PALUSO, COMMISSIONERS Minute No. 1-S-88 Office of the County Commissioners � Washington, Pa., January 4, 1988 The Washington County Salary Board met in session in the Public Meeting Room of the Courthouse Square Office Building, Washington, Pennsylvania, at approximately 10:20 a.m. on Monday, January 4, 1988, for the purpose of reorganization, with the following members being present: Commissioners Mascara, Petrosky and Paluso and Controller Beharry. Elected Officials present were: Judge Gladden; John Yoney, Treasurer; Bob Franks, Prothonotary; Farrell Jackson, f S 9 Coroner; Barbara Gibbs, Clerk of Courts; John Pettit, District Attorney; Kathleen Flynn Reda, Register of Wills; and James Fazzoni, Sheriff. PALUSO, COMMISSIONERS Roll call vote taken: Miss Beharry - Yes; Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Motion carried unanimously. Approval of Minutes Chairman Mascara noted that approval of Minute No. 10-S-87 dated September 3, 1987, and Minute No. 13-S-87 dated December 17, 1987, would be held in abeyance. Commissioner Petrosky suggested that if there were any administrative discrepancies (i.e., incorrect dates, misspelling of names, etc.) discovered, that they be handled adminis- tratively as opposed to bringing them up at this meeting. Salaried Employees Moved by Mr. Petrosky, seconded by Mr. Paluso, that the 1988 salaries include a 4% or $800.00 (whichever is greater) increase for all salaried employees, or higher as noted on the salary schedules; and that any salaried employee hired during the 1987 year will have his/ her raise applied on his/her anniversary date in 1988 on a pro -rated basis, effective on his/her ,anniversary date. Remarks: Miss Beharry commented that she does not favor this motion and feels that this policy discriminates against some employees who are underpaid and that such a policy is not fair. She stated that she feels the County should re -think its vacation policy instead. Discussion followed between Miss Beharry and Mr. Petrosky. Roll call vote taken: Miss Beharry - No; Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Motion carried. Union and Non -Union Hourly Employees x Moved by Mr. Petrosky, seconded by Mr. Paluso, to set forth the negotiated 35-cents/hour I !increase for all union employees and non -union hourly employees, which includes per diem, part - °time and temporary employees, with the exception of Children & Youth employees due to extension of the wage re -opener provision with PSSU. Remarks: It was noted that Children & Youth employees' salary would be taken up at a later date if and when new salaries are agreed upon. COMMISSIONERS ------ =4194-294 - DISTRICT ATTORNEY I Moved by Mr. Pettit to retain all positions (payroll and contracted) listed on the I E ;salary schedule at the 1988 salaries in accordance with today's previous motions, subject to #one proposed change which is the change of classification of Betty Durante from Clerk Typist I a Ito Clerk Typist II. Mr. Pettit also discussed the matter of changing the Detective position from part time Ito full time. He noted that one of the reasons he was asking for this change was -due -to a> recent meeting held in conjunction with Judge Terputac, the Pennsylvania State Police, CYS and 'a few other agencies wherein it was noted that there was concern relative co investigations of child molestation cases. He noted that Mr. Baker, Chief County Detective, has worked on some of these cases, but there are so many cases that he can't investigate all of them and continue to do his other required duties. More discussion followed. Mr. Pettit requested the Board's consideration of this matter at some point in time. Relative to the matter of Betty Durante's change in classification, the Board advised 8 7 JMr. Pettit to forward a letter to the Personnel Director requesting that the matter be I ';presented to the Reclassification Appeals Board. Mr. Pettit therefore withdrew from his motion the change of classification for Betty gDurante. Motion seconded by Mr. Petrosky. Miss Beharry questioned Mr. Pettit as to the number of hours that the contracted Assistant District Attorneys are expected to work. Discussion followed between Miss Beharry and Mr. Pettit. A lengthy discussion also was held among Commissioners Mascara, Petrosky and Miss Beharry. As a matter of fact, the creation of new positions in the Budget Office and the bargaining unit positions will require posting, will they not? Mrs. Pennline: The bargaining unit positions would not require posting as long as the whole I job or the greater portion of that job is taken. If the people are transferred and if the job remains the same or very similar, then the job does not have to be posted. We had that once before in the Controller's Office, I'm sure before you came on board, as to the posting of someone's own position. In other words, if a person is doing a certain job... Miss Beharry: Do you have a new job description for a revenue clerk or an accounts