LANE, JOHN MAZZA, COMMISSIONERS Motion by Mr. Pettit, seconded by Mr. Elfish, that because of a lack of a quorum., bids be tabled for tabulation and further study. Motion carried. There being no further business to come before the Board at this time, the meeting adjourned. NO. 235 Office of the County Commissioners Washington, Pa,., November 5., 1954 1 Board of County Commissioners and the County Controller met in special session for the purpose of awarding the contracts for the construction of the Foundation and Piers for the proposed Aircraft 'IT" Hangars at the Washington County Airport, and the furnishing., fabricat-1 ing and delivery of all steel 11" Airplane Hangars. Those present at the meeting being Commis- sioners Pettit, Lane., Mazza,, Controller hlish and Deputy Controller Marino. Motion by Mr. Lane, seconded by Mr. Mazza, that the DONORA CONSTRUCTION COMPANY., Meldon Avenue, Donora., Pennsylvania., be awarded the contract for the construction of the Founda- i Lion and Piers for the proposed Aircraft 'IT" Hangars at the Washington County Airport in South Franklin Township., Washington County., Pennsylvania., in the total amount of bid of $2.,973,15; this being the lowest responsible bidder. Motion carried unanimously. Motion by Mr. Lane,, seconded by Mr. Mazza, that the FAIRMONT SUPPLY COMPA14Y, 437 Jefferson Avenue,, Washington., Pennsylvania., be awarded the contract for the furnishing., fabricat-1 ing and delivery to the Washington County Airport, South Franklin Township., Washington County., Pennsylvania, of six (6) all steel 'IT" Air -plane Hangars as proposed in the specifications in the total -amount of bid of $8.,%3-75; this being the only responsible bidder. Motion carried unanimously., with Mr. Elishand Mr. Marino leaving the meeting. Motion by Mr. Lane., seconded by Mr. Mazza, that the following Resolution in regards to a Bridge across Brush Run be adopted; and the following Indemnity Agreement between the Borough of Canonsburg and the County of Washington. RESOLUTIO,V WHEREAS, it has become necessary that the County of Washington., Pennsylvania., acquire a portion of the lands of John Dano and Eva Magera Dano., his wife, situate partly in the Borough of Canonsburg, Washington County.. Pennsylvania., and partly in the Township of Cecil., Washington County,, Pennsylvania., for the purposes of ingress and egress onto and over a bridge across Brush Run in the first Ward of the Borough of Canonsburg., and in connection with the re- placement., expansion., development and improvement of said bridge being undertaken in the vicinity thereof; and WHEREAS., the said County of Washington has been unable to acquire the same throughl amicable negotiations., it is the desire 01 the said County to condemn the said land. NOW THEREFORE, BE IT RESOLVED., that a portion of the lands of John Dano and Eva i Magera Dano., his wife, situate partly in the Borough of Canonsburg., and partly in the Township of Cecil,, Washington County., Pennsylvania,, as shown on the plans prepared in connection with the MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYL'VANIA FRANCIS E. PETTIT, W. J. LANE, JOHN MAZZA, COMMISSIONERS n 1 replacement, expansion, development and improvement of the said county bridge across Brush Run at Cecil Street, First Ward, Canonsburg, Washington County, Pennsylvania, be condemned for the purposes thereof, and the County Solicitor is hereby authorized to take any and all appropriate steps and actions to legally acquire the said land. Duly adopted and passed this 5th day of November, 1954. INDEMNITY AGPMERP MADE this llth day of October, 1954, between the COUNTY OF WASHINGTON, a body politic, within the Commonwealth of Pennsylvania, hereinafter called the "County", MOM the BOROUGH OF CANONSBURG, a municipal corporation organized and existing under the Laws of the Commonwealth of Pennsylvania, and located within said County of Washington, hereinafter called the "Borough'". WITNESSETH: That the said County does hereby agree to and with said Borough that, at its sole cost and expense, it will erect, or cause to be erected, a new bridge over Brush Run in the First Ward of said Borough, where Cecil Street crosses said Brush Run, and at its own cost and expense will do or cause to be done, whatever may be necessary in the dredging, widening, con- fining, or altering the course of and otherwise improving the stream bed of said Brush Run, so as to better accommodate said new bridge, all in accordance with the plans and specifications therefor, prepared by the engineering office of said County and now on file in the Office of the County Engineer. That, if it becomes necessary so to do, the County will condemn or appropriate sud land as might be necessary for the proper erection of said bridge and alteration of the stream bed of Brush Run in accordance with the aforementioned plans on file in the Office of the County Engineer, and if amicable settlement, agreeable to and approved by the said Borough, cannot be made with the owner or owners of the land so taken, injured or destroyed, it, the said County, will institute and prosecute viewers proceedings, and/or defend against any viewers proceedings brought, for the purpose of ascertaining the amount of damages due any property owner or owners for any taking, injury or destruction of their respective lands, which might be caused by the erection of said bridge and alteration of said stream bed. The said Borough in consideration of the erection of said Bridge by the County, and of the benefits to accrue to the Borough and its citizens and residents by reason thereof, does hereby agree to and with said County that it will: 1. Indemnify the said County for payment of any damages, amicably agreed upon, between said County and any property owner whose land is or will be taken, injured or destroyed in connection with the erection of said bridge, or the alteration of said stream bed, provided said amicable settlement has first been submitted to and approved by said Borough, 2. Indemnify and save harmless, the said County, of and from all actions, proceed- ings, claims, outlays, damages, costs or expenses, which the County may in anywise incur, in de- fending, prosecuting, settling or discontinuing any proceedings, actions or claims, in consequenc of or arising in any way out of the said County's appropriation or condemnation of lands for the aforesaid purposes. IN WITNESS WHEREOF, the Borough of Canonsburg, by virtue of the authority vested in it for that purpose, and by virtue of Ordinance No. 750 duly adopted by the Council of said Borough on the llth day of October, 1954, and approved by the Burgess of said Borough, has caused these presents to be signed by its President, attested by its Secretary, approved by its Burgess, and its official seal to be hereto affixed, and the County of Washington, pursusant to a resolution duly adopted by the Commissioners of said County at a meeting held on the 5th day of November, 1954, has caused these presents to be executed by the Commissioners of said County and attested by the Chief Clerk, and its official seal to be hereto affixed, all on the day and year aforesaid.
