The Washington County Salary Board Reorganization Meeting re -convened at
10:45 a.m. on Thursday, March 8, 1984, in the Public Meeting Room of the Court-
house Square Office Building, Washington, Pennsylvania, with the following member
being present: Commissioners Mascara, Petrosky and Paluso and Controller Beharry
Elected officials present were: Judge Gladden; District Attorney John Pettit;
Sheriff Fazzoni; Bob A. Franks, Prothonotary; Kathleen Flynn Reda, Register of
Wills; John F. Yoney, Treasurer; Barbara Gibbs, Clerk of Courts; Olga Woodward,

Recorder of Deeds. Also present were: Jean Hamel representing Coroner Jackson;
Chief Deputy Sheriff Ferdal Littleton; Chief Clerk Dallatore; Margaret Pennline,
(Personnel Director; Solicitor Bassi; Administrative Assistant Davis; Judy Lomago,
Executive Secretary; Janice Urban, Office Manager of the Personnel Office; Judith
Costa Sasselli, Payroll Audit Supervisor; Attorney Debbie O'Dell Seneca; Lou Lig-
nelli, Director of Administration; Captain Fred Johns of the Sheriff's Office;

Chairman Mascara called the meeting to order and noted that the meeting
was being re -convened from January 3, 1984. He entertained a motion to establish
the effective date for the abolishment of positions.
Moved by Mr. Petrosky, seconded by Mr. Paluso, that any action taken by
this Board which may result in the abolishment of a position will be effective at
the end of the business day on;Friday, March 23, 1984.
Roll call vote taken:
Miss Beharry - Yes; Mr. Paluso - Yes;
Mr. Petrosky - Yes; Mr. Mascara - Yes.
Motion carried unanimously.
Miss Beharry: Mr. Chairman, may I state for the record before we begin the
agenda that I object to the fact that I was presented with the agenda in its pre-
sent form at approximately 9:30 this morning. I have had about an hour and ten
minutes to review numerous significant changes in this County's salary schedule,
and I personally am not prepared to sit here and vote on this agenda today con-
sidering that we have been in recess for more than two months, we've had an adopt
ed budget for almost three weeks. I have seen two previous agendas which are not
incorporated into this agenda. I feel it's really putting upon the energies and
abilities of an elected official to have to act on these matters. I will do my
best in the areas in which I have had an opportunity to examine what's on this

it is even against the policies of the Board to present these matters under these
circumstances.
Chairman Mascara apologized for any inconveniences to Miss Beharry. Some
discussion followed between Chairman Mascara and Miss Beharry.

"no" for all management raises and vote to retain positions
as they existed and, of course, approve all bargaining unit
raises as negotiated by the Commissioners.

Miss Beharry: If I calculate the salary schedule we have before us in your offic ,
the net cost to Washington County in the change in your office in comparison to
Mr. Bigi's operation of the office is $36,560 and some odd cents per year. Now,
I don't understand why it is that we're sitting here talking about laying people
off' in other row offices and we're giving management raises and we're creating an
additional $36,000 in costs in the District Attorney's office when, in fact, you
talked about running that office on the same money or less than Mr. Bigi.

