The Washington County Salary Board met in session in the Public Meeting
Room of the Courthouse Square Office Building, Washington, Pennsylvania, at
approximately 10:35 a.m. on Thursday, October 31, 1985, with the following mem-
bers being present: Commissioners Mascara, Petrosky and Paluso and Controller
Beharry. Also being present: President Judge Gladden; Mary Drewitz, Court
Administrator; Chief Clerk Dallatore; Attorney George Retos of the Solicitor's
Office; Coroner Jackson; Margaret Pennline and Janice Urban, Personnel Office;
Wayne Fleming and Ken Barna, Tax Assessment Office; Chief Deputy Sheriff Little-
ton; Judi Lomago, Executive Secretary; Linda Hands, Clerk -Steno II; Earl Bugaile,
Planning Commission; Natalie Eddy, Herald -Standard; Jon Stevens, Observer-ReportEr;
and Jim Jefferson, WJPA.
Chairman Mascara called the meeting to order and asked if there were any
corrections, additions or omissions to Minute No. 5-S-85, each member having
received a copy. Miss Beharry questioned the base rate and 80°0' thereof for the
position of RN, Grade 8, as listed on page 385, Account No. 4461-1020. Mrs. Penri-
line gave an explanation of the rate listed. Miss Beharry noted her objection
to the rate listed.
Moved by Miss Beharry, seconded by Mr. Paluso, approving Minute No. 5-S-8`
as written.

Mr. Petrosky - Yes; Mr. Mascara - Yes.
Motion carried unanimously.
WALLACE TRIAL JURY
Judge Gladden informed the Board that a conference call among John Felice.
Labor Consultant, Mary Drewitz, Court Administrator, and Margaret Pennline,
Personnel Director, was held on October 30, 1985, relative to the out -of -county
jury selection for the Wallace trial and resulted in the following conclusions:
1. That those employees who are non-exempt under the Fair Labor
Standards Act and who turned in 24 hours per pay on their pay
statement for the trial will receive payment for 16 hours per
day for pay period #22.
2. John Felice will again contact the Department of Labor to ascer-
tain the method of payment for the additional 8 hours per day since
it was in some cases interrupted sleep time.
3. At the end of the trial, all unpaid time that has been deemed
compensable but unpaid (as per Department of Labor) will be paid
to the employee in that pay period.
4. Due to the effects of the Garcia decision, all hours worked
over 40 in one work week will be compensated at time and one-half
according to the Fair Labor Standards Act as of this date.
