Office of the County Commissioners
Washington, Pa., January 6, 1986
The Washington County Salary Board met in session in the Public Meeting
Room of the Courthouse Square Office Building, Washington, Pennsylvania, at
approximately 10:00 a.m. on Monday, January 6, 1986, for the purpose of reorganiz
tion, with the following members being present: Commissioners Mascara, Petrosky
and Paluso and Controller Beharry. Elected Officials present were: Judge Gladde ;
Olga Woodward, Recorder of Deeds; John Yoney, Treasurer; Farrell Jackson, Coroner
Kathleen Flynn Reda, Register of Wills; Barbara Gibbs, Clerk of Courts. Also
being present were: Fred Johns, Sheriff's Office; Paul Petro, District Attorney'
IOffice; Phyllis Matheny, Deputy Prothonotary; John Rogers, Public Defender's Offi�e;

[Approval of Minutes
Chairman Mascara noted that approval of Minute No. 8-S-85 dated December
I30, 1985, would be held in abeyance.
986 Salary Schedules
Chairman Mascara noted that the figures listed in the respective depart-
mental salary schedules include the union contract raise for all union employees
and non -union hourly employees (which includes per diem, part-time and temporary
employees), and a 4°0' increase for salaried employees, with a few exceptions which
will be noted by Mrs. Pennline, Personnel Director.
COURTS
Moved by Judge Gladden, seconded by Mr. Petrosky, to retain all Court
employees for 1986 at the salary schedule listed under each of the following
accounts.

Commissioner Petrosky questioned Miss Beharry as to how she arrived at
the figure of $30,000 for her Solicitor.
MS. BEHARRY: That was the minimum figure recommended by Mr. Carroll. There were
several discussions with Mr. Carroll, an attorney. I understand that I requested
{ $20,000 in my August budget request. There have been several additional pieces o
work added to pending litigation and issues needing advice and counsel. What we'
looking at now is really two years' worth of Solicitor's and Controller's work.
It just seems impossible that it will be able to be done at less than $30,000. Tie
Court Administrator recommended $50,000 to get the litigation moving, but I'm wil -
ing to try $30,000, and I do recognize that the Commissioners have budgeted in a
special 4800 account $20,000, but I know you understand my position that it is a
requirement of law that the Salary Board act to create these positions and salari s
as opposed to contracts and that is a matter of pending litigation.
MR. MASCARA: Well, let's take them in part. First of all, you requested $20,000
which you had said in your initial request and we have put $20,000 aside. I thin
we also sent you some communication regarding that matter that the Board of Com-
missioners was willing to honor the Court Order that we're under from Judge Bell
regarding the matter of a Solicitor. The other matter is a question of law whic

you have been attempting to define as to whether a Solicitor has to go through
the Salary Board and be voted on or not, which I think the last piece of litiga-
tion or request for an appeal was denied both by the Commonwealth Court and the
Supreme Court. I think that's where that lies right now, isn't it?
MS. BEHARRY: The Supreme Court does not act as ----.
SOLICITOR BASSI: It's a matter of clarification. The law provides that the
Controller should be entitled to a Solicitor and we have budgeted for a Solicitor.
You have no right to select a Solicitor for the Controller and you have never don(
that, but you have fixed the amount of money for the position as anticipated and
provided fors by statute. Factually, since the employment of Roger Ecker, there
has not been anybody whom the Controller has appointed to act in that capacity
although the budget has been open in that amount and available for appointment.
The Order of Judge Bell is effective, it is operative and it is available for the
Controller to use on litigation.
My --------- question, and I think it is something we should talk
about, is my concern about the whole spectrum of the County's ability to contract
and, of course, we all know by Purdons that the County Commissioners are the sole
contractors for the County ---- and what ramifications, Miss Beharry, would this
have if it were adjudicated that these people were, in fact, employees of this
County, what kind of costs would be brought to bear on the County if that's the
direction we would take and not only satisfy your request but then Barbara Gibbs
or the Register of Wills, Kathy Reda, and all the other elected officials, if we
were to revert back to pre-1980 when Commissioner Gilmore, now Judge Gilmore, and
myself and Mr. Paluso decided that there was an undue burden on the County to hav(
you people have all the fringe benefits, to pay FICA, to pay unemployment com-
pensation, workmen's compensation and what have you, for an attorney who is not
an employee of the County. We don't direct these people as employees. They're
professional people and we're contracting with them. Do you realize the ramifi-
cation and the cost that is going to be heaped upon the County if we do what you
want us to do? Have you given that any thought?
MS. BEHARRY: I have given that a great deal of thought, Mr. Mascara, and what
you're asking me to do is to judge whether or not the County should be legally
liable for those costs and I indicate to you that that's a matter of pending
litigation at the moment.
MR. PALUSO: It's not a legal matter ---.
MS. BEHARRY:
MR. PALUSO:
It is a legal matter.
It's an administrative matter.
MS. BEHARRY: It's pending before the Court and Mr. Bassi knows full well that --
SOLICITOR BASSI: Ms. Beharry, you are on appeal ----. There is no supersedeas.
The Order of Judge Bell is effective and it's operative. Now you've got to live
with whatever the dictate of the Court is at this stage of the game. If and when
the Supreme Court hears the case and overturns it, then we will be compelled to d
otherwise than we now are doing.

MS. BEHARRY: And the legal question at stake is whether or not the Salary Board
Imust act to create that position is now pending. I am of the opinion and Mr.
Carroll is of the opinion that, in fact, the Salary Board must set salaries for
the position of Solicitors as appointed officials under the County Code. Now ---
MR. MASCARA: Salaries ---- the number of positions and their salaries ---. Can
we contract with them?
MS. BEHARRY: No. If there are costs associated with ---. Following the statute
of the Commonwealth of Pennsylvania, then it seems that the County must bear thos
costs.
MR. MASCARA: In other words, you completely have no sympathy whatsoever about
cost? It's black and white and it's there to be employed and you don't care what
lit costs this County.
MS. BEHARRY:
It has nothing to do with sympathy. It has to do with what is
legally required. I find ----.

month period, approximately $23,000 was spent for legal fees for her representa-
tion in litigation. He also noted that the Commissioners have appropriated in
the 1986 budget the sum of $20,000 for legal fees for litigation for the Con-
troller in addition to the $3,000 retainer for her Solicitor for day-to-day legal
