Those present at this meeting being: Commissioners Pettit, Cummins, Mazza, County Solicitor 3 Docktor, Solicitor Sismondo, Mr. Murdock representing County Controller Elish, I. W. McCaskey, j Taxpayer and Citizen of Washington County, Mr. Donnan, representative of A. E. Masten & Company, i Mr. Whitmore, representative of McJunkin, Patton & Company, Harvey Stuart, Chief Clerk and Jack Crouse, reporter for the Observer Publishing Company. i In accordance with the aforementioned advertisement, bids were opened by Mr. Murdock t and read by Mr. Docktor. I Motion by Mr. Mazza, seconded by Mr. Cummins, that the award be,temporarily tabled, in! order to hear Mr. McCaskey. Motion carried unanimously. Mr. McCaskey objected to the bond issue for various reasons. Mr. Docktor told the Board that in his opinion the Board could award the bid at this time. Motion by Mr. Mazza, seconded by Mr. Cummins, that the following resolution be adopted; as read: R E S O L U T I O N WHEREAS, Pursuant to public notice by advertisement given according to law, the follow-� ing bids have been received for the purchase of the issue of bonds of the County of Washington, Pennsylvania, in the sum of Six Hundred Thousand Dollars ($600,000.00) dated September 1st, 1961, and known as "Funding and Improvement Bonds of 1961". BE IT FURTHER RESOLVED, that the checks accompanying the bids of the unsuccessful be returned to them by the Chief Clerk. Roll call vote taken: Mr. Pettit Yes Mr. Mazza Yes Mr. Cummins Yes Motion carried unanimously. Mr. Mazza asked Mr. Docktor if the County Commissioners were proceeding legally. Mr. Docktor answered yes to this question stating that in his opinion, the Commissioners were proceeding properly. Motion by Mr. Mazza, seconded by Mr. Cummins, that the Board recess for fifteen (15) minutes at the request of the County Solicitor. Motion carried unanimously. After the requested recess, the meeting was resumed. Motion by Mr. Mazza, seconded by Mr. Cummins, that the following resolution providing the issue and sale of $600,000.00 Funding and Improvement Bonds of 1961 be adopted as read: RESOLUTION PROVIDING FOR THE ISSUE AND SALE OF $600,000.00 FUNDING AND IMPROVEMENT BONDS OF 1961 WHEREAS, the County of Washington, Pennsylvania, has inter alia outstanding an unfunded debt incurred for current operating expenses in the amount of Three Hundred Eighty -Three Dollars ($383,000.00) which is due and owing, and WHEREAS, the Court of Quarter Sessions of Washington County has by Order of Court dated July 27th, 1961, authorized the funding of such unfunded indebtedness, and WHEREAS, it is necessary that the bonded indebtedness of the County be increased by the amount of Two Hundred Seventeen Thousand Dollars ($217,000) for the following purposes:- To estab fish, construct and provide for air navigation facilities stithin the County of Washington, and to erect, equip and furnish a suitable building to be used exclusively for the confinement of child- ren awaiting trial or hearing in the Courts of the County; 202 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA FRANCIS E. BLATCH CUMMINS, JOHN MAZZA, COMMISSIONERS NOW THEREFORE BE IT RESOLVED, and it is hereby resolved by the Board of County Comm- issioners of the County of Washington, as follows: - Section 1. That the bonded indebtedness of the County of Washington be and it is heret increased by the amount of Six Hundred Thousand Dollars ($600,000) for said purposes by an issue of general obligation bonds of the said County. Section 2. Said bonds shall be in coupon form, numbered consecutively from one (1) to six hundred (600), both numbers inclusive, each in the principal sum of One Thousand Dollars ($1,000), dated and bearing interest from the first day of September, 1961, at the rate of two and seven -eighths per centum (2-7/8%) per annum, payable semi-annually on the first day of the months of March and September in each year during the term of said bonds which shall mature in numerical order and be paid as follows:- Sixty bonds, Sixty thousand dollars ($60,000.00) on September first in each of the years 1962 to 1971, both inclusive. The principal and interest of said bonds shall be payable at the Office of the County Controller of said County in the City of Washington, Pennsylvania. Said bonds shall also provide that the County of Washington will pay or refund any tax (except gift, succession or inheritance tax) legally levied or assessed upon said bonds or upon the debt secured thereby under any present or future law of the Commonwealth of Pennsylvania. Section 3. Said bonds are hereby declared to be general obligations of the County of Washington, and shall pledge the full faith and credit of the County. Section 4. The period of usefulness of the improvements for which a portion of the said bonds are to be issued is thirty (30) years. Section 5. Section 8. There is hereby established a sinking fund for the payment of the bonds hereby authorized. Motion by Mr. Cummins, seconded by Mr. Mazza, that the following resolution for Approval of the Undertaking of Surveys and Plans for An Urban Renewal Project and the Filing of An Applic tion, be adopted: RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY, PENNSYLVANIA