payable clerk? Do you have a new job description for that? Miss Pennline: The revenue clerk is not going to need a new job description at this point in time. That's essentially the same job. Accounts payable clerk is essentially the same job. Miss Beharry: Might I ask, then, why did the Budget Office need revenue clerks and accounts payable clerks? Mr. Mascara: I thought we discussed that when we met with Mr. Wagner and Mr. Cecchetti about reorganization in an attempt to facilitate the backlog in your office of paying bills? Miss Beharry: I think when we met and discussed something briefly it was the creation of something called a "Receiving Department" where a couple of clerks would do some organization of papers as opposed to... We want the same people that worked ... to do that process. Miss Beharry: Well, maybe I don't understand exactly what you have in mind. I think there's la grave distinction and important distinction between someone who collects papers and puts them in order and someone who audits accounts payable. And it appears to me from what I understood not only in the meeting we had on December 8 but in subsequent discussions with Mr. Humble and Mr. Prascak that we will now be duplicating Controller's functions because much of which Mr. Humble intends to do upstairs will still need to be done in the Controller's office. And it will most likely not resolve some of the major problems we have. Unfortunately, we were not able to respond... Mr. Mascara: I think what we're trying to do, Miss Beharry, and you gentlemen correct me if I'm wrong, what we're trying to zero in on matters that have been very elusive, at least in my mind for the past five years, that I've had to prepare a budget for this county without the benefit of an accounts payable. Nobody can tell me what this county owes. And I thought that, it was twofold. One, we were going to zero in with software, the use of computers, to facilitate at least for by next year an accounts payable run. Two, was to assist you in processing papers because it's my understanding from the meeting that we had and from the years that you've been here that this is not right and we wanted to make sure that everything reaches your office is in ,proper order. Now what you have to do is sit down and ascertain whether that bill is legal to pay. And, if so, eventually all you'll have to do is say "yes" or "no". Right now you got a backlog and a ... of paper backlogged in your office of papers strewing all over, bills and desks and on drawers and on the floors. We want to get rid of that. We want to work with you, and I think we told you that at that meeting. We spent how long, a couple of hours, huh? I thought it was... Mr. Petrosky: It wasn't necessarily a short meeting. Mr. Mascara: Well understood what we were attempting to do. Now if you want to resurrect that, 1 you may do that; but this board is prepared and ... at no peril to county employees that we want Ito do this. I have no problem with it rather than spend, which I estimate to be by the end of your term about a million dollars, which you've cost this county and I'm still looking for a dime that you recovered. I think it's very serious, and I think the electors of this county indicated to us that they want this Board to run this county. And we're going to run it in spite of you. They choose to become the recordkeeper and the fiscal supervisor of the County. And I think that if the Commissioners and their Solicitors review the law in terms of who is to enter and control the accounting records of counties, it will be the Controller and not the Commissioners. Motion carried unanimously. j 4133-133 - CONTROLLER I Miss Beharry: First, I would like to make note for the record that in my budget request I submitted an entire reorganization of the Controller's Office, including changes in job descrip- tions to provide for more efficient crosswork under Judge Acker's order, permanent injunction, so that under certain classifications virtually every employee could do auditing and clerical work; and I am requesting an audit supervisor and field auditors in order to perform my duties under the law. Mr. Mascara: I can tell you what that's for. That's for potential future litigation because she hasn't done her duties under the law, and we contracted with the Auditor General to do the Magistrates. The job has to be done. You choose to do whatever you do in your office. You know, if you choose to go out and audit the Magistrates, that's fine. If you comply with the law, that's fine. If you don't comply with the law, that's your problem, not my problem. So you have elected to be a litigator rather than a fiscal management type person. Miss Beharry: Secondly, at the meeting on December 8, there was some vague discussion of what might be in the works to ensure that the problems the Controller's Office is experiencing of ,performing the duties would be somehow limited by individuals who are responsible for the for- warding