Ford, Sr., Diana L. Irey and J. Bracken Burns, Sr. and Controller Paul Belcastro. Elected officials present included: President Judge Gladden; John Pettit, District Attorney; Sam Secreet, Sheriff; Phyllis Ranko Matheny, Prothonotary; Kathleen Flynn Reda, Register of Wills; Coroner Timothy Warco; Barbara Gibbs, Clerk of Courts; Kathy McCullough -Testa, Recorder of Deeds; Francis King, Treasurer; and Judith Fisher and Sandra Ortwein, Jury Commissioners. Chairman Ford noted for the record that the Salary Board met in executive session on January 2, 1997, in order to discuss personnel matters. Chairman Ford entertained a motion to approve Minute No. 3-S-96 dated July 11, 1996. Moved by Mrs. Irey, seconded by Mr. Burns, to approve Minute No. 3-S-96 dated July 11, 1996, as written. Moved by Mrs. Irey, seconded by Mr. Burns, that the salaries listed on the respective departmental salary schedules reflect the negotiated wage increase for union and non -union hourly employees as negotiated with (1) Service Employees International Union (SEIU); (2) Pennsylvania Social Services Union (PSSU); (3) Washington Court Association of Professional Employees (WCAPE); (4) Teamsters Local 205; and (5) Deputy Sheriffs Association; and reflect a 3% increase for salaried employees, effective January 1, 1997. Roll call vote taken: Mr. Belcastro - Yes; Mr. Burns - Yes; Mrs. Irey - Yes; Mr. Ford - Yes. Motion carried unanimously. Chairman Ford noted for the record that it is the consensus of the Board that any procedural errors in the salary schedules may be corrected administratively by the Office of Employee Relations. COURTS Moved by Judge Gladden, seconded by Mrs. Irey, to retain all Court employees as listed under each department at the classifications and salaries as contained in the salary schedule book. Roll call vote taken: Judge Gladden - Yes; Mr. Belcastro - Yes; Mr. Burns - Yes; Mrs. Irey - Yes; Mr. Ford - Yes. Motion carried unanimously. Moved by Judge Gladden, seconded by Mrs. Irey, to CREATE a position of Senior Judge Secretary/Court Crier at a salary of $24,360.00. Roll call vote taken: Judge Gladden - Yes; Mr. Belcastro -Yes; Mr. Burns - Yes; Mrs. Irey - Yes; Mr. Ford - Yes. Motion carried unanimously. Moved by Judge Gladden, seconded by Mrs. Irey, to waive the one-year eligibility requirement for across- the-board increases for Law Clerks. (It was noted that this involves adjustments for two Law Clerks and that their 1997 salaries will be $25,453.) Roll call vote taken: Judge Gladden - Yes; Mr. Belcastro - Yes; Mr. Burns - Yes; Mrs. Irey - Yes; Mr. Ford - No. Motion carried. MINUTE BOOK SALARY BOARD WASHINGTON COUNTY, PENNSYLVANIA Moved by Judge Gladden, seconded by Mrs. Irey, approving a salary increase for the two positions of Masters in Divorce. (The 1997 salary will be $19,999.) Roll call vote taken: Judge Gladden - Yes; Mr. Belcastro - Yes; Mr. Burns - Yes; Mrs. Irey - Yes; Mr. Ford - Yes. Motion carried unanimously. Moved by Judge Gladden, seconded by Mrs. Irey, approving a salary increase for the Juvenile Master. (The 1997 salary will be $20,000.) Moved by Judge Gladden, seconded by Mrs. Irey, to CREATE an additional contract position of Conflict Attorney at a salary of $20,000.00. (This salary is also applicable to the two existing positions.) Roll call vote taken: Judge Gladden - Yes; Mr. Belcastro - Yes; Mr. Burns - Yes; Mrs. Irey - Yes; Mr. Ford - Yes. Motion carried unanimously. RECORDS MANAGEMENT Moved by Judge Gladden, seconded by Mrs. Irey, to CREATE a part-time position of Records Clerk at the rate of $8.15/hour (maximum of $10,000.00). COURT ADMINISTRATOR Moved by Judge Gladden, seconded by Mrs. Irey, to approve a salary increase for the position of Court Administrator. (The 1997 salary will be $42,038.) Moved by Judge Gladden, seconded by Mr. Burns, to approve a salary increase for the position of Probation Officer Supervisor from $33,096 to $34,464. Commissioner Burns stated that it was his understanding that these positions give the Sheriff a broader pool of employees and that they are only used when needed. Chairman Ford stated that according to the Budget Director, these part-time positions have been used on a regular basis. Roger Metcalfe, Budget Director, noted that there are currently ten (10) part-time and one (1) per diem Deputy Sheriff positions and that in 1996 a total of $111,818 was spent for these positions. Commissioner Irey asked if any overtime dollars were saved by having these part-time positions. Mr. Metcalfe stated that over $117,000 was spent in overtime in 1996 and that this amount was pretty much in line with what has been spent in the past. Sheriff Secreet stated that if these part-time positions are eliminated, his only alternative is to pay his regular