Bids are opened in accordance with advertisement, at the designated date and hour, contracts awarded one week later, giving the Solicitor and Purchasing Agent an opportunity to review all bids received. Moved by Mr. Mazza, seconded by Mr. Bevec, that all bids be tabled until a tabulation can be made by the Solicitor and Purchasing Agent. Contract to be awarded on Thursday, July 15, 1965, at 10:00 a.m., or shortly thereafter. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Coleman, bidder, left the meeting at this time. Deputy Controller Whalen reported $800, 000. 00 temporary indebtedness outstanding as of this date, one note has been repaid to the Pittsburgh National Bank, and one can now be paid to the Mellon National Bank; excess interest earnings from the Capital Reserve Fund and Sinking Fund Commmission have been in excess of $2, 000. 00. Bradshaw, the Herpst Brothers, Reporter Robertson and various bidders. Chairman asked if there were any corrections, additions or omissions to Minute No. 93, each Commissioner having received a copy. Moved by Mr. Mazza, seconded by Mr. Bevec, that Minute No. 93 be approved as read. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Old Business: Mr. Capano: I have the resolution ready for the borrowing of the money and we have to fill in the appropriate dates when the payments are due, otherwise it is in order to be passed at this time. We have all the necessary approvals from the Department of Internal Affairs. Mr. Capano read said resolution. Mr. Sittler of the Taxpayers' Association entered the meeting. Moved by Mr. Mazza, seconded by Mr. 'Bevec, that the following resolution be adopted, and that the Board of Commissioners ne empowered to execute all the necessary legal papers. RESOLUTION WHEREAS, the County of Washington adopted a Resolution on February 11, 1965, to participate in the Project 70 Land Acquisition Assistance Program, as provided in the Project 70 Land Acquisition and Borrowing Act No. 8 of P. L. 1964, and to file Form BCD-70-2, Application for Project 70 Land Acquisition Assistance Grant, Part I, Site and Development Proposal, with the Bureau of Community Development, Department of Commerce. WHEREAS, said application for the selection of site and grant of funds was approved by the Bureau of Community Development, Department of Commerce on May 4th, 1965. WHEREAS, in fulfillment of the obligations of the County to participate and obtain the grant of funds from the Commonwealth of Pennsylvania it is necessary that the indebtedness of the County of Washington be increased by the amount of Two Hundred Fifty Thousand ($250, 000. 00) Dollars for the purpose of providing funds for capital expenditures for municipal improvements consisting of the acquisition of land, easements, rights -of -way;. and other facHities as may be required by the Commonwealth of Pennsylvania. WHEREAS, on July 1, 1965, a Resolution was unanimously adopted by the Board of County Commissioners to increase the indebtedness of Washington County by Two Hundred Fifty Thousand ($250, 000. 00) Dollars in order to participate in Project 70 Land Acquisition Assistance Program and the Solicitor is hereby directed to prepare all necessary resolutions and legal papers. WHEREAS, the various banking institutions were requested to submit bids, by letter, on the rate of interest they would charge on a loan to be evidenced by a Temp- orary Indebtedness Note of the County of Washington, it has been determined that the First National Bank of Fredericktown, Pennsylvania, with its bid of 2.738% per annum, to pro- vide the necessary funds for the aforesaid capital improvements, is the lowest net interest rate offered to the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Washington County as follows: 1. The indebtedness, of the County of Washington, Pennsylvania, be and it is hereby increased by the amount of Two Hundred Fifty Thousand ($250, 000. 00) Dollars for the purposes hereinabove recited. 426 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON -COUNTY, PENNSYLVANIA MICHAEL R. Borrowings made pursuant to the authority of this Resolution shall be evidenced by Temporary Indebtedness Note of the County not to exceed the aggregate prin- cipal amount of Two Hundred Fifty Thousand ($250, 000. 00) Dollars, such Note to bear in- terest at the rate of 2.738% per annum (said interest to be computed on the basis of 365 days to the year) from the date of said Note and to be issued to the First National Bank of Fredericktown, Pennsylvania, its successors or assigns, and upon delivery to receive payment of the face amount thereof. 