of information and paperwork, doing it in a more proper and efficient manner. That recommendation of the recommendations that occurred at that December 8 meeting, which was requested by my Solicitor, Mr. Wagner, was solely at the recommendation of Mr. Prascak and Mr. Humble, who were given the responsibility of appraising the situation and coming up with something that would help the Commissioners get their house in order. (laughter) Mr. Mascara: What I want to comment on is that we invited the Controller and her Deputy to visit any county they wanted to visit. We also approved travel by both Mr. Cecchetti and by the Controller to come back to this Board if they had any other suggestions, we'd be glad to enter- tain them. And, in fact, I think they did in this letter where you lied and said that you asked for a meeting, you said that you did take a trip and you'd like to go back. We'd be glad to approve another trip to Mercer County or any county in the state or the country if you want to visit to come back and make some suggestions or recommendations. So I wanted you to know that. You know, you don't get half the story, you have to get the whole story. Go ahead, proceed. .Miss Beharry: It's interesting to note in that regard that a trip to Mercer County proved very enlightening with regard to the number of people that Mercer County has doing its budgeting, its ... and shipping, its duplicating, its purchasing. I think there are three people in Mercer County who perform those jobs. In Washington County, I think we probably have 20 people doing those jobs. Mr. Petrosky: That's not true. Miss Beharry: It is true. Mr. Petrosky: We don't have 20. Miss Beharry: As a matter of fact, if a comparison were made, there would be 40 people in the Controller's Office in Washington County to put us on a par with the Budget and Purchasing and ,Shipping/Receiving Office. It also showed what a competent purchasing agent could do in terms of resolving and pre- venting problems that our office experiences a great number of because we are not following ;proper purchasing procedures or acting in accordance with law whether it be with contracts or with bidding or whatever it might be. My recollections are that this Board, in direct communication with Mr. Wagner, indicated that some time before the budget meetings that we would get together with the (Deputy Controller's Office and her and Mr. Wagner and he was invited to go over a proposed reorganization. The purpose of this reorganization was to facilitate the breakdown that was being experienced by both the Controller's and as well as the Commissioners' end and that we were looking for a system by which we could tie up the loose ends on both. We gave the ... this 1 Board of Commissioners gave the responsibility to work out a proposed reorganization to Mr. Prascak and Mr. Humble, hoping that all of the elements of politicalizing this situation would Abe taken away and it would be handled in the highest professional manner. I would also like to say that, and certainly compliment Mr. Prascak and Mr. Humble for the job that they did, that it took, I think, over a period of three months to develop what we felt was a significant proposal in terms of change that would not only help the operation of the Commissioners' Office in terms ,of attaining all the proper documentation and making sure all of the p's and q's were in order, 1but also aiding the Controller's Office by lessening her responsibility, not to take her 692 SALARY MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY PENNSYLVANIA FRANK R MASCARA, METRO PETROSKY, JR, EDWARD M. With this thought in mind and not jeopardizing the constitutional responsibilities of the Controller's Office, a proposal for reorganization was made to Miss I leeharry and Mr. Cecchetti and Mr. Wagner on December the 8 at a joint meeting; and it was indi- cated that during this transition certain changes would be necessitated in terms of moving employees around, giving the Controller's Office the benefit of additional employees, well, not additional, but to at least on a part-time basis during the transition period to give her the opportunity to hire people in those places that we were taking out of her office; and to supple- ment this action by the establishment of a sophisticated software in terms of accounting. At the December 8 meeting, based on my recollections, it was decided that they were going to take it, the Controller's Office was going to take this reorganization under advisement and get back to us. And in the process, they were to visit, by choice, some counties or a county to see where we ;developed some of our information relative to our proposed reorganization. We did not hear from Miss Beharry for whatever reason, and I'm not faulting her; I'm just stating a fact. We did not hear from her with the exception of a letter that we received on December the 30... and indicating that, "At Mr. Wagner's recommendation," I haven't