BEVEC, JOHN MAZZA, COMMISSIONERS 7 1 n passed to this effect and Mr. Yablonski presented letter from the President of the Harness Racing Council, which brought the matter up, to the Board. Mr. Flynn informed Mr. Yablonski that this matter will be taken under advisment and requested that Mr. Capano, County Solicitor, be furnished a copy of the letter. Mr. Flynn read letter from the Network Election Services dated September 30, 1964, requesting that the Board of Commissioners submit to them a certificate of authorization allowing them to appoint watchers during the tally of votes in this forthcoming election, November 3rd. General discussion followed at this time on the above -mentioned letter, Chairman requested that the matter be tabled and the Solicitor in- structed to send letter to the Network Election Services informing them that when names are submitted to us, we will send the names to Court for recommendation, in compliance with the law. Motion by Mr. Bevec, seconded by Mr. Mazza, that the request of the Network Election Services for authorization to appoint watchers during the tally of votes in the forthcoming November election, be tabled. Solicitor to send letter informing them when names are received, we will send them to Court for recommendation, in com- pliance with the law. Mr. Gillespie, Budget Secretary, entered the meeting. Motion by Mr. Bevec, seconded by Mr. Mazza, that Charles A. Gillespie, be appointed as the Project Director for the National Youth Training Program under the 1964 Economic Opportunity Act; this appointment to be effective October 1, 1964. Remarks: Mr. Mazza: Will this interfere with his work as the Budget Secretary? Mr. Flynn: No. It will tie in with hiis-, work. Mr. Gillespie: My duties will consist 75% in directing this program (Federal Govern - I ment) and 25% in County budgetary work. The County will be reimbursed for my salary. Mr. Flynn: I received the following letter from our Solicitor, Mr. Capano, in reply to Mr. Yablonski's request to act upon a resolution authorizing employees (not police officers) on the County payroll, making less than $6, 000. 00 per year, to be permitted to � hold stock in harness racing. JOHN MAZZA, COMMISSIONERS i At your request, I read the letter submitted by Mr. Yablonski from the Racing Commission. I also checked the section of Purdon's (307.2 (4)) to which the letter refers. The Act specifically states: "The provisions of clause (3) of this sub- section (A) shall not apply to a public employee of a political subdivision (other than a police officer or paid employee of a police department, sheriff's office, district attorney's office or other law enforcement agency) whose compensation is less than six thousand ($6000) per annum", etc. The Act does not differetiate as to type of employees. It is my opinion since sheriff's employees are specifically mentioned as a type of employee who cannot -be excluded from the provision of owning or holding stock, no resolution could be adopted to make Mr. Yablonski elegible. Cooperative Agreement between the Washington County Planning Commission and the Soil Conservation Service into on July 24, 1964, be approved and that the Chairman of the Board of Comm- issioners and the Chief Clerk to the Commissioners affix their signatures and County seal to said Agreement. Motion by Mr. Bevec, seconded by Mr. Mazza, that we approve and i adopt the resolution authorizing the filing of the Preliminary Statement of Interest (Letter of Intent) re: "Project 70 Land Acquisition Program" for these proposed areas to be used for recreational purposes, namely: Mingo Creek Area and Cross Creek Area. Wilson, City Councilman, Washington City, showed the Commissioners plans for the proposed modernization of Main Street and construction of a mall. Project calls for the extending of the curbs five feet on both sides of Main Street and the elimination of parking meters. Plan also includes the placing of pedestral benches I and placing i of potted trees. The Washington Association of Downtown Merchants are sponsoring this project and it will be financed 50% by the property owners and 50% by the merchants along Main Street. Mr. Wilson requested that the Commissioners participate in this project, Washington County share the cost would be $3, 345. 