Calvin Turner, Seely Office of the County Commissioners Washington, Pa., August 25, 194$ Board of County Commissioners in regular session, those present being Messrs. Pettit and Lane. Mr. Lowstuter having notice of the meeting but being absent. Motion duly made and seconded that the following Resolution be adopted: WHEREAS, certain tracts of the Pittsburgh Vein of Coal with mining rights and partial interest in certain tracts, situate in Morris Township, North Franklin Township and South Franklin Township, as set forth in the schedule attached hereto and made a part hereof, were sold to Washington County by the Treasurer of Washington County on the dates shown on the said schedule and were sold as the property of the owners or reputed owners also shown on said schedule for unpaid County, School and Road taxes in the approximate amount of 41,4".83 and WHEREAS, the said coal and mining rights have been transferred to the Washington County Tax Claim Bureau under the provisions of the Act of July 7, 1947; and WHEREAS, the said Washington County Tax Claim Bureau under the provisions of the said Act of Assembly is authorized and permitted to sell the aforesaid coal and mining rights at private sale with the approval of all the taxing districts interested therein; and WHEREAS, the said Washington County Tax Claim Bureau has received an offer from the Berkshire Land Company to purchase the said coal and mining rights for the sum or price of $30,950.00 and has agreed to sell the said coal and mining,rights for said price with the approval and consent of the said taxing dii rJjets involved, to wit, the North Franklin Township School District,;'the Road Supervisors of North Franklin Township, the South Fra4lin Township School District, the Road Supervisors of South Franklin Township, the Morris Township School District, the Road Supervisors of Morris Township, the'County of Washington and the Washington County institution District. NOW THEREFORE BE IT RESOLVED that the County of Washington, in accordance with the provisions of the ict'of July 7, 1947, agree to a private sale by the Washington County Tax Clain Bureau to the Berkshire Land Company 'for the price of $30,950.00 of the tracts bf coal and the partial interests in those tracts of the Pittsburgh Vein of Coal, with mining rights, situate as aforesaid in North Franklin, South Franklin and Morris Townships, as shown on the schedule hereto attached, which were sold to Washington County by the County Treasurer for the non-payment of taxes as set forth above, and now held by the said Washington County Tax Claim Bureau, as trustee grantor, easy execute and deliver a deed for said coal and mining rights and convey title to the said purchaser, free, clear and discharged of all tax claims and tax judgments of - this District to the date hereof. Motion duly made and seconded that the following Resolutions be adopted: THIS AGREEMENT, Made and entered into this 25 day of August, A. D. 1948, by and between the Commonwealth of Pennsylvania, acting through the Department of Highways, hereinafter called the COMMONWEALTH, and the County of Washington, by its County Commissioners, hereinafter called the COUNTY. WITN_E83kT1 WHEREAS, The Commonwealth is making, or is about to make an improvement on Legislative Route 108, opposite Station 463486.2, in North Strabane Township, Washington County, Pennsylvania, which will require the taking of additional property for the accommodation of a proposed change in the channel of Chartiers Creek and the payment of damages to the owners thereof; and WHEREAS, The County, by resolution duly adoptdd.. has refused to assume responsibility for any of the property damgges involved in the improvement, but desire to make a contribution to said damages in order to assist in the construction of the highway. NOW, THEREFORE, IT IS AGREED by and between the parties hereto: SECTION 1. The Commonwealth will proceed to make the improvement and will assume responsibility for all property damages incurred by reason thereof, and will pay to the property owners, or others legally entitled to receive the same, when and as ascertained, eithir-,-,b)^•legal proceedings, or by agreement with the owners, the full amount of property damages to which they are legally entitled. SECTION 2, The County of Washington shall pay to the Commonwealth the sum of Twenty Five Hundred ($2500.00) Dollars, said sum to be paid either in installments or as a whole, at the option of the Commonwealth, upon receipt of certification or certifications from the Secretary of Highways, setting forth the amounts that have been expended by the Department of High- ways, in the settlement of property damages in connection with the aforesaid improvement. It is understood and agreed that the contribution of said County shall not exceed the sum of Twenty Five Hundred ($2500.00) Dollars. SECTION 3. The estimated amount of property damages in connection with the proposed improvement is Five Thousand ($5,000.00) Dollars. IN WITNESS THEREOF, the Secretary of Highways, acting for an on behalf of the Commonwealth of Pennsylvania, has hereunto affixed his hand and the seal of the Department of Highways, and the County Commissioners of Washington County, acting for and on behalf of the sAid County, have hereunto set their hands and official seal, pursuant to due and legal action authorising the same by said County. WHEREAS, The Commonwealth of Pennsylvania, acting through the Department of Highways, is about to improve a section of State Highway desig- nated as Legislative Route 108, in Washington County, and WHEREAS, The Commissioners of Washington County have refused to assume liability for the property damages invo3#ed in said improvement, but have indicated their willingness to make a contribution toward the cost of said damages resulting from this improvement.