talked to him so I can't verify that, "I am 'requesting that you give full consideration to my staffing request as outlined in my memorandum on November 25, 1987. Hopefully, 1988 will bring progress in our mutual desire to see that the County's vendors are paid properly and promptly." I agree with that..."and will allow for a more comprehensive review of proposed changes." Unfortunately, I don't think that we can give l €the time that Miss Beharry requires in terms of waiting for her to make up her mind whether she dikes it or dislikes it. We're going to plunge in. We're going to make the changes. We're going to supplement the system with the computerization, and we're going to make every effort at least on our end to make sure that the system works. Because the stakes here are greater than any political controversy between the Controller's Office and the Commissioners' Office. The stakes are simply that we must get these vendors paid, and we are going to make every effort to get the vendors paid. And whether it's a bill for $50.00 or $30.00 or $28.00 or $28,000.00 or $40,000.00 or $500,000.000, we have to be in a position where we can develop some credibility in terms of the vendors once again in Washington County. And I think we've lost that. I think the reputation of this county has been hurt considerably, and we simply have to break the logjam.; What we're presenting in terms of the Controller's Office is an effort to break the logjam. I believe personally through the efforts of Mr. Prascak and Mr. Humble that it's a workable system.'. It may not satisfy both sides. It may alienate one side. Somebody, one of us may not like it. But I think it's the best system that we have right now in terms of trying to implement in !breaking the logjam. And this is our ... That's my only comment. } I � !Miss Beharry: Couple of comments. One, what we've acted on today so far and what you propose gtoday in accordance with, for the Controller's Office is not really, does not represent what ;Mr. Prascak and Mr. Humble recommended on December 8. I mean, if that's i a problem... � Mr. Petrosky: The functions are... !Miss Beharry: ...only functions are different. `Mr. Petrosky: No, no. The functions are not different than what was proposed to you on !December 8. Yes, we made some changes in terms of where those people were assigned after further discussion with Mr. Humble and Mr. Prascak. We felt that they would be best supervised, °and we'll give you reasons for this. Number one, the Deputy Budget (Director) is your former Deputy, Roger Metcalfe, and we felt that in terms of consistency that it would work much better by having two of your employees plus Mr. Metcalfe do the work in terms of gathering the necessary data to ship to your office for payment (end of tape) and, secondly, would not be basically aware of all the documentation that you may or may not require. So that was one of the reasons that the changes were made in that manner. Miss Beharry: Well, Mr. Humble has taken a contradictory position in regards to the December 8 meeting and the position to date. On the December 8 meeting, Mr. Humble indicated that no auditing functions would be done in this... Mr. Mascara: There will... Mr. Petrosky: We're not auditing... Mr. Mascara: We tried to... Mr. Petrosky: We tried to tell you that... Mr. Mascara: ...insert that into this conversation. Mr. Petrosky: We are not auditing. That is your responsibility. I don't want that responsi- bility. Mr. Mascara: That's your responsibility. I don't want it. Mr. Petrosky: We are not auditing. We're gathering data. We're gathering data. And by the system that we have attempted to devise here we feel that we are going to eliminate some of the day-to-day routine in terns of paperism that your office gets involved. So all we're doing is transferring that function basically. Miss Beharry: I certainly agree that certain department heads and elected officials need some assistance in the processing of papers. That they have not been doing an effective or efficient job in the ordering of goods or services... Mr. Petrosky: That may be true, Miss Beharry, but I don't think you could substantiate the backlog of unpaid bills in your office on that account. I really can't. Mr. Mascara: I think P;r. Petrosky, my colleague, said very clearly and distinct that it was an attempt by this Board to solve a problem on both ends. He didn't say that we were faultless; we didn't have problems. Nobody's perfect. Number two, Judge Gladden ruled in a decision of his earlier in the case of the salary board's decision being sacrosanct in that regard so I think any more conversation in that regard is useless; and if there's nothing else to come before this Board... Miss Beharry: There's a couple of things ... I would like to say. Roll call vote taken: Miss Beharry - No; Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Motion carried. Mr. Mascara: And that doesn't mean that it's not subject to change. If things