr. Bevec, seconded by Mr. Mazza, that the contract for the purchase of the issue of bonds of the County of Washington, Pennsylvania, known as "Fu Bonds of 1964" in the sum of Five Hundred Thousand Dollars, be awarded to Moore, Le and Lynch, et al, they being the highest responsible bidders. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Motion by Mr. Bevec, seconded by Mr. Mazza, that the Chief Clerk be instructed to return all checks to the unsuccessful bidders. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Regular order of business: Mr. Flynn asked if there were any corrections, additions or omissions to Minute No. 24, each commissioner having received a copy. Motion by Mr. Bevec, seconded by Mr. Mazza, that Minute No. 24 be approved as read. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Following items of business presented to the Board by Chief Clerk Debreczeni, Jr.: Motion by Mr. Mazza, seconded by Mr. Bevec, that M. Elizabeth Mc 77 Morgan Avenue, Washington, Pennsylvania, be appointed as assessor for the Borough of East Washington, Washington County, Pennsylvania, to fill the unexpired term of J. C. McCleery, who resigned. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Motion by Mr. Bevec, seconded by Mr. Mazza, that Ray W. Church, We Finley, Pennsylvania, be appointed as assessor for the Township of West Finley, Washingt County, Pennsylvania, to fill the unexpired term of Wiley F. Irey. This vacancy created the death of Mr. Irey. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. yJ 1 1 Motion carried unanimously. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Motion by Mr. Bevec, seconded by Mr. Mazza, that the following changes of polling places for the coming Primary Election to be held Tuesday, April 28, 1964, be approved. Zion Baptist Church To: 3rd Ward School (2nd floor classroom) Rental: None - Janitor $5.00 Reason: By petition of residents BURGETTSTOWN 2nd Precinct Roll call vote taken: From: Harriet Gatus Storeroom To: Our Lady of Lourdes School Rental: $25.00 ($10.00 increase) This place to be permanent. Reason: Storeroom too small and no longer available. Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Motion by Mr. Bevec, seconded by Mr. Mazza, that the County Controller's e be authorized to transfer the sum of $210.67 from the Institution Fund Account No. 3-2-014860 to the General Fund Account No. 83-2-014852; and that this Institution Fund count be closed. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Motion by Mr. Bevec, seconded by Mr. Mazza, that the Tax Assessment ce be authorized to prepare tax refund for the following due to either duplication or rpayment on real estate tax. 1. Green, John Robert & Elizabeth Marie, Box 429, R. D. 2, Finleyville, Pennsylvania, for overpayment of 1962 County Tax. On August 1, 1962, tax was paid in the amount of $46.14 on property situate in the Township of Union, Wash- ington County, Pennsylvania, described as 1 story brick house, 1 acre surface -valuation $3765. Tax .Correction slip dated January, 1963, reduced valuation to $3150 and tax to $38.99, making a refund due in the amount of $7.15 to said owners. This property is to be included in the same sale as authorized by Minute No. "22" dated March 26, 1964. Motion carried unanimously. Dushan J. Nicksick, County Engineer, entered the meeting. Motion by Mr. Bevec, seconded by Mr. Mazza, that the County renew their agreement for the proposed construction of State Highway 247-T. R. 88, in Carroll Town- ship and the City of Monongahela, Washington County, Pennsylvania, and the period of payments to be changed from $20, 000. 00 per year for a five-year period to $25, 000. 00 per year for a four-year period; also that the following resolution be adopted: RESOLUTION BE IT RESOLVED by the Commissioners of Washington County, Washington, Pennsylvania, that the proposed Construction, including the changing of grade; lines; locati and widths of State Highway 247-T. R. 88, from a point adjacent to the Monongahela Valley Country Club, in Carroll Township, to a point in the City of Monongahela, all in W County, Pennsylvania; has been considered by the Washington County Commissioners, and y agree that Washington County will not assume liability for any property damages re- sulting from the changing of the above highway as proposed; or any damages arising out of changes or alterations of drainage resulting from the construction or maintenance of highway; or any damages resulting to any property holdings of any Public Utility Company, nor will the County assume any damages resulting to Coal or other minerals, or Water, in and underlying the property affected by this improvement; but upon presentation of a completed plan, when said plan is approved by the Washington County Commissioners, Washington County will contribute the sum of One Hundred Thousand ($100, 000. 