3. The Temporary Indebtedness Note to be issued hereunder shall pro- vide for the repayment of 20% of the face amount thereof on day of August in each of jthe years 1966 to 1970, inclusive, and for the payment of interest on the unpaid principal amount thereof at the rate hereinabove set forth on the day of each third month after ' the date of issuance of the Note. The right of the County of Washington is hereby reservers to anticipate the payment of all or any part of the principal amount of such Noteon the date any interest thereon is payable. 4. The Temporary Indebtedness Note to be issued hereunder shall be sub- stantially in the form annexed hereto, made part of and marked Exhibit A, with such changes as may be necessary to conform to the requirements of this Resolution. 5. The period of usefulness of the capital improvements to be purchased with the proceeds of the Temporary Indebtedness Note hereinabove authorized is hereby stated and determined to be at least five years from the date of their issuance. 6. The Temporary Indebtedness Note herein authorized are hereby de- clared to be the general obligations of the County of Washington and shall pledge the full faith, credit and taxing power of the County. 7. The Temporary Indebtedness Note shall be signed by the County Com- missioners, attested by the Chief Clerk to the County Commissioners under the seal of the County of Washington and the County Treasurer is authorized to deliver said Note to the First National Bank of Fredericktown, Pennsylvania and receive payment therefor on be- half of the County. 8. There is hereby levied and assessed upon all persons and property subject to County taxation an annual tax in tach of the following fiscal years in such amount as will yield sufficient funds for the payment from time to time of installment payments of principal and of interest to be paid on said Note in accordance with the following schedule: For the year 1966 - $56, 845 For the year 1967 - $55, 496 For the year 1968 - $54, 107 For the year 1969 - $52, 738 For the year 1970 - $51, 364 9. There is hereby appropriated from the general funds of the County the sum of for the purpose of meeting interest payable on these Notes during the year 1965 and pending collection of the tax to be levied in subsequent yearsand such amount so appropriated shall be repaid out of the proceeds of the tax levied and to be collected for the year 1966. 10. It is hereby declared that the debt to be incurred, hereby together with the existing net debt of the County is not in excess of any constitutional or statutory limitations and that the action of this Board in filing the Constitutional Debt Limitation Statement dated July 1, 1965, with the Department of Internal Affairs of the Commonwealth of Pennsylvania as required by Article VII-A of the Act of Assembly of the Commonwealth of Pennsylvania, approved June 25, 1941, P. L. 159, as amended, is hereby ratified and confirmed. This Temporary Indebtedness Note is issued by the County of Washing- ton to provide funds for capital expenditures for municipal improvements in accordance with Article VII-A added to the Municipal Borrowing Law of Pennsylvania (Act of 1941, P. L. 159) by Act No. 299 of the General Assembly of the Commonwealth of Pennsylvania 1959 P. L. 802, as amended, and pursuant to a Resolution by the County of Washington duly adopted by the Board of County Commissioners on July 1, 1965, duly recorded according to law and pursuant to the further approval dated July 7, 1965, by the Department of In- ternal Affairsof the Commonwealth of Pennsylvania of the Constitutional, Debt Limitation Statement of the County Commissioners, as required by law, made in connection with the proceedings authorizing this Note. It is hereby certified that every requirement of law affecting the issuance hereof has been duly complied with; that provision has been made for the collection of an annual tax sufficient to meet the installments of interest and principal hereon as they may become due, and that the total amount of the debt of the County of Washington, Pennsylvania, including the aggregate amount of this Temporary Indebtedness Note does not exceed two per centum (2%) of the last preceding assessed valuation of the taxable property in the County of Washington and that this Temporary Indebtedness Note and the debt created thereby are within every debt and other limit prescribed by the Constitution and laws of the Common- wealth of Pennsylvania and that for the prompt and full payment of all of the obligations hereof the entire faith, credit, taxing power and resources of the County of Washington, are thereby irrevocably pledged. Mr. Capano: That has been done. This loan was on a competitive basis with the Chief Clerks asking the various banking institutions with which the County does business to submit a letter stating the rate of interest they would charge. The lowest net interest rate was submitted by the First National Bank of Fredericktown, Pennsylvania - 2. 