Washington, Pa., March 10, 1983
The Washington County Salary Board met in session on Thursday, March 10,
1983, at approximately 10:30 a.m. in the Public Meeting Room of the Courthouse
Square Office Building, Washington, Pennsylvania, with the following members
being present: Judge Sweet, Commissioners Mascara and Gilmore and Controller
Beharry. Absent being: Commissioner Paluso who was ill. Also being present:
Chief Clerk Dallatore; Personnel Director Margaret Pennline; Administrative
Assistants Davis and DuJordan; Judith Costa, Payroll Audit Supervisor; Linda
Hands, Clerk -Steno II; Lucy Rea and Norman Baker, interested citizens.
J060 - JUVENILE PROBATION
Judge Sweet brought up the matter of stand-by pay for Juvenile Probation
employees at the rate of 25% of straight time. Commissioner Mascara stated that
his personal opinion is that this is not a matter for the Salary Board but rather
a matter between the Commissioners and the Courts. He further stated that he
thinks we should have an agreement between the Commissioners and the Courts and
submit it to the Controller for payment. Judge Sweet stated that it is his
understanding that the Controller won't go along with that without a motion of
Salary Board. Discussion followed. Judge Sweet noted that this is a matter of
precedence in a sense in that we would be putting somebody on, day on -day off,
indefinitely, at 25% of straight time to receive calls. Further discussion was
held concerning whether or not this was a matter for Salary Board. Controller
Beharry stated that she is not looking to approve on -call time or overtime but
that she is looking to find a fixed rate for payment for those instances.

Moved by Judge Sweet, seconded by Miss Beharry, that the Juvenile Probation
Office be authorized to engage any one of its persons, being but one at a time,
from time to time as directed by the Juvenile Court Judge, to be on an on -call.
basis for the receipt of phone calls at a publicly designated number. Such per-
son to be compensated at the rate of 25% of such person's rate (straight time,
no overtime); this is work of a different quality and nature.

COURT REPORTERS
Judge Sweet asked Mrs. Pennline, Personnel Director, to explain the status
of the salary schedule set up for Court Reporters. After Mrs. Pennline explained
the schedule, a discussion was held. Controller Beharry stated that she feels
the confusion rests in the Board's intent to have a raise issued to a certain
,level on an anniversary date versus anniversary date raise and January lst raise.
More discussion followed. The Board was in agreement that the salary schedule
should be updated every year. Commissioner Gilmore stated that every January,
if there is an across-the-board raise that affects the Court Reporters, the salary
schedule will have to be updated; and then on the employee's anniversary date,
if he/she is not in line with the schedule, their salary will be adjusted accord-
ing to the salary schedule. Commissioner Gilmore requested that the minutes re-
flect that an updated salary schedule for Court Reporters will be included in the
Reorganizational Meeting of Salary Board every January for the ensuing year and
that the salary of a Court Reporter will fit said schedule depending upon when
their anniversary date falls.

MAGISTRATES' SECRETARIES
Judge Sweet reminded the Board of the matter of the Magistrates' Secretaries
which is pending. Commissioner Gilmore noted that a recommendation should be
ready for the next meeting.

APPROVAL OF MINUTES
Chairman Mascara asked if there were any corrections, additions or omissions
to Minute No. 48-S, each member having received a copy. Controller Beharry re-
quested that the minutes on page 57 (J060 - Juvenile Probation) read as follows:

Controller Beharry asked about her written request to
Chairman Mascara to have the on -call pay question placed
on the agenda for this meeting. The Commissioners made
reference to their memo of 2-11-83 citing an agreement
with the Courts to make payments at 1/4 the regular
hourly rate. Controller Beharry cited the County Code
related to the Salary Board establishing compensation
and advised that she could not make payments based on
a Commissioners agreement with the Courts. Commissioner
Gilmore questioned the payment of overtime. Controller
Beharry advised that provision is made in the SEIU Con-
tract for such payments, but no provision exists for
on -call pay in the contract. The Commissioners advised
that they would pursue the avenue of a formal amendment
to the Union Contract. Miss Beharry stated that she will
not approve payment of on -call time until the contract is
amended.
Miss Beharry also requested that the minutes reflect that the transfer of
the two Watchman positions from Liquid Fuels to the Property & Supplies Depart-
ment (A029) be retroactive to 1-1-83 (p. 57).
Moved by Miss Beharry, seconded by Mr. Gilmore, that Minute No. 48-S be
approved subject to the above changes as requested by Controller Beharry.

Controller Beharry commented that she would very much appreciate any effort
that could be made to furnish her with an agenda before 10:00 a.m. on the day of
the meeting. Chairman Mascara noted that the Commissioners get their copies at
that same time.
Controller Beharry also asked the Board members if they had an opportunity to
review her memo of 3-2-83 concerning the method of payment to Special Deputies
and as to whether or not those payments should be wages and subject to withhold-
ing and the employee and employment relationship. Commissioners noted that they
had not had an opportunity to review the matter yet. Some discussion followed.
No action taken.
There being no further business, Chairman Mascara declared the meeting ad-
journed at approximately 11:00 a.m.