Mr. Mascara: Miss Beharry, I should remind you that I think you have a distorted
perverted view of your role on this Salary Board. I haven't seen you yet vote
for a tax. You keep asking other people about what they spend, and maybe we
should all sit down and discuss really what you spend and what you've cost this
County.
Miss Beharry: I've asked for the opportunity to do that, sir, and I've been
denied the opportunity to discuss that.
Mr. Mascara: ....in trying to balance a budget and in trying to give a union
raise, I'll remind you that you decided to give the Commonwealth of Pennsylvania
$100,000 that they didn't want but you insisted that they take and that caused
a lot of.problems for the employees of this County and the row officers who have
been asked to temporarily give up an employee...so if you want to put the cart..
if you want to use this as a forum for politics, then we'll do that ... I'm not
going to let it go on too long. Your office is doubled the size of my office...
wait a minute, I'm speaking... that included the fiscal affairs department. You
spent 500 hours doing an audit out at Reichel's office, County taxpayers' dollars
and you found nothing. So let's put the cards on the table. You area spendthrift
and you want to pretend that you're looking after taxpayers' dollars and you
haven't looked after taxpayers' dollars since you came here. Let's call it like
it is. Don't sit there and play games with me. Now, one other point, then you
can talk. You don't tax. You don't sit down and figure out how this money's
going to be spent and worry about if it's going to come in or not. Your obliga-
tion as elected County Controller is ministerial. You have a vote and that's it.
We decide who gets what because we have to pay; we're responsible, not you. You
want to run the Courts and you've been trying to do that. Now you want to run
the D.A.'s office and you're not going to do that. We need a good D.A. We need
the staff and we're going to support him. We're going to give him all the assist
ance we can give him. And the row offices have been asked to relinquish one per-
son; that's a temporary situation. Most of them have agreed to go along with it.
We're working with a crystal ball. We don't know what's coming in in 1984 and
those are the decisions we have to make and we're making them. Those are not
your decisions to make. You have a vote - yes or no. I don't think John has an
obligation to sit down with you and tell you how he's going to run his office.
We don't come down to your office and tell you how to run it. Now go ahead and
speak.
Miss Beharry: Thank you. I believe that the Controller by law is placed on the
Salary Board to ask precisely the kinds of questions that I am asking...
IMr. Mascara: To set positions and salaries.
Miss Beharry: That's what we're doing here, Mr. Mascara.
IMr. Mascara: When you start raising the money, I'll let you go ahead and make
Isome decisions.

the Commonwealth of Pennsylvania and on an October lst fiscal year with the
federal government; and when you prepare a budget, the best thing you're doing ie
,a guess.
Miss Beharry: Can I talk now, Mr. Mascara, you said you were finished.
Mr. Mascara: I can cut the whole debate off now. Go ahead and hurry up 'cause
I got to get moving here, tying a lot of people up here, costing the County money
see?
(Miss Beharry: We don't have a crystal ball, Mr. Mascara, but we're willing to
give....
Mr. Mascara: We don't. You don't.
Miss Beharry:...someplaces 18, 20% raises to individuals who are in high manage-

Mr. Paluso: I think we should point out too, Mr. Pettit, that, you know, the in-
cident of crime in this County is, like everyplace else, increasing and we can
prove that by the situation in all the jails. There are some ..... make some ex-
ceptions to cutting budgets to take care of priorities. Quite frankly, one of
my priorities is convicting criminals, John, and that's the reason I'm voting for
this one additional person to put on here.....
Mr. Pettit: For the record, and I don't intend to engage in any debate at this
time either, but, Miss Beharry, your facts aren't correct. The difference be-
tween 1984 and 1983 is approximately $19,000. I had requested $25,000 and it is
approximately $19,000, and the fact that we are now almost two and a half months
into 1984 and I've been functioning with somewhat of a, not a skeleton staff, but
certainly less than what they had in 1983, has effected a savings of over $7,500
at this point in time; and I also have not been using the per diem County Detec-
tives which was $5,400 in the 1983 budget, so when these figures are matched out,
I think when I come back to this Board next year, even though you have granted me
the additional person, I think the overall dollars spent by my office will effect
a savings and I appreciate the Board's consideration.

Mr. Pettit brought to the Board's attention a request he received from
Attorney Debbie O'Dell Seneca for payment of 3 hours for time that she worked on
1-3-84. Mr. Pettit made some further comments on the matter. He noted that he
is willing to authorize the payment out of his budget if she agrees to not re-
quest any vacation benefits. Mr. Pettit then went on to talk about a file which
he understood had been in the possession of Attorney Debbie O'Dell Seneca and
which he felt was the property of Washington County and which he now understands
Ihas been turned over to Attorney Herman Bigi. He further stated that he feels
the file is a work product of the County and that it should be turned over to his
administration to be used in the proper administration of law enforcement.
Moved by Mr. Pettit, seconded by Mr. Petrosky, approving the foregoing pay-
ment to Attorney Debbie O'Dell Seneca with the understanding that there would be
no vacation time attached to her request for payment.
Discussion was held between Miss Beharry and Mr. Petrosky as to whether or
not this matter required a vote by the Board. Solicitor Bassi recommended that
a motion be made in order to avoid any problems. Discussion was then held be-
tween Miss Beharry and Mr. Pettit.
Attorney Debbie O'Dell Seneca responded to the Board that she did not do any
thing of any impropriety. She stated that the file is the personal property of
Attorney Bigi and that Attorney Bigi does have'the file and that it is comprised
of copies of appellate briefs that are in existence in the District Attorney's
office. She further stated that she is requesting to be paid for those three
hours worked and that she will not make a request for any additional benefits
from the County.

