THE FOREGOING MINUTE READ AND APPROVED: Febru 1957 ATTES 11hief Clerk No. lo6 Office of the County Commissioners Washington., Pa., February 14., 1957 Board of County Commissioners in special session., those present being Commis- sioners Pettit, Lane and Mazza. Motion by Mr. bane, seconded by Mr. Mazza, that the following Agreement., between the Commonwealth of Pennsylvania., acting through the Department of Highways,, concerning certain Legislative Routes., better described in the Agreement, all mutes located in South Strabane and Somerset Townships,, Washington County, be adopted: THIS AGREEMENT, Made and entered into this 14th day of February., A.D. 1957, by and between the Commonwealth of Pennsylvania, acting through the Department of Highways,, herein- after called the GONMNWEALTH., and the County of Washington., by its County Commissioners herein- after called the COUNTY. W I T N E S S E T H WHEREAS, The Commonwealth is making, or is about to make an improvement on Legis- lative Route 62088, Section 12 62054 Spur E,, Section 1., from Stations 201+79.21 to 352+00.00; Route 62103., from Stations 31+55.00 to 32+43.01; Route 62075, from Stations 8+66.00 to 30+49,77, , Route 62088 Relocated., from Stations 8+75-00 to 16+12.99 and Township Road #533,, from Stations 4+00.00 to 14+00.00" all located in South Strabane and Somerset Townships, Washington County, which will require the taking of additional property for right-of way purposes., and the payment of damages to the owners thereof; and WHEREAS, The County., by resolution duly adopted., has-refused to assume responsi- bility for any of the property damages involved in the improvement., but desires to make a contri- bution to said damages in order to assist in the construction of the highway. NOW,, THEREFORE., IT IS AGREED by and between the parties heretot SECTION 1. The Commonwealth will proceed to make the improvement and will assume responsibility for all property damages incurred by reason thereof, and w y to the property ill pa y owners, or others legally entitled to receive the same., when and as ascertained, either by le gal proceedings., or by agreement with the owners., the full amount of property damages to which they are legally entitled. I SECTION 2. The County of Washington shall pay to the Commonwealth the sun of Tan Thousand ($10.,000.00) Dollars, said sum to be paid either in installments or as a whole, at the option of the Commonwealth., upon receipt of certification or certifications from the Secretary of Highways,, setting forth the amounts that have been expended by the Department of Highways in the settlement of property damages in connection with the aforesaid improvement. SECTION 3. The estimated amount of property damages in connection with the pro- posed improvement is Two Hundred Fifty Five Thousand Two Hundred ($255..200,00) Dollars. Hurush , Dekuty Attorney General VHEREAS, The Commonwealth of Pennsylvania,, acting through Use D4POLrtment of Highways., is about to improve a section of State highway designated as Legislative-Route 62088, Section 1; Route 62054 Spur E, Section 1, Route 62103; Route -62075, Route 62088 and Township Road #533, in Washington Count ; and WHEIM, The Commissioners of Washington County have refused to assume liability for the, property damages involved in said improvement, but have indicated their willingness to make a contribution toward the cost of said damages resulting from this improvement. NOW., THEREFORE., BE IT RESOLVED: That the County of Washington,, by its County Commissioners, enter into an agreement with the Department of Highways., providing that the Department of Highways will assume responsi- bility for the property damages in connection with the proposed inprovement; and providing further that the County will contribute the amount of Ten Thousand ($10,,000,00) Dollars., toward the cost of said property damages involved in said improvement.
