The Washington County Salary Board met in session on Thursday, December 15,
1983, at approximately 10:20 a.m. in the Public Meeting Room of the Courthouse
Square Office Building, Washington, Pennsylvania, with the following members
being present: Commissioners Mascara, Gilmore and Paluso and Controller Beharry.
Also being present: Judge Sweet; Chief Clerk Dallatore; Chief Deputy Sheriff
Littleton; Lou Lignelli, JTPA Director and Director of Property & Supplies; Per-
sonnel Director Margaret Pennline; Administrative Assistant Davis; Linda Hands,
Clerk -Steno II; Joann Sarkett, Brownsville Telegraph; Jon Stevens, Observer -Repor-
ter; and Jim Provance, The Herald Standard.
Chairman Mascara called the meeting to order and asked if there were any
corrections, additions or omissions to Minute No. 68-S, each member having re-
ceived a copy. Moved by Miss Beharry, seconded by Mr. Gilmore, that Minute No.
68-S be approved as read.

1-10-84 due to the fact that a new Clerk of Courts would be in office
and felt that the new officeholder should make a recommendation con-
cerning the leave. It was noted that Ms. Shinko and the Clerk of
Courts -Elect should be so notified of this decision.

C001 - DOMESTIC RELATIONS
Judge Sweet explained to the Board the circumstances surrounding the
resignation of Emilie Carson and asked that the Salary Board vote to approve a
severance pay for her in the amount of $1,593.58. Discussion followed. Miss
Beharry stated that she feels it is not a matter of Salary Board to establish
policy and that it is solely a discretionary matter on the part of the Commission-
ers. More discussion followed.
Moved by Judge Sweet that Salary Board approve a severance pay for Emilie
Carson in the amount of $1,593.58.
Miss Beharry objected to the motion in terms of it not being a proper
matter for consideration for Salary Board.
Chairman Mascara directed Judge Sweet to send a memorandum to the Board of
Commissioners requesting a severance pay for Emilie Carson as per above and that
the County Solicitor draft a release form for Ms. Carson's signature.
(Judge Sweet and Mr. Brady left the meeting.)

Mr. Paluso stated that he doesn't think this is a priority item especially con-
sidering the financial condition of the County. Mr. Gilmore explained the painti.ig
to be done and that the money had already been borrowed to do the work.
Motion seconded by Miss Beharry to establish the two slots as per above
for a period not to exceed five weeks.

Mrs. Pennline, Personnel Director, began presenting to the Board for their
consideration and approval the items listed on the agenda. However, Controller
Beharry requested that before the Board went any further, she would like the fol-
lowing comments made a part of the record.
Miss Beharry: I consider the Board acting on creation of positions effective
after the first of the year to be illegal. What I have before me, which I re-
ceived at 9:15 this morning, certainly in my opinion constitutes a virtual reorganii-
zation. It seems that this Board has no power to bind a future Salary Board; and
any action taken today could, in fact, not be considered valid after the first of
the year and the new Salary Board would have to meet at reorganization. I also
have a problem with it because County officers who have a statutory right to sit
on decisions which are being made here today, in fact, are not here and have not
been advised of their right to be here.

Chairman Mascara took exception to Miss Beharry's comments and explained
that the County officers (i.e., Judge Gladden, the District Attorney and the
Clerk of Courts) have agreed with this action in order for their offices to be
staffed with the necessary people on Tuesday, January 3rd, in order to conduct
the official affairs of the County. Mr. Mascara further explained that he plans
to recess the Salary Board reorganization meeting to be held on January 3, 1984,
until a later date due to the fact that the new Board of Commissioners will proba-
bly re -open the 1984 Budget. Further discussion followed between Chairman Mas-
cara and Controller Beharry. Commissioner Paluso then requested a point of order.

I can't go along with that until we get into it a little more. If we get into it
at reorganization, that's a different thing; but I don't see how we'll get every-
body paid. We still have other obligations, and I don't think this is going to
Ihelp things.
'Miss Beharry: It's very simple how you get everybody paid. You have reorganiza-
tion before payroll is run the first week in January. That's how you do it.
;That's how it should be done and proper notification given to members of the
Board.
Mr. Mascara: We'll let the motion die and take it up in January.
