Board of County Commissioners in regular session, those present being Mr. Cummins,
Mr. Pettit and f+r, O'Neil.
Minute No. 97 read and approved.
The following Resolution read and approved and made a part of this minute:
RESOLUTION

The Honorable Joseph F. Guffey, U. S. Senator
The Honorable Francis J. Myers, U. S. Senator
The Honorable Thomas E. Morgan, U. S. Congressman
The Honorable Edward Martin, Governor of Pennsylvania
WHEREAS, the Congress of the United States has, by its action,
j appropriated funds for the establishing of a Veterans* Hospital in Western
Pennsylvania; and
that section of Western Pennsylvania, comprised of
Washington, Greene and T.yette Counties, and large areas in the Ohio Valley,
with Washington County forming the center of this large part of the State,
is so situated that it is now necessary for any veteran desiring to avail
himself of the facilities of the now existing Veteransr Hospital to travel
very far and through heavily congested areas to reach the desired Hospital;
and
11HEREAS, Washington County would be the logical location for the
proposed hospital, for the specific reason of its geographical location
together with its many and adequate means of transportation;
NOVI., THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of the said County of Washington, on behalf of the citizens of Washington County
and the returning veterans of said County and surrounding areas, that you be
earnestly requested to give favorable consideration to the urgent need of
establishing a Veterans" Hospital in Washington County.
The following opinion of David H, Weiner, County Solicitor,

read and ordered made a part of this minute:
'
"My opinion has been requested as to the legality of
awarding a contract for work to be done on a time and material basis
feven
though the total may exceed the sum of $500.00.
In the case of Ruggles et al. v. Moore et al., 97 Pa.
Superior Ct. 47, the Court held that it is not always necessary that the
Commissioners award a contract for everything to be done by them, but

might direct the work themselves. This would mean that the Commissioners
would have the right to employ men by contract to do some work on a time
I
and material basis, provided they reserve, the right to direct how the
work should be done. This does not necessarily mean personal supervision,
but could be done through the head of the particular department in which
the work is being done.
As set forth in the case of Lane v, McDowell, County
Controller, 25 D. & C. 296, which arose in Westmoreland County, the Court
there in a lengthy opinion explained the wide latitude and discretion
permitted the County Commissioners in the performance of their duties
in order that those duties imposed upon them might be performed to the
best of their ability and to the best interests of the taxpayers, Where
the best interest in the judgment of the Commissioners require the work
to be done on a time and materia 1 basis, the Commissioners would have
the legal right to elect to have the work performed in that manner,
In the light of the foregoing, it is my opinion, and I so
advise you that where the Commissioners, acting in good faith, as the
result of their best judgment, decide that work can best be done on a
time and material basis, they have the legal right to do so."
County Controller Harvey Stuart called into the meeting for the purpose of awarding
contract for the repair and restoration of books now on file in the offices of the Prothonotary

and Register of Wills.

Motion by lir. Pettit, seconded by Mr. Cummins, that contract for said repair and
restoration, in accordance with specifications and a list of volumes approved by the Prothonotary
and Register of Wills, be awarded to C. Edwin Hultman Company upon their bid of $92.15 per volume for

the Prothonotary's Office and $56.25 per volume for the Register of Wills Office, theirs being
s'
the only bid received.

Motion carried.
Motion duly made and seconded that bid of Austin N. Knestriok, being the only one re-
ceived in accordance with advertisement of the County Controller for the furnishing and installing
of fifteen fluorescent futures, in the sum. of $1495,00, be rejected, inasmuch as it is considered
iexcessive.

Motion carried, and the County Controller is instructed to return the certified check
which accompanied the bid.

Minute No. 98 read and approved.
j Motion by fir. Pettit, seconded by Mr. OtNeil, that the County Controller be authorized
to advertise for the replacement of approximately 1200 square feet of sidewalk and approximately
3 cubic yards of extra depth concrete under same around the Court House, in accordance with
specifications to be furnished upon application at the office of the County Engineering Department.
Motion carried.
There being no further business to come before the Board at this time, the meeting was
j adjourned.
