Minutes Nos. 115 and 116 read end approved. I Upon request of the Board, the following opinions were submitted by 1 David H. Weiner, County Solicitor: "My opinion has been requested as to the legality of the practice of the Board of Commissioners in awarding contracts for the purchase of gasoline by rotating the same among the various suppliers in the county on a monthly basis. In view of the fact that a maximum price ceiling has been fixed under regulations of the Tbderal Government for gasoline, the Commissioners are justified in awarding the contracts as they do, by virtue of the Act of May 21, 1945, P. L. 507, Even though we disregard the provisions of the Act cited herein, it is my opinion that since the tank wagon price of gasoline is uniform among all the suppliers in the district, the case comes within the principle laid down by our Supreme Court that where nothing can be gained by advertising and competitive bidding, there is no abuse of discretion or of the law in awarding the contracts in the manner heretofore followed by the Board of Commissioners." f "My opinion has been requested as to the authority of the Board of Commissioners to contract for the coal necessary for county purposes without the formality of the usual advertising and competitive bidding. Since a maximum price ceiling has been fixed under regulations of the h Federal Government for the various grades of coal, it is my opinion q and you are so advised, that under the Act of May 21, 1943, P. L. 507 the Board may award the contract to the person, firm, or corporation found, from your experience in connection therewith, to be the lowest and best bidder, without advertising for bids, even though such contract may exceed the sum of $500.00. The provisions of the Act cited herein applies during the existence of the present state of war and for six months thereafter. Since a state ofY a war continues to exist until the signing of a peace treaty, or at least an armistice, the six months period thereafter allows sufficient time for the Board to take advantage of this Act during the time for which this coal contract must necessarily run." Motion duly made and seconded that the rate of 6� per mile for the necessary - travel incidental to the duties of David M. Hasel, Assistant Assessor employed by the Board of Assessment and Revision of Taxes in connection with making the 1946 assessment of real estate in various districts of the county, as set forth in Washington County Salary Board Minute No. 12—S, dated June 22, 1945, be adjusted to 83e per mile for the actual number of miles travelled. 1 d Motion carried. Notion duly made and seconded that the County Treasurer be authorized to abate penalty and interest on all County Taxes due for the years 1931 to 1945, inclusive, on an adjusted valuation of $5,000.00 for 99 acres and 91 perches of surface in Borth Franklin Township, former- ly owned by Howard L. yankirk, if and when the proceedings now pending in the United States District Court under the Frazier -Lemke Act are discontinued. This action is taken in concurrence with resolutions of the Board of School Directors and the Road Supervisors of Forth Fpanklin Township. Notion carried. County Controller Stuart called into the meeting for the purpose of opening bids submitted in accordance with advertisement of the Controller for the printing and delivering to the office of the County Commissioners the necessary ballots and election supplies required for the conduct of the lunicipal Election to be held Tuesday, November 6, 1945. JOHNSTON COMPANY I In accordance with the advertisement of the County Controller, inviting proposals for the furnishing and delivering to the office of the County Commissioners supplies to include tally sheets, return sheets, envelopes, numbered lists of voters, voter's certificates, etc. (Voterts Guides not to be included), required for use of the election officers at the Municipal Election to be held November 6, 1945, having examined the attached specifications and understanding the same, I (or We) propose to furnish these supplies in accordance therewith, for the sum of j992.50 -------------- I Motion by Mr. Pettit, seconded by Mr. Lowstuter, that contract for printing and de- livering ballots be awarded to Monongahela Publishing Company and ward Printing Company upon f their joint bid as set Forth above, it being the only bid received. f Motion carried, with County Controller Stuart present when this action was taken. Motion by Mr. Pettit, seconded by Mr. Lowstuter, that contract for furnishing election supplies be awarded to William G. Johnston Company, of Pittsburgh, Pa., upon their bid of $972.50 as set forth above, it being the only bid received. Motion carried, with County Controller Stuart present when this action was taken. Motion duly made and seconded that the proposal of T. M. Bedillion for delivering ballots, ballot boxes and other election supplies to the Judges of Election of Washington County for the municipal election to be held Nov. 6, 1945, for the sum of $299000, be accepted. Motion carried. Motion duly made and seconded that the County Treasurer be authorized to abate penalty and interest on 1944 County Tax assessed against property of Louis P. and Florence Mo Lehman in the Third Ward of the City of Washington, inasmuch as an adjustment in assessment of this property was not completed in time to allow the payment of this tax before the discount period expired. Motion carried. I E Motion duly made and seconded that the County Controller be authorized to advertise for bids for the furnishing and delivery of approximately one hundred and twenty (120) cubic yards of Transit Mixed Concrete to the Wade Avenue Bridge, Chartiers Creek No. 61, in the City of 'ashington.j Motion carried.
