PALUSO, COMMISSIONERS Minute No. 9-S-87 Office of the County Commissioners Washington, P6., August 20, 1987 The Washington County Salary Board met in session in the Public Meeting Room of the Courthouse Square Office Building, Washington, Pennsylvania, at approximately 10:55 a.m. on Thursday, August 20, 1987, with the following members being present: Commissioners Mascara, Petrosky and Paluso and Controller Beharry. Moved by Miss Beharry, seconded by Mr. Petrosky, that Minute No. 6-S-87 dated April 30, 1987, be approved as written. (Matter of Controller's solicitor) Miss Beharry: The other item that I would like to bring before the Board is in relation to the solicitor's position. It's my understanding that there was a r $25,000 annual compensation set for that position at this time. There is no hourly rate set. I think that the $25,000 annual ... (discussion between Chairman Mascara and Miss Beharry)... I would like the Board's permission to make payment of that $25,000 atan hourly rate of up to $100 an hour. That means if I can negotiate down to $90 or $80, I will do that. At this point, I have two individuals interested at $100 an hour but... Mr. Paluso: I'm sure you have every attorney in Washington County interested for a hundred bucks an hour, including myself. Miss Beharry: No, I don't. Mr. Mascara: We have Judge Bell's order that we went over and over, around and around, $75 dollars. Now didn't he talk about $75 and didn't recently Judge k r TTerputac say $75 an hour. Why do you feel ... do you have information that leads you to believe that you can't hire any attorney for $75 an hour? Miss Beharry: Well, as a matter of fact, I have through experience since January realized that a flat rate, considering that it is an open-ended contract for an amount of work and no one will do that. As I indicated, I have two attorneys that I have spoken to. I P actually Y surveyed the whole Washington Count Y 9 Y Bar, and there is one attorney whose current hourly rate is $100 an hour and would be interested at that rate and one other lawyer in Pittsburgh. It is apparently a reasonable rake for the work that has to be done, but if I can have it done for less. Really, what we're looking at here is not an increase in the amount of money. What we're looking at is a method in which to pay because it's my understanding, and I had as brief discussion with Marge, if you set an annual compensation, whether it be for my solicitor or the Recorder of Deeds solicitor, that is to be paid in twelve equal installments, one month at a time; that no elected official has the right to expend at an hourly rate their solicitor's annual compensation in one month. So that my hands are tied at this point even with the upper limit because I have been unable to hire someone since January if that were to be paid in annual in- stallments. Mr. Mascara: They don't want to work for $75? Miss Beharry: Not under the survey they don't. Mr. Mascara: How many attorneys did you survey? Miss Beharry: The entire Washington County Bar. PALUSO, COMMISSIONERS - - - _ ., .., Mr. Mascara: And how many responses did you get from people that were favorable? I Miss Beharry: About three. Mr. Mascara: And how many people are in the Bar? Miss Beharry: I think I surveyed 200... Mr. Mascara: Doesn't that tell you something? You got one out of Pittsburgh and how many did you survey in Pittsburgh? Miss Beharry: I didn't. I talked to a specific firm in Pittsburgh. Interestingly, of course, there are several attorneys in the 200 that are criminal attorneys who are not experienced in municipal law or several civil attorneys who are not experienced in municipal law. Mr. Mascara: Is it difficult to find somebody that specializes in municipal law? I mean, is that a problem? Miss Beharry: Well, there are several attorneys who do. Mr. Paluso: Every township has a solicitor experienced in municipal law, every single one of them. There are 67 municipalities, as I recall, in this county. Every one of them has an attorney in municipal law and they belong to a firm that does the same thing so I don't understand that. Mr. Petrosky: I'm not sure that I understand your conjectures here. You're saying that basically unless you receive the $100 an hour figure, that the majority of attorneys that you've talked to will not accept a monthly payment in terms of providing legal services for your department. Is that what you said? Miss Beharry: Right. Mr. Petrosky: So even though that this Board as a Salary Board in January established a salary of $22,000 a year for your litigation plus $3,000 for the .day-to-day advice, you're saying that the attorneys that you talked with will not accept that figure, is that correct? Miss Beharry: That's correct. They will not accept the set rate with unlimited demands upon their time and resources. Mr. Petrosky: Well, it's very curious that you come before the Salary Beard now. We're talking ... we established the initial rate back in January for this coming year during reorganization, giving you the $25,000. Now you're coming back in August, at the end of August, which means we only have about 4 months left in, the year, 4 or 5 months, and you're saying that unless you establish a rate of $100 a month or $100 an hour that your chances of securing air attorney are some- what limited and you still have the bulk of that money ay.ailable in your account to expend on legal services. Miss Beharry: There are several reasons...one is that I have attempted to... advertising both in Washington County and Allegheny County the terms and conditions that are established by this Board in the $25,000. Mr. Petrosky: I saw the ad and I'll have to say, Miss Beharry, stay out of the P.R. field because you'll never make it. Miss Beharry: The ad did not attract any one but out of... Mr. Petrosky: I'm sure it didn't the way it was stated. Miss Beharry: It didn't attract anyone but out of college or out of law school, students or individuals; there were 2 or 3 that thought it was a staff position where there was someone to do the typing and would have an office position. They didn't realize that it was, in fact, part of them to hire a paralegal and to pay them and hire a typist and to pay them out of the $25,000. The other reason that it has gone unattended is because I did send the survey out when the second ad failed to secure anyone, but it was just recently that several actions have been filed against the Controller. Mr. Carroll was continuing and is continuing to represent me in the pending litigation in which he was not permitted to withdraw his appearance so that there was no pressing need in terms of litigation or an attorney until five actions were filed in the last four weeks. So it's become very necessary. Mr. Petrosky: Do you know whether or not Mr. Carroll has any charges against the A County in terms of representing you that have not been submitted as yet? Miss Beharry: I'm sure that he has because he continues to work on the briefs in the surcharge appeal and the equity appeal, and I absolutely instructed Mr. Carroll to prepare time charges to submit to Judge Acker which he has failed to do. I've been instructing him to do that since February. Mr. Petrosky: But do you have any idea how much money that is, how much that amount is? Miss Beharry: I have no idea. As I said, in February, I instructed him to pre- pare charges. He has not done... Mr. Petrosky: So, therefore, what you're suggesting, what we're saying here in effect is that it could very well be that Mr. Carroll will be drawing down on the $22,000 that was allocated? Miss Beharry: No, Mr. Carroll is not my solicitor. Mr. Petrosky: Where's that money going to come from` Miss Beharry: I don't know. Judge Acker sat in the courtroom when Mr. Carroll tried to withdraw his appearance... Mr. Mascara: Whoa, Whoa, time out. I've been letting you go on here... ' Miss Beharry: I'm answering a question. Mr. Mascara: No, no, but I want to shed some light on it. First of all, if billE are submitted by Mr. Carroll for legal fees and you have $22,000 in that account, you most certainly can pay out of that account... Mr. Paluso: And you certainly will. Mr. Mascara: And if you need other monies, then of course, we could always make a supplemental appropriation out of unappropriated balances. I mean, do you have a problem with paying Mr. Carroll out of your budget? 1 E SALARY MINUTE BOOK 607 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY PENNSYLVANIA FRANK R MASCARA, METRO PETROSKY, JR., EDWARD M. PALUSO, COMMISSIONERS (Miss Beharry: I don't even know if Mr. Carroll's request for payment will be authorized. Judge Acker sat in the courtroom the day Mr. Carroll attempted to withdraw and said very plainly that he could not ensure that he as a Judge could order payment in that circumstance. He just refused to permit him to withdraw. Mr. Mascara: Did he provide the services? Miss Beharry: He's providing services. IMr. Mascara: No ... I understand there's about $6,000, and I don't know where I got that figure, but someone had said that Mr. Carroll has around $6,000 in out- standing bills for services rendered to the County Controller. Miss Beharry: I've never heard... Mr. Mascara: Well, you know, maybe we ought to check, you ought to call Mr. Carroll and say what do we owe you because, you know, given that I disagree with the amount of money being spent on litigation, if the man provided the services, then he should be paid and I think we have an obligation, you as his employer... Miss Beharry: I'm not, though. Mr. Mascara: Well, whatever...I'm not going to get into semantics over the matter... Mr. Paluso: ..-the Court's employee... then let him represent the Courts, not you. Miss Beharry.: Our', contract expired December 31st. IMr. Mascara: Well, you don't want to pay Mr. Carroll? Miss Beharry.: I have no idea what will happen with Mr. Carroll's request for payment. I have no idea. Mr. Mascara: You won't even pay your own attorney? A Miss Beharry: I have no idea... Mr. Mascara: Then why do you want $100 an hour; that doesn't even make any sense. First of all, I have since you did request this Board meeting and request that you wanted to discuss your solicitor, that we have some information on solicitors' and I matched it against the Observer -Reporter's report of the comparison of 4th ,1 class county controllers and the only one I can see a discrepancy in, and correct me if I am wrong, Tina, 'cause I think you gathered the data or someone in your office, Ed, I'm not sure ... okay, there's a $300 difference between the annual benefits. Beaver County is $1,800 a year for benefits and our figures show $1,50C a year so there's a $300 discrepancy. But I would like to enter both of these, into the record as, you know, we're doing some homework on this; and I also have a letter, a copy sent to Miss Beharry in regard to her request for information 'from one of the attorneys. Put that into the record to indicate perhaps the kindE of responses she received from her request about hiring an attorney. I think your picture's getting tainted here ... taking shape and form out of. It's apparent that/nobody wants to serve in that capacity and given that, if that's the truth, then there's some very serious problems with what you're doing apparently because I've never know of attorneys, my son's an attorney, to turn down an opportunity to make $25,000 a year. e 608 SALARY MINUTE BOOK Mr. Mascara: Well, he got... Mr. Paluso: He was Court ordered... Mr. Mascara: ... $39,000. Miss Beharry: No, he lost money at the $39,000. Mr. Paluso: Oh, boy, he sure did. I saw him in bankruptcy court. Mr. Mascara: Well, that ... God only knows, you probably spent a lot of time with him. Mr. Paluso: That will be the day. Mr. Mascara: Well, do you want to go ahead and make a motion? Moved by Miss Beharry that the Salary Board approve an hourly rate of up to $100 an hour for the hiring of an attorney within the limit,($25,00O.