738 Per Cent. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chairman stated it was the unanimous opinion of the Board in conjunction with the Purchasing Agent and County Solicitor, that the bids received in reference to the repairs and retubing of boilers, be rejected. Moved by Mr. Bevec, seconded by Mr. Mazza, that all bids received for the Retubing and Repair of Two(2) Steam Boilers that produce heat for the Washington County Courthouse, Jail, and various County buildings, Washington, Pennsylvania, be rejected. 4�8 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. BEVEC, JOHN MAZZA, COMMISSIONERS Remarks: Mr. Flynn: Under date of July 14, 1965, a certified check in the amount of $800.00 was received, submitted by the O'Brien Steel Company, which they did not submit with their bid on July 8, 1965. Advertisement stated bid must be accompanied by a certified check in the amount of 10% of the total bid sumitted. With that in mind, in view of the fact that this company was the low bidder, the bids were rejected. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanmously. Moved by Mr. Bevec, seconded by Mr. Mazza, that the County Controller in conjunction with the Purchasing Agent, be authorized to re -advertise for Retubing and Repair of Two (2) Steam Boilers that produce heat for the Washington County Courthouse, Jail, and various County buildings., Washington, Pennsylvania. Said bids to be received in the Office of the County Controller until 11:00 a.m., Daylight Saving Time, Thursday, August 5, 1965, and opened immediately thereafter in the Office of the County Commis- sioners. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously, with bidders leaving the meeting. Remarks: Mr. Mazza: Is there any way we can expedite the return of these checks to the unsuccess- ful bidders ? Mr. Capano: The Controller does this promptly. New Business: Moved by Mr. Bevec, seconded by Mr. Mazza, that the Tax Claim Bureau General Account (consisting of school account, road account, partial payment, partial payment option) be transferred from the Pittsburgh National Bank to the Mellon National Bank and Trust Company, a depository for County funds. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chairman informed the Board of an Agreement for Public Works Plan Pre- paration received from the Housing and Home Finance Agency whereby the Government offers to make an advance not to exceed $208, 159. 00, for preliminary and final plan preparation for the County Home and Hospital for Aged - Indigent. Moved by Mr. Bevec, seconded by Mr. Mazza, that the Board of Commis- L� sioners accept this Agreement for Public Works Plan Preparation and that the Chairman of the Board of County Commissioners, Michael R. Mr. Sittler: Is this under the Hill -Burton Act? Mr. Flynn: No, this is advance planning money. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Charles E. Bradshaw introduced the Herpst Brothers to the Board (from Mt. Pleasant Township). Mr. Bradshaw: We assume that the Washington County Planning Commission is under the jurisdiction of the County Commissioners, are we right in that assumption? Mr. Flynn: You are right. Mr. Bradshaw: Is the opinion as expressed by the Director of the Planning Commission in the Washington Observer (July 13, 1965) the opinion of this Board? Mr. Flynn: Not necessarily so. The Washington County Planning Commission is a creature of the County Commissioners. The Washington County Planning Commission has been in existence for some time; they are an independent agency governed by a Board of Directors comprised of five members. Mr. John Cromwell is Executive Director appointed by the Planning Commission Board. Mr. Bradshaw: What we have reference to is the statement made by Jack Cromwell; it is their opinion that the agricultural economy of Washington County in Pennsylvania has no value. This is a very dangerous opinion. Mr. Bevec stated a letter from Mr. Thomas Paxton Sherwood had been published in the newspaper (Letters to the Editor) and Mr. Cromwell had answered this letter. (The Washington