Sheriff Fazzoni stated that he does not intend to abolish the position of
,Captain Deputy Sheriff (Fred Johns), but that he is going to do away with this
position temporarily until the County becomes feasibly sound with money. Chairma
Mascara thanked Sheriff Fazzoni for his cooperation and stated that given the fis-
cal condition of the County turns for the better, the Sheriff can count on his
cooperation to staff the Sheriff's office properly. Sheriff Fazzoni made some
comments in reference to comments made earlier by Commissioner Paluso (p. 187) in
relation to the increase of crime in Washington County. He noted for the record
that some time in the near future he still wants it possible to request the Kirin
of six additional deputies that he had previously requested. It was noted that
the position of Captain Deputy Sheriff was not being abolished; it would be a lay-
off.
4193-293 - CORONER
Chairman Mascara made reference to a letter submitted by Coroner Jackson stat
ing that he could not attend this meeting due to the necessity of his being in
Harrisburg but was requesting that Jean Hamel continue to be the Deputy/Supervisor/
Secretary of the Coroner's Office and to have her salary increased from $17,825.0
to $19,325.00, which amounts to a $1,500.00 increase (and includes the $50.00 per
month for weekend duty). Chairman Mascara advised Mrs. Hamel that the Commission
ers would talk to Mr. Jackson personally when he returned and noted that the Boar
of Commissioners has made a decision of granting to management personnel a raise
of 4% or $1,000.00, whichever is greater. Mrs. Hamel explained the reason for
Mr. Jackson's request of an increase of $1,500.00 for her. She noted that in the
1984 Budget he had requested that deputies be allowed to act in his behalf when

Ms. Gibbs: As Mr. Fazzoni has alluded to, as the District Attorney has alluded
to, I believe that cutting back an employee in this office is really going to
seriously hamper the functions in that office. And I am certain that you can
appreciate that and I can also appreciate the position of the Salary Board and o
the fiscal condition of the County at the present time. In the other offices, a
cutback of one employee is approximately 8 to 10% of the work force, but in the
Clerk of Courts office, it approaches 20% reduction in force. I think I can wor

Mrs. Woodward stated that she feels the Clerk Typists in her office are
the lowest paid hourly employees among individuals in other offices that perform
the same type of work. She stated that she feels they should be changed from
Clerk Typist I's, Grade 2, to Clerk Typist II's, Grade 4. Chairman Mascara ad-
vised Mrs. Woodward that this matter should go through the Reclassification Board
She noted that in October of 1983 she requested a reclassification, but that it
was suggested that the matter be held until the union contract was ratified.
Mrs. Pennline noted that the matter had been considered for the Reclassification
Board but there had not been any meetings of the Reclassification Board during
union contract negotiations; therefore, the matter did not go through the Reclass
fication Board. Chairman Mascara suggested that Mrs. Woodward submit a memo re-
questing that the matter be considered by the Reclassification Board.
Mrs. Woodward: I've been listening to all the motions this morning and I'm a
little perturbed because I'm in the same position Mr. Yoney is; and as one of the
executive board members of our state association, I fought hard to get an increas
in fees for any recordings in my office because I realize County government has
to function and practically your only source of revenue is taxation. So last
year, we were successful in getting an increase in fees which this year should
possibly amount to a 50% increase in income from the Recorder's Office. Several
years ago, when we had to go through a financial bind in the County, I did

eliminate one employee and I took it upon myself to do that work. Mr. Bassi is
in that office every day and he knows the work that I do. I had a retirement in
January and because we have been a little slow, I have not filled that vacancy.
Hopefully, I could get it done in April when our busy season starts to come
around. And the problem in my office is that I have two employees that are en-
titled to a 5-week vacation, and I think Mel can verify the fact that my Deputy,
Caroline, has not had a 5-week vacation in the last four years. The most she has
taken is 3 weeks because we have been up against the wall and we just have to havE
help. The other two clerks are entitled to 4 weeks' vacation so virtually I'm
stuck without a clerk all year.
Discussion followed between Chairman Mascara and Mrs. Woodward. Mr. Mascara
stated that the Commissioners have asked the row officers to beg their indulgence
to go along with them and see what direction we're headed. He noted that it may
be necessary for the Commissioners to sit down with each officeholder and review
their workload and work period and make adjustments if necessary. More discussion

