HLATCH CUMMINS, JOHN MAZZA, COMMISSIONERS 0 Motion by Mr. Cummins, seconded by Mr. Mazza, that the deed be executed for the following described properties to the following described persons for the stun or price set oppo- site the same under and by virtue of the action of the board taken May 31, 1960j. as recorded in Minute No. 39, and the order of the Court of Common Pleas, dated September 19, 1960, the said deed to be delivered to the purchaser named therein upon payment of the consideration recorded therein together with the costs of the proceedings and that Francis E. Pettit, be and he is hereby authorized to execute the said deed as and for the County of Washington and is hereby constituted and appointed attorney in fact to acknowledge the said deed before any person authorized to take such -acknowledgements: NO. & TERM 713-, May T., 1960. Motion by Mr. Cummins, seconded by Mr. Pettit, that Helen Bury, be appointed as a cleaning woman for the Courthouse, this action to be retroactive to October 11, 1960. Motion carried. Motion by Mr. Cummins, seconded by Mr, Pettit, that Grace Cole, be appointed as a cleaning woman for the internal Revenue Building, this action to be retroactive to October 13, 1960. Motion carried. Motion by Mr. Cummins, seconded by Mr. Pettit, that Monica Kucherawy, be appointed as a temporary clerk in the Tax Assessment Office, this action to be retroactive to October 4, •.• Motion carried. Motion by Mr. Cummins, seconded by Mr. Pettit, that Lorraine Camp, be appointed as a temporary clerk in the Tax Assessment Office, this action to be retroactive to October 11, 19eb. Motion by Mr -Cummins, seconded by Mr. Pettit, that Mike Lemonakis, be appointed .as a temporary clerk in the Tax Assessment Office, this action to be retroactive to September 26, 1960. Motion carried. Motion by Mr., Cummins., -seconded by Mr. Pettit, that Martha B. Carey, be appointed as secretary for the Office of Civil Defense, this action to be retroactive to September 16, 1960,. Motion carried. Motion by Mr. Cummins, seconded by.Mr. Pettit, that the following QUIT -CLAIM DEED, between Washington County and W. R. Sample, -be approved by the Board of County Commissioners, THIS DEED QUIT -CLAIM MADE the 25th day of October in the year of our Lord one thousand nine hundred and SIXTY (1960), BETWEEN WASHINGTON COUNTY, a municipality under the laws of the Commonwealth of Pennsylvania, party of the first part AND W. R. SAMPLE, widower, of 1003 Shutterly Avenue, California, Washington County, Pennsylvania, pWty of the second part, WITNESSETH, that the said party of the first part, for and in consideration of the sum of ONE ($1.00) Dollar lawful money of the United States of America unto the said County of Washington will and truly paid by the said party of the second part, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, has released, quit -claimed and conveyed, and by these presents does release, quit -claim and convey unto the said party of the second part, his heirs and assigns, all the estate, right, title and interestof the said party of the first_',pan in and to the following described property: - ALL those two half lots or parcels of ground being parts of Lot #9, situate in the Borough of California, (formerly East Pike Run'Township), Washington.County, Pennsylvania, bounded and described as follows: PART 91. BEGINNING at the corner of Shutterly Avenue and a 30 foot street, in Shutterly Exten- Sion to the Meadow Plan of Lots; thence along said Shutterly Avenue in a southerly direction 40 feet to Lot 412, of said Plan of Lots; thence westwardly along the line of said Lot 412, 72-feet; thence northwardly and parallel with said Shutterly Avenue 40 feet -to the said 30 foot street; thence eastwa-rdly along the said 30 foot street 72 feet to the place of BEGINNING, and being a par-, of Lot 49 of said plan. PART 92. BEINQ the same property conveyed to Alice M. Sample and W. R. Sample, her husband, by deed of L. W. Sample, widower, dated June 9, 1942, and recorded in the Recorder"'s Office of Washington County, Pennsylvania, on June 29, 1942, in -Deed Book Volume 658`, Page 370. The said Alice M. Sample died interstate on August 19, 1950, leaving W. R. Sample as a surviving tenant by the entirety. On April 25, 1940, the above described property was sold by the County Treasurer to the County Commissioners as the property of Louis and Bertha Sample for $162.47 taxes and $24.02 costs. A deed to the County Commissioners dated February 7, 1941, and recorded in the Prothonotary's Office in Treasurer's Deed Book Volume 5, Page 476, was Slade by John,L. Past, County Treasurer. -As of this date, said deed still appears on the records in the Prothonotary's Office, and constitutes a cloud on the title -of W. R. Sample. The said property was redeemed by the owner as is evidenced by Receipts Nos. 5761 and 5793 from the Office of the County Com- missioners for the sum of $623.86, which included the taxes due at the time of the sale, and also taxes and costs up to and including the time of the -redemption. There is no record of ownership in the County Commissioners other than the Tresasurer Deed herein recited and W. R. Sample has maintained ownership and paid taxes on said property, it being asses0ed in his name, since June 29, 1942. The purpose of this deed is to relinquish any claim the County Commissioners have against said property, to the intent and purpose that the cloud on the title created by the Treasurer's Deed through inadvertence. (and not cancelled), is cleared. 70GETHER with all and singular, the property, improvements, privileges, heredita- ments and appurtenances whatsoever thereunto belonging, or in anywise appertaining, and the reversions and remainders, rents, issues and profits thereof; and all the estate, right, title, interest, property, 'claim and demand whatsoever of the said party of the first part, in law, equity or otherwise, howsoever, of, in and to the same and every part thereof. TO HAVE AND TO HOLD the said property, hereditaments and premises hereby granted, or mentioned, and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, to and for the only proper use and behoof of the said party of the second part, his heirs and assigns, FOREVER. AND said party of the first pant, does by these presents covenant, grant and agree to and with the said party of the second part, his heirs and assigns, that as to the regularity and validity of its original claim or claims and the procedure through which it pur- chased the said property, it SHALL AND WILL SPECIALLY WARRANT AND FOREVER DEFEND. The said Washington County does hereby c6nstitut6 and appoint Joseph A. Di Filipp to be its attorney for it, and in its -name and as and for its corporate act and deed to acknowle•ge this Deed, before any ptrson having authority by the laws of the Commonwealth of Pennsylvania to take such acknowledgment, to the intent that the same may be duly recorded. This Deed is made under and by virtue of a resolution of the Board of County Com- missioners of'Wa'sh1bgton'County duly passed at a special mheting thereof held on'tbe 25th day of October, A.D., 1960, a full quorm being present, authorizing and directing the same to be made and done.
