NO. 87 Office of the County Commissioners Washington, Pa., December 28, 1948 Board of County Commissioners in regular session, those present being Messrs. Pettit, Lane and Lowstuter. Motion duly made and seconded that the Pittsburgh Vein of Coal with mining rights, of approximately 1804 acres in Canton Township which was sold to the County on March 242 1942, for unpaid taxes as the property of John W. Donna, 1/3; James Kuntz, Jr., 1/3; Robert McCarrell, 1/12; J. Albert McClane, 1/12; Ebenezer McClane, 1/12; and M. W. McClane, 1/12, be and the same is hereby transferred to the Tax Claim Bureau. Motion duly made and seconded that the following Resolution be adopted: WHEREAS, certain tracts of the Pittsburgh Vein of Coal with mining rights, being 1804 acres more or less, in Canton Township were sold to Washington County by the Treasurer of Washington County on March 24, 1942, and were sold as the property of the following persons in the interests set opposite their names for unpaid County, School and Road taxes in the approximate amount, including tax, penalty and interest, of $72,650.28, to wit: John W. Donna, 1/3; James Kuntz, Jr., 1/3; Robert McCarrell, 1/12; J. Albert McClane, 1/12; Ebenezer McClane, 1/12; and M. W. McClane, 1/12; and WHEREAS, the said coal and mining rights have been transferred to the Washington County Tax Claim Bureau under the provisions of the Act of July 7, 1947, P. L. 1368, and WHEREAS, the said Washington County Tax Claim Bureau under the provisions of the said Act of Assembly is authorized and permitted to sell the aforesaid coal and mining rights, at private sale with the approval of the taxing districts interested therein; and WHEREAS, the said Washington County Tax Claim Bureau has received an offer from Jonathan -Allison to purchase the said coal and mining rights for the sum or price of $45,100.00 and has agreed to sell the said coal and mining rights for said price with the approval and consent of the said taxing districts involved, to wit, the Canton Township School District, the Road Supervisors of Canton Township, the County of Washington and the Washington County Institution District. NOW THEREFORE BE IT RESOLVED that the County of Washington, in accordance with the provisions of the Act of July 7, 1947, P. L. 1368, agree to a private sale by the Washing- ton County Tax Claim Bureau to Jonathan Allison for the price of $45,100.00 of the tracts of coal of the Pittsburgh Vein of Coal with mining rights, situate as aforesaid in Canton Town- ship which were sold to Washington County by the County Treasurer for the non-payment of taxes as set forth above and now held by the said Washington County Tax Claim Bureau; and does hereby agree upon receipt of said purchase price that the said Washington County Tax Claim Bureau, as trustee grantor, may execute and deliver a deed for said coal and mining rights, and convey title to the said purchaser, free, clear and discharged of all tax claims and tax judg- ments of this District to the date hereof.