APPROVAL OF THE UNDERTAKING OF SURVEYS AND PLANS FOR AN URBAN RENEWAL PROJECT AND THE FILING OF AN APPLICATION WHEREAS, under Title 1 of the Housing Act of 1949, as amended, the Housing and Home (Administrator is authorized to extend financial assistance to localities in the elimination and 1prevention of the spread of their slums and urban blight through the planning and undertaking of Urban Renewal projects; and s WHEREAS, it is desirable and in the public interest that the Redevelopment Authority of the County of Washington, Pennsylvania, prepare surveys and plans, presently estimated to cost approximately seventy-one thousand eight hundred and forty six dollars ($71,846.00) in order to undertake and carry out an urban renewal project of the character contemplated by Section 112 or said Title 1, in that certain area, proposed as an Urban Renewal Area, situated in the Borough of California, County of Washington and Commonwealth of Pennsylvania, and described as follows: BOUNDED on the South by Holy Trinity Cemetery, on the West by California State College, on the North by California State College, on the East by the Monongahela River. ;e 1 WHEREAS, the above -cited Federal law requires as a condition to the execution of a c for a loan and capital grant for an urban renewal project that the locality present to the MINUTE BOOK X7 BOARD OF COUNTY COMMISSIONERS WASHINI3TON COUNTY, PENNSYL\/ANIA FR.ANCIS E. BLATCH CUMMINS, JOHN MAZZA, COMMISSIONERS Ll and Home Administrator a workable program, as set forth in Section 3-12 of said Title 1, for utilizing appropriate public and private resources to eliminate and prevent the development or spread of slums and urban blight, to encourage needed urban rehabilitation, to provide for the redevelopment of blighted, deteriorated, or slum areas or to undertake such other feasible comm- unity as may be suitably employed,to achieve the objectives of such a program; and WHEREAS, it is recognized that contracts for loans and capital grants for urban newal projects will require, among other things, (1) the approval of the urban renewal plan by t governing body of the locality in which the project is situated; (2) the provision of local gran in -aid which may consist of donations of cash, land, demolition or removal work, and the install ation, construction or reconstruction of streets, utilities, parks, or other improvements or the provision of other public buildings or facilities; and (3) the development of feasible method fo the relocation of families displaced from the urban renewal area, P10W, THEREFORE, BE IT RESOLVED BY THE COUNTY COMMISSIONERS FOR THE COUNTY OF WASH- INGTON, PENNSYLVANIA: Section 1. That the proposed Urban Renewal Area described above is a slum, blighted, deteriorated or deteriorating area appropriate for an urban renewal project and that the by the Redevelopment Authority of the County of Washington, Pennsylvania, of surveys and plans f an urban_ renewal project of the character contemplated by Section 112 of the Housing Act of 1949 as amended and supplemented, in the proposed Urban Renewal Area described above, is hereby appm Section 2. That the financial assistance provided under said Title 1 to assist urban renewal projects is needed to enable the Redevelopment Authority of the County of Pennsylvania, to finance the undertaking of the project. Section 3. That it is cognizant of the cond-Itions that are imposed in the under- taking and carrying out of urban renewal projects with Federal financial assistance under Title 1, including the requirements of said Title 1 respecting the workable program mentioned above, ar_d that it is the sense of this body (a) that a method for the relocation of families displaced from the urban renewal area, in conformity z-'ith said Title 1, can be prepared, and (b) that loca grants-in-aid consisting of donatior_s,of cash, land, demolition or removal work and the install- ation, construction or reconstruction of streets, utilities, or other improvements or the provi- sion of other buildings or facilities, necessary for carrying out in the Urban Renewal Area the urban renewal objectives of said Title 1 in accordance with the urban renewal plan, can and will be provided in an amount which will not be less than one-fourth of the net project cost and whic� together with the Federal capital grant, will be generally, equal to the difference between gross 3ro1ject costs and the proceeds or value of project land sold, leased or retained for use in accordance with the urban renewal plan. Section 4. That the filing of an application by the Redevelopment Authority of County of Washington, Pennsylvania, for an Advance of funds from the United States of America an amount not to exceed seventy-one thousand eight hundred and forty-six dollars ($71,846.00) surveys and plans for an urban renewal project in the urban renewal area described above is h approved, and that the Director of the Redevelopment Authority of the County of Washington, Pennsylvania, is hereby authorized and directed to execute and file such Application with the J Housing and Home Finance Administrator, and to provide such additional information and to