00) Dollars, toward the payment of property damages; said sums to be paid as follows: 1. $25, 000. 00 to be paid September 1, 1964. 2. $25, 000. 00 to be paid September 1, 1965. 3. $25, 000. 00 to be paid September 1, 1966. 4. $25, 000. 00 to be paid September 1, 1967. Chairman of the Board declared an indefinite length of time for a recess, until Mr. Finder, Solicitor, could return with the necessary resolutions in connection with the Bond Issue. Meeting called to order at 11:30 a.m., by the Chairman of the Board. Motion carried unanimously. Motion by Mr. Bevec, seconded by Mr. Mazza, that the following resolution RESOLUTION PROVIDING FOR THE ISSUE AND SALE OF $5,00, 000. 00 FUNDING BONDS OF 1964. WHEREAS, the County of Washington, Pennsylvania, has, inter alia, out- standing an unfunded debt incurred for current operating expenses in the amount of Five Hundred Thousand Dollars ($500, 000. 00) which is due and owing, and WHEREAS, the Court of Quarter Sessions of Washington County has by Order of Court dated March 9th, 1964, authorized the funding of such unfunded indebted- ness; NOW, THEREFORE, BE IT RESOLVED, and it is hereby' resolved by the Board of County Commissioners of the County of Washington, as follows: - Section 1. That the bonded indebtedness of the County of Washington be anc it is hereby increased by the amount of Five Hundred Thousand Dollars ($500, 000. 00) for the purpose of funding an unfunded debt incurred for current operating expenses by an issue of general obligation bonds of the said County. Section 2. After such registration, fer shall be valid unless made at said Office by the registered owner in person or by an attorney duly authorized and similarly noted thereon. This bond shall, however, charged from registration by being in like manner transferred to bearer and thereafter shall be transferable by delivery; but it shall continue subject to successive registration and transfer to bearer as aforesaid at the option of the holder. The transferability of the coupons by delivery shall not be affected by registration of the bond. The collection of said tax shall commence with the fiscal year beginning 1965, being the first fiscal year following the issuance of said bonds. Section 7. There is hereby established a sinking fund for the payment of the bonds hereby authorized. All money realized from the taxes hereby levied shall be paid into the sinking fund hereby created as collected and shall be applied exclusively to the payment of the principal of said bonds at maturity and to interest and State tax there meanwhile to which purposes they are hereby irrevocably pledged. Section 8. There is hereby appropriated and transferred from the General Funds of the County the sum of $7,.500.00 for the purpose of meeting the requirements of this issue of bonds for debt service charges pending the collection of the tax levied for that purpose and such amount so appropriated and used shall be repaid to the General Fur out of the proceeds of the tax levied for the year 1965. Section 9. It is hereby declared that the debt to be incurred hereby, t with the existing net debt of the County is not in excess of any constitutional or statutory limitation and the County Commissioners, or a majority of them, and the County Controlle are hereby directed and authorized to prepare, verify and file with the Clerk of the Court of Quarter Sessions of Washington County, the statement required by the Act of Assembly approved June 25th, 1941, P. L. 159, as amended, and to do and perform all other acts proper in connection therewith. r Section 10. Mr. Flynn read a letter received from the Commonwealth of Pennsylvania, Advisory Commission on Elections and Election Laws, with reference to the authority and responsibility and methods of appointment of watchers; selection of election board officials. method of training, payment, etc. Said letter being filed in the Office of the Chief Clerk and Election Department; no action taken on this subject. adjourned.