Reporter, issued July 14, 1965). Mr. Bradshaw: We have no comment on this, Mr. Bevec; but on the statement - all farms in Pennsylvania could be taken out of production without any loss. Mr. Flynn stated that the Board had done some research on the agricultural economy and that this information was on file. Mr. Bradshaw: It causes confusion among the agricultural economy plus many industries that depend on the economy, when the Director of the Planning Commission puts this thing in the newspaper. Mr. Bevec: We can't control what he puts in the paper. Mr. Flynn: What happened originally probably was that he took exception to the letter written by Mr. Sherwood. We have no control over the man's thinking or his statements. Mr. Flynn also stated the Board was aware of the agricultural economy with figures and facts to substantiate as to its importance. Mr. Bradshaw: Has the Board any plans to increase the agricultural economy? Mr. Bradshaw: Nothing developed. Mr. Mazza: We were not satisfied with the results of the Industrial Development in our County for the last two or three years; we have seen fit to take action and there will be action taken to step up Industrial Development in our County and I think we should get into this agricultural development and there is no question in my mind that under the new set-up we have, we probably could stimulate the agricultural program in the County. Mr. Flynn remarked that neither he nor Mr. Bevec had any knowledge as to what had taken place before their term began. Mr. Mazza: Mr. Bradshaw has been pretty much of a leader, for instance, in the poultry market where eggs were being shipped in from other states and purchased by our stores. Mr. Bradshaw tried to form a Co-op; of course there was money involved and that never developed. I Mr. Bradshaw: If the Industrial Development Committee had taken action, they could have saved Harper's Feed Mill with 138 jobs and Schronz Dairy with 17 jobs. s Mr. Flynn reported the Board had been attending a meeting and by a strange coincidence had attended one just the night before with the Redevelopment Industri- al Board of Directors, Director, Mayor, City Council, etc., and the chief topic of discus- sion was Industrial Development. Mr. Flynn also commented that the men involved with Planning -Redevelopment were dedicated men who perform their services. Mr. Mazza suggested that Mr. Bradshaw and his group offer recom- mendations or it might be wise to sit down* with the Industrial Development Committee or mail some ideas to 'them. Mr. Capano reviewed the article in question. Mr. Capano: There is nothing derogatory. Mr. Cromwell is just answering the article. This article does not reflect the views of this Board. i Mr. Mazza: They had the right to come before this Board to clarify the matter. Mr. Bradshaw and the Herpst Brothers left the meeting. Reporter Merdian entered the meeting. Chief Clerk presented a request received from the Pennsylvania Army National Guard under date of June 28, 1965, signed by Joseph Lynn, Col. Attached to this request was a certificate attesting the results of the Annual General Inspection for the past fiscal year. Request being in reference to budget appropriation for the year 1965. Moved by Mr. Bevec, seconded by Mr. Mazza, that the sum of $1, 500 as appropriated, be approved for payment to Pennsylvania Army National Guard. Check to be made payable to Joseph Lynn, Lt. Enclosed also, the bill for boarding prisoners at the institution, for the period beginning January 1, 1965 and ending June 30, 1965, which is now due and payable - 1, 191 board days @ $5. 61 per inmate per day for a total amount of $6, 681. 51. Moved by Mr. Bevec, seconded by Mr. Mazza, that the Articles of Agreement between Washington County and Allegheny County Workhouse and Inebriate Asylum, Parkview, Pennsylvania, be executed; this being a semi-annual contract (July 1, 1965 to December 31, 1965) covering the board of prisoners in said institution. Remarks: Mr. Flynn: We have no alternative. Mr. Sittler: This is a long term, you keep them here up to .two years. Mr. Flynn: One year, eleven months. Mr. Sittler: These are sentenced longer. Mr. Bevec: Longer than two years. Roll call vote taken: Mr. Mazza - Yes; Mr. Bevec - Yes; Mr. Flynn - Yes. Motion carried unanimously. Leave of Absence: Moved by Mr. Bevec, seconded by Mr. Mazza, that Peter Polites, an employee of the Washington County Bridge Department, be granted a leave of absence from his present duties for a period of sixty (60) days; this action. to be effective August 2, 1965.
