jAttorney Mcllvaine presented an amendment to the petition originally filed and
this amendment sets forth that the Veterans' Ballot of Francis E. Ward should not have been count
in this election and that the application for a Veterans' Ballot that was made for Francis E. Ward,
ion his behalf by Mildred Collins, a hospital worker, gave his voting residence as Canton Township
;2nd Ward, Washington County. It was discovered that the voter Francis E. Ward is registered in t
!registration books of the County in the 3rd Ward of Canton Township; and therefore since he has ca
is ballot for the 2nd Ward, which is other than his actual residence, then we say that this ballot

jshould be discarded.
The case we have cited to support our position in this election case is the
iNorthampton Bureau of Election, 79 D �_ C, page 481.
{ Attorney Solomon: For the record: I contend as to the amendment petition, tha

,it is not well taken and not taken in due time. The voting residence of Ward is a matter of re-
cord and could have been discovered before this time. This card qualifies the vote, not the peti
I cite in support of my contention that a voter should be given every opportunity to have his

counted; the case of Bauman's Election.
Xr. Ward did vote in Canton Township and that vote is good, regardless of
there is some irregularity in the case of the card.
Mr. Mcllvaine: Since the application is defective, we contend -that the vote is
not good.
Mr. Pettit: It is the intention of the Board to rule on the legality of this
ballot upon the recommendation of the Attorney, Paul Simmons, who is presently employed and he re-
commends to the Board that the ballot not be counted for the reason that Francis E. Ward was pre-
sumably given a Canton 2nd ballot when he should have received a Canton 3rd ballot.
Motion by Mr. Cummins, seconded by Mr. Mazza, that the ballot as cast by Francis
�E. Ward be ruled as void and cannot be counted.