Miss Beharry: Because you don't deserve it.
Mr. Petrosky: Well, that's your opinion, Miss. That is your opinion and I think
you should state it as such.
Miss Beharry: It is my opinion.
Mr. Petrosky: Obviously, there are some people in this County who think we're
doing the right work and doing it in the right manner.
Miss Beharry: I don't think a single row officer in this County would agree with
you today, Mr. Petrosky.
Mr. Paluso: They don't raise any taxes.
Mr. Petrosky: Well, for your information, Miss Beharry, I contacted every single'
row office personally at the direction of this Board; and, certainly, if I'm a
row officer, I'm going to come down here and object to losing an employee also,
okay? But they understand the greater scheme of things, and sometimes you lose
sight of that because you're so interested in making political hay and calling us
foolish and irresponsible when the label applies to you, Miss Beharry.
Miss Beharry: Mr. Petrosky, I don't have to call you anything. Your actions
demonstrate your capacity and your motivations .... your raises for your pet employ-
ees.
Mr. Petrosky: I am quite happy and quite satisfied...

Miss Beharry: Mr. Chairman, the table of organization which was presented to me
this morning incorporates my conversation with Mr. Petrosky yesterday morning in
the respect that it abolishes the position of Clerk III in the Controller's Offic
and the Controller's effort to cooperate with the Commissioners in their financia
need. It, however, reflects three things that I did not request -- two things I
did not request and it does not reflect one that I did. A request for two manage
ment raises which I did not request and which I do not wish to incorporate in my
salary schedule and it does not...
Mr. Mascara: Which are you speaking about?
Miss Beharry: Deputy Controller and Payroll Audit Supervisor.
Mr. Petrosky: Who is that?
Miss Beharry: Roger Metcalfe and Judith Costa Sasselli.
Mr. Mascara: You don't want to give them the raise?
Miss Beharry: That's correct. I couldn't lay somebody off in my office and....
grant management raises.
Mr. Paluso: What do you suggest we do, we cancel the labor contract?
Miss Beharry: No, my employees would stay in my office and work at the rates tha
they are ...... Mr. Paluso.
jMr. Paluso:
Thought maybe you wanted to caneel'the contract.
(Miss Beharry: That's something you have to live with. What we've done today is
(something we've made ourselves live with.
(Mr. Paluso:
You really think that's fair?
Miss Beharry: Yea, I do. The only other problem we're having and I know we
talked about it ongoing for months and that is the Audit Manager position which
was funded last November at a reorganization at $15,000. At that time, that posit
tion was funded because an Accountant position was abolished in the Controller's
Office and there was no additional cost...
Mr. Mascara:
What was the salary of that Accountant?
Miss Beharry: $14,79 something. We rounded it off to $15,000. We traded an
Accountant's position for an Audit Manager position. At that time the Board indi
cated that they would not go along with the $20,000 position unless they knew somE
qualifications of the -individual who might take that position. I have attempted
to call a Salary Board meeting prior to today's reorganization of the Board to
get auditing of District Justices underway. That has failed. Due to the failure
to deal with that position in the first two months of the year, we have now gen-
erated enough surplus in the $15,000 position to pay the Audit Manager the equiva-
lent of $20,000 for the remainder of the year without any additional cost to the
County and certainly the difference in a couple of thousand dollars of management
raises would help offset that even further. Sitting here as the Controller, I am
willing to concede a savings to the County in my salary schedule somewhere in the

