O'NEIL, COMMISSIONERS 1 D Deputy Controller Dentel called into the meeting for the purpose of opening bids for the replacement of approximately 1200 square feet of sidewalk and approximately 3 cubic yards of extra depth concrete around the Court House, in accordance with advertisement of the County Controller. In accordance therewith, the following bid was opened and read: T. ilk. MOORE In accordance with the advertisement of the County Controller, inviting proposals for the replacement of approximately 1200 square feet of sidewalk and approximately 3 cubic yards of extra depth concrete around the Court House, having examined the attached specifications and understanding the same, I (Or -we) propose to replace said items at the following prices: 1200 sq. ft. of two course concrete sidewalk, 4" depth......... .................. .44 per sq. ft. 3 cue yds. extra depth concrete under sidewalk .............................. 45.00 per cue yd. iA certified check in the amount of $200.00 is herewith enclosed. Motion by Mr. Pettit, seconded by Mr. Lowstuter, that contract for said replacement of sidewalk and extra depth concrete be awarded to T. M. Moore, 158 Park avenue, Washington, Pa., upon his bid as set forth above, it being the only bid received. Motion carriedg with Deputy Controller Dentel present when this action was taken. Motion duly made and seceded that the County Controller be authorized to advertise for the removal of the existing Bituminous Nearing Surface, and for the placing of a new one - course Bituminous'Wearing Surface, on the timber deck and on the brick approach spans of the Aonora-Webster Bridge over the Monongahela River. Moti on carried. Motion duly made and seconded that the Bell Telephone Company of Pennsylvania, its successors or assigns, for the consideration of $1,00, be hereby granted the privilege and authority to construct and maintain poles, wires, etc., over or on Washington County owned 100 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHIN13TON COUNTY, PENNSYLVANIA ROSS R. Minutes Nos. 115 and 116 read end approved. I Upon request of the Board, the following opinions were submitted by 1 David H. Weiner, County Solicitor: "My opinion has been requested as to the legality of the practice of the Board of Commissioners in awarding contracts for the purchase of gasoline by rotating the same among the various suppliers in the county on a monthly basis. In view of the fact that a maximum price ceiling has been fixed under regulations of the Tbderal Government for gasoline, the Commissioners are justified in awarding the contracts as they do, by virtue of the Act of May 21, 1945, P. L. 507, Even though we disregard the provisions of the Act cited herein, it is my opinion that since the tank wagon price of gasoline is uniform among all the suppliers in the district, the case comes within the principle laid down by our Supreme Court that where nothing can be gained by advertising and competitive bidding, there is no abuse of discretion or of the law in awarding the contracts in the manner heretofore followed by the Board of Commissioners." f "My opinion has been requested as to the authority of the Board of Commissioners to contract for the coal necessary for county purposes without the formality of the usual advertising and competitive bidding. Since a maximum price ceiling has been fixed under regulations of the h Federal Government for the various grades of coal, it is my opinion q and you are so advised, that under the Act of May 21, 1943, P. L. 507 the Board may award the contract to the person, firm, or corporation found, from your experience in connection therewith, to be the lowest and best bidder, without advertising for bids, even though such contract may exceed the sum of $500.00. The provisions of the Act cited herein applies during the existence of the present state of war and for six months thereafter. Since a state ofY a war continues to exist until the signing of a peace treaty, or at least an armistice, the six months period thereafter allows sufficient time for the Board to take advantage of this Act during the time for which this coal contract must necessarily run." Motion duly made and seconded that the rate of 6� per mile for the necessary - travel incidental to the duties of David M. Hasel, Assistant Assessor employed by the Board of Assessment and Revision of Taxes in connection with making the 1946 assessment of real estate in various districts of the county, as set forth in Washington County Salary Board Minute No. 12—S, dated June 22, 1945, be adjusted to 83e per mile for the actual number of miles travelled. 1 d Motion carried.
