BLATCH CUMMINS, JOHN MAZZA, COMMISSIONERS Mr, Hornell informed the Board that Mr. -Mike Packrall and Mr, Frank Jones have Sited an appeal with the Supreme Court in regard to their Nomination Papers, (Good Govern- ment Party). Hearing date of this case set for September 30, 1963. Mr, Hornell checking with the Election department to see if a hearing scheduled at such a late date would jeopardise the election machinery. In the event that it would he will seek to have the the hearing scheduled during the month of June in Philadelphia, Attorney Richman pre sente d the Commissioners ( all three) and the County Solicitor with a letter objecting to the le Agreement as prepared for execution between the County of Washington and John Co Hicollella, ex , Mr. Hornell asked Mr. Richq= the name of this client, Nr, Richman said that he did not believe it was necessary to divulge his client-s name at this particular time. Mr,,Richman asked that the Secretary make a record of the letters having been delivered and objections formally presented, Mr. Pettit informed Mr. Richman that upon study of his objections the Hoard would notify bin if they determined it necessary to have a hearing on this matter, Motion by Mr. Cumiainsp seconded by Mr. Massa, that the meeting be adjourned. Also present being County Solicitor Hornell, Tax Claim Bureau Solicitor Yablonski, Acting Engineer Yuhas, Attorney Samuel Goldfarb, Mr, Robert McCarrall, Jr,, Mr, D. B. Brown and Reporter Crouse. Letter dated April 16, 1963, from the Department of Forests and staters with reference to their investigation of the flooding conditions along Chartiers Creek at Meadowlands, (near the B.C.A. Plant and downstream to the Rubber Rolls Plant) was presented to the Board by Mr, Masaa, Inspection made to determine the extent of anAttance which could be pro? vided under the Stream Clearance Program. Necessary for channel in the Canonsburg -Houston Area to be improved to have a bottom width of 60 feet more or less. County to acquire rights -of -entry. Excavated materials (spoil) to be disposed by Contraotor,0 After discussing this matter the following notion was made. Notion by Mr, Cummins., seconded by Mr, Massa„ that the Board of Commissioners adopt a resolution to furnish the department of Forests and Waters with rights -of -entry for that area of channel widening within the vicinity of the R.C.A. Plant, Rights of entry to be acquired from each property owner along both banks of the strw ,, (Copy of resolution adopted is herewith incorporated). BLATCH CUMMINS, JOHN MAZZA, COMMISSIONERS d ri3:; ♦ A I i 0 i BE IT RESOLVED By the Commissioners of Washington Coms►tys PsncSAVania, hersin- after designated as SPONSOR; and WNWS, the Department of Forests and Waters of the Commenwisalth of Pennsylvania,, has proposed improving the channel of Chartiers Creek in Chartiers Townships Washington County, Pennsylvania, so as to alleviate in part the damage occasioned by floods and to prevent as far as practicable the recurrence of similar flood damage; and the Department of Forests and Watere will undertake, at its awn cost, to perform the work aforementioned provided the SPONSOR shall, at no cost to the Departments supply all services and materials requested in the loner of proposal dated April. 261, 1963, Fits No, S 63:26, acquire and furnish all necessary .aak m6abs and rights -of -way for the entire projects and indemnify., protect and save free the doemnosalth of Pennsylvania, Department of Forests and Waters and/or its contractors and agents jointly and severally frame and against any and all claims, damages., demands or actions in law or in equity resulting from any damage to Property, public air privates by reason of the aforesaid work. NOW, tom+, in consideration of the promises aforesaid and of the benefits to be derived by said SPONSOR and for the protection of the public welfare, health, and safetys the SPONUMs in rumal session not., does hereby agree to acquire and furnish all, at the SPONSORIS cost, r eqa 6sW services and materials, the necessary oasements and rights -of 4my for the entire projects and to notify in writing the Department of Forests and Waters when the said materials and services will be available and eases and rights -of. -way have been acquired. The SPONSOR further agrees to maintains at its own expenses the completed channel in rovesen►t and any and all dikes, levees, or other such items which are constructed by or for the Commumealth as a part of the aforesaid work. Instructions regarding maintenance of the completed work will be farm.sheds upon requests by the Department of Forests and W hters. PROJECT PROPOSED: April 16, 1963 Motion carried unanimously, Mr. Pettit instructed Acting Engineer Yuhas to make a sturdy of the tributary which is known as McClane+s Run from the Bridge to Chartiers Creek and make a report to the Board of his findings. Mr. Goldfarb informed the Board that he would give the County a right -of -entry (approximately 11 feet) also he will grant them pauLasion to have the excavated materials (referred to as spoil) deposited on their property with the understanding that it will be done in an orderly fashion. No large mounds, stay within the contour of the land. Mr. Goldfarb to prepare permission leases for deposit of spoil. Depositing of this material will be donna by the contractor from the State. Mr. McCarrell commented on the tributary stream. An adequate channel should be designed for the water shed. Mr. Pettit read a portion of a letter from R.C.A in which they state that this work shall be done. Messrs. Goldfarb, MaCarrells Tubas and Yablonaki left the meeting at this time D. ' E. Brown, President *ad General Manager of the Conumdty Transit Service of Bridgeville.. (a bus line) informed the Washington County Board of ssioner$ that the Commissioners of Allegheny County approved a mass transit system program early this week. This program will be administered by the Allegheny County Port Authority and Mr. Brown stated that three bus lines presently operating in Washington County will be purchased by the Authority* Bus lines to be affected by this program area Cad+amunity Transit Service, Peskin CoMpany operating in the western end of our County and the Noble J. Said member to have a voice on bus rates, schedule and service, The Port Authority will notify our County in order that we can officially appoint a member to,the Board, The Board expressed their the to Mr. Brown for this information and at this time he left the meeting.