neighborhood of $9,000 or $10,000 that would incorporate an annual equivalent in
the Audit Manager position for the remainder of the year at $20,000 and I would
like to move the table as outlined as I have indicated.
(Mr. Paluso questioned Miss Bbharry as to exactly what she was moving.)
Mr. Mascara: You used to handle the CETA audit for the County, accounting for
CETA, at one time?
Miss Beharry: We used to handle the accounting.
Mr. Mascara: Yes, the accounting for CETA. You handled all their billings and
processing of checks.
Miss Beharry: We still do.
Mr. Mascara: Still do. You know, that was at ... What was the high on that, Lou,
eight million at one time?
Lou Lignelli: Yes.
Mr. Mascara: What's it down to now?
Lou Lignelli: A couple million dollars.
Mr. Mascara: A couple million dollars. I think that's a salient point to make
and consider. The other .... point in auditing is that under the recent Revenue
Sharing Act, it was changed from an audit of the entire County from once every
three years to annually so beginning with this fiscal year, the federal govern-
ment, we will be required to audit the entire County.
Miss Beharry: I understand that, Mr. Mascara. I'm aware of it. I think you are
also aware of the statutory requirement for the Controller to audit District Jus-
tices.
Mr. Mascara: Yea, it would be impossible to spend 500 hours in every office;
there's 14 offices. It's my understanding that the federal government will accept
the audit of the District Magistrates by the independent certified public account-
ant to do the audit so it would look to me that there would be a duplication of
effort on the part of your office to...
Miss Beharry: Well, how about the federal government accepting the audit of the
District Justices by the Controller as mandated by State law?
Mr. Petrosky: I was under the impression, Miss Beharry, that the federal govern-
ment would not accept an audit done...
Mr. Mascara: They won't.
Mr. Petrosky:... done by your office.
Miss Beharry: I have no idea. All I know is...
Mr. Petrosky: ...that it has to be by a big 11811 firm. Those are the guidelines
that we must function on.
Miss Beharry: ... What the federal government does or does not accept in its
federal revenue sharing does not negate the Commonwealth's requirement for the
Controllers to audit.

Mr. Mascara: The Commonwealth will accept the federal government's audit of...
the federal government accepts the audit of the revenue sharing....
Miss Beharry: I am not of that understanding, Mr. Mascara. There is a require-
ment for the Controller to annually audit all District Justices...
Mr. Mascara: I can refer you to...
Miss Beharry: ...It is not in lieu of federal revenue sharing audits. It's not it
lieu of outside auditors. It is a statutory requirement.
�Mr. Mascara: And you would want to go ahead and spend the money anyway even
though we had an audit done by...
Mr. Paluso: The statute doesn't say how it's to be done. It says...
Miss Beharry: It says the Controller shall audit. It does specifically state
the Controller shall audit.
Mr. Mascara: But they will accept the duties that have been performed...
Miss Beharry: I think your argument, Mr. Mascara, is with the Legislature, not
with the...
Mr. Mascara: No, my argument is with anybody. I was told or I saw a letter from
a legislator, a very prominent one, who said that the general revenue sharing
audit that was once every three years, now it's going to be every year, which
would satisfy your requirement. It would seem to me that at least we owe it to
ourselves since we're so conscious of money, the taxpayers' money, that we should
pursue that; and if that is in fact the case, then why should we go and duplicate
services of a big '18" audit when we have to send it in anyway.
Miss Beharry: I don't think they will be auditing all District Justices as a
matter of fact, Mr. Mascara.
Mr. Mascara: They will.
Miss Beharry: In previous federal revenue sharings, the one that I was involved
in 1981, they barely touched row offices let along any District Justices. They
did not encompass anywhere near the County funds that the Controller's responsible
under law to audit.
Mr. Mascara: Things have changed now in revenue sharing.
Mr. Paluso: I really don't think there's any problem in getting somebody to fill
that job .... We're talking about auditing the County's part of the Magistrates
office and that is not .... If we did it the way you did the last one, then it'll
take four years.
,Miss Beharry: I understand what you're saying, Mr. Paluso. Mrs. Pennline, you
helped us draw up the qualifications for the job in terms of degree and some ex-
perience in auditing and you saw that the salary requirements of the individuals
who had some experience. Would you express to the Board what they were.
Mr. Paluso: Do you want an Accountant or do you want an Auditor?
Miss Beharry: Someone who has some experience in auditing.
Mr. Paluso: A graduate Accountant...