don't go well, we'll come back here and we'll do it over again. But we're going to get the system down and it's. going to work properly. Now do you want to go ahead. Miss Beharry: Just a couple of things. One, you put two per diem employees who have no experi- ence and no knowledge into the office to help get rid of the backlog. That doesn't work. Mr. Petrosky: Unfortunately, I disagree with you because this gives you an opportunity to train them in the fashion that you choose... Miss Beharry: To do what? IMr. Petrosky: Hold on. And, secondly,... Mr. Mascara: Count peas, jelly beans. Mr. Petrosky: And, secondly, because of the responsibility that you will no longer have in Lerms of the gathering of the documents should afford you an opportunity to not only apply these people, the per diems, but also your present staff to getting, hopefully, some of the backlog cleared up. Miss Beharry: Well, you create some other problems. The solution is shortsighted and it is from a very one-sided perspective because the Controller's Office, as you said, they're working for 3 months before we had a meeting on it; and it was clear to me that... 5 Mr. Mascara: I don't think he meant on that program. He means on software... ideas of how we're going to ... Mercer County... ',Miss Beharry: It's very shortsighted because several of the duties that the employees you intend' !to take out of the Controller's Office will still have to be performed in the Controller's Office A 3so it will create more of a problem. It will create more of a problem in performing day-to-day a Functions than it will solve. Mr. Mascara: That's exactly what I predicted. Miss Beharry: That has nothing to do with ... per diems. Mr. Mascara: That's exactly what I predicted... Miss Beharry: ...per diems can not function in the same capacity as someone who is trained and skilled. It has only to do with the fact that now... s Mr. Petrosky: If you remember correctly, Miss Beharry, at least I do, I thought the request for i t } per diem employees was made by your solicitor. Miss Beharry: He was talking through a transition period when we put in new software. I mean it was your insistence that we be very specific in terms of how long Ewe hired them for. So we're being specific. If you need them for a longer period of time to r handle toe transition, you certainly can come back to the Salary Board and request it. IMiss Beharry: Wouldn't it be a better solution to have individuals answerable to Mr. Humble or Ito the Commissioners trained by the Commissioners or Mr. Humble than to take the trained people out of the Controller's Office to be answerable to Mr. Humble. Mr. Mascara: Who knows better what you want than the people that work for you? Mr. Paluso: There's only one person... :Miss Beharry: They will not be answerable to the Controller. They will be answerable... Mr. Petrosky: No, he didn't say that. He said what better people would know what you're looking for than people... Miss Beharry: It won't make any difference, gentlemen. Mr. Mascara: See, I told you. It won't make any difference. Miss Beharry: ...won't make any difference what they know. Mrs. Pennline: Who's the accounts payable; who's the trained person? Miss Beharry: Pam's in there right now ... she's got 6 weeks in the job. Mr. Mascara: To call anybody an accounts payable is a misnomer, Mrs. Pennline. Mrs. Pennline: Beg your pardon. Mr. Mascara: It's a misnomer... accounts payable; there's no such thing. It doesn't exist. Only by name. Mrs. Pennline: She's saying trained person. What trained person... Mr. Macara: She doesn't have anybody trained... Miss Beharry: Charlotte's one of them ... and the functions that Charlotte does now will be done in the Controller's Office. They will have to be done in the Controller's Office... Mr. Mascara: I'm not going to let this go on much longer. Miss Beharry: ...in addition to several other duties that Charlotte performed that will have to be performed in the Controller's Office. (NOTE: The first agenda submitted to all Board members listed the salary at $75.00/hour up to a maximum of $25,000.00. Miss Beharry stated that she does not want Mr. Wagner's salary divided and that she wants it set at $25,000 at $75.00 per hour. More discussion followed. Commissioner Petrosky noted that this would not be consistent with previous actions taken or their intent at this time. Rather, he stated that the salary was broken down in terms of $22,000 for litigation and $3,000 for day-to-day advice. To clarify the matter, Chairman Mascara asked if the members who voted in the affirmative for the Controller's Office salary schedule as contained on page 691 (vote recorded on page 694)' concurred that when they voted, they agreed that the $25,000 salary for Mr. Wagner was divided for $3,000 (annual retainer) and $22,000(@ $75.00 per hour for litigation). The respective members who voted in the affirmative (Commissioners Mascara, Petrosky and Paluso) indicated their concurrence.