employees time and a half. Commissioner Irey questioned Sheriff Secreet as to what duties increased that did not allow him to save any money by utilizing these part-time positions. Sheriff Secreet stated that it was due to being overburdened by the Courts. He stated that he is in the process of providing to the Commissioners and the news media a list of all duties performed by the Sheriff's Office in 1996 which will include a yearly total of prisoner transports, service of papers, etc. P 323 MINUTE BOOK SALARY BOARD WASHINGTON COUNTY, PENNSYLVANIA Commissioner Irey asked Budget Director Roger Metcalfe and Assistant Solicitor Jill Devine if they had any information pertaining to the increased workload and related costs of the Sheriff's Office for 1996 as compared to 1995. Assistant Solicitor Jill Devine stated that according to the Court Administrator a substantial portion of the Sheriff's budget is attributable to the cost of juvenile transportation which is an uncontrollable cost. Discussion followed. Commissioner Irey suggested that this matter be held in abeyance until the Board can obtain more information in order to make an appropriate deicision. Assistant Solicitor Jill Devine left the meeting to contact the Court Administrator's Office and Judge O'Dell Seneca to obtain information on these costs. When she returned, she reported that the number of juvenile transports increased dramatically from 1995 to 1996, but there is no way to determine if there is going to be an increase in 1997 because it is unpredictable. Therefore, he entertained a motion to ABOLISH the position of Clerk Typist II. Judith Fisher, Jury Commissioner, stated that it had been her understanding since she took office three years ago that the County Solicitor would serve as the Solicitor for the Jury Commissioners. Just recently she was informed that there is a conflict of interest and the County Solicitor cannot represent the Jury Commissioners. She provided to the Board members a list of the job duties performed by the Clerk -Typist in their office and stated that the Jury Commissioners are here to fight for this position and that the office cannot operate efficiently without this position. She questioned the Board as to who authorized the Budget Department to eliminate funding for this .position from the Jury Commissioners' 1997 budget. Chairman Ford stated that it was a recommendation made by President Judge Gladden who had indicated to the Commissioners that the functions of the Clerk -Typist would be performed by the Court Administrator's Office. Mrs. Fisher stated that it is hard for her to understand that President Judge Gladden has the authority to make this recommendation. She stated that the office of Jury Commissioner is a gray area in that she feels it is not included in either the judicial or executive branches of government. Chairman Ford stated that he feels the office is an extension of the Courts and suggested that she discuss this matter with Judge Gladden. She stated that she has tried many times to discuss this issue with Judge Gladden but he has not been available. She stated that through conversations with the Director of Administration and the Budget Director she found out that this position was not being funded. Sandra Ortwein, Jury Commissioner, explained that there was a meeting wherein Judge Gladden made it very clear that he was going to remove some of the administrative duties from the Jury Commissioners' Office and transfer it to the Court Administrator's Office. She said it may be a matter of semantics but the statement was never made that the Clerk -Typist position or person was going to be removed. Chairman Ford asked the Jury Commissioners if they have done anything to challenge Judge Gladden's recommendation. Judith Fisher stated that she talked to an attorney, but unless the Jury Commissioners pay him personally, they don't have any representation. Commissioner Irey asked if there is a provision in the County Code which allows for a solicitor for the Jury Commissioners. Attorney Jim McCune, County Solicitor, stated that he is unaware of anything that would require the provision of a solicitor for the Jury Commissioners. Chairman Ford asked Attorney McCune for his opinion on this matter and whether or not it is proper for the Salary Board to act on Judge Gladden's recommendation or should the matter be held in abeyance. Attorney McCune stated that it is his opinion that the Salary Board does have the authority to act on this matter and that it is proper for the Salary Board to do so. 1 1 Commissioner Irey asked if Judge Gladden has the authority to transfer this work assignment from the Jury Commissioners to the Court Administrator, should he be the one to vote on the action.