Mr. Petrosky: Well, isn't it true that you have some Auditors in your office tha.
have experience?
Miss Beharry: No, I do not.
Mr. Petrosky: It was to my understanding that both Mr. Metcalfe and also Mr. Sas.
selli, or Mrs. Sasselli, excuse me, Judith, I'm sorry, that have formerly done
audits on Magistrates.
Miss Beharry: That's incorrect. Both Judith Costa Sasselli....
Mr. Bassi: That is not incorrect. That's in a deposition that we took.
Miss Beharry: Just a minute now. Judith Costa Sasselli and Roger Metcalfe work-
ed under the direction of Mr. Gillespie who was conducting the audit. We are
looking for an individual to supervise the audit. We're not looking for individu
als to do work in the audit. I have a very important point. Judith Costa Sasselli
and Roger Metcalfe have full time duties as it is. They have no time. Do you
want me to put Judith Costa Sasselli in that slot and hire another Payroll Audit
Supervisor or do you suggest I move Mr. Metcalfe out to audit and hire another
Deputy Controller? There are only so many hours in Mr. Metcalfe's and Mrs. Sas-
selli's day. And what I'm saying to you is that we have the money in our budget.
I'm talking about getting you back $10,000 in savings in one position and not
costing you any more to give me one qualified person for the rest of this year
and I'm only talking for nine months.
Mr. Mascara: We gave you an extra person to do Reichel's office, right? Five
hundred hours....
Miss Beharry: That was under Court Order.
Mr. Mascara:
Well, I understand that, but that doesn't change the idea of how
much time it takes to audit a Magistrate's office. What we're interested in and
I think what the taxpayer's interested in, is you took so much money in, you paid
so much money out, you should have so much money left. We're not interested in
reviewing thousands of pieces of what would you call them, Mel, the citations,
the performance audit, you know. I don't profess to be a lawyer and I'm not goinc
to tell the Courts or the Magistrates how to run the Magistrate's office.
Miss Beharry: I understand that too, Mr. Mascara.
Mr. Mascara: Once again, you have displayed the propensity and proclivity to try
to tell people how to run their offices and we can't afford that. We can't afforc
that luxury.
Miss Beharry: We didn't do that at all, Mr. Mascara. In fact, the audit took a
little longer than it would normally take because...
Mr. Mascara: Five hundred hours. That is a 50-hour...
Miss Beharry: I don't agree with you. I would have to check on that.
Mr. Mascara: Well, you can check on that. It takes 50 hours at maximum from in-
ception of the audit which is a pre -audit...

Mr. Mascara:
...from the inception of an audit to the completion of an audit,
post -audit interview, exit interview, it should take 50 hours. You took approxi-
mately 500. I won't say 500 'cause I'm not sure of the number. So if you take
that times fourteen offices, your budget would be double what it is.
Miss Beharry: You see, there are two major considerations here. One, they were
per diem Auditors who never audited Magistrates or District Justices before. We
had a shift in that person midstream so we had to take two individuals and start
them from scratch on auditing District Justices, the manual, the procedure. And
the other thing to consider is that the audit procedure, the audit program which
was followed was not my audit program. It was the Attorney to the Auditor Genera.
and State Court Administrator's Office and the Association of District Justices
which drew up the guidelines. We followed programs established. We did not writ)
our own program and that's what took those hours. As I indicated to you, as I
indicated to Mr. Petrosky, the Controller's office is willing to do everything it
can in consideration of the financial strain in which the County finds itself. I
think a $10,000 concession is a very sizeable and reasonable concession and I
think that the $15,000 that will be spent for the remainder of the year for an
Audit Manager position, let's evaluate it. At the end of nine months, after I've
already spent that $15,000, we'll see how long it takes -to audit the District
Justices. We've been shooting at the dark. Everybody claims they know how long
it takes them, why can it take that long...
Mr. Mascara: A professional said that. I didn't say that.
Miss Beharry: The professionals, Mr. Mascara, when they dealt with the situation
said that if they found no problems and no mistakes...
Mr. Mascara: You didn't find any? Was there any defalcations at Reichel's?
(Miss Beharry: No, there were not. There are 13 other District Justices.
Mr. Paluso questioned the motion.
Miss Beharry: I want to drop my management raises, go to $20,000 (for the Audit
Manager position) and I'll abolish one position. (Miss Beharry made that motion.
Motion died for lack of a second.
Mr. Paluso suggested $17,500 for the Audit Manager position but stated
that he would not accept not granting the other two people their raises.
Moved by Miss Beharry, seconded by Mr. Paluso, setting the salary of the
Audit Manager position at $17,500.
