There being no further business to come before the Board at this time, the meeting Office of the County Commissioners Washington, Pa., October 8, 1953 Board of County Commissioners in special session,' those present being Messrs. Pettit, Lane and Mazza. Motion by Mr. Mazza, seconded by Mr. Pettit, that Minute Nos. 145, 146, 147, 148, 149, 150, 151 and 152, were read and approved. Motion carried ',unanimously. Motion by Mr. Mazza, seconded by Mr. Pettit, that a refund voucher in the amount of $16.32 paid on August 1, 1953 be made payable to First Federal Savings and Loan Association of Waynesburg, Pa., on property situate in the City of Monongahela 2nd Ward, described as 2 story frame house, lot, 412 Second Street. This refund being made, due to the fact, that on July 28, 1953, the same amount of 416.32 was paid by Joseph Silvagnia, for the 1953 County Tax. Therefore, the Tax Claim Bureau is authorized to prepare the said voucher for this refund of duplicate payment. Motion carried unanimously. Motion by Mr. Mazza, seconded by Mr. Pettit, that a refund voucher in the amount of $12.48 paid on August 1, 1953 be made payable to First Federal Savings and Loan Association of Waynesburg, Pa., on property situate in the City of Washington 8th Ward, described as 2 story shingle house, part lots 14 55 Brookside Avenue. This refund being made, due to the fact, that on July 29, 1953, the same amount of $12.48 was paid by George R. & Helen P. Levers, for the 1953 County Tax. Therefore, the Tax Claim Bureau is authorized to prepare the said voucher for this refund of duplicate payment. LANE, JOHN MAZZA, COMMISSIONERS At this time 'County Controller, George F. Roule, entered the meeting for the purpose of awarding the coal bid. Motion by Mr. Lane, seconded by Mr. Mazza, that the Coal Contract for the 1953-1954 season for furnishing and delivering coal to the Court House and Jail.as per specifi- cations attached to the submitted bid, be awarded to FRAM T. WARGO, FRA* WARGO COAL COMPANY, Box 243, Hickory, Pa., the bid being $6.20 per ton including delivery and $5.50 per ton without delivery; this being the lowest and a responsible bidder. Motion, carried unanimously, with Mr. Roule being excused from the meeting. Motion by Mr. Lane, seconded by Mr. Mazza, that the following Agreement be adopted. THIS AGREEffENT, Made and entered into this 8th day of October, A. D..1953, by and between the Commonwealth of Pennsylvania, acting through the Department of Highways, hereinafter called the COMMONWEALTH, and the County of Washington, by its County Commissioners, hereinafter called the 'COUNTY. W I T N E S S E T H WHEREAS, The Commonwealth is making, or is about to make an improvement on Legislative Route 62210, Section 1, in Washington County, Peters Township, between Stations 0 + 14.30 and 71 + 99.50, which will require the taking of additional property for right-of-way purposes, and the payment of damages to the owners thereof; and WHEREAS, The County, by resolution duly adopted, has refused to assume re- sponsibility for any of the property damages in the improvement, but desires to make a contribu- tion to said damages in order to assist in the construction of the highway. NOW, THEREFORE, IT IS AGREED by and between the parties hereto: SECTION 1. The Commonwealth will proceed to make the improvement and will assume responsibility for all property damages incurred by reason thereof, and will pay to the property owners, or others legally entitled to receive the same, when and as ascertained, either by legal proceedings, or by agreement with the owners, the full amount of property damages to which they are legally entitled. SECTION 2. The County of Washington shall pay to the Commonwealth the sum of Five Thousand ($5,000.00) Dollars, said sum to be paid either in installments or as a whole, at the option of the Commonwealth, upon receipt of certification or certifications from the Secretary of ffighuays., setting forth the amounts that have been expended by the Department of Highways in the settlement of property damages in connection with the aforesaid improvement. SECTION 3. The estimated amount of property damages in connection with the proposed improvement is Seven Thousand One Hundred Seventy -Five (7,175.00) Dollars. LANE, JOHN MAZZA, COMMISSIONERS WHEREAS, The Commissioners of Washington County have refused to assume liability for the property damages involved in said improvement, but have indicated their willingness to ,.make a contribution touard the cost of said damages resulting from this improvement. NOW, THEREFORE, BE IT RESOLVED: That the County of Washington, by its County Commissioners, enter into an agree- ment.with the Department of Highways, providing that the Department of Highways will assume re- sponsibility for the property damages in connection with the proposed improvement; and providing further that the County will contribute the amount of Five Thousand ($5,000.00) Dollars, toward the cost of said property damages involved in said improvement. Motion by Mr. Lane, seconded by Mr. Pettit,that Fred Pirazzo, be appointed as a handy man at the County Garage; this action retroactive to October 1, 1953- Motion carried unanimously. Motion by Mr. Lane, seconded by Mr. Pettit, that Samuel J. Bondi, be appointed as a Clerk in the Tax Assessment Office; this action being retroactive to October 1, 1953- Motion carried unanimously.