00 for its frontage along South Main Street. i Solicitor Capano entered the meeting. Motion by Mr. Mazza, seconded by Mr. Bevec, that the request of Mr. Wilson's (shopping mall) be tabled and referred to the Solicitor for his legal opinion a;• to whether or not the Commissioners are empowered under the County Code to make a contribution to this project. Motion carried unanimously. Mr. Sittler of the Taxpayers' Association entered the meeting. The Commissioners with the County Controller briefly discussed the letter and editorals concerning payments to foster mothers of Washington County. Letter complaining about the uncertainty of when foster mothers receive their monthly checks appeared in the Observer on Saturday, October 17, 1964. Editorial entitled "Justified Complaint" appeared in the Reporter on Wednesday, October 21, 1964. It was agreed that the delay in payment of these bills (foster mothers' checks) is due to the method of pro- cessing checks in the Office of the County Controller. Payments cannot be processed like regular county payroll checks, impossible to put foster mother checks on a master sheet. Controller Elish prepared a statement in answer to these complaints, explaining and out- lining the specific problems involved in processing payments to the foster mothers. Article should appear in the Observer on Friday, October 23, 1964; copy also on file with the Chief Clerk to the County Commissioners. Mr. Kittridge, Purchasing Agent, entered the meeting. It was suggested by Mr. Mazza, that Mr. Gillespie with his vast ex- perience in this field, (Welfare Department and auditing for the Commonwealth) meet once again with the Controller's Office and other concerning departments and review this problem. Mr-. Flynn: Have you taken corrective steps concerning this problem? Mr. Elish: Yes. Hanna, Democratic Chairman of Washington County, have agreed to release one watchers' certificate each, which they are entitled to the Network Election Services, the County Commissioners go on record of approving this method of supplying watchers' certificates to the Teacher -Reporter Group for each county precinct. Certificates to be forwarded to Don Farmer, Pennsylvania State Manager and copy of letter to Chairman Protin and Hanna. Mr. Flynn reviewed action taken at the Prison Board Meeting held on October 15, 1964. In light of the communications from the Commonwealth and prior knowledge of the conditions in the jail, the Prison Board unanimously agreed that the conditions con- stituted and emergency sufficient to waive ordinary requirements for bidding on the immedilate repairs that are needed. The Prison Board then voted unanimously to ask the O'Brien Steel Construction Company to submit a proposal to make the necessary temporary repairs. Therefore, motion by Mr. Bevec, seconded by Mr. Mazza,, that the ` O'Brien Steel Construction Company be retained to make a survey of what corrective action u fl can be taken and submit a proposal to make the necessary temporary repairs. At this time, Purchasing Agent William Kittridg@, made the following comments concerning the unsafe conditions of the present boilers at the Washington County Home and Hospital for Men. The need for either new or used boilers is urgent. This condition is both serious and dangerous, a state of emergenct exists. Presently the cost ?er day for repairs is amounting to $120.00. Upon meeting with Mr. Jollick, Superintendent of the Washington County Home and Hospital for Men and several different boiler companies, along with a verbal recommendation from a boiler inspector (written recommendation forthcoming) this high pressure boiler is unsafe and needs replaced. Also, two low pressure boilers are in a deplorable condition and it's questionable whether they will be dependable for heat throughout this winter. The situation is one that must be taken care of immediately to assure heat and steam this winter and most important to remove the hazardous condition that exists. Remarks: Mr. Bevec: Repairs have been made to the boilers at the Washington County Home and Hospital for Men under emergency power granted by the County Code and we now find that a critical condition still exists wherein a new or used boiler must be obtained. This being an emergency which requires immediate attention, I, John Bevec, therefore move that the need for a boiler being an immediate need, that we declare an emergency to exist and we hereby empower the Purchasing Agent to immediately procee d to purchase a new or used boiler and contract for its installation, during any and all work which may be required, under this emergency, seconded by Mr. Mazza. Mr. Elish, County Controller, being present at this meeting, also agreed that a state of emergency exists at the Washington County Home* and Hospital for Men, and that immediate' action to remedy the situation is required. adjourned.