- consisting of $22,000 for litigation and $3,000 for day-to-day advice). Mr. Petrosky: Before we take a vote, I just have a comment or two. It seems tha,6 the Salary Board once again must address the issue of legal representation for the Controller; and, in the past, it has always been developed in the media, either by design or by accident, that this Board has tried to limit in some way the Controller from having legal representation, and I don't think that that's the case at all. And I think Judge Acker in his opinion (No. 1622 of 1986, Decree Nisi issued on July 25, 1986) sums it up very well when he says, and I quote from his opinion: "...The Commissioners, as managers and as members of Salary Board, owe a duty to the taxpayers to see that government is run efficient.y. To that end, the Commissioners are given the power and responsibility to balance the quality of County government against its oost. Certainly if the Controller's office was given twenty additional employees, it could perform its functions with virtual perfection. However, the additional cost to the County would be disproportionate to the gains in quality. In our system of government, the Commissioners, sitting as managers of fiscal affairs and as members of the Salary Board, are vested with the discretion to make such decisions, and it is not the function of the Courts to disturb the exercise of that discretion lawfully exer- cised. " And I make that quotation to basically substantiate or make a base for my opinion on the matter, and that is simply that consistently over the last 3-3/4 years that I have sat on this Board, the Court through Judge Bell's decision, Judge Terputac's decision, has always indicated that $75 an hour is the going rate in Washington County for the legal community and it's been an accepted rate. And I think I would be hard-pressed as a member of this Salary Board to break that precedent, and I'm not going to. I think we owe it to the Controller to give her as much leeway and flexibility in terms of securing an attorney, and I don't think as a Salary Board we've stood in her way. I think the problem is hers. It rests with her. If she can't get an attorney for $75 an hour, I sympathize and empha- thize with her, but I'll be damned if I'm going to vote for $100 an hour. And I want to make it very clear that this Board, I don't believe, is prohibiting Miss Beharry from securing an attorney by allocating $22,000 a year for legal expenses SALARY MINUTE BOOK 609 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY PENNSYLVANIA FRANK R. COMMISSIONERS r_ - ...... ... ... .... -_ -_ plus $3,000 in day-to-day expenses; and I certainly don't think this Board is prohibiting Miss Beharry from securing legal advice by allocating a $75 an hour fee to any attorney that chooses to represent her. If she can't get an attorney for that amount, that's her problem. That's not the Salary Board's problem. Motion died for lack of a second. Moved by Mr. Petrosky, seconded by Miss Beharry, that a fee of $75 an hour be instituted. (NOTE: Mr. Petrosky made this motion in conformance with precedent that has been set in many instances by vote and by Judges of the local Court of Common Pleas. Miss Beharry noted that she seconded it only because it ,is important that an hourly rate be established to even begin to negotiate with anyone.) Discussion followed. Mr. Petrosky: Well, I don't think $75 an hour, Miss Beharry, is such a pittance' as you seem to let on...I think $75 an hour is quite substantial. Miss Beharry: Unfortunately, Mr. Petrosky, what ends up happening is that you pay the paralegals and the secretaries to do work out of that $25,000. Mr. Petrosky: I'm talking about the $75 an hour. Miss Beharry,: We have an upper limit that confines the attorney in terms of... Mr. Paluso: ..I think that everybody that I know of has an upper limit on their, salary... Mr. Petrosky: I think that it's been indicated by both Mr. Mascara and Mr. Paluso if you expend, expire, the $22,000 that's appropriated to your budget, you can always come back to the Commissioners in terms of a supplemental appropriation. Miss Beharry: I appreciate hearing that. Mr. Paluso: You can request that ... I don't want to intimate that you're going to get it...at least ... and I don't think that the five cases you refer to either require the appearance of an attorney, quite frankly. They're all mandamus actions on unpaid overdue bills that are cut and dry, and there's no legal re- quirement whatsoever and I can't see $75 an hour. Miss Beharry: That's just a conclusion unfounded on your part, Mr. Paluso. Mr. Paluso: Would you like to bet the $25,000 that you will lose those mandamus actions and spend this money needlessly and lose like you did the other $49,000? Miss Beharry: Would you like to bet that in the end, you filed them needlessly, that every penny that will be expended upon was needless?
